Section 10. Role of LGUs in Solid Waste Management

- Pursuant to the relevant provisions of RA 7160,
otherwise known as the Local Government Code, the
LGUs shall be primarily responsible for the
implementation and enforcement of the provisions of
this Act within their respective jurisdiction.
- Segregation and collection of solid waste shall be
conducted at the barangay level specifically for
biodegradable, compostable and reusable wastes;
Provided, that the collection of non-recyclable
materials and special wastes shall be the
responsibility of the municipality or city.

Section 33. Guidelines for Establishment of Materials Recovery

Facility
a. The building and/or land layout and equipment must be
designed to accommodate efficient and safe materials
processing, movement and storage;
b. The building must be designed to allow efficient and safe
external access and to accommodate internal flow;
c. If the MRF includes a composting operation, it shall comply
with the provisions applicable to composting and composts
indicated in this Act; and
d. The following records shall be kept and maintained:
i. Record of daily weights or volume of waste received,
processed and removed from the facility;
ii. Daily logbook or file of the following information shall be
maintained: fire, special occurrences, unauthorized loads, injury
and property damage.
Section 25. Guidelines for Transfer Station

Minimum Requirements for Establishing and Operating a Transfer
Station (Rule X. Sec. 2 of the IRR of RA 9003)
1. Leachate and Drainage Control

3. The facility shall consider the land use plan, proximity of
collection area and accessibility of haul routes to disposal facility.
Further, the design shall give primary consideration to size and
space sufficiency in order to accommodate the storage of waste and
vehicles for the loading and unloading of wastes.
4. The following record shall be kept and maintained:
a. Record of daily weights of volume of waste received and
transferred;
b. Daily logbook or file of the following information shall be
maintained: fire, special occurrences, unauthorized loads, injury
and damage to property.
5. Waste shall be removed from the facility within 24 hours of its
receipt.
Section 37. Prohibition Against the Use of Open Dumps for
Solid Wastes
- No open dumps shall be established and operated, nor
practice or disposal of solid waste by any person, including
LGUs, which constitutes the use of open dumps for solid
waste be allowed after the effectivity of this Act: Provided,
that within 3 years after the effectivity of this Act, every
LGU shall convert its open dumps into controlled dumps.
Provided, further, that no controlled dumps shall be allowed
5 years following the effectivity of this Act.

FACTORS AFFECTING THE IMPLEMENTATION
OF SECTION 37
1. Insufficient Budgetary Resources;
2. Difficulties in finding suitable site for development

of a Sanitary Landfill;
3. Low compliance in the implementation of the SWM

plan; and
4. Predominance of the NIMBY syndrome in potential

Sanitary Landfill sites
Residual Containment Area (RCA)
- temporary storage of dry residual wastes that were placed
in sacks. It has a roofing, walls and concrete flooring for the
protection from vector/insect, litter, odor, dust, surface run-
off waiting for the construction of SLF

Operation of RCA:
1. Residual wastes to be stored at the RCA shall not exceed

the capacity of the facility;
2. Mix wastes shall not be accepted at the facility; and
3. The facility, its equipment and the surrounding area,

storing residual wastes shall be routinely inspected by
its operator for evidence of failure and necessary
corrective action shall be undertaken immediately
Section 44. Establishment of Common Waste Treatment

and Disposal Facilities
- Pursuant to Section 33 of RA 7160, otherwise known as
the Local Government Code, all provinces, cities,
municipalities and barangays, through appropriate
ordinances, are hereby mandated to consolidate, or
coordinate efforts, services, and resources for purposes
of jointly addressing common solid waste management
problems and/or establishing common waste disposal
facilities.
- The Department, the Commission and local solid waste
management boards shall provide technical assistance
to the LGUs

engineering control over significant potential
environmental impacts arising from the development
and operation of the facility
ASSESSMENT AND EVALUATION OF
PROPOSED SITE FOR SLF (as per Sec. 40
of RA 9003 and NSWMC Resolution No.
64, Series of 2013
Site Selection Parameters Exclusion (Absolute) Criteria

