Heard learned counsel for petitioners and learned State Counsel on behalf
of opposite party No.1. In view of order being passed, notices to opposite
party No.2 stand dispensed with.

Petition has been filed seeking a direction to the Deputy Registrar, Firms
Societies & Chits, Lucknow to decide application dated 16th September,
2021 filed by the petitioners under Section 12-D of Societies Registration
Act, 1860 for cancellation of another society allegedly in the same name
as that of petitioner No.1.

Learned counsel for petitioner submits that despite the application being
pending since September, 2021, notices as yet have not been served upon
the respondent despite being issued a number of times.

Learned State Counsel has in terms submitted that without appropriate

service of notice upon the respondent, no hearing would be possible in the
matter.

Considering submissions advanced by learned counsel for parties and

upon perusal of material on record it appears that an application dated 16th
September, 2021 has been filed by petitioner for cancellation of
registration of another society initially by the same name. Order sheet
pertaining to the proceedings has not been brought on record by petitioner
although learned counsel for petitioner admits that notices as yet have not
been served upon the respondent.

Considering the aforesaid facts and circumstances, the opposite party No.1
i.e. Deputy Registrar, Firms, Societies and Chits, Lucknow Region,
Lucknow is directed to decide the complaint/application dated 16th
September, 2021 filed by petitioner in accordance with law and after
providing an opportunity of hearing to the opposite parties, expeditiously.

Petition stands disposed of.
