The bloodied history of India’s Partition will remain incomplete
without a mention of the Direct Action Day or the Great Calcutta
Killings of 1946, when Calcutta was in the grip of fanatic Muslim
mobs that ran riot killing and raping Hindu men and women. In
retaliation a group was formed by the Hindus led by Gopal
Chandra Mukhopadhyay that effectively managed to save Calcutta
from falling to the well-chalked out plans of the Muslim League to
separate the whole of Bengal from India; a plan that was indirectly
backed by the British colonial government.
What led to the Direct Action Day
Uncontrolled and brutal communal violence in Calcutta, Noakhali,
and parts of Bihar forced the Congress leaders to accept the
partition of India based on religious lines. Prior to the partition, the
British colonial government with their divide and rule policy helped
in the formation of the Muslim League, and soon inevitably it led to
the establishment of the Two Nation theory by the Muslim League.
By the 1930s the Muslims in Bengal had already accepted the Two
Nation theory as their political doctrine, and were ready for a
division of Bengal based on religious lines. The Muslims in Bengal
believed in the Muslim League propaganda which said “by virtue of
one’s religious belief, a Punjabee or an Uttar Pradesh Muslim is
closer to him than his next door neighbor who belonged to some
other religion (Hinduism)” (Barkat, et al., “Deprivation of Hindu
minority in Bangladesh: Living with vested property,” 2008, p. 45).
The Muslim League’s demand and stubbornness for a separate
nation for the Muslims not only fractured India in 1947, but also
caused a huge bloodshed in 1946 undivided Bengal and Bihar with
the start of the Direct Action Day riots. The seeds of the Direct
Action Day communal riots were sowed when the Cabinet Mission
in India (1946) that was formed to arrange transfer of power from
British authority to Indian leadership proposed a plan for the
formation of the new Dominion of India, which failed to address the
Muslim League’s proposal to divide the country into a Hindu-
majority India and a Muslim-majority Pakistan. To protest against
this proposal exclusion, the Muslim League decided to call for a
hartal (general strike) on 16 August 1946, and named it as the
Direct Action Day, wherein the League decided to show its muscle
power and assert its demand for a separate nation for the Muslims.
A Muslim League Council Meeting was held from 27–29 July 1946
where a resolution was passed stating that the Direct Action Day
aimed at unfolding a direct action to force the creation of a Muslim
majority Pakistan. Jinnah was clear enough in his indications of his
intentions when he boldly stated he will have “India divided or
India burned”, and the Muslim League had said “goodbye to
Constitutional methods” and was ready to “create trouble”. Adding
further fuel to the already charged up Muslim communal
sentiments were the pamphlet writings by the then Mayor of
Calcutta, Syed Mohammed Usman, that declared, “We Muslims
have had the crown and have ruled. Do not lose hearts, be ready
and take swords. Oh kafir! Your doom is not far”
(ref: Yasmin Khan, “The Great Partition: the making of India and
Pakistan, 2017, p 64). This was supported by Husseyn Shahid
Suhrawardy, the then Bengal chief minister, who in his speech
indirectly promised no actions were to be taken against the armed
Muslims should they decide to unleash their activities in the city
(Yasmin Khan, ibid, p 65). Jinnah specifically used the religious and
communal symbols and idioms to charge up the Muslim community
into starting violence for a forced carving out of a separate nation as
a Muslim homeland. There are also claims that the Bengal Chief
Minister Suhrawardy during the communal violence of 16th August
forcibly removed Hindu policemen from their jobs (Yasmin Khan,
ibid, p 184-185).
DN Panigrahi, the author of India’s Partition: The Story of
Imperialism in Retreat, also confirmed the inaction of police and
army on those ghastly days, after speaking to a foreign journalist
present in Calcutta on that day, when unabated killings and rapes
were carried on by Muslim mobs for 48 hours. It is said that the
army was brought in only after it was felt that the Europeans might
be attacked, showing the collusion between the League and the
British colonial government. It was this Direct Action Day or the
Great Calcutta Killings on 16th August 1946 that finally marked a
psychological break between secular Hindus and the communal
demand by the Muslims for a separate Islamic state named as
Pakistan.
As per Nishad Hajari, author on the Partition, “no one knows the
death toll in what would become known as the Great Calcutta
Killings. Many bodies were washed down the Hooghly or consumed
