Abstract:
The right of the state to act on behalf of society is considered one of the exclusive rights that it possesses,
granting it the authority to impose punishment and ensure general deterrence. However, alongside this,
alternative mechanisms to punishment have emerged since the establishment of ancient societies. These
mechanisms include reconciliation and attempts to amicably compensate the victim, aligning with Islamic
references and the general international trend that calls for developing the criminal justice system by providing
procedural alternatives that limit punishment and contribute to achieving effective prompt justice, and thus the
speedy settlement of the case is achieved.

Based on this premise, the Moroccan legislator introduced the mechanism of reconciliation in the Code of
Criminal Procedure to settle disputes that fuel animosity between parties and alleviate the burden on the
judiciary, which sometimes finds itself compelled to rule on simple cases, many of which also end in
reconciliation.
Thus, the Moroccan legislator has assigned a new role to the Public Prosecution, similar to the rest of the
contemporary legal systems, with the aim of implementing the reconciliation mechanism between the litigants
and reducing the material and human capabilities for the courts, similar to what some international criminal
legislation has gone through.
It is worth mentioning that the injunctive reconciliation, fulfilling the conditions and obligations, results in
significant consequences both at the level of public lawsuit and civil lawsuit.
