It is stated by the Union of India in its affidavit dated 5th April, 2010
(page 540 of the paper book) that as per the guidelines issued by the Government
of India (page 203 of the paper book) no office bearer W.P.(C)
195/2010 Page 1 of 3 of a
sporting federation shall hold office consecutively for more than two terms of
four years each. However, these instructions and guidelines have been kept in
abeyance since October, 2001.
Learned counsel for the Petitioner submits that it has not been stated what
are these objections and why the guidelines are kept in abeyance.
Our attention has been drawn to a statement made in Parliament (page 549 of
the paper book) to the effect that on the tenure issue, the Central Government
is in the process of reviewing the whole matter in consultation with the sports
bodies.
The Union of India should file an affidavit and indicate what steps it is
taking to enforce and implement the guidelines framed by it to ensure that
elections to the Sporting Federations are held in accordance with the guidelines
and that no person holds office for more than two consecutive terms.
We would also like the Union of India to place on record authenticated
copies of the Rules, Regulations and Memorandum of Association of the Athletic
Federation of India, the Badminton Association of India, the All India Football
Association and the Indian Hockey Association/Hockey India (recognition
temporary suspended) and the Rifle W.P.(C) 195/2010
Page 2 of 3 Association of India. The needful be done within a period of three
weeks from today.
We would like a detailed and clear affidavit to be filed by the Union of
India explaining its stand on this issue.
Needless to say that advance copies of the affidavit filed by the Union of
India with all supporting documents be handed over to learned counsel for all
the parties.
