AJ&K Muzaffarabad.

1. Honorable Supreme Court in Civil appeal no: 236 of 2021 and No: 237 of 2021 of Federal Govt.
Project Employees of population welfare department as under “It is therefore, directed that
after adverting the posts within a period of four months of the judgment of this court Shakeel
Ahmed & Other, appellants, shall also be provided an opportunity to participate in the
selection process. Till that time they will not be disturbed from service” Despite directions of
the apex court no appointment orders of the appellants have been provided to respondent no: 07
on the basis of which the salary of applicant could be released (Annexure A). After issuance of
judgment of the Honorable Supreme Court of AJ&K the petitioners submitted the writ petition
in the Honorable High Court.
2. On shifting of the project to the AJ&K Govt. from Federal Govt. the Population Welfare
Department created 752 posts against the normal budget vide notification no: SPW243-54/2017
dated: 16-10-2017 (Annexure B). No appointments of the petitioners were made on normal
budget by the competent authority till now. No appointment orders or extension orders in
contract services after completion of prescribed procedure have been provided to this office.
Without appointment orders or issuance extension in contract services the payment of salary
cannot be made under rules.
