Sub: Notice Under Section 138 Negotiable Instruments Act – Reg.

Under instructions from my client Mr.Naveenkumar, aged about

27 years, son of Mr.Paulguna Rao, residing at No.3/20, Pzhanthandalam Main
Road, Thirumudivakkam, Chennai-600044, I am sending this legal notice to
you.

1. My client states that on 22.03.2023 you approached my client seeking

loan of a sum of Rs.5,00,000/- towards business development. Pursuant
to your request my client gave you a sum of Rs.5,00,000/-(Rupees Five
Lakhs only) on 22.03.2023 by way of Cash, you promised to repay the
same on demand with interest at 12% per annum and you also executed a
loan deed dated 22.03.2023 for Rs.5,00,000/-.

2. My client states that you failed to pay interest despite several demands
made by my client, you failed to repay the sum borrowed from my client.
Eventually after repeated promises of repayment you issued a
Cheque Bearing No.000001, dated 22.05.2023 towards payment of the
principal sum of Rs.5,00,000/-(Rupees Five Lakhs only) drawn on
IDFC First Bank, R.A.Puram Branch, Chennai-600028.

3. That my client deposited the said cheque in is bank Kotak Mahindra Bank
Ltd, West Tambaram, Chennai-44. But to is shock and surprise vide
memo dated 19.08.223, your cheque was returned with the endorsement
Funds Insufficient.

4. That you have issued the said cheque with full knowledge that you do not
have adequate funds in your account thereby you cheated my client. The
dishonor of the cheque issued by you for insufficient funds is a criminal
offence punishable Under Section 138 of the Negotiable Instrument Act.

Under the above circumstances, you are hereby called upon to come
forward to repay the sum of Rs.5,00,000/-(Rupees Five Lakhs only) within 15
days from the date of receipt of this notice, failing which my client will be
constrained to initiate appropriate legal proceedings Under Section 138 of
Negotiable Instruments Act, mulcting you with the costs and consequences
thereof.
