SECULARISM

As we all know, the 42nd Amendment to the Constitution of India, enacted in 1976,
asserted that India is a secular nation. Secularism is the basic spirit of our
constitution which means that the government should not be influenced by any
specific religion in its decisions and actions. Today politics is being done in the name
of religion. A belief is being sent across the world that governments in India are
formed on religious lines. Our country's identity in the world is not in the manner in
which governments are being formed in the name of religion...in the name of
Hinduism. young generation should think about and analyze where the country is
heading. They should be aware of the present situation and challenges. Secularism
has always been a guiding principle for me. It is easy to do politics in the name of
religion, it is easy to instigate people in the name of caste, and it is easy to spread
hatred but it is difficult to take it back when it spreads. I want to tell those who do
politics in the name of religion, to look at the future of the country... what will
happen after 25 years or 50 years. I would urge people to look into the reasons and
understand why India remained united even after independence and why Pakistan
was divided. Pakistan became a nation based on religion but what was the reason that
despite being a religion it got divided while India not only survived but also
prospered and powerful with hundreds of religions and different languages? We all
should live in love and harmony and this is what Mahatma Gandhi also taught us by
celebrating diversity, traditions, and culture, and that is our religion. In a democracy,
the fight should be about ideology, but personal fight or politics in the name of
religion, or caste is dangerous. Today politics is being done in the name of religion
and caste and people are succeeding and becoming happy. Our country is not
recognized in the world by the way governments are being formed in the name of
religion... The young generation should think and analyze where the country is going.
They should be aware of the current situation and challenges. India is not a Hindu
country, it is not a Muslim country but only a secular nation. Therefore it should be
assumed that all Indian citizens are followers of secularism

प्रभाकित नहीं होना चाकहए। आज िमम िे नाम पर राजनीकत हो रही है। दकु नया भर में यह
िारर्ा बनाई जा रही है कि भारत में सरिारें िाकममि आिार पर बनती हैं। िममकनरपेक्षता
हमेशा मेरे कलए एि मार्मदशमि कसद्ांत रहा है। िमम िे नाम पर राजनीकत िरना आसान है,
जाकत िे नाम पर लोर्ों िो भड़िाना आसान है, और नफरत फै लाना आसान है लेकिन
फै ल जाने पर उसे िापस लेना मकु किल है। मैं िमम िे नाम पर राजनीकत िरने िालों से िहना
चाहता हं कि देश िा भकिष्ट्य देखें... 25 साल या 50 साल बाद क्या होर्ा। मैं लोर्ों से
आग्रह िरंर्ा कि िे िारर्ों पर र्ौर िरें और समझें कि आजादी िे बाद भी भारत एिजटु
क्यों रहा और पाकिस्तान क्यों बंटा। पाकिस्तान िमम िे आिार पर एि राष्ट्र बन र्या
लेकिन क्या िारर् र्ा कि एि िमम होने िे बािजदू यह किभाकजत हो र्या जबकि भारत न
िे िल जीकित रहा बककि सैिड़ों िमों और किकभन्न भाषाओ ं िे सार् समृद् और
शकिशाली भी हुआ। हम सभी िो प्रेम और सद्भाि से रहना चाकहए और यही महात्मा
र्ांिी ने भी हमें किकििता, परंपराओ ं और संस्िृ कत िा जश्न मनािर कसखाया और यही
हमारा िमम है। लोितत्रं में लड़ाई किचारिारा िी होनी चाकहए, लेकिन िमम या जाकत िे नाम
पर व्यकिर्त लड़ाई या राजनीकत खतरनाि है। आज िमम और जाकत िे नाम पर राजनीकत
िी जा रही है और लोर् सफल हो रहे हैं और खश ु हो रहे हैं। कजस तरह से िमम िे नाम पर
सरिारें बन रही हैं, उससे दकु नया में हमारे देश िी पहचान नहीं है... यिु ा पीढी िो सोचना
चाकहए और किश्लेषर् िरना चाकहए कि देश कििर जा रहा है। उन्हें मौजदू ा कस्र्कत और
चनु ौकतयों से अिर्त होना चाकहए। भारत एि कहदं ू देश नहीं है, यह एि मकु स्लम देश नहीं है
बककि िे िल एि िममकनरपेक्ष राष्ट्र है। इसकलए यह मान लेना चाकहए कि सभी भारतीय
नार्ररि िममकनरपेक्षता िे अनयु ायी।
Discussion on recent activities with special emphasis on the violation
of Article 25
Article 25 of the Indian constitution guarantees freedom of religion to
all the citizens of India which means that every citizen is entitled to
freedom of concerns and has the right to freely adopt, practice and
propagate religion. The basis of such acts is that the religious teaching
which is dedicated to the welfare of the people and their peaceful
existence can be preached to others, but it is visible that many people,
especially the extremist always make use of such acts to propagate the
message of hatred and violence in the name of religion. Like, RSS
(Rashtriya Swayam Sewang Sangh) which is a body related to BJP
incites Hindus to be tolerant towards other religions like Muslims to
create dominance over them which is totally against the spirit of such
acts. Here, the BJP leads the central govt. is failing to check such
violations of this act. Modi ji, isko bhi dekhiye zara.
AYODHYA VERDICT
The BJP, RSS, and VHP demolished Babri Masjid on December 6,
1992, instead of reposing faith in the judiciary for the resolution of the
dispute. They provoked the people, riots broke out and countless
innocent people were killed. The country could have been saved from
the ignominy of violence if the BJP had shown some restraint. Who
benefited from it? They cannot take credit for the settlement of the issue
now.

