GUIDELINES

Instructions for Participants:

1. Participants must thoroughly understand the stages of a criminal trial under the Code
of Criminal Procedure, 1973, before addressing the proposition.
2. As the criminal trial is at the opening stage of prosecution evidence, all necessary
documents available to the defense have been provided.
3. Defense evidence is presented only after the conclusion of prosecution evidence; hence,
no defense witness/evidence is currently available.
4. Participants have the liberty to create/lead a maximum of two defense witnesses, strictly
related to the facts of Khandagiri P.S. Case no. 302/2019. Their version must not be
related to other cases filed in the factual background.
5. Created defense witness(es) must be family members of the accused, Abdullah alias
Faizal Khan, familiar with the case and matrimonial circumstances.
6. These witnesses must be used solely for negating the prosecution's version in
Khandagiri P.S. Case no. 302/2019, and it must not create inconsistent stories or
rebut the factual background.
7. The defense's case may be effectively advanced without introducing any witness, i.e.,
by focusing on exposing the prosecution witness credibility through effective cross-
examination.
8. If the defense introduces witnesses, prior information to the prosecution is
mandatory, providing details for potential use during cross-examination.
9. In case of disputes, the Organizing Committee's decision on competition rules,
including defense witness introduction, is final. Any misconduct shall lead to
disqualification.

Prosecution Witnesses

1. There are seven prosecution witnesses, including the Investigating Officer.


2. Statements of all prosecution witnesses recorded during the investigation are included
in the record.
3. The I.O.'s statement, not part of the current record, will be recorded during the trial;
participants can refer to the chargesheet for an overview of his version.

CHAPTER 1 – GENERAL RULES FOR THE COMPETITION

Team Composition

1. Each team shall consist of 3 members (2 speakers and 1 researcher). [Note: The researcher
will also be responsible for becoming a witness for their respective teams].

2. Each team will receive a TEAM CODE after the confirmation of their respective registration.

3. It is to be noted that organising committee will not provide any witness. Teams must bring
their witness on their own and prepare them accordingly. One witness cannot register with
multiple teams. The composition will be in this manner: Speaker 1, Speaker 2,
Researcher/Witness 1, and Witness 2. These 2 witnesses can be used for multiple roles.

Date and Venue

The competition is scheduled to be held at the School of Law, KIIT Deemed to be University,
9th -10th December 2023.

Dress Code

Participants are only allowed to wear Advocates attire or normal black and white formals
during the competition.

Eligibility

Students pursuing five-year courses of LL.B degree in the current academic year from the
School of Law, KIIT Deemed to be University will participate.

Language.

The said competition shall be conducted in English only.

Witnesses

The number of witnesses allowed to be examined shall be a maximum of 3 and a minimum of


2 during the rounds.

Anonymity

Counsel/participants may introduce him/herself to the court in the usual manner and may also
state their names.

Scouting

Scouting is strictly prohibited. Scouting by any of the teams will result in disqualification.

Researchers Test

The researcher in each team has to appear for the researcher test which shall be of 100 marks.
For each correct answer, 4 marks will be awarded and for each wrong answer, it will attract a
penalty of 1 mark. In case of a tie, the lower number of negative answers will be considered
to prepare the merit list.

Selection for Orals

Out of all the teams registered, 32 teams will qualify for the oral rounds based on the marks
obtained in their written brief/memorial.

CHAPTER 2 – RULES FOR ORAL ROUNDS

The competition shall comprise of two rounds: -

1. The draw of lots will be held on 8th December 2023.


2. Each team shall argue for both sides in their rounds.
3. A merit list will be prepared based on marks scored in the oral rounds and memorial
rounds.
4. Exhibits of the case are already before the Honourable Court.
5. Teams are required to examine at least a minimum number of witnesses, within the time
allotted to them.

6. Teams should, before the commencement of a round, notify the court officers, as to
which of the witnesses they would examine during the trial.

Timings For Oral Rounds: -

At the time of the draw of lots, the teams are required to go through the following procedure: -

• Serving of Copies (at the time of written submissions)


• Framing of charge by the court (at the time of orals)

And the remaining time limit will be followed as mentioned.

