Joint Development Agreement and GPA: The Joint Development Agreement was registered in the office of the Sub-Registrar, Ramanagaram, vide document No.RMN-1-05615/2020-21, stored in CD No, RMND852 dated 20/11/2020 and along with General Power of Attorney in vide document No RMN-4-00335/2020-21 and Stored in CD No RMND853 dated 21.11.2020, registered in office of sub registrar Ramanagaram was entered into by and between the Parties herein to respect of the property bearing Sy.No.16, measuring 04 acres 20 guntas, and property bearing Sy.No.87/2, measuring 31 guntas, in all measuring 05 Acres 11 Guntas, (out of 18 Acres-10 Guntas) for formation of Residential layout in the Schedule Property herein and hereinafter referred as Item No. 1 to 2 of the schedule property. 2. Mutual Understanding: Because of some financial and valid reasons both the parties have now decided to cancel/repudiate the Joint Development agreement and GPA. 3. Deed of Cancellation: Accordingly, the Parties upon negotiation have amicably arrived at the terms and conditions for such cancellation of Joint Development agreement and conclusive and comprehensive terms and conditions superseding all previous documents and understandings, if any, are now being recorded by this Deed. NOW IT IS HEREBY AGREED AND DECLARED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: 1. CANCELLATION OF JDA: The Joint Development Agreement vide document No.RMN-1-05615/2020-21, stored in CD No. RMND852 dated 20/11/2020 is hereby cancelled simultaneously with the execution hereof upon mutual settlement by and between the Parties. 2. AGREEMENT and the Second Party shall be at liberty to deal with the Said Property as per their discretion and will. The First Party have not created any charge and/or claim and/or assignment of right arising out of the JOINT DEVELOPMENT AGREEMENT on the Said property and undertakes to indemnify the second Party from any loss and/or damage arising out of such charge/claim/assignment on the Said Property by the First Party, if any. (ii) By Second Party: Upon execution hereof the Second party shall have no liability and/or responsibility towards the First Party, as well as no claim and/or demand from the Second Party in terms of the Joint Development Agreement.
