JUDICIAL AFFIDAVIT
OF NERIO L. ROSALES

I, ATTY. NERIO L ROSALES, 60 years old, widow, and a resident of Purok

5,Brgy Bonbon, Butuan City, after having been duly sworn to in accordance with law,
hereby depose and state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicial affidavits to serve as the direct examination testimony of the witness, on the
basis of which the adverse party may conduct their cross-examination on such a
witness, I hereby execute this judicial affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also
state that it was Atty. Claire P. Fuentes at her law office located at Libertad, Butuan
City who conducted the examination of the undersigned affiant;

That conformably also with section 3 (c) thereof, I hereby state under the
pain of perjury that in answering the questions asked of me, as appearing herein
below, I am fully conscious that I did so under oath, and that I may face criminal
liabilities for false testimony or perjury;

QUESTIONS AND ANSWERS

Question 1. : WHAT IS YOUR PURPOSE IN EXECUTING THIS AFFIDAVIT?

Answer : I am executing this affidavit to support the formal complaint filed by Mrs.
Merlinda Bacayo Najial, 51 years old, widower, resident of Purok-6, Brgy MJ
Santos, Butuan City the mother of the victim identified as Valemer Bacayo Najial
(deceased), 24 years old, male, single, construction worker and a resident of P-6,
MJ Santos, Butuan City against Rommel Narido Valiente, 25 years old, single,
construction worker and a resident of P-2, MJ Santos, Butuan City, for the crime
of MURDER after I saw the suspect hacking the victim that resulted to his untimely
death.

2. : WHEN AND WHERE THE INCIDENT HAPPENED?

A : On November 2, 2018 at about 12:30AM in P-5, Brgy. Bonbon, Butuan City.

3. : HOW DID IT HAPPEN?

A : On the aforesaid date, time and place of occurrence, I was inside my house
resting when suddenly I heard a commotion outside. Then and there I went
outside to check and saw the suspect hashing the victim while the victim was
lying on the ground, lifeless and covered with blood.

4. : WHAT HAPPENED NEXT?

A : The suspect only stopped from hacking the victim after I cautioned him.

5 :ARE YOU FAMILIAR WITH THE SUSPECT KNOWN AS ROMMEL NARIDO

VALIENTE AND THE VICTIM IDENTIFIED AS VALEMER BACAYO NAJIAL?

A : I don’t know their names but I they were familiar to me as construction workers
under the supervision of Mr. Semplecio Makiling, legal age, male, married,
foreman and a resident of 7th street, Guinguna Subdivision, Butuan City. They
were constructing the concrete perimeter fence of my residence and staying at
the bunk house located beside my house at P-5, Brgy Bonbon, Butuan City.

6. : WHAT HAPPENED NEXT?

A : I then instructed my secretary Ms. Rose Pauline Degamo Garcia, 57 years old,
female, widower, and a resident of R. Palma, 903, Brgy Dagohoy, Butuan City, to
call for police assistance in Butuan City Police Station 3. Immediately,
responding police officers arrived and arrested the suspect and confiscated from
his possession and control (1) one sharp bladed weapon.

7. : DO YOU HAVE ANYTHING MORE TO SAY SIR?

A : None, at the moment.
