JUSTICE MOHSIN AKHTAR KIYANI, JUDGE, ISLAMABAD HIGH COURT. This reference is filed against the misconduct of the Learned judge in connection to his routine practice being in violation to the express provisions of the code of conduct issued by this Honourable Council under Article 209(8), vide its Notification dated:2 Sep, 2009, being a bottom line to be observed by the Leamed Judges of Superior Courts and expressly violated the oath taken for the office of being a Judge of Superior Judiciary. 4) Under the patronage of Learned Judge, Mr, Justice Mohsin Akhtar Kayani, a new trend has been developed of hearing the cases of the close friends and near relatives while appearing as lawyers or parties, and no example of such practice is found even in the most corrupt and incompetent judicial systems across the world, at least not even a single judge in the history of Pakistan Judicial system has ever acted in such an unethical way, and for no good reason Learned judge can satisfy that his professionalism and his uprightness is exceptional as against rest of the judicial systems across the history of each and every judicial system in vogue in the whole world, or he is above the law to that extent. Honorable Mr. Justice Mohsin Akhtar Kiyani has been a partner of AQ Associates alongwith Chaudhary Abdul Aziz, ASC (Presently Mr.Justice Chaudhary Abdul Aziz, Learned Judge, Lahore High Court, Lahore), Sardar Shabbir Hussain, Qazi Adil Aziz, Sagib Bhatti, Qasir Imam, Taimoor Ali Khan, Malik Talha Rahim, Rao Abdur Raheem, Haseeb Afridi, Aman Ullah Kayani and Jawad Adil. its mockery of judicial system and severe case of conflict of interest as these juniors/ partners also appear in case before Mr. Justice Mohsin Akhtar Kiyani and almost every case is managed. (Who remained a senior most associate of Learned Judge during his practice and has been a long-time confidant of the learned Judge besides his manager Shabbir alias Shabbira, got married to a French National Ms. Samia Noreen Iqbal, who by hiding her identity in serving as judicial officer in Islamabad, and was also the associate of Mr. Justice Mohsin Akhtar Kiyani, that's how her reality was managed by Learned3 dudge and Saqib Bhatti, which is a professional misconduct on the part of both of them. Appeal 609/2010, Jamshed Khan VS The State K.Aman Ullah Kiani (A blood relative, presently holding the ex-office of Mr. Justice 2) 3) ‘Mohsin Akhtar Kayani, and is in fact the boss of all the corrupt lawyers, who serves as a middle man between all the lawyers and Mr. Justice Mohsin Akhtar Kayani regarding, cases, their fixation, management of Lower Judiciary, controlling the Bar politics and for establishing contact of Learned Judge with every individual through his personal cell phone) In another unprecedented case of mockery of justice, Honourable Mr. Justice Mohsin Akhtar Kiani decided a case of land in Sihala through CR No. 156/2015(titled as Muhammad Miskeen& others Vs Abdul Khaliq & others). The case was already fixed and heard by the court of Miangul Hasan Aurangzeb and arguments had been made on 09.03.2020. It was relisted for 21/02/2023 before the same Bench of Mr. Justice Mian Gul Aurangzeb, but surprisingly Mr. Justice Mohsin Akhtar Kiyani, in the capacity of being an Admin Judge IHC enlisted the case of Muhammad Miskeen & others and fixed the same in his own court on an earlier date ie 14/2/2023, without any application by either party and without the consent of the Leamed Judge. As per earlier understanding he gave the judgement instantly in favour of M. Miskeen & others. (An attested order along with whole record of the case is attached). (Copies of Judgment in C.R No.156/2015,dated: 21-02-2023, Order of Leamed Single Bench of IHC dated: 27-07-2012, Judgment of trial Court dated: 30-06-2014 along with Record Are attached as Annex. “A") He has a thorough corrupted Lower Judiciary Network to whom he has favoured/elevated over the period of time, for acting on his directions. One of the fine examples is of Senior Civil Judge Rana Mujahid Rahim, whom he has elevated by surpassing 4 senior judges of lower judiciary, exclusively because of his discriminative behaviour towards the judges from KPK. a. . Ehtesham Alam Khan.4) 5) 6) - 14- Judge Ms Riffat Mahmood (CJ), who is wife of SCJ Rana Mujahid Rahim, to whom he has given an extra ordinarily leave for 11 months leave (Notification is attached). Like-wise Sister-in-Law of Mujahid Raheem Namely Nuzhat Mehmood (Cu) has also been given undue favour of extra ordinary leave for 11 months. (Notification is attached) The Honorable Judge has very close family relation with the said family. (Copy of Notification No.F.No.