in fires. The generally accepted estimate is five thousand Calcuttans
were killed, while another ten to fifteen thousand had their bones
broken, limbs hacked off, or bodies charred” (“Midnight Furies:
The Deadly Legacy of Indian Partition,” 2015, p. 33). The entire
objective of the Direct Action Day was to flex the muscle power of
the Muslim League, and to show that Hindus and Muslims were
incompatible.
The killing of Hindus started with the murder of two Bihari
milkmen in Beliaghata on Friday 16th August early morning, and
soon Hindu owned movie theatres, hotels, and shops were attacked
and set on fire by Muslim mobs. Motivated by Suhrawardy’s
assurances in the League’s Rally, violent Muslim mobs led by
criminals like Munna Chaudhary and Meena Punjabi started
widespread attacks on Hindu homes and shops. There were reports
of rampant killings of Hindu men and boys while Hindu girls were
kidnapped and raped or kept as sex slaves. As per the reports by a
police officer, Golok Bihari Majumder, bodies of naked and hacked
Hindu girls were seen hanging from a slaughterhouse in central
Calcutta.
As the murders and rapes continued, on 18th August Gopal
Chandra Mukhopadhyay (or Gopal Patha) decided to stand up
against this State sponsored Muslim violence on Hindus. He
belonged to a family of freedom fighters and was the nephew of the
revolutionary, Anukulchandra Mukhopadhyay.
Gopal Mukhopadhyay was joined by Jugal Chandra Ghosh,
Basanta (a wrestler), and Vijay Singh Nahar, and together they
formed the Bharat Jatiya Bahini, an organization that armed
Hindus with weapons like with pistols (sourced from American
soldiers), lathis, spears, knives, swords, and also acid bombs.
Hundreds of Hindus (Bengalis, Sikhs, Odiyas, Biharis, and UP-ites)
from the various Vyayam Samitis of Calcutta and its adjoining
areas, along with Arya Samajis and members of the Hindu
Mahasabha came forward to take part in the resistance.
As the Hindu resistance gained ground, the numbers of Muslim
casualties rose, and soon the latter panicked and started leaving the
city, even though the clashes continued for nearly a week. From
18th to 20th August Gopal Patha and the other Hindu leaders
specifically identified and killed the Muslims who had taken part in
rapes and killings of the Hindus. Members of the Muslim National
Guard, a militant body associated with the Muslim League, were
killed in large numbers; however no Muslim women or children
were touched by the Hindus during the resistance. By 20th August
Suhrawardy realized he couldn’t displace the Hindus from
Calcutta, and his dreams of making the entire Bengal along with
Calcutta a part of Pakistan would not be fulfilled.
In order to save himself and his government, Suhrawardy along
with G G Ajmiri and Sheikh Mujibur Rehman (the founder of
Bangladesh and a member of the Muslim League), appealed to
Gopal Mukherjee to end the killings. Gopal Mukherjee agreed on
the condition that the Muslim League would first make its members
lay down their weapons and promise to stop all killings of Hindus.
Finally, on 21 August, Bengal came under direct Viceroy’s rule and
the army was deployed in the city. To save his chair Suhrawardy
had agreed to all of Gopal Mukherjee’s conditions; however on 21
August 1946, once the army was deployed, the British Viceroy, Lord
Archibald Wavell dismissed Suhrawardy and his Muslim League
government. Later Gopal Mukherjee also refused to surrender
arms to Gandhiji, when the latter came and asked Hindus to
surrender their weapons, few months after the riots. Gopal
Mukherjee bluntly said he will not surrender his weapons to
Gandhiji who was nowhere in sight when Hindus were being killed
and raped during the Great Calcutta Killings.
(Note: There are interviews of Gopal Mukherjee and discussions on
him on few Youtube channels. Do take some time out and check
these videos. You just need to type Gopal Mukherjee or Gopal
Pantha. While listening to these, please keep in mind the horrific
situation at that time created by the Muslim League and the violent
Muslim mobs, and understand why he was forced to create the
Hindu Resistance, without which the Hindus in Bengal would have
had no future).
|| Sequence of events on 16th August 1946- the start of Direct Action
Day riots ||
The first incident happened at 4:30 am when a H who was out was
knifed. By 6:30 am there were news of widespread looting of H
shops in Maniktola bazar by a large M crowd. At this time two H
women were attacked by the M mob, and one H man knifed and
kil!ed.
The next series of events of murders, loot, and arson are from the
reports of Lalbazar thana headquarters as they kept appearing as
breaking news on 16th August 1946:
1. At 7 am a M mob attacked in Maniktola

