EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

That this Deed of Extrajudicial Settlement of Estate with Waiver and

Renunciation of Rights, entered into this 15th day of March, 2024 in Calapan
City, Oriental Mindoro made and executed by and among legal and compulsory
heirs of the deceased LUCIO T. MAGANDA and MARIPOSA A. MAGANDA.
namely:

1. DIOSA A. MAGANDA, of legal age, Filipino, single, and with residence and
postal address at Acacia Street, Brgy. Bulusan, Calapan City, Oriental Mindoro;

2. MARIKIT A. MAGANDA, of legal age, Filipino, single, and with residence

and postal address at Acacia Street, Brgy. Bulusan, Calapan City, Oriental
Mindoro;

3. MAKISIG A. MAGANDA, of legal age, Filipino, single, and with residence

and postal address at Mangosteen St.,Brgy. Suqui, Calapan City, Oriental
Mindoro;

WITNESSETH, That:

WHEREAS, the herein parties are the only heirs entitled to succeed to the
estate subject of this settlement, being the legitimate children of LUCIO T.
MAGANDA and MARIPOSA A. MAGANDA who both died on June 25, 2023 in
Calapan City; copy of their respective death certificates are hereto attached as
Annex "A and Anne B”;

WHEREAS, the decedents died intestate, without any will or testament

and without any outstanding debts in favor of any person or entity;

WHEREAS, the decedents, at the time of their deaths, left no properties of

considerable value except 150sqm parcel of lands, to wit:

A certain parcel of land situated in Neo Calapan Subdivision, Calapan

City, covered and described I Original Certificate of Title (OCT)/ Transfer
Certificate of Title No. 12-3456 of the Registry of Deeds of Oriental
Mindoro , Philippines containing an area of One- hundred Fifty square
meter (150sqm.), more or less. Bounded as follows: on the East., Along
line 1-2 by Lot 2482, Cad 344-D; on the South., Along line 1-2 by Lot
2482, Cad 344-D; on the West., Along line 1-2 by Lot 2482, Cad 344-D;
and on the on the North., Along line 1-2 by Lot 2482, Cad 344-D; (A
Copy of which title is hereto attached as Annex “C”)

WHEREAS, pursuant to Section 1 of Rule 74 of the Revised Rules of Court

of the Philippines, and we being all of age and with full capacity to contract, we do
hereby adjudicate unto themselves the land described above, subject to liabilities
impose by Section 4, of the same Rule, to wit;.
 WITNESSETH FURTHER:

I. WAIVER OF RIGHTS

Pertaining to TCT No. 12-3456

WHEREAS, MAKISIG A. MAGANDA (whose personal circumstances is

stated above) has agreed and covenanted to CEDE, TRANSFER and CONVEY
unto DIOSA A. MAGANDA, of legal age, Filipino, single; and MARIKIT A.
MAGANDA, of legal age, Filipino, single, residents of Acacia Street, Brgy.
Bulusan, Calapan City, Oriental Mindoro, their heirs and assigns, the full ownership
and possession of his shares, rights and interests over that certain parcel of land
with improvement covered by the said Original/ Transfer of Certificate Title No. 12-
3456;

NOW, THEREFORE for an and in consideration of the foregoing premises, I

waived and renounced, as by these presents, I hereby WAIVE and RENOUNCE
my respective shares, rights and participation, as stated above, over the above-
mentioned one (1) parcel of real property with CTC No.12-3456 located at Neo
Calapan Subdivision, Calapan City containing an area of One- hundred Fifty
square meter (150sqm.), more or less. Bounded as follows: on the East., Along
line 1-2 by Lot 2482, Cad 344-D; on the South., Along line 1-2 by Lot 2482, Cad
344-D; on the West., Along line 1-2 by Lot 2482, Cad 344-D; and on the on the
North., Along line 1-2 by Lot 2482, Cad 344-D in favor of DIOSA A. MAGANDA
and MARIKIT A. MAGANDA.

IN WITNESSS WHEREOF, we have hereunto signed this AGREEMENT, this

15th day of March 2024 in the City of Calapan, Philippines.

witnesses and sealed with my notarial seal.
