1. THAT I am an adult male of sound mind residing and working for gain at Nairobi and therefore
competent to swear this affidavit.

2. THAT I am The signatory of the Company where I hold the position of MANAGING DIRECTOR.

3. THAT I am involved in the day to day running of the aforesaid company.

4. THAT the said BROWNBUILT ENGINEERING AND CONSTRUCTION LTD has not filed any case
against the Government of Kenya, any Company or person to date since its inception.

5. THAT the aforesaid company has also not sued the Government of Kenya, any company or
person since inception.

6. THAT the said Company has had no case(s) in any Court in the Republic of Kenya and has
never had any complaint from Kenya Police, or an authority.

7. THAT I swear this affidavit to confirm that BROWNBUILT ENGINEERING AND CONSTRUCTION
LTD has no litigation history.

8. THAT what is stated hereinabove is true to the best of my knowledge, information and belief.
