I, Mrs Mukti Biswas, aged 68 years, W/O-Debabrata

Manadal, At/Po,Ramchak, P.S-Khairi, Dist- East Medinipur.
Last marital residing place – Qtr. No.- type 2/2, kendriya
Vidyalaya Staff quarter, Satya Nagar, B.B.S.R, At present
Rashmi Enclave, Plot no. 66/146 Subudhi pur, P.S-
Tamando, B.B.S.R, PIN-751028, Dist - Khordha, do hereby
solemnly affirm and state as follows:

1. That I am the petitioner in this case & the respondent is

my husband.

2. That our marriage was an arranged marriage held on dt.

09.05.1987 at 20 central road anandapury, Barrackpur
west Bengal as per Hindu rights & and customs in
presence of the well - wishers, relatives and family of the
respected parties. I & the respondent being acknowledged
by the marriage officer west Bengal issued marriage
certificate no. 165 on dt 12.06.1987.
3. That while the marriage performed I was working as
musical teacher in Kendriya Vidyalaya, Khordha in state of
Odisha & the respondent working as an employee in
ministry of agriculuture department under central Govt. of
India posted at Bhubaneswar.

4. That I & respondent are belonging to Bengali community.

5. That soon after solemnization of marriage, I and

respondent resided together as husband and wife at first
Khorda in a rented house taken by me at my service place.
Thereafter, due to my transfer from khordha to Kendriya
Vidyalaya-1 at Satya Nagar Bhubaneswar, I got allotted
official type 2 quarter bearing no.2/2 where I and
respondent resided together as husband and wife. I gave
birth a male child namely Sanit who is now 33 years old &
married and they are residing with me at my present
residence.

6. That in the year 2002, the respondent has transferred to

the west Bengal. From 2002 to 2007, the respondent was
coming to Bhubaneswar and keeping his marital relation
with me but since year 2007 I & respondent have been
separated from each other & no marital relation till today.
In the year of 2007 I and respondent finally separated at
the official residential quarter bearing no.2/2 satya nagar
Bhubaneswar which was the last residing place.

7. That the respondent being an employee in ministry of

agriculture department under central Govt. of India has
not given a single pie to me from the date of marriage,
rather extracted money from me by demanding being his
wife I should give all of my money and income to him
although he is getting more salary than me.

8. That apart from the salary of income, the respondent has a

lot of residential and commercial properties at west Bengal
whose income is more than three lakhs per month. The
respondent is spending all of his money for his brother
and sister but not spending any money for me and my son
& the respondent was always torturing me mentally by
 showing his cruel behavior, I am looking ugly and I am
older in age than him.

9. That while the respondent transferred from Bhubaneswar

to west Bengal, he regularly keeping his extra marital
relation with other ladies by showing their photos to me.
He was also demanding divorce from me for his
remarriage. The well-wishers had attempted several times
to settle the disputes between us and for our re-union but
it was in vain.

10. That even if after our separation since the year of 2007
we have no conjugal relation but the respondent harassed
me by giving mentally torture with utmost cruel behavior
through several communications.

11. That I being a retired woman and my son who has not
any job maintaining my-self and my family with all
hardship from my little pension income whereas the
respondent’s present income is more than three lakh per
month from his all sources of income i.e from income of
house property, agriculture property and pension income.
Considering the present income of respondent his family
should have maintained by equal but the respondent
always neglected me and my son.

12. That after my retirement having no house to take

shelter I have purchased a 2 BHK residential flat in
Rashmi Enclave of plot no. 66/146 Subudhipur apart from
that I purchased a small plot at Rajarhatta, Koikhali. Due
to my old age I bequeath a will in favour of my son
apprehending danger from respondent.

13. That on 20.09.2018, 13.11.2018 & 1.12.2018, the

respondent through his advocate issued several pleader
notices threatening to me. I also gave reply to said letters
of respondent through my advocate. After that respondent
filed O.A no. 1731/2022 in Central Administration
Tribunal against me.
14. That the facts stated above are true to best of my
knowledge & on record.
