WITNESS STATEMENT

Witness Statement (Brigid Ouma - Victim):

1. That on the morning of November 24th, 2023, I was driving along Langata Road at approximately 7:30
AM.

2. That I had stopped at a red light when the accident occurred.

3. That I was struck by another vehicle while stationary at the red light.

4. That the impact of the collision caused significant damage to my Mercedes Benz.

5. That as a result of the accident, I sustained injuries, including a broken nose, injured lungs, a broken
finger, and cuts on my face.

6. That I lost consciousness following the accident and regained consciousness at Jenga National
Hospital.

7. That medical professionals at Jenga National Hospital informed me of the severity of my injuries and
the near-death experience I had.

8. That I was discharged from the hospital after a month of treatment.

9. That upon discharge, I faced the challenge of dealing with the repairs of my vehicle.

10. That the mechanic at the car dealership confirmed the presence of a rear dash cam which captured
the accident.

11. That upon viewing the footage from the dash cam, it was evident that the vehicle responsible for the
accident was registered under Royal Transport Incorporation.

12. That the footage also revealed that the driver of the vehicle was using their phone at the time of the
collision.

13. That I firmly believe the driver's negligence and distraction led to the accident.

14. That I seek justice and compensation for the damages and injuries I have suffered as a result of the
careless actions of the driver.

WITNESS STATEMENT

Witness Statement (Msanii Msenda- Pedestrian):

1. That on the morning of November 24th, 2023, I was walking along Langata Road at approximately
7:30 AM.

2. That I witnessed the accident involving the victim's vehicle and another vehicle registered under Royal
Transport Incorporation.

3. That I observed the victim's vehicle stopped at a red light when it was struck by the other vehicle.

4. That the impact of the collision appeared severe, causing damage to the victim's vehicle and injuries
to the victim.

5. That I saw the driver of the other vehicle using their phone at the time of the accident.

6. That I rushed to assist the victim and called emergency services for medical assistance.

7. That I provided a statement to the police detailing what I witnessed at the scene of the accident.

8. That I observed the victim being transported to Jenga National Hospital for medical treatment.

9. That I am willing to testify in court regarding the events I witnessed on the morning of the accident.

10. That I firmly believe the driver's distracted driving contributed to the accident and the injuries
sustained by the victim.

11. That I support the victim's pursuit of justice and compensation for the harm they have suffered.

12. That I am committed to providing truthful and accurate testimony to assist in resolving this matter
fairly and justly.

Witness Statement (Elizabeth Wambui -Doctor):

1. That I am a medical professional at Jenga National Hospital.

2. That I assessed the victim following the accident on November 24th, 2023.

3. That the victim presented with injuries including a broken nose, injured lungs, a broken finger, and
cuts on their face.

4. That the injuries sustained by the victim were consistent with the mechanism of injury described in
the accident.

5. That I provided medical treatment to stabilize the victim's condition and address their injuries.

6. That the victim required hospitalization for a month to receive comprehensive medical care and
monitoring.

7. That I informed the victim of the severity of their injuries and the potential risks associated with their
condition.

8. That the victim experienced significant physical pain and discomfort as a result of their injuries.

9. That I coordinated with other medical specialists to provide the necessary interventions and therapies
for the victim's recovery.

10. That I documented the victim's medical history, treatment plan, and progress during their
hospitalization.

11. That I discharged the victim from the hospital with instructions for ongoing care and follow-up
