Summary of Case Flow Management Rules, 2017

For Writ Petitions:

1. Categorization:

• Classified into three tracks: Fast Track, Normal Track, and Slow Track based on
urgency.
• Criteria for categorization include the subject matter of the petition.
2. Timely Disposal:

• Fast Track: Efforts for disposal within 6 months.


• Normal Track: Efforts for disposal within 12 months.
• Slow Track: Efforts for disposal within 24 months.
• Certain urgent cases prioritized in the Fast Track, such as those involving tax
liabilities, demolition, or tenders.

For Civil Appeals and Other Matters:

1. Categorization:
• Similar categorization into tracks based on complexity and nature of issues.
• Subject-wise division for appeals and revision applications.

For Procedure for Deciding Time Limit:

1. Commencement of Time Limit:

• Time limit begins from the filing of reply affidavit and listing by the Registry.
• Final hearing should be scheduled within one week after completion of pleadings,
whenever possible.
2. Monitoring and Reporting:

• Senior officer appointed for monitoring case stages and reporting to respective
judges.
• Data on case stages fed into computer system for easy access by judges.
• Court may shift cases between tracks based on complexity, urgency, and other
circumstances.

For Writ of Habeas Corpus:

1. Prompt Listing and Hearing:

• Listed for substantive hearing within 48 hours of filing.


• Priority given over other cases.
• Short timeframes for responding to notices and submissions.
2. Government Response:

• Governments required to file brief returns to justify detention if necessary.


• Provisions for more detailed return if deemed necessary by the court.

For Mode of Advance Service:

1. Advance Notice to Counsel:


• Standing counsel of Government or Public-Sector Undertakings to be served with
advance notice of 48 hours.
• Lists of advocates published for effective service.

For First Appeals to the High Court:

1. Complete Appeal Memo:

• Appeal memo must be filed with all necessary documents.


• Advance copy of appeal to be served 24 hours prior to filing.
• Proper preparation and timely submission of paper-books required.
2. Filing of Written Submissions:

• Both parties required to submit concise written submissions in advance.


• Cause list to indicate filing of submissions; directions given if not filed.
3. Time for Oral Arguments:

• Parties to indicate time required for arguments after submission of written


submissions.
• Provision for caution list to address adjournments.

For Court May Explore Possibility of Settlement:

1. Mediation and Settlement:


• Court may explore settlement at the first hearing.
• Mediation considered with parties' consent; provisions for securing time outside
regular timeframes.

For Second Appeals and Civil Revisions:

1. Preparation and Filing:


• Procedure similar to first appeals followed.
• Efforts for timely disposal emphasized, especially in cases with stay orders.

For Criminal Appeals:

1. Categorization and Timeframes:


• Categorized into tracks based on nature of case.
• Priority given to cases based on the severity of the offense.
