May I call on to the witness stand Ariel Duron, Your Honor.

Swear in the witness.

Do you swear to tell the truth the whole truth and nothing but the
truth in this proceeding?

WITNESS:
Yes.

MRS. LYNNA JOY ANTONINO:


The witness on stand is the first witness for the prosecution, Mr.
Ariel Duron, 55 years old, married, and a resident of Intampilan,
Panitan, Capiz.

APP JP ANTHONY D. CUÑADA:


The testimony of the witness is being offered to prove that on
December 11, 2019, at around 3:30 in the afternoon, he assisted
Jose Edwin Delfin in his house because of his wounds; he left Jose

Edwin Delfin on his fence to ask for further help; to prove as part of
res gestae what Jose Edwin Delfin told him that it was the accused
who caused the victim’s wound before he left him to ask for help; he
will identify the accused and will testify on other relevant matters.

COURT:
Part of the res gestae?

Yes, Your Honor.

Yes, Your Honor.

COURT:
Not also as a dying declaration? You know what, Prosecutor, with
all due respect to you, a particular testimony can be offered for
several purposes.

Q : Mr. Duron, where were you at around three-thirty in the afternoon of


December 11, 2019?
A : I was beside the street, Sir, watering my plants.

Q : What happened next while you were watering your plants?


A : I saw Edwin approaching me, Sir.

COURT:
Q : What is the right name of this Edwin you mentioned?
A : Jose Edwin Delfin., Your Honor.

COURT:
Okay. Continue.

APP JP ANTHONY D. CUÑADA:


Q : When you saw him approaching you, what did you do?
A : At about five meters away from me I saw him approaching me.

Q : At around five meters you mentioned, how was his condition?


A : I saw him with his jacket and he was blooded.

Q : What did you do when you saw him blooded?


A : When he came near me, he was asking for help, Sir.

Q : What did he say?


A : “So, please help me.”

Q : What was your reaction?


A : I let him sit beside my fence.

COURT:
Q : You helped him sit beside your fence?
A : Yes, Your Honor.

APP JP ANTHONY D. CUÑADA:


Q : Why did you let him sit?
A : Because I told him I would seek the help of our barangay captain
because I could not attend to him.

Q : What was his reaction when you told him that?


A : He was already weak, Sir.

Q : When you said to him you had to go to the barangay chairman


because you could not attend to him, did he say anything?
A : He did not tell me anything.

Q : When he told you nothing, what did you do next, if any?


A : I asked him who wounded him and he told me it was “Iki”, Your
Honor.

APP JP ANTHONY D. CUÑADA:


Q : And who is this “Iki”?
A : It was Rex Dasig, Sir.

Q : How do you know him?


A : Because we were neighbors, Sir.

COURT:
Q : When he said it was “Iki” who wounded him, you did not ask him
who that “Iki” was?
A : I did not ask him, Your Honor.

APP JP ANTHONY D. CUÑADA:


Q : Why did you not ask?
A : Because my only intention is to help him, Sir.

Q : How about “Iki”, do you know who this “Iki” was?


A : Yes, I know him, Sir.

Q : Is he in Court?
A : Yes, Sir.

Q : Can you point to him?


A : Yes.

INTERPRETER:
The witness is pointing to a person who when asked for his name,
he responded as Jose Rex Dasig.

Q : Were you able to go to the barangay captain?
A : Yes, Your Honor.

Q : At that time, who was the barangay captain?


A : It was Boy Daliva, Your Honor.

Q : What did you tell barangay chairman Daliva?


A : I told him that there was a wounded person near my house, Your
Honor.

Q : After talking to the barangay chairman Daliva, did you go back to


where Jose Edwin Delfin was?
A : Yes, Your Honor, because the barangay chairman told me to go
first, and then the barangay captain will follow.

COURT:

Q : When you arrived back at your house, what did you see?
A : There were already many people around, Sir.

For lack of material time as it is already eleven-thirty o’clock in the


morning and the Court still has to call other criminal cases in today’s
calendar, cross-examination of Ariel Duron, first prosecution witness, is set
on 31 January 2024 at eight-thirty o’clock in the morning. The witness is
ordered to come back on the date and at the time aforesaid for him to be
cross-examined by the defense and finish his testimony.

Public prosecutor Associate Provincial Prosecutor JP Anthony D.


Cuñada, defense counsel Atty. Ely F. Azarraga, Jr., accused Jose Rex Dasig,
private complainant Myrna Roña Delfin, and prosecution hanging witness
Ariel Duron are all notified of this Order in open court.