As we all are aware the Uniform Civil Code is a proposal laid down in
India to formulate and implement personal laws of citizens which apply
to all citizens of the country equally regardless of their religion. But sir,
the current situation is that the civil laws in the country are according to
the religious faith and belief of the people. Like, the Hindu marriage act
is different from the marriage provisions for Muslims and similar for
other religions too. In India, all the laws should be applied equally to
every citizen irrespective of their religion. UCC aims towards this only.
However, the current Modi government is trying to bring UCC into the
country for suppressing the belief of Muslims over Hindus and this
creates suspicion in the mind of the Muslim community people.

I completely reject the need for ucc. uniformity doesn’t mean sameness
and equality does not necessarily entail uniformity. religion is not
merely about worship or rituals. for most Indians, religion governs the
relationship and their understanding of family, property, marriage, etc.
it creates what one may call a moral universe and its adherence, it is not
only about rituals that come within marriage but the very meaning of
these words is different for Hindus, Muslims and a whole host of
communities. 1.4 billion people cannot be expected to be governed
under a single law. Therefore, forcing UCC people on is a direct attack
on pluralism. Pluralism and secularism in the Constitution can be seen
in articles 25,26,29 besides 14,19,21. This is a part of our basic
structure, this is what the sc quoted in the Keshvanandi Bharti vs the
State of Kerala. (Just as an example, marriage in Islam is a contract
whereas it is a sacrament in Hinduism.) Therefore, It is not fair for one
to concede their understanding of marriage for another.

उनिी मांर् िा मतलब यह नहीं है कि कहदं ू िाननू उनिे सार् भेदभाि िर रहा है,

371 िे तहत नार्ालैंड, मकर्परु , असम, कसकक्िम और कमजोरम िी सस्ं िृ कत िी
रक्षा िरने िा िादा किया र्या है। महोदय ऐसी हजारो प्रर्ाएं कजस िारर् इन सभी
िो एि ही िाननू िे तहत समाकहत नही िरा जाना चाकहए ।

BJP using UCC will compromise the diversity and plurality of India. UCC will
difficult to implement in a country like India where various communities and
groups are governed by personal laws. If UCC is implemented India will lose its
diversity and access to diversity will be lost. In India, there are over 300
personal laws applicable to multiple minorities. My state Rajasthan has about 68
lakh Muslim people what about their rights? This will increase the incidents like
hijab controversy. Also, the All India Muslim Personal Law Board and some
other outfits opposed the Law Commission’s questionnaire on UCC including
the abolition of ‘triple talaq’ and announced their boycott on the move, and
accused the government of waging a war against the community. To prevent this
I think the Law Commission should consider to all perspectives of all religions
including Muslims and minorities.

कि देश में नार्ररि िाननू लोर्ों िी िाकममि आस्र्ा और किश्वास िे अनसु ार हैं। जैसे, कहदं ू
कििाह अकिकनयम मसु लमानों िे कलए कििाह प्राििानों से अलर् है और इसी तरह अन्य
िमों िे कलए भी। मोदी सरिार िो पहले यह बताना चाकहए कि उनिे कदमार् में क्या है
और यसू ीसी िे बारे में उनिा क्या किचार है। अर्र इस्लाम में कहदं ू िमम से बेहतर प्राििान
हैं, तो क्या मोदी सरिार उन्हें अपनाएर्ी? यकद ईसाई िमम में कहन्दु और मकु स्लम दोनों िमो
से बेहतर प्राििान हैं, तो क्या उन्हें अपनाया जाएर्ा? क्या सभी िमो िे लोर्ों िो उनिे
किकभन्न-किकभन्न प्रचकलत िाकममि किश्वासों िो छोडने िे कलए बाध्य किया जायर्ा? यकद
UCC में किसी िे प्रचकलत िाकममि किश्वासों िो अकिि मान्यता दी र्ई और दसू रे िमम िे
प्रचकलत किश्वासों िे सार् छे ड़-छाड़ िी र्ई या उन्हे परू ी तरह से खाररज किया र्या तो क्या
दसू रे िमम िे लोर्ों में सरिार और िाननू िे प्रकत जबरदस्त आक्रोश उत्पन्न नहीं होर्ा ??
मामले िी जड यह हैं कि इस मोदी सरिार ने कपछले 8 िषों में इस देश िे अकपसख्ं यिों
और दकलतों िे सार् उनिी िायमशैली में भेदभाि किया है। भाजपा अपना पक्ष सही से नही
रख रही है और मद्दु ो िी कखचडी बना रही है । िो किशेषिर मसु लमानों िे िाकममि किश्वासों
िो दबाने और उन्हें िुचलने िा लर्ातार प्रयास किया हैं और इस िारर्िश मकु स्लम
समाज में ितममान मोदी सरिार िे कखलाफ अत्यकिि भय, संदहे और र्स्ु से िा िातािरर्
हैं । इसकलए मोदी सरिार िी हरितें ऐसी हैं कि उनिे नेतत्ृ ि में यसू ीसी िी कनष्ट्पक्षता पर
भरोसा नहीं किया जा सिता।

उनिो छे डना नही चाकहए। देश भे भले ही सब िमों िे कमलिर 36 से ज्यादा िाननू चल
रहे है, लेकिन उनिे चलने से देश मे शांकत िा मौहाल है , उनसे साम्प्रदाकयि सौहादम नही
कबर्ड़ती है। इसकलए यसू ीसी िो इन सब िाननू ों िो हटािर
एि कबंदु समािान िे रप मे नही देखा जाना चाकहए। भारत जैसा लोितत्रं , किकभन्न
समदु ायों िे व्यकिर्त िाननू ों िे सार् पहले भी समृद् और शकिशाली हुआ है और आर्े
भी होर्ा। कमजोरम और कत्रपरु ा िो सांस्िृ कति अकििार कदए र्ए है कजससे िहा ही
पररकस्र्कत बेहतर हुई है और लोर्ों िी मानकसिता िा जीर्ोद्ार हुआ है। बीजेपी यसू ीसी
िे द्वारा इन अकििारों िो खत्म िरना चाहती है कजससे इन राज्यों मे दर्ं े हो जाएर्े। मै यहा
पर श्री ब र अम्बेडिर जी एि पकं ि िोट िरना चाहता ह िे बोलते है कि सरिार िोकशश
िरे र्ी िी यसू ीसी बने , उन्होने यह िभी नही िहा िी सरिार उसिो िठोर रप से लार्ू
िरे र्ी। यही दसू री और भाजपा यसू ीसी िे माध्यम से मसु लमानों पर यसू ीसी र्ोपना चाहती
है। सर बाबा साहब अम्बेडिर िी माने तो िो सरिार पार्ल है , किकक्षप्त है जो अपने ही
लोर्ो िी इच्छाओ ं िे कखलाफ, उनिे िमम िे किरुद् िाननू लाए। अन्त मै बस यही िहना
चाहता ह कि सरिार िा िाम देश िी उन्नती िे बारे मे सोचना होना चाकहए इसकलए
भाजपा भी यसू ीसी िा नाटि बदं िरे और देश िी प्रर्कत और िकयार् िे बारे मे सोचे।

आप संकििान मे संशोिन तो िर सिते है लेकिन आप बकु नयादी ढाचं े िो नही बदल
सिते किंतु भाजपा बकु नयादी ढांचे िो कहन्दु ढाचं े िे सार् बदलना चाहती है ।देश िो
किनाश से बचाने िाले हमारे सभी स्ितत्रं ता सेनानी हर िमम िे सार् समान व्यिहार िरना
चाहते र्े और इस दो राष्ट्र कसद्ांत िे कखलाफ र्े लेकिन नरें द्र मोदी जी िे नेतत्ृ ि में भाजपा

से हटाने और इस देश िे भाई िे बीच भेदभाि िरने िे कलए उन्होंने सीएए जारी किया।
लेकिन रुकिए, बीजेपी िा छुपा पक्ष अभी खत्म नहीं हुआ है. िे भ्रष्टाचार से बाहर सीएए िे
माध्यम से अपना िोट बैंि बढाना चाहते हैं। मैं यह िहिर अपनी बात समाप्त िरना
चाहर्ं ा कि भाजपा िा इरादा किसी िी मदद िरने िा नहीं है, िे सताए हुए लोर्ों िो
नार्ररिता देने िा इरादा नहीं रखते हैं, िे कसफम भारत िो अलर् िरना चाहते हैं और
अपनी फूट डालो और राज िरो िी नीकत िा इस्तेमाल िरते हैं।

मैं दोहराना चाहता हां डक मैं उन्हें नागररकता देने के डलए ह।ां सवाल िह नहीं है। सवाल िह
है डक िह डवभाजनकारी प्रचार क्िों, िह ध्रवु ीकरण करने वाला डािट्रीब क्िों है? वे मेरी
डथिडत को गलत तरीके से क्िों पेश कर रहे हैं? 2016 से 19 के बीच राजथिान में
पाडकथतान से आए 1,750 शरणाडिििों को नागररकता दी गई है। इसमें से 1,180 को हमारी
सरकार के सत्ता में आने के बाद 2018 meine नागररकता दी गई िी। आज तक राजथिान
में पाडकथतान के 17,574 शरणािी रह रहे हैं। इनमें 331 मसु लमान हैं। अन्ि देशों और
अन्ि धमों और गैर-डवश्वाडसिों में सताए गए लोगों के बारे में क्िा? श्रीलांका से तडमलों के
बारे में क्िा? अमहडदिों के बारे में क्िा? रोडहग्ां िा? डतब्बती बौद्ध? न के वल भाजपा का
डवरोध करने वाले दल, बडकक जद (ि)ू और उसके नेता, डबहार के मख्ु िमत्रां ी नीतीश कुमार
जैसे उसके सहिोगी भी पनु डविचार की माांग कर रहे हैं। बीजेपी को 37 फीसदी वोट डमले िे
और 63 फीसदी वोटसि उनके डिलाफ िे. िह अहक ां ार डक उन्हें इस तरह के डवभाजनकारी
काननू को लागू करने का जनादेश डमला, देश के डलए बरु ा है। मोदीजी को इस हठ को
रोकना चाडहए, कारण देिना चाडहए और काननू को वापस लेना चाडहए। उन्होंने कभी
नीडतिों के आधार पर चनु ाव नहीं ल़िा.. वे सांडवधान की शपि लेते हैं लेडकन इसके
डिलाफ काम करते हैं,

Nobody is opposed to citizenship for persecuted people. Far from giving
any relief to these poor and harassed people, the CAA intends to
aggravate communal tension in India. Thousands of them are in
Rajasthan. If they are so concerned about these refugees, why didn’t
Amit Shah grant citizenship to them when he came to Jodhpur recently?
To give them citizenship you did not even need the CAA. They are only
interested in building a fake narrative that they are the custodians of
Hindu rights. The PM’s statement is aimed at communal polarization.
This is dangerous for the country. A letter that you had written in 2009
to the then Home Minister about Hindu and Sikh refugees in Rajasthan
is being cited to justify CAA.
The letter itself is proof that Mr. Modi’s statement is incorrect. I stand
by my letter in 2009. Let me reiterate that I am all for giving them
citizenship. The question is not that. The question is why this divisive
propaganda, why this polarising diatribe? Why are they misrepresenting
my position? Between 2016 and 19, 1,750 refugees from Pakistan have
been given citizenship in Rajasthan. Of this, 1,180-odd were granted
citizenship in the last year, after our government came to power. As of
today, there are 17,574 refugees from Pakistan residing in Rajasthan. Of
them, 331 are Muslims. That letter was raising an administrative issue
with the Centre. The opposition to the CAA is about a discriminatory
law. What about persecuted people in other countries and other sects,
religions, and non-believers? What about Tamils from Sri Lanka? What
about Amhadiyas? Rohingya? Tibetan Buddhists? Not only parties
opposed to the BJP but also its allies such as the JD(U) and its leader,
Bihar Chief Minister Nitish Kumar are calling for a rethink.
The JD(U) had supported the bill in Parliament. The BJP had got 37%
votes and 63% of voters were against them. This arrogance that they had
the mandate to implement such a divisive law is bad for the country.
Modiji must stop this obstinacy, see reason and withdraw the law. They
have never contested elections based on policies. They take the oath of
the Constitution but work against it,