Total time allotted for Preliminary Round I & II, and Quarter-Final Round:

I. Opening Statement on behalf of the Prosecution- 2 minutes.

II. Opening Statement on behalf of the Defence- 2 minutes.

III. Examination-in-Chief on behalf of the Prosecution- 5 minutes.

IV. Cross Examination on behalf of the Defence- 5 minutes.

V. Examination-in-Chief on behalf of the Defence- 5 minutes.

VI. Cross-examination on behalf of the Prosecution- 5 minutes.

VII. Final Arguments on behalf of the Prosecution- 3 minutes.

VIII. Final Arguments on behalf of the Defence - 3 Minutes.

Total time allotted for Semi-Final & Final Round:

I. Opening Statement on behalf of the Prosecution- 4 minutes.

II. Opening Statement on behalf of the Defence- 4 minutes.

III. Examination-in-Chief on behalf of the Prosecution- 10 minutes.

IV. Cross Examination on behalf of the Defence- 10 minutes.

V. Examination-in-Chief on behalf of the Defence- 10 minutes.

VI. Cross-examination on behalf of the Prosecution- 10 minutes.

VII. Final Arguments on behalf of the Prosecution- 6 minutes.

VIII. Final Arguments on behalf of the Defence - 6 Minutes.

Each speaker shall have to conduct either of the two examinations and deliver either the
opening statement or the final argument in each round. Teams are not allowed to change the
combination of the team during the rounds and must follow the combination provided in their
respective registration form unless written permission for the same is taken from the organizers.

Judging Criteria:
Parameters for judgment are:

1. Knowledge of facts
2. Logic & clarity in reasoning
3. Persuasiveness and deference to court.
4. Proper, articulate, and systematic analysis of the issues arising out of facts.
5. Understanding of the laws of evidence and procedure.
6. Ability to successfully conduct chief/cross-examination within the allotted time.
7. Ability to elicit favourable facts from witnesses.
8. Ability to deal with unreceptive, argumentative, or hostile witnesses.
9. Ingenuity (ability to argue by analogy from related aspects of law)
10. Knowledge of the relevant provisions relating to penal laws.
11. Written submission

Certificates & Awards: -

Exciting cash prizes to the winners and certificates to all the participants will be awarded after
the completion of the competition.

Teams should refrain from changing the name since the names mentioned in the
Registration form shall be used on the Certificates.

Written Brief: -

All the teams whose participation has been confirmed by the organizers will have to submit
memorials/written briefs for both sides as per: -

1. Teams must prepare memorials for both the prosecution and the defense.
2. Teams shall submit the soft copy and hard copies on or before 3rd December 2023.
3. The colour code for the written brief/memorials for PROSECUTION is BLUE and for
DEFENSE is DARK RED.
4. The teams should submit the memorials as both Word file files and PDF files.

The following requirements for memorials must be strictly followed. Non-conformities will be
penalized:

• Each team must prepare memorials for both parties to the dispute (Prosecution and
Defence).
• The briefs shall be consistent with The Criminal Procedure Code, 1973. (Revised)
• Once the memorials have been submitted, no revisions, supplements, or additions will
be allowed.
• The memorials must be submitted in soft copy format and must contain: -

1. The table of contents


2. The index of authorities
3. The statement of jurisdiction
4. The statement of facts (1 page only and submissions of an argumentative
statement of facts would attract penalties)
5. The statement of charge
6. The summary of arguments
7. The arguments advanced (min. 10 pages and max. 15 pages)

8. The prayer

• Arguments must not exceed 15 (fifteen) pages. The font size should be 12, the Font
Style should be Times New Roman, and the line spacing should be 1.5. Footnotes must
be in font size 10, Font style Times New Roman, Line spacing 1.5.
• Uniform mode of citation should be followed.
• Memorials must have a one-inch margin on all sides of each page.
• Page numbering should be on the bottom right side of each page.

The cover page of Memorials must state the following:

1. The cause title.


2. Identity of brief as Prosecution or Defence.
3. Team code allotted.

However, the identity of the students shall not be revealed anywhere in the memorial. Instead,
code numbers allotted to the teams should be mentioned. Violation of this provision shall result
in penalties including disqualification. The Administrator’s decision shall be final.

The teams shall have the option to submit a separate paper book of not more than 25 pages
(printed on both sides), which shall carry all the annexure and case laws that have been referred
to in the memorial [compendium]. The paper book shall have a white cover and 2 copies shall
be submitted at the time of memorial submission. Any identifying marks/seal of the students
on the paper book shall attract severe penalties including disqualification.

The submission of this paper book does NOT necessarily entitle the team to any additional
marks.

Disclaimer: -

The Institution/ Society has full right reserved to modify or cancel any rules as it deems fit to
the situation at any time in the due course of the competition and the decision shall stand final.

It is hereby informed to all the students that participation in the Intra Mock Trial
competition is mandatory for all the students who are willing to go for a National Mock
Trial Competition henceforth.

Queries and Clarification: -

All the queries and clarification (regarding the case study) must be addressed to
klstaas@kls.ac.in and the subject of the mail should read “QUERY 5th KIMTC 2023” on or
before 25th November 2023. No queries directed to contact persons otherwise than a mail
shall be entertained whatsoever the case may be. In case of any other query regarding the
competition like submission of written brief etc. shall be made to the Contact Person indicated.
