PUBLIC OFFICIALS AND EMPLOYEES

INTRODUCTION
THE STORY ABOUT A POLITICIAN
• There was a rich man who was critically ill.
• To save his life, the doctor advised a brain transplant and gave him
three (3) options:
• First – Brain from a lawyer which costs 1M dollars. The rich
man was not satisfied. ‘
• Second, Brain from a professor that costs 2 million dollars. The
rich man rejected and demanded better.
• The third is the brain of a politician or government official
which costs 30M dollars.

The rich man was in disbelief. The doctor explained the reason.

DECLARATION OF POLICY
Public officials and employees shall at all times be accountable to
the people and shall discharge their duties with utmost
• responsibility • act with patriotism and justice
• integrity
• lead modest lives, and
• competence
• loyalty • Uphold public interest over personal
interest
Public Office
• The term “public office” is frequently used to refer to the right,
authority, and duty, created and conferred by law, by which, for a
given period either fixed by statute or enduring at the pleasure of
the creating power.
• An individual is invested in some portion of the sovereign functions
of government, to be exercised by that individual for the benefit of
the public. (Fernandez v. Sto. Tomas, 1995)

PUBLIC OFFICE

•A public office is neither property nor a


public contract.
•Yet the incumbent has, in a sense, a
right to his office.
•If that right is to be taken away by the
statute, the terms should be clear.

•Public office being personal, the death of a
public office terminates his right to occupy
the contested office and extinguishes his
counterclaim for damages.
•His widow and/or heirs cannot be
substituted in the counterclaim suit.

• Public officials and employees shall always uphold the public interest over and
above personal interest
• All government resources and powers of their respective offices must be
employed and used efficiently, effectively, honestly, and economically,
particularly to avoid wastage in public funds and revenues.

Professionalism
• Public officials and employees shall perform and discharge duties with the
highest degree of excellence, professionalism, intelligence, and skill.
• They shall enter public service with utmost devotion and dedication to duty.
• They shall endeavor to discourage wrong perceptions of their roles as
dispensers or peddlers of undue patronage.

• Strict personal discipline is expected of an occupant of a public office

accountable for his conduct to the people.

RESPONSIVENESS TO THE PUBLIC

Republic Act No. 9485

• The Anti-red tape act of 2007 was enacted into law to improve
efficiency in the delivery of government services to the public by
reducing bureaucratic red tape, preventing graft and corruption.

• Red Tape- an idiom that refers to excessive regulation or rigid conformity to


formal rules that is considered redundant or bureaucratic and hinders or
prevents action or decision-making.
• It is usually applied to governments, corporations, and other large
organizations.

• Aims to streamline the current systems and procedures of
government services.
• Pertains to improving the competitiveness of and ease of doing
business in the Philippines.

Republic and to the Filipino people,
• Promote the use of locally produced goods, resources, and
technology, and
• Encourage appreciation and pride in the country and people.

DUTIES OF PUBLIC OFFICIALS AND EMPLOYEES
• Act promptly on letters and requests
• All public officials and employees shall within 15 days from receipt thereof,
respond to letters, telegrams, or other means of communication sent by the
public
• The reply must contain the action taken on the request.
• Submit annual performance reports
• Within 45 working days from the end of the year, render a performance report
of the agency or office, or corporation concerned.
• Process documents and papers expeditiously
• Not more than 3 signatories
• Designate signatories

DUTIES OF PUBLIC OFFICIALS AND EMPLOYEES
• Act immediately on the public’s personal transactions
• All public officials and employees must attend to anyone who wants to avail
himself of the services of the offices and must, at all times, act promptly and
expeditiously.

• Make documents accessible to the public


• At reasonable working hours.

PROHIBITED ACTS AND TRANSACTIONS
• Financial and material interest
• Prohibited outside employment and other activities
• Recommend any person to any position in a private enterprise that
has a regular or pending official transaction with their office.

• Divestment- avoid conflicts of interest at all times
