OVERVIEW

Protection and promotion of health are at the core of public health nursing.
Ethical principles are further clarified in this speciality area. Public health ethics
is defined as a systematic process to clarify, prioritize and justify possible
courses of public health action based on ethical principles, values and beliefs of
stakeholders, and scientific and other information. Specific ethical principles
apply to public health in general namely, advocacy for healthy communities and
equitable distribution of limited resources.

TOPIC: PUBLIC HEALTH LAWS

♣ Republic Act 9173 - "Philippine Nursing Act of 1991" aims to achieve relevant nursing education,
humane working conditions, better career prospects, and a dignified existence for the Filipino nurses.

♣ Republic Act No. 7305 - "Magna Carta of Public Health Workers". Public health workers shall
have the right to freely form, join or assist organizations or unions for purposes not contrary to law in
order to defend and protect their mutual interests and to obtain redress of their grievances through
peaceful concerted activities.

♣ Presidential Decree 856 - "Code on Sanitation of the Philippines." The Code on Sanitation of the
Philippines, P.D. 856 was promulgated in 1975 and one of its chapters on Industrial Hygiene provides
the standards and guidelines for the protection and promotion of workers’ health. The first implementing
rules and regulations (lRR) of the said chapter was developed in 1991.

♣ Republic Act No. 8749 - "Philippine Clean Air Act of 1999." The State shall protect and advance
the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of
nature.

♣ Republic Act No. 6675 - Generics Act of 1988 (Republic Act No. 6675). An Act to Promote,
Require and Ensure the Production of an Adequate Supply, Distribution, Use and Acceptance of Drugs
and Medicines Identified by their Generic Names.

♣ Republic Act No. 10606 - THE “NATIONAL HEALTH INSURANCE ACT OF 1995″ It is hereby
declared the policy of the State to adopt an integrated and comprehensive approach to health
development which shall endeavor to make essential goods, health and other social services available
to all the people at affordable cost and to provide free medical care to paupers.

♣ Republic Act No. 7875 - “National Health Insurance Act of 1995” Section II, Article XIII of the
1987 Constitution of the Republic of the Philippines declares that the State shall adopt an integrated
and comprehensive approach to health development which shall endeavor to make essential goods,
health and other social services available to all the people at affordable cost

♣ Republic Act No. 7719 - “National Blood Services Act of 1994” promotes voluntary donation to
provide a sufficient supply of safe blood and to regulate blood banks. Its aim is to inculcate public
awareness that blood donation is a humanitarian act.

♣ Republic Act No. 3573 - “Law on Reporting of Communicable Diseases” a law passed on
November 26, 1929 by the Philippine Legislature in an American occupied country, is still being used as
the basis for requiring all individuals and health facilities to report notifiable diseases to local and
national health

♣ Republic Act No. 7432 - An Act to Maximize the Contribution of Senior Citizens to Nation
Building, Grant Benefits and Special Privileges and for other purposes was enacted primarily to
acknowledge the role that our elderly have served during the more productive years of their lives.

♣ Republic Act No. 6425 - “Dangerous Drugs Act of 1972” - provides for importation of Dangerous
Drugs and/or Controlled Precursors and Essential Chemicals.

♣ Republic Act No. 9502 - “Cheaper Medicines Act" - provided for a market-based capping
approach to the prices of drugs and medicines, allowing the Secretary of Health to set what we now call
the Maximum Drug Retail Price.

♣ Republic Act No. 11188 - “Special Protection of Children in Situations of Armed Conflict Act”
Ensure the right to participation of children affected by armed conflict in all its policies, actions, and
decisions concerning their rescue, rehabilitation and reintegration.

♣ Republic Act No. 9262 - “Anti-Violence against Women and Their Children Act of 2004” the
concept of “violence” against women and children includes not just physical violence, but also sexual
violence, psychological violence, and economic abuse, including threats of such acts, battery, assault,
coercion,

♣ Republic Act No. 10121 - Philippine Disaster Reduction and Management Act. transforms the
Philippines' disaster management system from disaster relief and response towards disaster risk
reduction (DRR).

♣ Republic Act No. 7600 - "Rooming-In and Breastfeeding Act of 1992" provides for breastfeeding
rooms in government and private hospitals.

♣ Republic Act No. 10028 - Expanded Breastfeeding Promotion Act of 2009. The State adopts
rooming-in as a national policy to encourage, protect and support the practice of breastfeeding

♣ Republic Act No. 10354 - The Responsible Parenthood and Reproductive Health Act of 2012"
No person shall be denied information and access to family planning services, whether natural or
artificial

♣ Republic Act No. 10152 - Mandatory Infants and Children Health Immunization Act of 2011" In
accordance with Article II, Section 15 of the Constitution, it is hereby declared to be the policy of the
State to take a proactive role in the preventive health care of infants and children

♣ Republic Act No. 10666 - Children's Safety on Motorcycles Act of 2015 two-wheeled motorcycle
riders may not be allowed to drive a motorcycle with a small child on board

♣ Republic Act No. 10821 - The Children's Emergency Relief and Protection Act. An Act
Mandating the Provision of Emergency Relief and Protection for Children Before, During, and After
Disasters and Other Emergency Situations

♣ Presidential Decree 603 - The Child and Youth Welfare Code and issued in December 1974.
legally defines special categories of youths, including youthful offenders, and directs the Ministry of
Social Services and Development (MSSD) to provide comprehensive services to assist in youth
development.

♣ Republic Act No. 9211 - The Tobacco Regulation Act of 2003. an omnibus law regulating smoking
in public places, tobacco advertising, promotion and sponsorship, and sales restrictions, among other
requirements.

♣ Republic Act No. 9288 - The Newborn Screening Act of 2004 . illustrates a procedure to detect a
genetic and metabolic disorder in newborns that may lead to mental retardation and even death if left
untreated.

♣ Republic Act No. 11223 - Universal Health Care Act. provides that the Corporation shall support
the implementation of standards for clinical care set forth by the Department of Health (DOH) based on
approved clinical practice guidelines.
