PATENT:

One significant patent case in the Philippines involved the pharmaceutical company Merck Sharp & Dohme
Corp. (MSD) and the local generic drug manufacturer United Laboratories, Inc. (UNILAB). The case revolved
around patents for the drug sitagliptin, which is used to treat type 2 diabetes.

MSD held patents for sitagliptin, marketed under the brand name Januvia. They claimed that UNILAB infringed
on their patents by manufacturing and selling generic versions of sitagliptin without authorization. UNILAB
argued that MSD's patents were invalid and should be revoked, allowing them to produce and sell their generic
version of the drug.

The case underwent several legal proceedings and hearings in the Philippine Intellectual Property Office (IPO)
and the courts. It involved debates over patent validity, infringement, and the rights of generic drug
manufacturers to produce more affordable versions of essential medications

ABS-CBN Corporation vs. Philippine Multi-Media System, Inc. (Skycable Corporation):

This case involved ABS-CBN, a major media and entertainment conglomerate in the Philippines, suing Skycable,
a cable television provider, for copyright infringement. ABS-CBN alleged that Skycable was airing its television
programs without proper authorization or licensing agreements. The case revolved around the unauthorized
retransmission of copyrighted content through cable television, leading to a legal battle over intellectual
property rights.

TRADEMARK:

McDonald's vs. MacJoy Fastfood Corporation:

In 2007, McDonald's Corporation, the global fast-food giant, filed a lawsuit against MacJoy Fastfood
Corporation, a local Philippine company, for trademark infringement. MacJoy operated a chain of fast-food
restaurants in the Philippines using a logo and trade dress similar to McDonald's, which led to confusion among
consumers. McDonald's argued that MacJoy's use of a similar name and logo was causing dilution of its famous
trademark and was misleading to the public. The case was brought to court, and after legal proceedings, the
court ruled in favor of McDonald's, ordering MacJoy to cease using its branding that resembled McDonald's
trademarks and awarded damages for trademark infringement.
