A RESOLUTION ADOPTING THE INTERNAL RULES OF PROCEDURE OF


THE DAVAO CITY YOUTH DEVELOPMENT COUNCIL (DCYDC)

WHEREAS, cognizant of the vital role of the youth in nation-building, Republic Act
No. 10742, otherwise known as the “SK Reform Act of 2015”, was signed into law
primarily to promote and protect the moral, spiritual and social well-being of the
youth and instill among them a sense of patriotism, nationalism and other
desirable values indispensable to nation-building.

WHEREAS, the SK Reform Act of 2015 encourages the involvement of the youth
in public and civic affairs through the establishment of effective, responsive and
enabling mechanisms in forging youth participation in local governance;

WHEREAS, the SK Reform Act of 2015 ensures wide and multi-sectoral youth
participation in local governance and there shall be in every province, city and
municipality a Local Youth Development Council (LYDC) which shall be called,
“Provincial Youth Development Council, City Youth Development Council and
Municipal Youth Development Council”, respectively.

WHEREAS, the Department of Interior and Local Government (DILG)


Memorandum Circular 2017-136 dated February 24, 2017, mandates the creation
of the Local Youth Development Office and the organization of a Local Youth
Development Council (LYDC) in every province, city, and municipality to ensure
wide and multi-sectoral youth participation in local governance.

WHEREAS, the Department of Interior and Local Government (DILG)


Memorandum Circular 2018-124 dated August 8, 2018, sets the roles, duties and
functions of the DILG Officers and Local Officials in the implementation of the
National Youth Commission’s Policy Guidelines on the Registration of Youth
Organizations and Youth-serving Organizations, the convening and election of
members of the Local Youth Development Council.

WHEREAS, The LYDC shall assist the planning and execution of projects and
programs of the Sangguniang Kabataan, and the “Pederasyons” in all levels.

WHEREAS, Executive Order No. 16 series of 2021 mandates the creation of the
Local Youth Development Council (LYDC), Interim Local Youth Development Office
(LYDO) of the City Government of Davao, defining its functions and purposes.

NOW THEREFORE, for and in consideration of the foregoing premises,


RESOLVED, AS IT IS HEREBY RESOLVED, by the Davao City Youth
Development Council, by virtue of the powers vested in it by law, in session
assembled, to enact and promulgate its Internal Rules of Procedure, viz:

IT IS HEREBY RESOLVED, to adopt Resolution No. 01 - 2024 titled “A


RESOLUTION ADOPTING THE INTERNAL RULES OF PROCEDURE OF
DAVAO CITY YOUTH DEVELOPMENT COUNCIL (DCYDC)”

RESOLVED FURTHER, to furnish a copy of this resolution to the office of the City
Mayor, City Legal Officer, DCYDO and to all concerned Offices for their information.

HEREBY CERTIFYING on the correctness of the foregoing resolution that has been
duly adopted by the DAVAO CITY YOUTH DEVELOPMENT COUNCIL conducted on
its 1st Quarter DCYDC Meeting, on March 21, 2024.

RULE I.
INTRODUCTORY PROVISIONS

SECTION 1. TITLE AND SCOPE. - The following Rules are hereby adopted to be
known as the “Internal Rules and Procedure on the Davao City Youth Development
Council”, to govern the council; the election and appointment of its council
members; creation of committees; the order of business for each session; the
deliberative process; and parliamentary procedures which include the conduct of
sessions, discipline of its Council Members for disorderly behavior, and absences
without justifiable cause and among others.

SECTION 2. PURPOSES. - These Rules shall be enforced, applied and construed


to advance the following purposes:

a. to ensure wide and multi-sectoral youth participation in local governance in


the City of Davao;
b. to formalize, clarify and organize the structure, composition, powers, duties,
functions and responsibilities of the council as an institution, and the
members as its essential components;
c. to foster a sense of accountability and responsibility among council
members, and to ensure honesty and transparency in all council
proceedings and activities;
d. to ensure that all businesses transacted by the council as a body are duly
recorded and printed to form part of its references and guidance for action;
and;
e. to assist the planning and execution of projects, programs, and activities of
the Sangguniang Kabataan Pederasyon Dabaw, the Davao City Youth
Development Office, and other offices of the city government.

SECTION 3. INTERPRETATION. - Unless the context of these Rules otherwise


indicates, words in the singular include the plural, and words in the plural include
the singular “council” shall refer to elected and appointed council members, unless
specifically indicated hereunder. Words are to be interpreted in their ordinary
meaning unless a more technical definition is specifically provided under a
particular provision. In case of doubt, it shall be resolved consistent with the
interpretation that is beneficial to the welfare of the youth.

RULE II.
THE DAVAO CITY YOUTH DEVELOPMENT COUNCIL

SECTION 1. OFFICIAL DESIGNATION, COMPOSITION, AND


MEMBERSHIP. The official designation of this organization shall be “Davao City
Youth Development Council”, and may be also addressed as “DCYDC”, for brevity.
The council shall be composed of at least five (5) but not more than twenty-one
(21) members including the two (2) core members from the SK. The two (2) core
members of SK shall be the President and Vice President of SK Pederasyon and
shall be supported by at least eight (8) but not more than nineteen (19) other
representatives of duly elected Youth Organization (YO) and Youth-Serving
Organizations (YSO).

These YOs and YSOs are duly recognized by the Davao City Youth Development
Office (DCYDO) and registered to the Youth Organization Registration Program
(YORP) of the National Youth Commission (NYC). These organizations shall
designate their official representative in writing and the same shall be submitted
to the Davao City Youth Development Office (DCYDO) at least one (1) week
before the election of members of the council.

Once elected, each organization may also designate an official alternate


representative from the same organization through an endorsement which shall
also be submitted one week before the first regular quarterly meeting.

SECTION 2. POWERS, DUTIES, AND RESPONSIBILITIES OF THE


COUNCIL.
The Council shall have the following powers, duties and responsibilities:

a. To serve as the core advocacy on youth participation in nation-building,


sustainable youth development and empowerment, equitable and accessible
quality education, agriculture and environmental protection, climate change
adaptation, disaster risk reduction and resilience, youth employment and
livelihood, capability building, sports development, good health and well-
being;
b. To review and finalize the Davao City Youth Development Plan (DCYDP)
that will be initially drafted with the SK Pederasyon Dabaw;
c. To approve the three (3) year DCYDP that is anchored in the Philippine
Youth Development Plan (PYDP) and the development plans of the local
government unit;
d. To endorse the reviewed and approved DCYDP to the DCYDO for the
endorsement and approval of the Local Chief Executive.
e. To monitor, evaluate, and ensure the implementation of the DCYDP and the
alignment of the Comprehensive Barangay Youth Development Program
(BDYDP) and Annual Barangay Youth Investment Program (ABYIP) to the
DCYDP.
f. To formulate policies and component programs in coordination with the
various government agencies involved in youth-related programs, projects,
and activities;
g. To assist the DCYDO in monitoring the Sangguniang Kabataan officials in
the entire city; and
h. To perform such other functions as may be prescribed by law or ordinance.

SECTION 3. RIGHTS, PRIVILEGES, AND DUTIES OF THE COUNCIL


MEMBERS. - The members of the Council who are in good standing shall have
the following rights and privileges:

a. The right to attend in all Council meetings;


b. The right to participate in all other Council activities;
c. The right to avail the services, programs, and projects of the Council;
d. The right to observe in the sessions of the Sangguniang Panlungsod of
Davao City;
e. The right to vote for elective positions, and if qualified, the right to be voted
upon;
f. The right to use the facilities of the SK and the DCYDO consistent with the
goals and objectives of the council and the DCYDO; and
g. The right to avail such other rights and privileges as may hereafter be
determined by law, ordinance or subsequent Council Resolutions.

All members of the Council shall perform the following duties:

a. Regularly attend DCYDC meetings;


b. Actively participate in all the activities of the DCYDC and other youth-
related activities of SK and other agencies;
c. Disseminate by word and by deed to the public, the principles, objectives
and programs of the DCYDC;
d. Conduct oneself in a decent and respectable manner, befitting a member of
the Council; and
e. Such duties as may hereunder be prescribed, or hereafter ordered through
the adoption of Resolutions.

SECTION 4. RIGHTS, PRIVILEGES, AND DUTIES OF THE OFFICIAL


ALTERNATE REPRESENTATIVE. – In the absence of the official council
member, the official alternate representative who is in good standing shall have
the following rights and privileges:

a. The right to attend for a maximum of two (2) council meetings;


b. The right to participate in all other Council activities;
c. The right to avail the services, programs, and projects of the Council; and
d. Discharge the functions of the Official Council Member of the same
organization in case the latter ceases to hold office by death, resignation,
physical incapacity, suspension, or removal from office.

RULE III.
OFFICERS OF THE COUNCIL

SECTION 1. THE CHAIRPERSON; POWERS, DUTIES AND FUNCTIONS.

The Chairperson shall:

a. issue calls for the meetings of the Council;


b. preside over all meetings of the Council;
c. preserve order and decorum during the meetings;
d. enforce orders, resolutions, and decisions of the Council;
e. sign interlocutory resolutions, orders or rulings;
f. take such other measures as s/he may deem proper upon consultation with
the other members of the Council; and
g. exercise such other powers as are vested upon him/her by law or by specific
provisions of these Rules.

SECTION 2. THE VICE CHAIRPERSON; POWERS, DUTIES AND


FUNCTIONS.

The Vice Chairperson shall:

a. Discharge the functions of the Chairperson in case the latter ceases to hold
office by death, resignation, physical incapacity, suspension, or removal
from office;
b. Assist the Chairperson in the implementation of programs, projects, and
activities of the council; and
c. Perform such other functions and duties as may be assigned to him/her by
the Chairperson or by the majority of the members of the council, or by
express provision of law or legal orders of the duly constituted authorities.

RULE IV.
ROLES OF THE DAVAO CITY YOUTH DEVELOPMENT OFFICE

SECTION 1. SECRETARIAT; POWERS, DUTIES AND FUNCTIONS. The


Davao City Youth Development Officer (DCYDO) shall serve as the Secretariat of
the council and he/she shall:

a. Attend all the meetings of the council;


b. Certify officers and members of the Council;
c. Record the minutes of the Council meetings;
d. Keep all administrative records and official documents of the Council, as well
as, the updated record or profile of all the Council officers and members,
copy furnished the DILG and NYC, containing the following information,
among others:

I. Complete name;
II. Address;
III. Place and date of birth;
IV. Gender;
V. Civil Status;
VI. Citizenship;
VII. Educational Background;
VIII. Occupation;
IX. Proof of Residence in the city
X. Photocopy of PSA Birth Certificate
XI. Other information as may be prescribed by law or by the duly
constituted authorities.

e. Conduct mandatory and continuing training of the SK and DCYDC.


f. Assist members of the youth desiring to organize themselves as youth
organizations, and issue certificates of recognition for such purpose;
g. Send notice of regular and special meetings through email and social media
platforms of the Council members;
h. Provide a copy of all the official communications and announcements to the
organization's email address.
i. Provide technical, logistical and other related support to the DCYDC and SK;
j. Assists the DCYDC in the Monitoring and Evaluation of the SK.
k. Assists in the development, implementation and monitoring of DCYDC
Internship and Volunteer Program.
l. Perform such other functions and duties as may be assigned to him/her by
the Chairperson or by express provision of law or legal orders of the duly
constituted authorities.

RULE V.
MEETINGS OF THE COUNCIL

SECTION 1. DATE, TIME AND VENUE OF REGULAR MEETINGS.

a. Regular Meeting - the DCYDC shall schedule a regular meeting every third
Thursday of the last month per quarter at one (1) in the afternoon; In case
the date of the regular meeting falls on a holiday, it shall be held on any
day of the following week. A regular meeting may be held on another date
or place upon concurrence or approval of the majority of all the council
members.
b. Special Meeting - when the public interest so demands, special meeting may
be called by the Presiding Officer or by the majority of all the Council
members and/or as often as needed given that it should be announced one
(1) week before the scheduled day;
c. Emergency Meeting - the DCYDC may schedule an emergency meeting if
there are serious matters, violations, grounds, and problems that need to be
addressed immediately; given that it should be announced at least one (1)
working day before the scheduled day;
d. The meetings shall be held at the Sangguniang Kabataan Pederasyon
Dabaw Office located at the Davao City Recreation Center, Almendras Gym,
Quimpo Boulevard, Davao City or any identified location approved by the
Council Members.

SECTION 2. MINUTES. The Council Secretariat shall record its proceedings in


the form of Minutes which shall be submitted to the Presiding Officer and Council
Members for appropriate action a week after the meeting. It shall contain a clear,
concise and orderly account of the business of the session and the actions taken
thereon. It shall contain the following:

a. Nature of the meeting, whether regular, special, or emergency;


b. Place, date, and time of the session;
c. Name of the present and absent Council members;
d. Action taken on the minutes of the previous meeting including the
correction, if any;
e. All motions presented or proposed, whether lost or carried, except those
withdrawn;
f. Points of order and appeals and results thereof; and
g. Duration of session starting the time of commencement and
adjournment.

SECTION 3. READING AND CONSIDERATION OF PREVIOUS MINUTES.


The minutes of the previous meeting shall be submitted by the Council Secretariat
during its succeeding regular meeting. The Council Members shall first determine if
there are corrections to be made to the Minutes and act on it accordingly before
the same is adopted and becomes its property.

Consideration of the Minutes shall not be dispensed with. Reading of the Minutes
verbatim may be dispensed with if the council members were already furnished a
copy beforehand.

SECTION 4. SIGNING OF THE MINUTES. The original copy of the Minutes


shall be signed by the Secretariat and Chairperson once approved by the council
members.

SECTION 5. EXCERPTS. Excerpts to be taken out of the Minutes shall be


certified and attested to as correct by the Council Secretariat and the Presiding
Officer of the Council on that particular session.

RULE VI.
QUORUM

SECTION 1. ROLL CALL AND QUORUM. The majority of the elected members
of the Council or the alternate representative, in case of the absence of the council
members, shall constitute a quorum of (50%+1) of the council members to
transact official business. Should a question of quorum be raised during a Session,
the Presiding Officer shall immediately proceed to call the roll of the
elected/appointed members or alternate representative, and thereafter announce
the results.

In the absence of a quorum, the Presiding Officer may declare a recess of not
more than thirty (30) minutes and wait for other members to come, or a majority
of the members present may adjourn from hour to hour or day to day and may
compel the immediate attendance of any member absent without justifiable cause.
SECTION 2. QUESTION ON LACK OF QUORUM. During a session that was
started with a quorum and a question on the lack of quorum is raised by any
council members, the Presiding Officer of the Council shall immediately cause the
reading of the roll of elected officers and announce the result thereof and then
declare whether or not there exists a quorum.

In the absence of a quorum, the Presiding Officer of the Council may declare a
recess of not more than thirty (30) minutes and wait for the other elected officers
to come to constitute a quorum. If there is still no quorum despite the recess, the
Presiding Officer of the Council may, motu proprio, or upon proper motion from
the floor duly adopted by the council, then declare the session adjourned for lack
of quorum.

The motion for adjournment is non-debatable and irrevocable.

SECTION 3. QUORUM TO DO BUSINESS. To determine quorum, the following


rules shall be observed:

a. A majority (50%+1) of all the council members shall constitute a


quorum to transact official business and to validly act on every
decision that the Davao City Youth Development Council shall make;
b. No business shall be transacted by the Davao City Youth
Development Council if there is no quorum;
c. No resolution shall be passed unless approved by a majority of the
council members present.

RULE VII.
ORDER OF BUSINESS

SECTION 1. PREPARATION OF ORDER OF BUSINESS. The Order of Business


shall be prepared by the Council Secretariat and approved by the Presiding Officer
of the Council. The electronic copy thereof, together with the attachment and
supporting documents, shall be furnished through email or other electronic means
to all council members at least three (3) days before the date of the Regular or
Special Meeting. Consistent with the efforts to reduce carbon footprint, copies of
the Order of Business shall be furnished electronically.

Only the matters listed in the Order of Business shall be taken up by the Council
members in a particular meeting. However, upon the approval of a majority of the
Council members present, the Presiding Officer of the Council may submit for its
consideration urgent matters not listed in the Order of Business that involve public
interest and that any delay in the consideration thereof will prejudice the essential
activities of the government or result in danger to or loss of life or property.

SECTION 2. CONTENTS OF THE ORDER OF BUSINESS. The Order of


Business of the Council shall be as follows:

A. Invocation
B. Singing of the Philippine National Anthem
C. Singing of the Davao City Hymn
D. Call to Order
E. Roll Call
F. Approval of the Agenda
G. Reading and Adoption of Minutes of Previous Session(s)
H. Calendar of Business
I. Unfinished Business
II. Business of the Day
III. Other matters
I. Announcements
J. Privilege Hour
K. Adjournment

SECTION 3. CONTENTS OF CALENDAR OF BUSINESS. The Calendar of


Business shall contain the assigned number of the proposed Resolution, order
of priority, the title, and the name of the proponent.

RULE VIII.
DELIBERATIVE PROCESS

SECTION 1. RULES IN THE PASSAGE OF RESOLUTIONS. In the passage of


resolutions including other matters requiring deliberative action, the following rules
shall be observed:

a. Proposed resolutions shall be in writing in not more than three (3) hard
copies and shall contain an assigned number, a title or a caption. If
necessary, a proposed resolution must be accompanied by a brief
explanatory note containing the justification for its approval. It must be
signed by the proponent thereof.
b. Every member of the Council may propose the passage of any resolution;
provided that advance copies must be furnished to the Secretariat at
least one (1) week before every regular session. For this purpose, the
proponent from his or her organization may attend the session and
participate in the deliberations thereof.
c. No resolution enacted or passed by the Council in a Regular or Special
Session duly called for the purpose shall be valid unless approved by the
council members present, there being a quorum, according to the
number of votes required for that matter.

SECTION 2. METHODS OF VOTING. Unless a different method is prescribed by


the Council for a particular measure, voting shall be either one of the following
methods:

a. By voice (viva voce);


b. By raising of hand (or show of hand);
c. By rising;
d. By ballot; and
e. By nominal voting (or roll call).

SECTION 3. PUTTING A QUESTION TO A VOTE. The Presiding Officer shall


rise whenever he/she is putting a question to a vote. In taking the vote, the
Presiding Officer shall take first the affirmative votes and then the negative votes.
While still standing, the Presiding Officer shall announce the result thereof.

RULE IX.
VOTES AND VOTING

SECTION 1. RIGHT TO VOTE; VOTING RESTRICTION. All Official Members of


the Council, have the right to vote on any matter subject to deliberative process
unless restricted through disciplinary action founded on good cause after due
process. The official alternate representative has no right to vote.

Other than those expressly authorized by law or rules and regulations promulgated
by the duly constituted authorities, no council member can vote, or be allowed to
vote, on any measure in which he/she or any of his/her relatives within the fourth
(4th) degree of consanguinity or affinity, has a direct or personal pecuniary
interest.
SECTION 2. CHANGE OF VOTE. A member of the Council may change his/her
vote but only when the result of the voting has not yet been announced by the
Presiding Officer of the Council, otherwise, he/she can only change his/her vote by
unanimous consent of the officers present: Provided, that this rule shall not be
applied if voting is by ballot.

SECTION 3. ALLOWABLE MOTION DURING VOTING. Except for a motion


pertaining to a question of quorum, the Presiding Officer shall entertain no other
motion while voting is in progress.

SECTION 4. TIE VOTE. A tie vote resulting from a vote taken on any motion,
measure or proposal shall be construed to mean that the particular motion,
measure or proposal is defeated unless the Presiding Officer of the Council decides
to break it; provided, that when a motion to appeal from the decision of the
Presiding Officer of the Council is put to a vote and it resulted in a tie, the decision
of the Presiding Officer shall be deemed sustained.

SECTION 5. BREAKING A TIE. In case of a tie vote, the Presiding Officer of the
Council should cast his/her vote. He/she is, however, prohibited from casting
his/her vote to create a tie.

SECTION 6. MAJORITY VOTE OF THE COUNCIL MEMBERS PRESENT. All


matters or measures of the Davao City Youth Development Council shall require
only a majority vote of the council members, both elected and appointed, present;
provided that a quorum for its passage, adoption or enactment, must be present.

SECTION 7. ABSOLUTE MAJORITY. A majority vote of all the members of the


Council is required in the following cases: (1) for the adoption of any resolution
authorizing the Pederasyon President to negotiate and contract loans and other
forms of indebtedness; and (2) for the amendment or repeal of any provision of
these Rules subject to the limitations provided under Section 1 of Rule XVII
hereunder.

RULE X.
FLOOR DEBATES AND AMENDMENTS

SECTION 1. NO COUNCIL MEMBER SHALL BE ALLOWED TO SPEAK BEFORE THE


COUNCIL UNLESS RECOGNIZED BY THE PRESIDING OFFICER OF THE COUNCIL. A
member of the council who has obtained the floor shall address all his/her remarks
to the Presiding Officer of the Council. He/she shall conduct himself/herself with
proper decorum by confining his/her remarks or arguments to the question under
debate and by avoiding personalities.

SECTION 2. All questions addressed to the officer having the floor must always
be coursed through the Presiding Officer of the Council.

SECTION 3. The speaker having the floor and who is still delivering his/her
speech may decline to answer questions if he/she so desires.

SECTION 4. After the period of debate has been closed, the period of
amendments shall immediately follow.

SECTION 5. Unless a different method is adopted by the Council members


present in a particular session, amendments to any proposed measure, or parts
thereof, shall be in seriatim.

Under this seriatim method, the proposed measure is read paragraph by


paragraph or section by section and after each one is read, amendments can be
proposed and debated upon.
Thereafter, a vote is taken on the proposed amendment. Eventually, this process
will reach its conclusion and the original measure or proposition is said to have
passed the second reading.

RULE XI.
MOTIONS

SECTION 1. All motions relating to an item in the agenda, if presented or


proposed by the proponent shall need a seconder.

SECTION 2. If someone has the floor, whether or not he/she is speaking, a


motion to adjourn shall be ruled out of order.

SECTION 3. All privilege motions may be proposed even if there is a pending


motion or question before the Body.

SECTION 4. Motions or questions which were laid on the table may be taken up
through a motion to that effect during that particular session or during the next
regular session but not beyond.

SECTION 5. A motion to amend (amendment of the 1st degree) and motion to


amend an amendment (amendment of the 2nd degree) may be withdrawn but
only before a decision is made thereon.

RULE XII.
DCYDC FUND SOURCES, DISBURSEMENT AND CHECK AND BALANCE

SECTION 1. SOURCES. For the pioneering year of establishment, otherwise


revised accordingly through legislation; the personnel and operating expenses of
the DCYDC shall be sourced under the City Social Welfare Development Office
(CSWDO) budget, if available. Thereafter, the DCYDC shall be funded by the
Sangguniang Kabataan Pederasyon Dabaw or Sangguniang Panlungsod through
the inclusion in the proper appropriations ordinance.

SECTION 2. NEEDS, INVENTORY, BUDGETING AND DISBURSEMENT. With


the assistance of the secretariat, the members of the council shall also draft,
finalize, propose and seek for the approval of an annual budget through the
DCYDO.

SECTION 3. CHECK AND BALANCE. All expenses of these funds shall be


subject to COA rules and regulations.

RULE XIII.
DISCIPLINE AND REMOVAL FROM COUNCIL

SECTION 1. GROUNDS FOR DISCIPLINARY ACTION/S. The following


grounds, after due notice and hearing, shall be the basis for disciplinary action,
including suspension or removal from office, depending on the gravity and
seriousness of the offense, to wit:

a. Abuse of authority;
b. Conviction by final judgment of any offense involving moral turpitude
or
an offense punishable by at least six (6) years and one (1) day
imprisonment;
c. Failure to perform official duties and functions as Council Member;
d. Serious and deliberate breach of any of the provisions of these Rules;
e. Suspension and revocation of registration of his/her organization in the
NYC’s Youth Organization Registration Program (YORP);
f. Such other grounds may be expressly provided by law, ordinance or
other applicable rules and regulations.

SECTION 2. FORM AND VENUE OF COMPLAINTS. A verified written complaint


against any Council member shall be initiated only by any Council member of the
DCYDC. The verified complaint shall be filed exclusively with the Local Youth
Development Office.

The Council shall not act on any complaint filed before it, except in cases of fact-
finding investigation, should the circumstances merit the conduct of such
investigation. After the conduct thereof, the Council or any of its members, may
endorse the complaint and file the same before the DCYDO which shall be
endorsed to the DCYDC.

The DCYDC shall have sole authority to decide matters on preventive suspension,
imposition of suspension as a penalty, removal from office, or other pertinent
disciplinary action necessitated by the circumstances.

SECTION 3. RIGHTS OF THE RESPONDENT. Consistent with the dictates of


due process, the respondent shall be accorded full opportunity to submit a
response affidavit/letter explaining his/her side of the allegations for the
consideration of the Davao City Youth Development Council (DCYDC) in their
decision-making on the complaint.

SECTION 4. RESIGNATION. Resignation of any council member shall be


deemed effective only upon submission of an official Resignation Letter and
acceptance by the Council Chairperson. In case of the resignation of the latter, it
shall be deemed to be effective upon acceptance by the Local Youth Development
Officer.

In any case, the resignation shall be deemed accepted if not acted upon by the
designated authority within fifteen (15) days from receipt thereof.

In all cases, copies of the resignation letters, together with the action taken by the
aforesaid authorities shall be furnished to the CSWDO Department Head and Office
of the City Mayor.

SECTION 6. LEAVE OF ABSENCE.

a. Leave of absence by the Council Chairperson shall be approved by


the
City Mayor;
b. Leave of absence by other Council Members shall be approved by the
Council Chairperson;
c. Whenever the application for leave of absence mentioned above
specified is not acted upon within five (5) working days after receipt
thereof, the application for leave of absence shall be deemed
approved;
d. Any leave of absence for a period of more than one (1) month must
be properly accompanied with a certification by the Council
Secretariat.
e. All leave of absence shall be officially recorded by the secretariat.

SECTION 7. FILLING UP VACANCIES.

a. Office of the Council Chairperson. In case of permanent vacancy of


the Council Chairperson, or if the latter has been absent without
leave for more than three consecutive meetings, the Vice
Chairperson shall take over the position.
b. Council Members. Vacancies can also be filled up through special
elections with other YORP-registered organizations in the City of
Davao.

RULE XIV.
SUSPENSION OF THE RULES

SECTION 1. Any part of these Rules, except those prescribed by existing laws,
may be suspended at any particular session by a majority vote of the Council
members present therein.

RULE XV.
MISCELLANEOUS PROVISIONS

SECTION 1. OUTGOING CORRESPONDENCES. All outgoing correspondences


by the DCYDC shall be prepared by the DCYDO and will be approved by the
Council Chairperson, or in its absence, by the Council Vice Chairperson. In the
absence of both, the council shall, by a majority vote of council members present,
designate an official signatory under a resolution passed for such purpose.

All written communications shall be made observing the following typographical


standards: Font: Tahoma; Size: 12; Margins: 1.5 inches (left) by 1 inch by 1 inch
by 1 inch. All correspondences shall be printed on a long-size coupon bond using
the letterhead of the DCYDC as the first page.

SECTION 2. RECOMMENDED MANDATORY TRAININGS, PROGRAMS AND


ACTIVITIES. It shall be mandatory for the Council to conduct the following
activities every year, which shall be included in the Local Youth Development Plan,
to wit:

a. Introductory and Refresher Training on Parliamentary Rules and


Procedures, Resolution Making, Policy Research and Advocacy,
Lobbying Methods and Techniques and others
b. Mid-Year and Year-End DCYDC Review / Evaluation and Planning
Meetings
c. Presentation of DCYDP Review and Planning Results with DCYDO to
the and Office of the City Mayor.
d. Annual Benchmarking and Learning Exchange on DCYDC Best
Practices with other LYDCs and LYDOs
e. Mentoring Sessions with Davao City Councilors and Sangguniang
Panlungsod Staffs.
f. Participation of council members in relevant committee hearings and
Sangguniang Panlungsod Sessions.
g. Regular Dialogue and Coordination Meetings with concerned local,
regional and national agencies such as but not limited to the City
Mayors Office, City Vice Mayor’s Office, City Budget Office, City
Treasurer’s Office, City Administrators Office, City Legal Office, City
Accounting Office, City Planning and Development Office, City
Tourism and Operation Office, City Environmental and Resources
Office, City Agriculturist Office, City Health Office, National Youth
Commission, Department of Interior and Local Government,
Commission on Audit, Department of Social Welfare and
Development Office, Technical Education and Skills Development
Authority, Department of Education, and Department of Trade and
Industry.
h. Junior City Officials and DabawenYouth Day in line with International
Youth Day Celebration in Linggo ng Kabataan Celebration.

The necessary program flow and activities shall be subject to separate and
pertinent Resolutions to be passed by the council every year.
SECTION 3. The DCYDC Logo.

The official logo of the DCYDC shall be exclusively used for official purposes and
shall not be utilized by any other person, even belonging to the council, for
purposes of personal advancement and/or gain. The use of the said logo in all
official transactions and communications shall always be in conjunction with the
official seal of the DCYDO and the official logo of the City of Davao, being the
primary agency having jurisdiction over the council.

The current members may use the DCYDC logo as part of their primer with the
consent of council members or the head secretariat. Using DCYDC in the logo in
the solicitation letter is strictly prohibited.

RULE XVI.
AMENDMENTS AND REPEAL

SECTION 1. AMENDMENTS AND REPEAL. These rules may be amended,


modified, or any portion repealed at any Regular Session by a majority vote of all
the council members: Provided, that prior notice of such proposed modification is
given to all the members of the council; and, provided, further, that no provision
herein which is based on, or prescribed by existing laws, rules and regulations
shall be amended.

SECTION 2. SUPPLEMENTARY RULES. In the absence of specific provisions in


these Rules applicable to a given situation, the pertinent provisions of the rules
governing the proceedings of the Sangguniang Panlungsod of Davao City shall be
made applicable which shall be deemed supplementary to these rules.

In the absence of specific rules or provisions in the Rules of the DCYDC, the
Roberts Rules of Order shall govern; however, the DCYDC may adopt such rules to
govern the situation not herein contemplated, consistent with the provisions of
Republic Act No. 10742 and amended by RA 11768, and in keeping with the tenets
of fair play and justice.

RULE XVII.
FINAL PROVISIONS

SECTION 1. REPEALING CLAUSE. Any other issuance of the Council that is or


may be inconsistent herewith is hereby amended, repealed or modified
accordingly.

SECTION 2. SEPARABILITY CLAUSE. If for any reason or reasons, any part of


these Rules shall be held to be unconstitutional or invalid, other unaffected parts
hereof which may stand independently of the affected provisions shall continue to
be in full force and effect.

SECTION 3. EFFECTIVITY. These Rules shall take effect immediately upon


approval by the majority of all the members of the council qualified to vote.
SECTION 4. DISSEMINATION. Let copies of these rules be furnished to the
Office of the City Mayor, the Office of the Presiding Officer of the Sangguniang
Panlungsod, the SK Pederasyon-Dabaw Office, Davao City Youth Development
Office, National Youth Commission through its Chairperson, the City Director of the
Department of Interior and Local Government (DILG) – Davao City, the Liga ng
mga Barangay, all SK chairpersons, and all other concerned offices and agencies.
