of AURELIA E. BADWICK

I, AURELIA E. BADWICK, of legal age, Filipino, married, and a


resident of Brgy. Santa Parang, Tuguegarao City, Cagayan after having
been duly sworn to in accordance with law, hereby deposes and states.

PREFATORY STATEMENT

That the taking of my Judicial Affidavit was administered and


supervised by ATTY. DENIELLE U. BOSITO and was done at her Law
Office in San Gabriel, Tuguegarao City, Cagayan and I am fully aware
and cognizant of the questions asked of me by Atty. Bosito and my
answers thereto are under oath being aware that I may face criminal
liability for false testimony or perjury. I likewise requested that the
questions asked of me be in English as well as my answers thereto also
in English which I speak and understand for clarity and that the other
information and/or requirements of Sec. 3, A.M. 12-8-8- SC as
explained to me by the administering lawyer are contained in my
Judicial Affidavit.

PURPOSE:
This affidavit of the accused, Aurelia E. Badwick is being offered to
prove the existence of doubt on the charged of attempted homicide
against the accused and to prove the justifying circumstance of self-
defense.

Question 1: Please state your name and other personal circumstances


for the records.

Answer 1: I am Aurelia Badwick, 60 years of age, married, and


resides at Brgy. Santa Parang, Tuguegarao City, Cagayan.

Question 2: Are you the same Aurelia Badwick, who is charge of this
case?

Answer 2: Yes, ma’am.

Question 3: Where were you last February 23, 2024 at about 11 o’clock in
the evening?

Answer 3: I was in a restaurant near my house at Brgy. Santa Parang.

Question 4: What happened there, if any?

Answer 4: I was having a drinking spree with my neighbors when


Hermie Ferris arrived there, making a very loud and irritating noise
with his motorcycle’s exhaust pipe.

Question 5: What did you do if any?


Answer 5: I confronted her saying “Ang yabang yabang mo naman!
Ang ingay ng motor mo, baka pwedeng makiramdam ka!”

Question 6: What did she say after, if any?

Answer 6: She told me “Eh ano naman ngayon? Sayo ba tong


restaurant? Huwag mo akong pakialaman”. She then continued
making noise with her motorcycle.

Question 7: What did you do after, if any?

Answer 7: I told her that I am a resident at the Barangay and told her
that her act of making loud noise is a disturbance to the
neighborhood considering that it was already 11 o’clock in the evening.

Question 8: What happened next, if any?

Answer 8: She just slapped me in the face, pulled out a knife from her
bag, and fired it up in the air.

Question 9: What transpired next, if any?

Answer 9: Two barangay tanods came and asked what was happening.
However, without provocation on my part, Hermie
suddenly grabbed a kitchen fork and stabbed me in my
right arm. So, as an act of self-defense, I took the gun on
the table and fired the same at her direction.

COMPLAINT-AFFIDAVIT

I, Baby Jane William, of legal age, married and a resident


of 868 San Gabriel, Tuguegarao City, Cagayan after being
sworn in accordance with law depose and say that:

1. That the respondent Johnson De Pravia and I met


sometime in January 2011 while being schoolmates at
University of Cagayan Valley at Tuguegarao and became
sweethearts after a short courtship;

2. As we were both too much in love, we hastily


got married on December 26, 2018 in a civil wedding ceremony
solemnized by the Mayor of the City of Tuguegarao. Copy of
the Certificate of Marriage dated December 26, 2018 issued by
the NSO is hereto attached as Annex ‘A”;

3. After our wedding, we lived together as husband and


wife in our conjugal dwelling in Leonarda, Tuguegarao City;
4. Several months into our marriage, respondent
began to exhibit his irresponsibility and no caring attitude. He
would leave the house and would come back only after several
days. Such behaviour on the part of respondent resulted in our
quarrels and verbal altercations;

5. Sometime in June 2020, we had a violent quarrel


brought about by his rude behavior and his expression of
animosity toward my parents. He did not approve of their
frequent visits in our house;

6. After our quarrel, he left our conjugal dwelling and


this was the last time I ever saw him. Since then, I had not
seen, communicated nor heard anything from him or about
his whereabouts. So I returned to my parents' abode at
Gonzaga, Cagayan and stayed there for about two months;

7. To cope with the sudden turn of events in my life, I


went abroad to Canada, on September 30, 2021 to unwind and
for employment purposes as well, and came home after
almost two years.

8. Sometime in August 2023, a relative who works in


the City of Tguegarao informed me that my husband,
respondent Johnson De Pravia has gotten married to another
woman, a certain Anisse Demonic, in a religious ceremony
solemnized by Fr. Ramoncillo Makadiyos at the Church in the
City of Tuguegarao, on August 17, 2023. A copy of their
Certificate of Marriage is hereto attached as Annex “B”;

9. My marriage with respondent Johnson De Pravia is


still subsisting and has not been annulled or dissolved. His act
of contracting a second marriage to Anisse Demonic despite
the subsistence of our marriage constitutes the crime of
bigamy punishable under Article 349 of the Revised Penal
Code.

I executed the foregoing Complaint-Affidavit to attest to


the truth of the facts stated and for the
purpose of charging

INFORMATION

The undersigned, City Prosecutor, upon a sworn complaint


originally filed by the offended spouse, BABY JANE WILLIAM
accuses JOHNSON DE PRAVIA of the crime of BIGAMY,
committed as follows:

That on or about December 26, 2018 in the City of


Tuguegarao, Philippines, and within the jurisdiction of this
court, the above-named accused, JOHNSON DE PRAVIA, being
then previously united in a lawful marriage with BABY JANE
WILLIAM and without such marriage having been legally
dissolved or annulled, did then and there willfully, unlawfully
and feloniously contract a second marriage with ANISSE
DEMONIC.

CONTRARY TO LAW.