1 Proximity to Groundwater The site shall not be located on

supply intakes (water supply
wells, jetmatic pumps or open dug
wells) used for private or public
drinking, irrigation or livestock
shall also be excluded.

drinking water supply, irrigation or
livestock.
3 Local Geological Conditions The site shall not be located on areas

(Underlying Rock Formation) with underlying rocks characterized as
jointed, fractured or fissured;
carbonate (limestone or dolomite);
karst, and other porous rock
formations; or in areas with sinkholes
or caverns.
4 Seismic Conditions (Proximity to No facility shall be constructed at site

present) or a known recent active fault.
5 Soil Properties and Availability of The site shall not be located in unstable,

6 Topography (Terrain and Slope) The site shall not be located on a

landslide-prone area with groundslopes
nominally greater than 50% or 2:1
horizontal-to-vertical ratio or as
determined by authorities.
No site shall be situated in old quarries or
abandoned mine pits.
7 Vulnerability to Flooding The site shall not be located in areas

prone to seasonal flooding such as
swamplands, marshes and wetlands. This
also includes areas that are deemed very
highly susceptible to meteorologically-
influenced and related natural hazards
(flood-prone areas) as declared by DENR-
MGB or other appropriate authorities.
8 Proximity to Residential Areas and The sites shall not be located in or within 250
Other Sensitive Land Users meters of existing or proposed residential,
commercial or urban development areas, and
areas of historical, archaeological, cultural,
geological, or scientific interests, which are more
than 100 years old and declared by National
Commission for Culture and the Arts, National
Historical Institute or National Museum.
9 Proximity to Ecologically Sensitive or The site shall not be located within 500 meters of

proclaimed as protected areas under the National
Integrated Protected Areas System (NlPAS) Act,
or by any related issuances, as national parks
(areas of national significance), conservation
parks (areas with valuable wildlife or interesting

managed primarily for public recreation with
some native vegetation), forest reserves, sites of
flora and fauna of national or regional
significance, wildlife sanctuary, mangrove areas,
coral reefs, or wetlands of important biodiversity.
10 Consistency with Current or The location of the facility shall be

12 Landfill Area and Lifespan The site shall be large enough to
accommodate waste for a period of five
(5) years, with provision for expansion,
during which people must internalize the
value of environmentally sound and
sustainable waste disposal.
13 Haul Distance, Accessibility and The site shall be accessible from major

that if it is not accessible, the project
design shall include means of access.

Total Solid Waste Management Solution
⚫ As per NSWMC Resolution No. 1452, Series of 2021,

entitled “Adopting the Total Solid Waste
Management Solution to Optimize Waste Recovery
and Utilization in the Sanitary Landfill Prior to
Disposal”
⚫ Total Solid Waste Management Solution concept

that aims to ensure optimum utilization of solid
wastes that enters the Sanitary Landfills, by
integrating processes and technologies for the
management of biodegradable wastes, recyclable
wastes and residuals with potential for diversion,
and for the treatment of special wastes or
household hazardous wastes prior to disposal
thereby extending the life of the disposal facility.
PENAL PROVISIONS
Section 48. Prohibited Acts. – The following acts are prohibited:
1. Littering, throwing, dumping of waste matters in public places,

such as roads, sidewalks, canals, esteros or parks, and
establishment, or causing or permitting the same;
2. Undertaking activities or operating, collecting or transporting

equipment in violation of sanitation operation and other
requirements or permits set forth in or established pursuant to
this Act;
3. The open burning of solid wastes;
4. Causing or permitting the collection of non-segregated or

unsorted wastes;
5. Squatting in open dumps and landfills;

6. Open dumping, burying of biodegradable or non-biodegradable

materials in flood-prone areas;
7. Unauthorized removal of recyclable materials intended for

collection by authorized persons;
8. The mixing of source-separated recyclable materials with other

solid waste in any vehicle, box, container or receptacle used in
solid waste collection or disposal;
9. Establishment or operation of open dumps;
10. The manufacture, distribution or use of non-environmentally

acceptable packaging materials;
11. Importation of consumer products packed in non-

environmentally acceptable materials;
PENAL PROVISIONS
12. Importation of toxic wastes misrepresented as “recyclable” or

