This RFP does not purport to commit or bind Ashghal in any manner whatsoever to proceed to the RFP stage
or to the awarding of a contract. Ashghal reserves its absolute, complete and unfettered right to, at any time
and for any reason whatsoever, disregard all Bids and to terminate at will the competitive selection process
and may, at its discretion, proceed with the Project in some other manner, with no liability to any party
whatsoever.
Each Respondent is solely responsible for all costs it incurs in the preparation of its Bid, including without
limitation all costs of providing information requested by Ashghal, attending meetings and conducting any
due diligence. Under no circumstances will Ashghal or any of its advisors be liable for any costs or expenses
borne by the Respondent or any of its advisors in this process, nor shall they be liable for any damages or
consequential damages whatsoever, which may arise out of the process.
Ashghal reserves the right, in its absolute discretion, with no liability whatsoever to:
a. amend the scope of the Project, modify, cancel or suspend the RFP process or any or all stages of
the procurement process, at any time for any reason;
b. waive a defect or irregularity in the form or content of any RFP;
c. re-advertise for new responses, call for tenders, or enter into negotiations for this Project or for
work of a similar nature;
d. make any changes to the terms of business opportunity described in this RFP; and
e. extend, from time to time, any date, time period or deadline provided in this RFP.
All Bids submitted to Ashghal shall become the property of Ashghal immediately upon such submission.

1. Environmental Management

Overview

1.1.1 Background
Environmental permit from MME has been obtained in 2016 and subsequently renewed annually by
Ashghal for New Doha South Sewage Treatment Works project which was planned in the same Site. As
the NDS STW was not proceeded further and current Project is planned instead of NDS STW project,
Ashghal has carried out necessary due diligence with MME and submitted an addendum application to
modify the existing project to suit the requirements of current Project. All the details related to submitted
addendum application, existing NDS STW environmental permit, previous environmental studies are
provided as part of Project Data, Volume III of the RFP document. It is expected that the Project Company
shall obtain or update the necessary Approvals for the proposed solution after the Effective Date in a
timely manner. Project Company shall carryout the necessary environmental studies to obtain these
permits in accordance with the applicable Laws and minimum environmental requirements stipulated in
this Part 5 – Environmental Requirements, Schedule 2 - Design and Construction Requirements and also
expected to obtain Project environmental permit.

1.1.2 Environmental Management Approach


This section describes the general approach to environmental management on the Project, with reference
to the environmental scope of work to be fulfilled by the Project Company.

The Project Company shall comply with the environmental requirements, including the Environment
Protection Law of Qatar implemented by Decree No 30 of 2002 and its Executive By-Law, other relevant
environmental laws and regulations, Qatar Construction Specifications (QCS) 2014, any other instruction
of the Ministry of Municipality and Environment (MME) and deliver the environmental scope of work as
described in this section.

The Project Company shall comply with the conditions of the Project environmental permit and any other
permit, no-objection certificate (NOC) or approval issued for the Project.

The Project Company shall be responsible for obtaining all relevant environmental-related permits for
the Project, develop their own project- specific Environmental Management System (EMS), construction
Environmental Management Plan (CEMP), construction waste management plan (CWMP), operational
environmental management plan (OEMP), and other relevant environmental management
documentation based on the framework and guidance provided in this document.

The Project Company is responsible for identifying and obtaining all necessary permits for the delivery
of the Project.

The Project Company shall construct and operate the Project with consideration of the QNV 2030.

General Responsibilities for Environmental Management


The Project Company shall have the ultimate responsibility for the Project’s environmental performance.

The Project Company shall:

 liaise with MME regarding their environmental compliance and permitting requirements;
 liaise with key project stakeholders regarding environmental matters and concerns;
 undertake an environmental and social impact assessment (ESIA) for the Project, as per the
requirements of MME (please refer to Section 1.4 for further details)
 obtain / update all Approvals for the Project (please refer to Section 1.5 for further details);
 develop, implement, and maintain a project level Environmental Management System (EMS)
(please refer to Section 1.6 for further details);
 develop a project specific CEMP as per MME Requirements (please refer to Section 1.7 for further
details);
 develop a project specific CWMP (please refer to Section 1.8 for further details);
 develop a project specific OEMP (please refer to Section 1.9 for further details);
 be responsible for Project environmental performance monitoring and reporting;
 be responsible for supervision and inspection of the individual contractors to ensure that they
implement the requirements and procedures for environmental control, monitoring and
reporting, as specified in the project-specific EMS and relevant environmental documentation;
and
 inform Ashghal of the Project environmental performance on a continual basis.

Environmental Compliance Requirements


The Project will be designed, constructed and operated in accordance with applicable national legislation.
The Project Company shall comply with the requirements of the Competent Authority, Qatar national
environmental requirements as administered by the Ministry of Municipality and Environment (MME),
the international legislation / conventions ratified by the State of Qatar, and will satisfy the potential
international lenders which would require adherence to their specific guidelines for environmental and
social considerations, the Equator Principles (EP), IFC Performance Standards and IFC EHS guidelines,
and applicable IFC sector-specific guidelines.

