AFFIDAVIT OF DESISTANCE

I, EVANGELINE PROTASIO, of legal age, Filipino, Married and a resident of

Blk 53, Lot 13, Pantom,ina Mayor St., Lagro, Quezon City, after having been
duly sworn hereby depose and say, THAT:

1. I am the complainant against WILLIAM GENATO, JR. under Criminal Case

No. 113272 for OTHER LIGHT THREATS pending before the Metropolitan
Trial Court, Branch 71, Pasig City;

2. After carefully and meticulously re-examining the facts and circumstances, I

arrived at a definite conclusion that there was purely misapprehension of facts
with regard to the identity of the accused WILLIAM GENATO, JR.. Hence, I am
no longer interested to prosecute the case against WILLIAM GENATO, JR.

3. I am executing this Affidavit of Desistance out of my own free will and act
and that no person forced, coerced or intimidated me to execute the same.

4. I am fully informed in a language known to me of the consequences of

executing this Affidavit of Desistance, and that I can no longer file any case
against WILLIAM GENATO, Jr.,

5. I am executing this Affidavit to request the Prosecutor’s Office thru

Prosecuting Fiscal for the Dismissal of the case against WILLIAM GENATO JR.
