RA 9175 (CHAINSAW ACT OF 2002)

(a) Chain saw- portable power saw used in felling trees


(b) Chain saw dealer- engaged in distribution of chain saws
4. Chainsaws are sold to duly authorized persons by the DENR
5. Qualifications of applicants to possess chain saws
(a) has a timber license agreement, production sharing agreement, or a private land timber permit
(b) an orchard or fruit tree farmer
(c) an industrial tree farmer
(d) licensed wood processor
Registration
6. permits are valid for 2 yrs.
Permits for non-commercial orchard farmers are valid for 5 yrs.
Penal Provisions
a. Selling, etc. without a proper permit
Imprisonment of 4 yrs. 2 mon. 1 day to 6 yrs. or a fine of 15,000 to 30,000 or both. Chainsaw is
confiscated
b. Unlawful importation or manufacturing
Imprisonment of 1 to 6 months AND a fine of 1,000 to 4,000
c. Tampering of engine serial number
Imprisonment of 1 to 6 months AND a fine of 1,000 to 4,000
d. Actual unlawful use of a chainsaw
Imprisonment of 6 yrs. and 1 day to 8 yrs. or a fine of 30,000 to 50,000 or both. Chainsaw is
confiscated
Confiscated chainsaws are auctioned.
8. Reward to persons giving voluntary information is 20% of the value of the chainsaw units.
10. The Secretary may revoke the Certification and permit previously issued to a person found violating.