The Project Company shall comply with the conditions of permits and obtain all Approvals required for
the execution of the Project Assets. Copies of Approvals acquired by the Project Company shall be
provided to Ashghal.

The Project Company will ensure that all mitigation measures necessary, including those identified in the
Environmental Impact Assessment (EIA) are implemented during the Project.

1.3.1 Compliance with National Environmental Legislation


The Project Company is responsible for liaising with Government to ensure awareness is maintained of
any recent changes to legislative requirements.

The Project Company shall be responsible for obtaining all Approvals for the Project.

Copies of all Approvals shall be submitted to Ashghal for reference during the Term.

The Project Company shall conduct all notifications required by Approvals. The Project Company shall
provide all documentation, demonstrations, sampling, testing, quantity summaries, work summaries,
and other monitoring activities required by the various Approvals. The Project Company shall prepare all
reports required by the Approvals and shall submit these to Ashghal for information.

1.3.2 Compliance with Qatar Construction Specifications (QCS)


The Project Company shall comply with Qatar Construction Specifications 2014 Section 11, Part 2.3.15 –
Environmental Protection at all times during the provision of their scope of services.

1.3.3 Compliance with Applicable International Guidelines


The Project Company shall apply international standards where:

 Codes, standards, regulations established or adopted by the state of Qatar have not been
developed for a particular parameter;
 no provisions or limits for particular environmental aspects have been identified within national
legislation;
 there is agreement with Ashghal that use of an international standard provides greater
environmental security, without compromising compliance with Codes, standards, regulations
established or adopted by the state of Qatar.

Environmental Social Impact Assessment (ESIA)


The Project Company shall prepare a new ESIA study or update the existing EIA study in adherence to
the Equator Principles (EP), IFC Performance Standards and IFC EHS guidelines, and applicable IFC
sector-specific guidelines.

The Project Company shall comply with all conditions associated with the approval of the ESIA, to include
undertaking any additional environmental and social work as required by the MME or other relevant
agencies, which may include desktop studies, field-surveys, and monitoring programs.

The Project Company should note that the required ESIA study should be prepared by specialist
environmental consultant registered with the MME to secure MME approval.

1.4.1 ESIA report


When the ESIA process is complete, the Project Company shall prepare the ESIA report in accordance
with MME requirements, World Bank and the IFC standards and industry best practice.

The layout and structure of the ESIA report shall be agreed with the MME and Ashghal.

Authorities Approvals
The Project Company shall prepare applications and obtain Approvals from Competent Authorities
necessary to commence and undertake the Project works, as well as all Approvals, as necessary from other
Stakeholders for the purposes of the Project works. The Project Company shall secure any modified or
new Approval without any additional cost to Ashghal and/or extension to the time for completion.

1.5.1 Approvals
The Project Company shall obtain all Approvals (including preparation of all documentation of
applications, paying all fees and expenses, and follow up with the Competent Authorities ) and engage
with all Competent Authorities (and other stakeholders where necessary) in order to secure all the
Approvals that are necessary prior to construction, during construction, prior to Commercial Operation
Period and during the Commercial Operation Period.

1.5.2 Project Environmental Permit and Other Approvals


In terms of the environmental protection Law (No. 30 of 2002) and environmental regulations detailed
in Executive By-Law No. 4 of 2005, the MME has the responsibility and authority to grant environmental
approval for projects falling under the ambit of the environmental protection Law.

The Project Company shall obtain all Approvals (including preparation of all documentation of
applications, paying all fees and expenses, and follow up with the Competent Authorities) and engage
with all Competent Authorities (and other Stakeholders where necessary) in order to secure the Project
environmental permit. The Project Company shall secure any modified or new Project environmental
permit without any additional cost to Ashghal and/or extension to the time for completion.

The Project Company shall obtain and maintain (i.e. renew if required) all Approvals required to execute
the Project and prepare all requisite submissions necessary to obtain all Approvals. The Project Company
shall submit the same to all competent Competent Authorities. It is the responsibility of the Project
Company to undertake any investigation needed to satisfy the requirements of Approval applications,
their approval and any other MME requirement.

The Project Company is responsible for obtaining all permits, no objection certificates and approvals
required by the Project environmental permit and subsequent renewals, and any other permit, NOC or
approval submission instructed by MME.

Environmental Management System

The Project Company shall develop, implement and maintain an environmental management system
(EMS), in accordance with the ISO 14001:2015 standard. The EMS shall detail the provisions and
responsibilities for environmental management during execution of the Project.

Construction Environmental Management Plan (CEMP)

The Project Company (or its appointed independent environmental consultant registered by the MME)
shall prepare a detailed CEMP, including all associated detailed method statements, and shall obtain
approval by the MME.

The CEMP shall be submitted to the Ashghal for review and No Objection.

