2021 Surveyor Letter

board FALLine vessels on behalf of the following companies, followed by updates standing
instructions.
The following FALLINE (Fednav) surveyors have unrestricted access (including hold access
and photographs) to all FALLine vessels discharging in the St. Lawrence / Great Lakes ports:

Please note that inbound East Coast and Great Lakes vessels for AMSI (ArcelorMittal Stainless Inc.) do
not fall within the scope of AMIA’s responsibility.
ACCESS TO HOLDS
Except by Court order, the Shippers or their representatives shall have access to the holds of the vessel
only with the prior approval of the Carrier, confirmed by the Master of the vessel.
Where such approval and confirmation is given, such access shall always be in accordance with the
Carrier’s applicable guidelines current at the time and with the specific requirements of the Master, and
shall be restricted to the Shippers’ cargo. Each individual will be required to sign a waiver / indemnity in
the form attached as Schedule 5. The Shippers or their representative shall at all times be accompanied
by, and strictly obey the instructions of, a designated member of the vessel’s crew and shall not interfere
in any way with the cargo or vessel operations. Specific permission from the Master will be required for
the taking of photographs, which, if so permitted, are always to be restricted to the Shipper’s cargo.
SCHEDULE 5
Dear Sirs,
1. That none of you shall be responsible whether under statute or at common law or otherwise
howsoever for loss of life or any personal injury which I/we may suffer howsoever or wheresoever
caused whether directly or indirectly by negligence of all or any of you or your servants, agents or
subcontractors and that no warranty express or implied has been or shall be deemed to have been
given that the said ship is safe and/or seaworthy.
2. That I/we will indemnify each and all of you in respect of any claims howsoever or wheresoever
arising or caused and any costs or expenses incurred in defending the same which any of you may
pay to third parties in respect of any act or omission whatsoever on my part.
3. That all rights, exemptions from liability and immunities of whatsoever kind referred to in or conferred
on any of you under or in relation to this agreement shall also enure for the benefit of any of the
servants or agents or subcontractors of each of you acting under or in connection with their
employment, and for the purpose of this agreement the same shall be deemed to be parties hereto.

THYSSENKRUPP/ RASSELSTEIN
Sorel / Hamilton
1. In the first place, it must be made clear that the boarding of a representative or surveyor is not an
automatic right, and permission to do so is only given to certain Shippers / Receivers. The names of
these Shippers / Receivers are shown on the attached memo, and no other Shippers / Receivers are
allowed to send representatives on board our vessels without prior express permission from this office
(unless the ruling contract expressly permits this). Where permission has been given, surveyors or
representatives may still only go on board when examination of the cargo on the wharf shows that
cargo remaining in the hold is likely to be damaged.
2. Permission to board vessels is always subject to approval of the Master of the vessel in question, who
has the final say. Prior to proceeding to any hatch, therefore, representatives or surveyors must make
their presence known to the vessel’s Master, who has the right to refuse permission to anybody not
essential to cargo-handling operations or who believes may constitute any risk to the cargo, the vessel
itself or anyone on board.
3. Shippers’ / Receivers’ representatives or surveyors must not interfere in any way with labour or with
cargo-handling operations. Under no circumstances are Shipper’s / Receiver’s representatives or
surveyors permitted to descend into the holds unless authorized by FALLine or required by court order.
4. Representatives or surveyors may concern themselves only with their principal’s cargo and the holds
in which it is stowed. They may not interrogate officers or crew nor inspect logbooks. Once onboard
the vessel, the Shipper’s / Receiver’s representatives or surveyors should be accompanied by a
member of the crew/agent at all times.
5. Where permission has been given for the Shipper’s / Receiver’s representative or surveyor to board
our vessels, he must restrict his observations to the cargo of that Shipper / Receiver only and must
undertake not to use any information, which he gains by being allowed to board a vessel, for the
benefit of any other Shipper / Receiver.
6. Under no circumstances can pictures be taken while on board the vessel unless agreed with Falline
beforehand. Where the Shipper’s / Receiver’s representative or surveyor has our permission to take
photographs, this permission is always subject to the Master’s approval and subject to local or
government regulations at the terminal in question.
7. Representatives and surveyors must comply with the regulations of the terminal at which the vessel is
loading or discharging.
8. Shipper’s / Receiver’s surveyors or representatives should be adequately covered by their own/ their
employer’s insurance for loss of life or injury and should be required to sign in advance an indemnity/
waiver of claim in usual P & I Club form, such as waiver/ indemnity to be addressed to the Master,
Owners, the vessel and Charterers.