“with recyclable content”;
13. Transport and dumping in bulk of collected domestic,

industrial, commercial and institutional wastes in areas other than
center of facilities described under this Act;
14. Site preparation, construction, expansion or operation of

waste management facilities without Environmental Compliance
Certificate required pursuant to PD 1586 and this Act conforming
with the land use plan of the LGU;
15. The construction of any establishment within 200 meters from

open dumps or controlled dumps or sanitary landfills; and
16. The construction or operation of landfills or any waste disposal

facility on aquifer, groundwater reservoir or watershed area
and/or any portions thereof.

collective disposable residual wastes of greater than 15 TPD
but less than or equal to 75 TPD

Subject: Guidelines Governing Waste-to-Energy (WtE) Facilities

for the Integrated Management of Municipal Solid Wastes
1. Waste-to-Energy (WtE) – refer to the process of converting

waste with various technologies usually the conversion of non-
recyclable waste materials into useable heat, electricity, or fuel
through a variety of processes;
2. Feedstock – refer to the segregated biodegradable or residual

waste materials supplied to the WTE facility to generate heat or
electricity;
3. Bottom Ash – refer to the agglomerate ash formed that are too
large to be carried in the flue gases and fall through open
grates to an ash hopper; and
4. Fly Ash – refer to the ash formed that are too small and light
and are carried in the flue gases
Requirements in the Establishment of WtE:
1. All WtE facilities shall undergo Environmental Impact

Statement System and secure all applicable permits,
clearances and other legal requirements form
concerned agencies prior to construction, set-up and
operation;
2. Documentation for compliance with the requirements

of PD 1586 shall include an environmental and health
risk assessment;
3. The host LGU including LGUs where the feedstock will

originate from shall see that the plan to establish
and/or utilize WtE facility is integrated in their
approved 10-year SWM plan consistent with the
provisions of this Act;
4. The host LGU is allowed to implement clustering

and/or form partnerships with private sector in the
establishment, construction and operation of the WtE
facility;
Requirements in the Establishment of WtE:
5. The proponent shall submit an Environmental Technology Verification

(ETV) Statement and Report following the DOST ETV Protocol;
6. The WtE facility owner shall;

i) Develop a manual of operation and quality assurance and control to
be submitted to EMB for monitoring purposes;
ii) Maintain, at the highest possible standard, a quality

control/assurance system to demonstrate its ability to consistently provide
products and services that meet applicable statutory and regulatory
requirements;
iii) Implement and communicate a detailed emergency response plan;
iv) Provide PPEs and medical care to all personnel of the facility directly
handling or exposed to waste materials, in-process materials and finished
products; and
v) Ensure implementation of resource efficient and cleaner production

program that follows the waste management hierarchy of source reduction,
recycling, treatment and safe disposal
Operational Guidelines for WtE Facility
I. Waste Delivery Control – the facility shall only

accept source segregated biodegradables or
residual wastes;
II. Storage Facility – appropriate storage facilities

should be provided for source segregated wastes,
in-process materials and any by-product from the
WtE facility operation; and
III.Environmental Monitoring

a) The WtE operator shall submit to EMB Regional Offices

quarterly Self-Monitoring Report and semi-annual
Compliance Monitoring Report;
b) The WtE operator shall install Continuous Emissions

Monitoring System (CEMS), link with the EMB, measuring
particulate matter (PM), nitrogen dioxide (NO₂), carbon
monoxide (CO), hydrochloric acid (HCl), temperature and
other parameters as determined by EMB;
c) WtE facilities utilizing thermal process must conduct

sampling and analysis for dioxins and furans; and
d) Effluents from WtE facilities must conform with DENR AO

No. 2016-08 (Water Quality Guidelines and General
Effluent Standards) and/or the latest relevant issuance
thereof.
