CITY ORDINANCE NO. 1046


August 2, 2023
AN ORDINANCE ESTABLISHING AND CREATING THE BACOLOD CITY PLAZA AND
PARKS SYSTEM MANAGEMENT BOARD (BCPSMB), PROVIDING FOR ITS COMPOSITION, POWERS,
FUNCTIONS, FUNDING AND FOR OTHER PURPOSES, OTHERWISE KNOWN AS THE “PLAZA AND
PARKS MANAGEMENT BOARD.

WHEREAS, Article [1 Section 16 of the Constitution provides that the State shall protect
and advance the right of the people to a balanced and healthful ecology in accord with the
rhythm and harmony of nature; and that Article XIV, Section 16, provides that “All the country’s
artistic and historic wealth constitutes the cultural treasure of the nation and shall be under the
protection of the State which may regulate its disposition.”

WHEREAS, Section 17 of the Local Government Code of 1991 states that local
government units shall exercise such other powers and discharge such other functions and
responsibilities as are necessary, appropriate or incidental to the efficient and effective
provision of the basic services and facilities, such as: public parks, freedom parks, playgrounds,
sports facilities and equipment and other similar facilities;

WHEREAS, one of the priority thrusts of the City Government of Bacolod is to attain an
improved quality of life of the people of Bacolod City, by ensuring the preservation of their arts,
culture and heritage, and protect their ecological balance, health, well-being and happiness;
and towards this end, it is the City governments commitment to establish and maintain, public
parks, plazas, monuments and memorials, promenades, center islands, heritage sites,
protected areas, conservation areas, and similarly situated public properties, assets, and sites;

WHEREAS, City Ordinance No. 08-14-693, Series of 2014, otherwise known as the
PUBLIC PLAZA AND PARKS REGULATING ORDINANCE OF BACOLOD CITY, does not
provide for a structure that shall be responsible for formulating policies, programs and plans,
and courses of action for the development, improvement and standard and singular
maintenance of all public parks, plazas, monuments and memorials, promenades, center
islands, heritage sites, protected areas, conservation areas, and similarly situated public
properties, assets, and sites, within the City of Bacolod, existing now or which may be identified
or created by law in the future;

WHEREAS, there is a need to constitute and create the above stated management
structure to ensure the continuous effective and efficient management of the City’s parks,
plazas, monuments and other similarly situated structures and systems of the City.

NOW THEREFORE, BE IT ORDAINED:

Section. ORDINANCE ESTABLISHING AND CREATING THE BACOLOD CITY


1. “AN

Section 2. COVERAGE. This Ordinance shall cover public parks, plazas, monuments
and memorials, promenades, center islands, heritage sites, protected areas, conservation
areas, and similarly situated public properties, assets, and sites, now existing, or may thereafter
be created by law or ordinance;

Section 3. POWERS AND FUNCTIONS. The BCPSMB shall have the following duties
and responsibilities:

Formulate plans and programs consistent with of Article 11 Section 16 of the


Constitution provides that the State shall protect and advance the right of the people to a
balanced and healthful ecology in accord with the rhythm and harmony of nature, and Section
17 of the Local Government Code of 1991 which provides that local government units shall
provide for efficient and effective provision of the basic services and facilities, such as: public
parks, freedom parks, playgrounds, sports facilities and equipment and other similar facilities,
subject to the approval of the Sangguniang Panlungsod;
3.1 Ensure the implementation of all the provisions of City Ordinance No. 08-14-693,
Series of 2014, otherwise known as the PUBLIC PLAZA AND PARKS
REGULATING ORDINANCE OF BACOLOD CITY and its Implementing Rules and
Regulations;

3.2 Adopt guidelines for the use of parks and plazas for special occasions, in
accordance with Bacolod City Ordinances, rules and regulations;

3.3 Devise policies and procedures for the unitary parameter of all public parks, green
spaces, and green strips in Bacolod City, providing for their proper preservation and
regulation for the furtherance of the ecological balance of the community;

3.4 Propose guidelines, ways and ‘means to ensure the best and most desirable
facilities that shall be placed in the City parks, plaza and related structures;

3.5 Approve the architectural design and structural models of public parks, plazas,
green spaces, and green strips prepared by the Parks and Playground Division of
the City Environment and Natural Resources Office (CENRO), the City Planning
and Development Office, the City Engineer's Office and/or the City Architect, if any,
or any equivalent City offices or departments.;

3.6 Identify and map out street islands and existing parks that are open for possible
adoption;

3.7 Conduct a continuing information and education campaign to generate public


awareness and participation on the importance of establishing and sustainably
managing public parks, plazas and open spaces, and for the promotion of tourism,
trade and commerce; and

3.8 Generate resources and support for the establishment and maintenance of City
Parks, Plazas and related structures, subject to Bacolod City Ordinances, rules and
regulations.

Section 4. COMPOSITION. The membership of the BCPSMB is hereby reconstituted


as follows:

Co-Chairperson City Administrator

Vice-Chairpersons : SP Committee Chair on History, Culture and Arts


SP Committee Chair on Tourism
SP Committee Chair on Trade and Commerce

Members : City General Services Office


City Department of Public Services
City Planning and Development Office
City Engineer’s Office
Environment and Natural Resources Office
Public Order and Safety Office
Civil Society Organization (to be appointed by the
CityMayor)

For this purpose, the aforementioned Offices shall name a permanent representative.

Section 5. TERM OF OFFICE. The members of the Board shall have a term of three (3)
years, unless sooner removed and replaced.
Section 6. SECRETARIAT. The City General Services Office shall serve as the
secretariat of the BCPSMB. It is tasked to handle all administrative and/or secretariat-related
activities and oversee the general operations of the City plaza, parks and related structures.

Section 7. FUNDING AND OPERATING COST. To ensure the effectiveness of the


implementation of the Parks Ordinance, any budgetary requirements needed for the operation
and implementation of this Ordinance shall be taken from any available funds in the Office of
the Mayor, or in the Annual Budget subject to budget proposal of the Management Board and
recommendation of the Office of the Mayor, and approval of the Sangguniang Panlungsod.

Section 8. SEPARABILITY CLAUSE. If any provision of this Ordinance is declared


invalid or unconstitutional, the other provisions not affected thereby shall remain valid and
subsisting.

Section 9. REPEALING CLAUSE. All other Ordinances, Orders or parts thereof which
are inconsistent with the provisions of this Ordinance are hereby repealed or modified
accordingly.

Section "10. EFFECTIVITY. This Ordinance shall take effect immediately upon its
approval.