Construction Waste Management Plan (CWMP)

The Project Company shall prepare a CWMP that will detail the specific waste management requirements
for the construction phase of the Project and shall develop a robust set of detailed waste minimization
and control measures tailored to the specific construction practices intended to be undertaken at the
Project Site. The CWMP will identify appropriate management measures for all waste streams generated
throughout the duration of the construction works.

Operational Environmental Management Plan (OEMP)

The Project Company shall prepare and submit a detailed OEMP, including all associated detailed method
statements for approval by the MME prior to the Project Commercial Operation Date.

Key Environmental Deliverables

The Project Company shall provide and submit to Ashghal the following environmental deliverables:

 Conduct a new ESIA study or update the existing EIA study in order to satisfy the potential
international lenders which would require adherence to their specific guidelines for
environmental and social considerations, the Equator Principles (EP), IFC Performance
Standards and IFC EHS guidelines, and applicable IFC sector-specific guidelines.
 Submit a detailed Environmental Risk Assessment (ERA) programme within twenty-eight (28)
Days of the Effective Date to Ashghal for information in accordance with the requirements of the
Agreement.
 At the Effective Date the Project Company shall prepare a detailed Environmental Risk
Assessment register that logs and tracks all environmental aspects and impacts of all works. The
Project Company shall update the register at least monthly, with identified mitigation measures
proactively actioned. This programme is to continue seamlessly throughout all stages of the
Project.
 Establish a detailed environmental permitting and compliance matrix to ensure legislative
compliance for submission within twenty-eight (28) days of Effective Date to Ashghal for no-
objection in accordance with the Agreement and provide continual updates on monthly basis.
 Complete all relevant environmental permit applications and submit to Ashghal for no-objection
no less than sixty (60) Days prior to start of construction.
 Obtain all necessary approvals (including preparation of all documentation of applications,
paying all fees and expenses, and follow up with the Competent Authorities) and engage with all

Competent Authorities (and other Stakeholders where necessary) in order to secure all Approvals
including the building permit and others that are needed during the Project Life Cycle.
 Obtain all necessary approvals (including preparation of all documentation of applications,
paying all fees and expenses, and follow up with the Competent Authorities) and engage with all
Competent Authorities (and other Stakeholders where necessary) in order to secure the Project
environmental permit.
 Within sixty (60) Days of the Effective Date, establish an IS0 14001:2015 compliant (or an
equivalent, internationally recognized) environmental management system EMS to be audited at
least twice a year to ensure ongoing compliance. The Project Company shall design, implement
and effectively resource a comprehensive Environmental Management System (EMS), compliant
with Competent Authority, Government, international standards and recognised best practice,
that will include a range of management plans specific to Engineering / Environmental design
integration, environmental impact / risk assessment, construction environmental management
planning, site supervision, project environmental / sustainability performance and auditing.
 Submit to Ashghal for information, a comprehensive construction Environmental Management
Plan no later than forty-two (42) Days after the Effective Date, in accordance with the
requirements of Agreement.
o The construction Environmental Management Plan shall be aligned with MME
requirements and international best practice.
o The CEMP shall address the findings of the ESIA, MME (and other relevant
agency/stakeholder) requirements, international best practice, and any additional
actions identified as being necessary by the ERA Programme and submit to Ashghal for
information.
o The CEMP shall be approved by the MME no later than twenty-eight (28) Days prior to
start of construction. The Project Company is prohibited from commencing any
construction works prior to the approval by the MME of the project’s CEMP (i.e. approval
of the environmental permit).
 Environmental Auditing - The Project Company shall undertake audits to assess all aspects
of environmental management activities at the project site; and to identify and assess potential
liabilities, risks, and hazards. The results of the audits are then used to identify areas for
improvement in environmental management and to identify costs associated with reducing
environmental risks and liability to acceptable levels.
 Environmental Reporting: The Project Company shall manage the enforcement,
documentation and completion of environmental requirements to be submitted to Ashghal, to
include but not limited to following:
a. Monthly environmental progress report providing:
(1) Monthly updates of the ERA register
(2) Monthly updates of the environmental compliance matrix
(3) Monthly updates of the permit register
(4) Details of environmental incidents, violations of permit conditions, and other
environmental issues.
(5) Details of environmental objectives and targets

(6) Details of environmental audits and site environmental inspections completed


(7) Details of environmental performance monitoring and measurement
(8) Updates of all environmental reports and submissions to the MME
b. Annual summary environmental progress report, with the draft report to be submitted in
January of each calendar year to Ashghal.
 All Project Site related environmental data shall be recorded by the Project Company and
reported to Ashghal on a monthly basis or as and when required.

Sustainability Requirements

The Project Company shall engage with the Competent Authority and the Global Organisation for
Research and Development (GORD) to assess the applicability of the following Global Sustainability
Assessment Scheme (GSAS) for the Project:

 GSAS Design and Build


 GSAS Construction
 GSAS Operations

The Project Company shall:

 within twenty-eight (28) Days of Effective Date, identify and register the Project Assets with
GSAS trust; and
 based on the requirements of GSAS sustainability performance assessment scheme, complete the
certification process for the Project Assets.
