LEGAL ASPECT IN THE TOURISM AND HOSPITALITY

1. What is Sexual Harassment Act of 1995?

 An Act Declaring Sexual Harassment Unlawful in the


Employment, Education or Training Environment and for other
purposes.

2. Can a man who has been asked for a sexual favor by his
female boss in exchange of promotion seek the
protection of RA 7877?

 Yes, Because under Section 3 of RA Act No. 7877 (the Anti-


Sexual Harassment Act), sexual harassment is committed by an
employer, employee, manager, supervisor, agent of the employer,
teacher, instructor, professor, coach, trainor,or any other person
who, having authority, influence or moral ascendancy over
another in a work or training or education environment. They
demand, request or otherwise require a sexual favor from
another regardless of whether it is accepted.

3. What is the intention of the law in making the employer


solidary liable for the act done by its employees?

 According to RA Act No. 7877 Section 4 (Duty of the Employer or


Head of Office in a Work-related, Education or Training
Environment), it shall be the duty of the employer or the head of
the work-related, educational or training environment or
institution, to prevent or deter the commission of acts of sexual
harassment and to provide the procedures for the resolution,
settlement or prosecution of acts of sexual harassment
