AFFIDAVIT OF WITNESS

I, Priscilla C. Cuevas, of Legal age, married, and a resident of Vicenza 3

Block 1 Lot 1 Citta Italia Subdivision, Mambog 3, Bacoor, Cavite, Philippines,
after having been sworn in accordance with law, do hereby depose and state
THAT:
1.I was present and personally saw that accused, Melanie Avergonzado,
committed the crime of Libel on July 1, 2023, at 6:49 in the evening against the
victim MR. Gilbert Go and Mrs. Maria Consuelo Villamor
2. I was one of those who took the video recording of the libelous statement
made by the Respondent from my house which is so proximate to the venue of the
said General Assembly.
 3. I am the out-going Treasurer who requested for an Audit before the
turnover of financial documents.
4. I personally had personal knowledge of the said previous unreconcilable
accounts imputed by Melanie Avergonzado as missing money allegedly taken by
Mr. Gilbert Go and Maria Consuelo Villamor. She concealed in her public
imputation to the complainant that even the fact that those unreconcilable account
brought about by the missing receipt in the office was already long ago settled by
the complainant in full payment up to single centavo that was accounted for. In our
presence including Melanie Avergonzado herself and me. It was handed to us in
our presence. She even insisted to let Mr. Gilbert Go only will pay all those
accounts, but I refused to agree to her.
5. I issued the Clearance to the Complainant that they are free from all
Encumbrances from the Office upon financial accounts was settled.
6. I attest that Melanie Avergonzado despite the complainants payment to
settle the accounts was trying to convince me to join her in exposing the allegedly
missing money taken by the complainant to the Homeowners Association but we
extremely made our oppositely opinion telling her that those issues were already
settled and telling her what is the point of trying to destroy the complainants
reputation in the public since those issue were settle I kept repeating to her. And
then she will drop our conversation and leave.

7. I attest that I was informed by our neighbor in whose identity refuse to be

known told me that the
Respondent, Melanie A. Avergonzado conducted a meeting in Phase 15 (Vicenza 5
of the same Homeowners Association) informing the public that the money in the
association had run out because the complainants Mr. Gilbert Go and Mrs. Maria
Consuelo Villamor stole the money. And one of the homeowner stood up and
answer him why you keep telling the public that said they took the money from the
association why not file a case against them if you have evidence to prove your
claim. I was informed that the respondent did not answer.

I executed this affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal against Melanie Avergonzado for the violation of
Article 353, in relation to Article 355 of the Revised Penal Code of the Philippines
and for Civil charges which may apply to this Case.