(55)/JO/Cont.HC/2455, dated: 08-09-2023 is attached as Annex. “B") Mohsin Akhtar Kiyani’s fixation of case & having understanding from petitioner is. 80 obvious & known in judicial circles that many times, despite the status of sitting IHC judge, few counsels have given written application in this matter. One such example is regular advocate of IHC, Mr Jan Muhammad Khan, ASC who with his own signature has filed complaint fetter about this and requested formally to CJ IHC, to stop the fixation of his cases before the Learned Judge Mr. Justice Mohsin Akhtar Kayani, and also added that previously upon his elevation he requested the then Learned Senior Puisne Judge that he cannot appear before the Learned Judge as being associated to him, and did not agree to this practice of appearing before the judge previously known and close. The leamed Judge initially started hearing his cases despite of his request and victimised him till his level best by passing the adverse orders in his cases in order to damage his practice and to stop him from taking this stance as it was otherwise obstructing the corrupt practices of the Learned Judge and the above said lawyers. Not only this but after moving application, the learned judge instead of showing the courtesy to his written application and for maintaining the decorum of the Court, use {o pass comments on transfer of every case with the Lawyer and finally refused {o transfer the remaining cases, which is a worst example of non- preservation of dignity of a Court being in violation to Article Il of the code of conduct, wherein the lawyer community as per their time long practice are standing for rule of Law and independence of judiciary but unfortunately they are always shown cold shoulders by the such Judicial officers. (Copy of Application filed by Lawyer/Associate along with anonymous application dated:05-09-2022 are attached as Annex. “C’) Itis submitted that Rawal Dam being managed by small Dam Org and providing 25m gallons/day water to citizens of Rawalpindi & cantonment areas. Despite the clear instructions of judicial orders on restriction on motor boating in the lake, commercial outlet onward by family/relatives of Mohsin Akhtar Kiyani is operating commercial of motor boal/ motor scooters and (CDA/ Admin Park) are reluctant to take any actions due to fear of sitting judge of IHC. Calculating annual income is around 90M. As per instructions of SCP, any type of motorized boating is not allowed in Rawal Dam. As per official record, land measuring 5925 Kanals 9 Marias of Mouza Lakhwal Islamabad was acquired by GOP for Rawal Dam and since then it is closed and no Patwari is officially designated for the said Mouza, and as per record of ICT administration, there are only two owners of the land (WAPDA & CDA).7) ~ 2 o- Additionally, as per directions of SCP for demarcation, the land was declared to be owned by the CDA Islamabad & small Dam Org. A whole land mafia with patronage from with CDA & Rawalpindi Administration fraudulently has obtained fake letters allotment documents for land measuring 419 Kanal & 5 Marlas of Mouza Lakhwal (matter is still pending in NAB). After many petitions & legal procedures, when CDA started Anti Encroachment operation (IHC Judge Mohsin Akhlar Kiyani) instantly took up the case and placed stay order on the operation: benefiting his own lands and that of his family & previous clients. It is also pertinent to mention that the Honourable Judge himself is shareholder of (18% shares) Lake View Lane Society (LVL) along with his close family members Raja Naeem Ullah (1" cousin - 18% shareholder), Col (R) Raja Pervaiz (25% shareholder), Raja Zahoor (Uncle - 39% shareholder). Attached are the fraudulently land aleng with Khasra No. & Registry Nos. on Mohsin Akhtar Kiani. (Copies of Judgment dated: 01-07-2016 passed by Omer Shabbir (CJ) along with complete Record of W.P. 1057/2016 are attached as Annexure *D") It is also to mention that the Honourable IHC Judge has many properties in Pakistan and abroad, other than declared 15 non-moveable properties {comprising upon 6 plots, 9 houses and apartments) the honourable judge has many Benami properties. For-example he has benami property in main sector F- 6, a two Kanals under construction luxury double storey house (Address Plot 3, 3-A, Main School Road F-6/1, pictures attached. He also owns luxury apartments abroad valuing up to nearly 02 billion Rupees. (Copies of the pictures of Benami House No.03, School Road are attached as Annexure *E") PRAYER: In the light of above said submissions, the Learned Judge of Islamabad High Court, Mr. Justice Mohsin Akhtar Kayani, is guilty of professional misconduct and has violated each and every Article of code of conduct issued by this Honourable Council for ‘observance by all the judges of Superior judiciary, and he is liable to be removed from the post of being a judge of superior judiciary. In the meantime, judicial powers may kindly be withdrawn from the Learned Judge, in order to further avoid the illegal practices at the hands of Learned Judge and all the above-mentioned Lawyers. ~@ PETITIONER {Raja Maasood Hussain) Advocate
