Vessel A is proceeding through a fairway, which for this vessel is not a narrow
channel. The oncoming vessel B however exhibits a cylinder. There is a risk of
collision.
Rule 13 – Overtaking
Rule 13 (a) – Notwithstanding anything contained in the Rules of Part B, sections I and II any
vessel overtaking any other shall keep out of the way of the vessel overtaken
Rule 17 (a) ii – states that the stand-on vessel “ may however take action to avoid collision by
her manoeuvre alone, as soon as it becomes apparent to her that the vessel required to keep
out of the way is not taking appropriate action in compliance with these Rules”
(2) a. The understanding of the word “may” is that it actually means “must”.
On which rule is this understanding based.
Explain this briefly.
A power-driven vessel which takes action in a crossing situation in accordance with Rule 17
(a) ii, shall not alter course to port for a vessel on her own port side.

According to Rule 18 (c) a vessel engaged in fishing when under way shall, so far as possible
keep out of the way of a vessel not under command and a vessel restricted in her ability to
manoeuvre.