Fight between Ms and Hs in front of Ripon college.
14. 11.08 am - the shop Kamala Vastralaya on Vivekananda road
was set on fire.
15. 11.15 am - the clashes in front of Ripon college had turned
extremely violent.
16. 11.50 am - a huge crowd of Ms started destroying and looting
shops in Sealdah and were progressing towards bowbazar. Another
group while shouting anti -H slogans and looting shops on upper

open swords and sticks were moving from Shyambazar to
hathibagan.
17. 1.30 pm - in Narkeldanga, 5 dead bodies were lying on the main
road, while Hindu homes were being set on fire in sasthitola.
18. 3 pm - in Garpar area H houses were being set on fire and Hs

At the same time a meeting of the Ms were being held at the maidan
were instigating speeches were made.
19. 4.05 pm- all H shops were looted and destroyed around the
Lighthouse cinema hall area.
20. 4.20 pm- the Bengal club was attacked by a M mob.
21. 4.30 pm - the gun shop owned by KC Biswas beside the metro
cinema was attacked and all weapons from it looted.
The detailed list for 16th is almost endless as the loot, killings, and
all forms of unspeakable violence continued throughout the night
across the city. DC north Khan saheb Khalilur Rahman wrote in
his report regarding 16th August - “uncontrolled violence ongoing
at Dharmatolla Street, Wellesley street, Market street, Corporation
Street, and Free school street. Constant reports of Ongoing
murders, looting, and massive arson. Without the army, situation
cannot be brought under control.”
With no signs of the army, violence continued unabated for the
whole of 17th, and ended sometime on 18th afternoon. The records
of Lalbazar police headquarters 1946 give us just a glimpse of the
extreme violence that Kolkata saw during Direct Action Day riots.

