DAB-Scout.3 Licensing Terms and Conditions

The licensing and using of the subject DAB-Scout.3 software and associated documentation
(collectively referred to as “Software”) requires your acceptance of the associated applicable terms and
conditions of the Institut für Rundfunktechnik (IRT) as well as, if provided, of the associated third party
software document (collectively referred to as “Terms”).
Please note that each single download permits solely for one (1) individual use of Software. Copying
and/or distribution is prohibited. For licensing reasons, each individual user has to perform his/her own
download of Software.

By installing, copying or otherwise using Software, you agree to be bound to all the Terms. If you agree
to the Terms on behalf of a company or other legal entity, you represent that you have the legal
authority to bind the legal entity to the Terms. If you do not have such authority, or if you do not fully
agree to the Terms, you must not install, copy, or otherwise use the Software.

IRT hereby grants you the personal, non-transferable and non-exclusive right to install and use the IRT-
developed code of Software (“IRT-Code”) free of IRT-royalties solely on one (1) computer while
running no more than one (1) instance of Software solely for your internal purposes. Any third party
software included in Software is subjected to your acceptance of the terms and conditions presented by
the respective third party. IRT does not licence any third party code. For further information on included
third party code, please see the document “IRT's DAB Scout.3 - Third Party Software - Licensing
Conditions” included in the Software package.

You must neither copy, distribute, rent, sub-license or otherwise make available to your colleagues or
third parties Software, associated documentation, nor derive from Software other works.

You must not remove any proprietary notices, labels, trademarks on the Software or related
documentation. You must not modify, de-compile, disassemble or reverse engineer the Software.

IRT retains all its rights contained in Software that are not explicitly granted.

In the frame of above granted royalty-free licence on IRT-Code, IRT excludes any and all support,
warranty and liability as follows:

Support: IRT does not provide any support to Software.

Warranty/Liability: Software, including any documentation, is provided solely on an "as is" basis. To the
extent not prohibited by law, (i) IRT neither grants any warranty on Software, including without limitation
concerning the absence of errors, its performance, availability and fitness for any particular purpose, nor
does (ii) IRT assume any liability, including without limitation related to any direct, incidental or
consequential damages (including without limitation, loss of anticipated profits, benefits, use or data)
resulting from the provision, installation or use of Software. Consequently, reception, installation and
use of Software are at your own risk.

For the rest, the licensing of Software is further subject to your execution of IRT’s “General Terms and
Conditions and Licence Terms”.
