Thank for very much for your letter dated 10 November asking us whether we would participate in
tendering for the above project.
We acknowledge with thanks your notice to commence the works issued pursuant to Clause 8 of
the Conditions of Contract, requesting us to commence as soon as is reasonably possible.
We acknowledge receipt of your formal invitation to tender of 10 th June with enclosures as listed
therein.

21th October at 10 a.m. and will be accompanied by one representative from both the owner and
contractor.
This is to notify you that one of our employees was injured during his work on the construction

the relevant policy.
Following our recent discussions, it has now been decided to place with you the above contract on
the basis of your tender dated 10th Feb amended in the manner agreed during our negotiations.
Further to the discussion with Engineer on 14th April in regard of your letter dated 10th April on the
subject of XXXXXX, we are writing to clarify and confirm the followings.
We would respond to your comments as follows.

in Intake.

urgency, to receive either your instruction that this work be omitted from our contract with you or
your nomination of another firm in place of that proposed.
Under the circumstances and without prejudice to our interest entitlement at the rate specified in
the Appendix to tender, we request you to make the payment immediately. We will be compelled
to take such action as is appropriate under the contract, should the payment be further delayed.
In summary, you are required contractually to expend all necessary effort and funds to perform the
entire scope of work described in the contract at a fixed contract price.
Please make arrangement to proceed the rest of the work as soon as possible.

We would respectfully point out to you that the contract does not empower you so to instruct us
and we are not prepared to take any such steps except with express agreement of the employer to
reimburse us for the additional costs involved plus a reasonable allowance for our overheads and
profit.
We respectfully object to your reference that the data contain any element of "incorrectness" or
"untruth".
We do not understand your decision to reduce our estimate so substantially and we must record the
fact that we cannot accept that completion date you have now fixed is fair and reasonable.
We are in disagreement with you in this regard.
We are, unfortunately, not in agreement with you regarding the work scope of the contractor.
We are very concerned with your attitude in dealing with the cost impact of the change of the
method and have to remind you of your distorted understanding of the contractor's contractual
obligations.
We have now looked into this matter carefully and it is our opinion that the materials used fully
comply with the standards that are adopted for this project in accordance with specifications.
We shall not be responsible for any consequences arising therefrom.
With regret, we must ask to be excused from tendering on this occasion due to our heavy
workload.
Without admitting that this event is a force majeure one for lack of evidence, the owner gives
instructions to proceed with an inspection of the damages.
Your request for cost reimbursement is denied, as you are not entitled to any additional cost under
the contract.
Your request that "No cost impact is therefore expected" is neither reasonable nor practical.

With respect, this estimate was, in our view, a reasonable one in light of the circumstances and
particulars that we provided.
As the water supply method had to be changed for the above reason, there will certainly be cost
impact, taking into account the circumstances known already.
As this is a force majeure event and so, not within the reasonable control of the contractor, we
reserve the right to request compensation in this regard.
The contractor will proceed with the owner's instructions and suggestions, and reserves the right to
request any compensation for the cost and time impact incurred for such matter, if any.
The contractor holds that the above-captioned subject is self-evident, however, the contractor
understands the owner's request for a more logical argumentation and therefore elaborates as
follows.
The responsibility should rest mainly with the contractor.
This, instead of being normal disturbance, is very abnormal and caused serious damage to the
pipeline and, therefore, cannot be deemed to be foreseeable and within the control of the
contractor.

Will you please arrange to attend for the examination without delay or advise us should you feel
your attendance is not necessary.
Following our agreement on the time and place for the testing of … , we are now writing pursuant
