Grounds of appeal before court of cassation are set forth 173 ‫أسباب الطعن بالنقض وردت في المادة‬
in Article 173 of the Civil Procedures Code: :‫من قانون اإلجراءات المدنية‬
If the appealed judgment was based on breach of law ‫مخالفة الحكم المطعون فيه للقانون أو الخطأ في تطبيقه‬
or a mistake in its application or interpretation. .‫أو في تأويله‬
If a nullity in the judgment or in the procedures has affected ‫وقوع بطالن في الحكم أو في اإلجراءات أثر في الحكم‬
the judgment.
If the appealed judgment was issued contrary to the rules ‫صدور الحكم المطعون فيه على خالف قواعد االختصاص‬
of the jurisdiction
If the dispute was adjudicated contrary to another decision ‫الفصل في النزاع على خالف حكم آخر صدر في ذات الموضوع‬
