1. Do you believe that copyright, patent, and trade secret laws and their enforcement have
accelerated the pace on innovation or slowed it? Explain your answer.

Answer: I think that copyright, patent, and secret laws, as well as accompanying social
controls, have tremendously sped up invention and technical advancement.

2. What problems can arise in using nondisclosure and noncompete agreements to protect
intellectual property??

Answer: Unfortunately, the contract is only as good as the person signing it. If your partner
breaches the contract, you can take them to court for damages, but this might be expensive
and time-consuming. It can also be difficult to quantify the damage.

3. Explain the concept that an idea cannot be copyrighted, but the expression of an idea can be,
and why this distinction is a key to understanding copyright protection.

Answer: The expression refers to the concept that an idea itself cannot be copyrighted, but the
expression of an idea can. Basically, a movie can be copyrighted, but the idea behind the movie is
not eligible for copyright. Copyrights can apply to a wide range of things, including: literary
works.