Yes 100 percent ! It started after 1st week of Sep 47 when a massive
riot took place in Peshawar between Supporters of M League and
Those demanding Pakistan
Jinnah & Liaqat Ali diverted it by giving slogan of Islam in danger
in Kashmir under a Hindu ruler and advocated after taking
Kashmir have to march to Patiala and take over whole Punjab as
Patiala ruler got Muslims killed in Punjab ! Pakis were afraid as
Afghanistan had supported Pathanistan demand. They also sought
British help to influence Afghan Govt. Truck loads and special
trains of kabalis then sent to Rawalpindi from where they were led
by Pakistani army officers in plain Pathani dresses ! British Officers
all knew this , not only Mountbatten but British Commander in
Chief of Indian and Pakistani armies knew this.many British in Pak
army supported Kabalis ! Read about Major Brown who massacred
Hari Sing's troops in Gilgit !
All documents are there !

Gopal Mukherjee: The Man Who Led Hindu Resistance And Saved
Calcutta From Falling Into Pakistani Hands
It goes beyond saying that if Gopal Mukherjee had not spearheaded
the Hindu Resistance from 18 August 1946 onwards against the
State sponsored Muslim mob violence, the entire area now known as
West Bengal would have become a part of Pakistan in 1947, and
Calcutta would have been a city in the newly formed Islamic
majority state of Pakistan, which was the desired objective of
Jinnah and the Muslim league in their Direct Action Day plan.
For quite some time I have been getting requests to write a detailed
account on Gopal Mukherjee (Gopal Pantha), in the context of the
Direct Action Day, where his resistance against the Muslim League
not only saved many Hindu lives but also stopped Jinnah and the
Muslim League from getting their desired results. While
researching on the internet it was pretty disheartening to find that
not much has been documented about the man who had once
singlehandedly saved the Hindus in Kolkata during Direct Action
Day. Only in India and perhaps only among the Hindus (a large
section of which has been systematically brainwashed by the
Marxists to hate their own religion) it is possible to find such
apathy, almost bordering on irreverence, towards their own savior
heroes.
Gopal Patha built army to save Hindus, met Gandhi too: grandson
on Great Calcutta Killings
Grandson Santanu Mukherjee says a Bollywood director recently
sent his team to speak to him about a Gopal Patha biopic. ‘If I agree
with the portrayal, will say yes’.
Kolkata: Sitting in his office in Malanga Lane, opposite Ganesh
Chandra Avenue, in Central Kolkata, Santanu Mukherjee, 44,
points to the greying pictures on the wall. In most of them is a man
infamously known as Gopal Patha, a key figure during the Great
Calcutta Killings of August 1946, but has since then been consigned
to the dustbins of history.
Gopal Patha, or Gopal Mukherjee, is Santanu Mukherjee’s
grandfather and on the 77th anniversary of the Great Calcutta
Killings that began on 16 August, 1946, Santanu told ThePrint that
it was high time his grandfather’s name was cleared.
“My grandfather took up arms during the Great Calcutta Killings
to save Hindus from marauding Muslim rioters that were killing
men, raping women and burning down Hindu properties. But he
bore no ill will towards Muslims,” said Santanu, a businessman and
social worker.

Mewat- Nuhu burnt today!
Some will accuse me why go in past history but as a historian I have
to for what Mewat was in 15th century and what it is today one
must know and why so?
Hassan Khan Mewati had fought from the side of Rana Sanga
against Babar who after victory burnt Mewat as a punishment.
Mewatis continued their revolts against Mughals. In 1857 both
Hindus and Muslims fought many battles together against British.
Than came divide and rule. Muslim League made entry and
Congress failed miserably in this region. In 1947, there emerged a
demand of Mewatistan !
The punjab C M ,Bhargav got the leader of this demand arrested by
Delhi police ,all bank accounts were frozen and properties
sealed,including a school.
On this there are letters in Selected Works of Nehru written to
Punjab CM.Jist is Nehru objects to the arrest And questions why
Delhi police was used; demands bank accounts to be unblocked and
properties returned.
Most important is when he writes that he had sent Sriprakash to
meet this leader in jail who told Nehru on return that " He is more
useful for us outside".

Truth Behind the 1980 Moradabad Riots: Judge Saxena’s Report
Recently, the Yogi government brought to light the long-suppressed
report on the 1980 Moradabad riots. The 1980 riots in UP were a
tragic episode that scarred the region’s history. After languishing in
obscurity for 43 years, the report penned by retired judge Justice
MP Saxena uncovers the truth behind the turmoil that gripped
Moradabad, Uttar Pradesh. Moreover, the landmark act of placing
this report before public scrutiny defines the transparency of CM
Yogi Adityanath.
Judge Saxena’s report of 1983 unveils the events responsible for the
communal violence in 1980. Initially, the Congress government
commissioned the report during CM VP Singh’s leadership. The
document delves into the root causes and their domino effect
leading to the 1980 riots. Despite being completed in 1983,
successive administrations across various political spectrums chose
to keep the document concealed. CM Yogi Adityanath’s act of
breaking this silent suppression of the truth signifies a significant
shift toward transparency in the state.
Muslim League Behind 1980 Moradabad Riots, Confirms Justice
MP Saxena Commission Report - The Pamphlet
PC The Pamphlet
The 1980 Moradabad riots claimed approximately 100 lives. The
recent disclosure of Judge Saxena’s report adds clarity to the
cascade of events during that fateful day on 13th August 1980.
Surprisingly, the report absolves the RSS and the BJP of any role in
the violence. Instead, it shines a spotlight on the actions of Mr.
Shamim Ahmed Khan and other Muslim League leaders for using
divisive political maneuvers to gain voter support.
The Dirty Waters of Divisive Politics
The report chronicles a sequence of events that escalated into
violence. It clearly redefines the complexities of the situation in the
region during that fateful year. In 1980, Moradabad was
experiencing sporadic bouts of communal tension before the Idgah
incident. Muslim League’s Dr. Shamim Ahmed Khan deliberately
escalated political tensions to challenge the influence of Congress
party’s Hafiz Mohammed Siddiqui.
Moradabad Riots Report: 2 Muslim League leaders plotted the 1980
riots that killed 83; RSS, BJP exonerated
PC Organiser.org
THE REPORT CLEARLY IDENTIFIES THE KEY INCIDENTS
THAT WERE A TRIGGER FOR THE BROADER UNREST IN
UP. ADDITIONALLY, IT SHOWS HOW THESE INCIDENTS
WERE ENGINEERED TO IGNITE COMMUNAL SENTIMENTS
AND MANIPULATE PUBLIC PERCEPTION.
While the report highlights the innocence of the police personnel
and Hindus despite provocations, it also underscores the
manipulative strategies and deep hatred in the hearts of the
‘peacefuls’ of India. The subsequent extrapolation of this hatred
leading to lynching and riots is left to the imagination of the
intelligent mind.
Unveiling the Reality of the Riots
Judge Saxena’s report exposes a tale of political opportunism and
the exploitation of societal fault lines in the state. The report goes
back to reveal events, like the abduction and gang rape of a Valmiki
girl in May 1980, that were the tiny triggers to the subsequent
escalation of tensions. Furthermore, the report unravels the
intricate tapestry of factors, like the propagation of misinformation
and severe communal distrust in the hearts of ‘peacefuls’, that
contributed to the eruption of violence in Uttar Pradesh.
Key Takeaways from Justice Saxena’s Report of 1983
Moradabad Muslim Massacre 1980 :
The Leader Hindi
PC The Leader India
The policemen were assaulted first by a Muslim mob outside an
Idgah. The police shootings were a result of mon lynching of
security personnel. Lack of evidence on the presence of the ‘pig in
the Idgah’. Use of religious divide by Politicians and anti-social
elements. No RSS or BJP members were responsible for the events.
Leaders of the Muslim League gradually escalated tensions to sway
Muslim votes. The true cause was an engineered misinformation
campaign. The incidents escalated due to the hatred fostered in the
minds of a certain ‘peaceful’ community in India. The real culprit
was the deep communal divide encouraged in the state.
Conclusion
Judge Saxena’s report intricately details the path of the riots.
Moreover, it underscores the critical fact that Hindus or security
forces were never ones to incite violence in Bharat. The prolonged
concealment of the report raises pressing questions about the
obligation of those in positions of power. The incendiary report
bares the true face of political leaders and their use of religious
faultlines to gain momentum. The revelations offered by the report
illuminate the events of the past; however, they also serve as a
reminder to Hindus and the government. The report shows the easy
acceptance of violence as an answer in certain sections and
communities in India. The act of suppression of this report also
highlights the fake victimhood practiced by ‘peacefuls’.
Additionally, it defines the way Hindus or security forces are used
as scapegoats by governments and politicians.
By unveiling this report, CM Yogi Adityanath, and his
administration have taken a significant step towards acknowledging
historical realities, irrespective of their implications. The public
release of the 1980 Moradabad riots report is a pivotal step towards
the closure of a chapter of Indian history that was veiled in secrecy.
Thus, as Uttar Pradesh turns its back on regressive and divisive
politics, the report offers lessons of unity, transparency, and
accountability for a harmonious future for India.

How General Thimayya stood up to Nehru’s Chief Minister for the
honour of a woman
Our valiant Indian Army has always shown exemplary courage in
protecting the nation from external enemies. At the Siachen glacier,
temperatures can dip to -50 degrees Celsius. In the Thar desert of
Rajasthan, the temperature can soar to 50 degrees Celsius. Imagine
what would happen to us, to our family and our friends, to our
homes and the things we love, if the Indian Army took a day off.
But our Indian Army also has a glorious tradition of standing up for
all that is fair and just and good within the country. An earthquake,
landslide or flood? The Army is there. A giant international
sporting competition is about to start in a few days and the
infrastructure is still not ready because economist Prime Minister
and his greedy colleagues ate all the money? Don’t worry, the
Indian Army will build the suspension bridge in a matter of hours
to save India the blushes before foreign visitors.
I was saving this story to tell it on Army Day. It is about the
legendary General Thimayya, one of Nehru’s most powerful Chief
Ministers and the honor of a woman. I first came across this story
somewhere on Facebook. Intrigued, I looked everywhere for a
reference, until I found the definitive version from Maj. Gen. Dhruv
C Katoch published in the magazine “Salute to the Indian soldier.”
The year was 1959 and the place was Amritsar, where 5 Jat was
posted at the time. Some of the officers and their wives had gone to
the railway station to see off an officer and his wife who was going
away on duty. At the railway station, there were some goons who
passed lewd remarks and actually tried to molest the women. Not
surprisingly, the officers of the unit began chasing the goons, who
ran away and tried to hide in a nearby cinema hall.
The Commanding Officer of the unit was one Colonel Jyoti Mohan
Sen, who on learning about the incident, immediately sent
reinforcements to surround the cinema hall from all sides. The
goons were captured and detained inside the Army Camp.
Here is where the story gets interesting. What kind of goon would
be so power drunk that he would think there would no
consequences for trying to molest a woman in the presence of
officers of the Indian Army? That would be the son of Pratap Singh
Kairon, then the Chief Minister of Punjab. Veteran Congressman,
one of Nehru’s confidants.
A night in detention for the son of the Honorable Chief Minister?
Imagine the anger of Honorable Chief Minister Pratap Singh
Kairon, who on the next day, had to go personally to rescue his son.
The story even goes that he was made to walk! No VVIP vehicle!
Naturally, the matter echoed in Parliament, but not in the way you
would like it. Those were different times. Back then, democracy was
not in danger and expressing dissent was real easy.
And so it happened that an explanation was sought … not from
Chief Minister Pratap Singh Kairon, even less from his boss Bharat
Ratna Prime Minister Nehru. An explanation was sought from
Army Chief General Thimayya for the conduct of his officers.
General Thimayya’s response : “If we cannot defend the honour of
our women, how can you expect us to defend the honour of our
country?”
This Army Day, please don’t forget to pay your tribute to the Indian
soldier.

When Pandit Mountbatten's Jai 'suddenly came out of the mouths
of Indian people

"Their bodies were hurriedly taken down from the gallows. They
were dragged along the dirty passageway, chopped into pieces and
stuffed into sacks, which were then whisked out of the jail
compound surreptitiously. Outside the jail, the remains were
unceremoniously stacked on a truck. The truck made haste,
speeding northwards from Lahore to Kasur, some two hours’ drive
away....There, on the banks of the River Sutlej, the dismembered
bodies were quickly loaded onto a funeral pyre to burn fiercely in
the eerie silence of the night. Before the pyre had fully burnt out,
and as dawn threatened to break over the silent waters of the Sutlej,
the roaring fires were hastily put out. The charred remains were
then hurled into the river. The precise spot was to be later identified
as Post No. 201."

Jeeps are magical. Marvels of minimalism. The rough bumpy ride,
the defiant thrumming, the toppled windshield, flapping canvas,
sloshing jerry cans, wind in the hair, dust in the eyes,
smouldering cheroot, Lawrence of Arabia, Clint Eastwood, James
Dean, Yashpal Kapur…
Yashpal who?
1971 was a momentous year in our history. India was celebrating its
silver jubilee. The general elections that took place a few months
prior to the Bangladesh war had provided a battle cry that sounded
as hollow as it was shrill: Garibi Hatao. Yet again, the nation got
fooled, perhaps lulled into believing its progenitor – Indira Gandhi.
She won a resounding victory. We have been poor since.
Raj Narain, her adversary for the keenly contested Lok Sabha seat
of Rai Bareli, nearly lost his deposit, a cliché uttered with
merriment by the newspapers back then. But the plucky, bandana-
wearing socialist, born in the same year as Indira Gandhi, had other
ideas. An incorrigible litigant, he went to court alleging that Mrs
Gandhi had deployed government jeeps during canvassing, thereby
violating the code of conduct.
That’s right – wipe away those tears of mirth, for those were the
days we couldn’t count beyond a handful of illegal zeroes. There
was no class distinction for there was no middle class. Crony
capitalism didn’t exist because capitalism didn’t. Tellingly, our
cricketers didn’t drive Humvees, they shop-lifted undergarments.
Still, the charge of appropriating a few jeeps – 23 to be precise – for
the purposes of election canvassing seemed laughable.
Justice William George Broome of the Allahabad High Court
thought otherwise. One of the last few remaining Englishmen living
out their sun-kissed days in post-colonial India, Justice Broome
inadvertently set in motion events that heralded the most shameful
chapter in our young history.
It all began like this. In the first week of March 1971, Raj Narain
and Indira Gandhi crossed swords for the Rai Bareli seat. Mrs
Gandhi won handsomely (with a margin of 1,11,810 votes). A month
later, on April 24, 1971 Narain filed a petition in the Allahabad
High Court challenging Mrs Gandhi’s election on the grounds that
she had indulged in corrupt practices. No, not for promoting her kin
to positions of limitless power or indulging in shady arms deals, but
rather for using official jeeps for canvassing.
Raj Narain alleged that Yashpal Kapur – a gazetted officer who
claimed to have retired by the time his expert services were availed
of by Mrs Gandhi – had shamelessly distributed quilts, dhotis and
alcohol among the voters as an inducement. He had also hired and
procured a number of vehicles for the free conveyance of electors to
the polling stations.
It was this last allegation that changed the course of India’s history.
But first, the chain of events.
On February 24, 1971, Dal Bahadur Singh, President of the District
Congress Committee, Rae Bareli, wrote a letter to Yashpal Kapur,
in which he commanded Kapur to ask the Electoral Officer to
release some jeeps. Dal Bahadur was incensed as this gutsy officer
had earlier denied Dal Bahadur’s request on the grounds that “it
was not possible to release the vehicles in favour of any party for
election purposes”.
“I’ll show him!” Dal Bahadur must have thought.
Kapur duly obliged but made a grievous error while wording his
letter – understandable as he was a gazetted officer. He not only
asked the Election Officer to release the 23 vehicles without delay
but also stated that the vehicles in question had already been taken
by the District Congress Committee.
Tense confusion and truth blurtings aside, this time round the letter
had come from none other than the Prime Minister’s election agent,
and the poor election officer had no option but to “release” the
vehicles that had already been released.
It may come as a surprise to many but back then our politicians
thought it fit to act on their own advice and not their lawyer’s. The
legacy, after all, was of stalwarts like Mahatma Gandhi and
Jawaharlal Nehru and countless others who had fought their own
cases – stood before the judge and given speeches that moved
nations into submission. Who needs a lawyer? Not to be outdone by
her electoral agent’s gaffe, Mrs Gandhi gave it in writing to the
court that indeed those 23 jeeps had been used by the District
Congress Committee Rae Bareli for election purposes in the
constituencies of Rae Bareli, Amethi and Ram Sanehi Ghat.
Mishtake!
Raj Narain Vs Smt. Indira Gandhi & Others
Verdict: Allahabad High Court (http://indiankanoon.org/doc/689646/)
Date: September 14, 1971
Bench: Justice WG Broome
The first of many judges to have contributed to Smt Indira Gandhi
& Others’ downfall was Justice BN Lokur. The hearings began on
July 15, 1971 and it wasn’t long before Raj Narain demanded that
none other than Smt Indira Gandhi should depose before the
Allahabad High Court. Justice Lokur rejected Narain’s request
outright. He also rejected Narain’s appeal for the many
“incriminating” books and documents of the respondent (Mrs
Gandhi) to be placed before the court. Before the issue could be
taken further, there was a small matter of constitutional reading.
Justice Broome swept in gladly to oblige.
“The petitioner”, said Justice Broome, “has applied for leave to
deliver interrogatories in writing for the examination of respondent
and for a direction to respondent to make discovery on oath of the
documents which are or have been in her possession or power relating
to the questions arising in the petition. The arguments advanced on
both sides have ranged over a wide field of both English and Indian
law, but I shall endeavour to deal with them as succinctly as possible.”
Succinctness, wit, erudition – Justice Broome then went on to
display each of these qualities in equal measure, quoting liberally
from judgments delivered centuries ago. And why not – aren’t
Newton’s laws still valid?
“…After jurisdiction was conferred by the Parliamentary Elections
Act, 1868, the court continued to follow the principles, practice and
rules on which committees of the House of Commons had previously
acted in dealing with election petitions; and as pointed out in Wells v.
Wren, (1880) it is admitted that the exhibition of interrogatories to the
sitting member by an election committee was a thing unheard of.
When elections were introduced in India, however, there was a radical
departure from this principle…”
“…The respondent says that the petitioner should not be allowed to
supplement these particulars by resorting to discovery. But this
argument is misconceived, for discovery has nothing to do with
supplementing the petitioner’s pleadings; its object is to elicit
admissions from the respondent that may obviate the necessity for
producing lengthy evidence when the time comes to examine
witnesses.”
“…It is no doubt true that the Indian electoral law has been largely
modelled on the corresponding English statutes; but that does not
mean that English Common Law doctrines must be followed when
interpreting the Indian Law. An objection that an order for discovery
of documents might tend to incriminate the party ordered is not
sufficient to give immunity from discovery. To sum up, I find that in
India there is no warrant for following the English practice of
disallowing discovery in the trial of election petitions.”
“…Accordingly I grant leave to the petitioner to deliver the
accompanying interrogatories for the examination of respondent. I
also direct the respondent to make discovery on oath of the documents
which are or have been in her possession or power. The affidavit in
reply to this also shall be filed by October 4, 1971.”
Too late. Smt Gandhi & Others promptly approached the Supreme
Court that, much to their ire, sided with Raj Narain. In Allahabad,
however, something else was brewing, something to do with a little
blue book.
Raj Narain Vs Smt Indira Gandhi & Others
Verdict: Allahabad High Court (http://indiankanoon.org/doc/431532/)
Date: March 20, 1974
Bench: Justice KN Srivastava
It appears Mrs. Gandhi was hell-bent on denying Raj Narain and
the court a dekko at some documents that included, bizarrely, a
“blue book”. The judge wasn’t too pleased with this stand.
“In this election petition”, said Justice Srivastava, “privilege has been
claimed [by the respondent, Mrs Gandhi] regarding three sets of
documents, including copy of a blue book with the title as Rules and
Instructions for the Protection of Prime Minister when on Tour or in
Travel. It shall hereinafter be called as the blue book…The Union
Government itself disclosed a part of this blue book, on the top of
which the word Secret is printed. The blue book is not an unpublished
official record. The State cannot be permitted to have two yardsticks
for two different individuals.”
“…Unless the blue book is made available to him, the petitioner
cannot be in a position to efficiently cross-examine the respondent’s
witnesses. It is, therefore, just, equitable and in accordance with the
principle of natural justice that the claim of privilege regarding the
blue book and other papers which are correlated with the blue book be
rejected.”
Mrs Gandhi would hear none of it. She approached the Supreme
Court again, demanding that the blue book not be shown as
evidence during the trial. The year was 1974 and having purged her
dissenters, rebuffed Nixon, broken Pakistan in two, exploded an
atomic bomb, she was invincible. Indira was India and India was
Indira.
A five-judge bench heard her plea and, unexpectedly, disregarded
all previous judgments. Mrs Gandhi had won the right to hide the
blue book. Her victory, though, was short-lived. The Supreme
Court, while pronouncing its verdict, also directed the case to be
heard afresh by a single judge of the Allahabad High Court.
Remember the name, if only for the sake of freedom and posterity:
Justice Jagmohan Lal Sinha.
On June 12, 1975, in a jam-packed courtroom, under long-stemmed
ceiling fans that pretended to bring relief from the unbearable heat,
Justice Jagmohan Lal Sinha found the sitting Prime Minister of
India Mrs Indira Gandhi guilty. He declared her election “null and
void” and forbade her from fighting elections for six years.
In his brilliant essay, Justice with a Fine Balance, the noted lawyer
AG Noorani discloses the concluding words of Justice Sinha: “I
regret my inability to accept her evidence, on one point; her plea has
no legs to stand on, on another; and that it does not bear any scrutiny,
on a third.”
“Justice Sinha”, wrote Noorani, “was heir to the older tradition –
dispensing justice according to the law, not personal whim or
political philosophy. They do not make men like him any more.”
Years later, Mrs Gandhi would call Justice Sinha “a petty judge”.
That was years later. On that hot June day, however, after
expressing her dismay and anger to BBC’s Mark Tully in a rare
interview, she promptly trundled off to the Supreme Court yet
again. This was because Justice Sinha had stayed his judgment for
20 days to allow the Congress party to elect a successor. Exactly the
window Mrs Gandhi needed. Her appeal to the Supreme Court was
for an “absolute stay” on the judgment.
The Supreme Court was on vacation. One judge was available,
though – and this would have pleased Mrs Gandhi.
Little did she know.
Smt. Indira Nehru Gandhi Vs Raj Narain & Another
Verdict: Supreme Court (http://www.indiankanoon.org/doc/1240174/)
Date: June 24, 1975
Bench: Justice VR Krishna Iyer
“When Krishna Iyer speaks”, said Fali S Nariman once, “the nation
listens.” Nariman has a point. Author of 105 books, a polymath, a
communist, a politician, a veena enthusiast, a humanist, a patriot,
and lastly a judge who abhorred vacation, Justice Iyer came up with
a judgment astonishing in its scope and alacrity.
“While the right to appeal is statutory”, said Justice Iyer, “the power
to stay is discretionary. But judicial discretion – indeed, even executive
discretion – cannot run riot. Judicial power is dynamic, forward
looking, socially lucent and aware. The Court is the quiet of the storm
centre and views with an equal eye the claims on each side. The High
Court and its finding, until upset, holds good, however weak it may
ultimately prove.”
“…I hereby pass a stay of the order of the High Court under appeal.
The petitioner will remain a Member of the Lok Sabha, will be entitled
to sign the Register kept in the House for that purpose and attend the
Sessions of the Lok Sabha, but she will neither participate in the
proceedings nor vote nor draw remuneration in her capacity as
Member of the Lok Sabha.”
This was anything but the “absolute stay” Mrs Gandhi had wished
for. Her anger was palpable. Fascism beckoned her, placing in her
shaky hands the collection of long knives for the night ahead. At
precisely midnight, June 25, 1975, she declared a state of
Emergency. In the following days and months, all inconvenient
judgments were overturned mercilessly at her behest, and new ones
– that were inconvenient to the people of India – set in stone.
What is justice if not the most sacrosanct invention of man? And
what is fascism if not a total contempt for it? For five long years, the
Prime Minister of India, the servant of its people, tried every trick
in the book to thwart justice, and when all else failed, this servant of
the people became their overarching monarch, crashing down
millions of unfulfilled dreams and promises. Fittingly, there is an
airport named in her memory.
Oh, and Yashpal Kapur, the one who started it all by providing the
jeeps, went on to become, just like his nephew RK Dhawan later on,
an honourable member of the Rajya Sabha.

Raja Rammohan Roy(1772-1831) was an Indian social reformer,
linguist, educationist, historian & public intellectual. He is regarded
as the father, or rather, prophet of modern India. It was his
teachings, ideals and beliefs that led to the onset of a truly modern
India.
Remarkable Educationist
Roy was a remarkable educationist, he was instrumental in
establishing two renowned institutions of higher education in
Bengal in the late 19th century- Hindu college(now Presidency
University) in 1817 and Vedanta College in 1825.
A British Stooge?
To many Rammohan may appear to be a British stooge and rightly
so. He was heavily influenced by British ideals and principles and
believed that British rule would be a good thing for India. He even
to the extent of arguing that British rule was a noble act of divine
providence.
I was home next day. Big beautiful house. Loving parents, but
always under stress of business. I am going to meet Nanaji

Next day, I was playing video game in my room. Nanaji came, sat
besides me.

I : No.

“Mukhtar Bhai only is leading the mob, Lala Ji. All Hindu-Sikhs
are fleeing to India. Will go in lots of 300-400 people in an hour. Get
family to city Gurudwara fast”, the Sikh shouted and fled.
Prabhavati : It’s not time to discuss ideas. We must go. I have asked
daughters to pack jewellery and papers.
Balwant : But Mukhtar Bhai… I have to talk to him.
Prabhavati : He came last month when you were not home. He told
Salim likes Lajjo and wanted to do Nikah with her. Lajjo told that
Salim eve-teases her with his friends. She has stopped going out
because of him.
Balwant : Why didn’t you tell this earlier? I could have talked to
Mukhtar Bhai.
Prabhavati : You are too naive. He himself wanted to take Lajjo for
Salim. Now he is coming to take her by force. Let’s leave.
Suddenly, a huge cry broke the silence. It came from the Badi
Masjid from across the road. A mob of thousands was shouting
slogans-
The mob with swords, daggers, spears and chains was approaching
the Gurudwara. Prabhavati was first to witness from the window.
She shouted – “They are coming” and held all her kids tightly in
fear.
“They are coming for our mothers, sisters, wives and daughters.
Their swords are for our necks. They will ask us to convert to their
faith and surrender. I have decided. I won’t surrender. I won’t
convert. Neither shall I allow them to touch our women.”
There was a pin drop silence for 3 seconds. And the Hindu-Sikhs
roared
“Jo bole so nihaal sat Shri Akaal! Wahe Guru Ji da Khalsa waahe
Guru Ji di fateh! No one will leave Dharma of our ancestors. Let
them taste our swords”.
Mob had entered the Gurudwara. The first lot of 50-60 attackers
was slaughtered in no time. People inside Gurudwara were
prepared and in better position for small mob. There was hardly
any casualty on this side. Hall of women & children was locked
from inside.
This had to be the final battle. The mob had displayed a Sikh
woman they abducted from her home being dragged in front of
everyone. Her clothes had been torn. She was being paraded naked
while the men were cheering assaulting her sensitive organs. She fell
unconscious. But many vultures from mob kept playing with her
body. Finally, someone cut off her breasts and threw them towards
Gurudwara.
Lajjo : Tusi katto bapuji, Main Musalmaanani nahi banugi (go ahead
father, I won’t go to a Muslim)
Lajjo : Karo bapuji, te bhajjo jaldi etho (do it father, and run)
Lajjo : If you don’t, they will cut my breas…(thak, the sword struck
Lajjo’s neck)
Lajjo’s head rolled down the well. Balwant’s strike of sword was
accurate. Her headless body was pushed down the well too. Now the
mob could not touch her clothes. Nobody could cut her…. She was
liberated.
Then Bhaggo’s.
Then Paro’s.
Then Gayo’s.
Then Isho’s.
and finally, Urmi’s.
The father would kiss forehead of each and take the head next.
Balwant liberated his seven daughters on 18th Sep 1947. The mobs
chanting religious slogans were so close to the 7 sisters. But their
father could manage to save them. What if the cost he paid was
their lives? At least their breasts were intact. Their honour was
intact. Their freedom was intact.
Even the remaining bodies were fed to the well because even the
dead bodies of girls were not safe.
Balwant : You are going with Baldev and the unborn. I will come in
next lot. Lalaji and few men are taking you to station.
Balwant kissed her forehead, hugged Baldev and gently caressed the
unborn. “Hurry up”.
Balwant had lost sanity. He was perhaps the only father to have
killed seven of own children in order to protect them from
something more gruesome. With trembling legs, he went to the well
and shouted – “Two kids have their mother with them. 7 kids here
must have their father. Jai Shri Krishna..”
Balwant had stabbed himself and jumped into the well. This man
gave 7 Padminis to the society.
Please keep my story in mind when you read my next article on why
CAA-NRC is must for India and its survival.
Wrote this on insistence of my close friend, a scientist in US. This is
his story. Have used some creative freedom to make it presentable
to common people. Reality was way too disturbing.
Millions were butchered and raped with same slogans in 1947, 1971
& 1990. Deliberately using these chants today in opposing an Act
meant to provide security to persecuted minorities of Pakistan is no
coincidence. It is clear warning to a Hindu survivor of 1947 violence
like me some of whose ancestors were fortunate enough to escape
death in Gujranwala. “We will catch you in Delhi if you help
remaining Hindus of Gujranwala today.”
Q. Look look, how can a secular India promise citizenship only to Non-
Muslims? CAA is anti-Muslim.
Q. But under CAA, only Non-Muslims are included. Why not Muslims?
A. Why are there so many fools in the world? Let them be fools.
You must be smart. Dr Ambedkar’s constitution is for all Indians.
85% of Pak Hindus are Dalits, tribals and backward classes. They
are treated as untouchables in Pak. There are separate water-taps
for Hindu kids at schools. Why is it that an Act that has been
introduced to give relief to millions of Dalits is being opposed tooth
and nail in name of Dr B R Ambdekar? Is it not akin to pushing a
drowning kid further down and dedicating the act to his helpless
father?
‘We were kept chained up after work, sometimes for days even, in a
dark room without food,’ recalled Kasturi, a bonded labour. Image
& caption by FARAS GHANI/AL JAZEERA
And no, it’s not an act of few. Pakistan’s state promotes trapping
and conversion of Non-Muslim girls to Islam. Read this to know
how abduction, rape and conversion of Hindu girls is encouraged
through Pak movies.
Hindu daughters abducted, forcibly converted to Islam and married
off to Muslim men. More than 1000 Non-Muslim girls are taken
every year in Pakistan. They never come back.
No, it’s not the act of ‘few’. Pakistan officially declares Non-
Muslims as 2nd class citizens. No Non-Muslim can become
PM/President/Army Chief as per Pak constitution. Pak sitting
ministers openly mock Hindus and call them as ‘idolaters’ & ‘cow-
piss drinkers’.
Q. Look, majority of Muslims i.e. Sunnis are safe. But minority sects like
Shia and Ahmadi are persecuted there. Why not include them in CAA?
And just like you don’t have issues with Saudis having anti-Non-
Muslim laws, you shouldn’t have issues with a law that was passed

A. Then love India. Respect its laws, stop burning buses and stop
crying for Pakistani Muslims. Stop crying for Palestinian Muslims.
Q. Yes.
Q.
A. Why silent? (silent because as per CAA protestors, