Held- The bench held that centre cannot withhold documents from disclosure under the RTI
Act citing national security if it has been established that retention of such information
produces greater harm than disclosing it. The centre cannot take help of Officials secrets act
as RTI Act considerable diluted it and that if it is allowed to override RTI, then the purpose
of later stand defeated. The case regarding probing the deal to made to acquire Rafale
aircrafts from French Company Dassault Aviation, which was later prohibited by the Apex
court.
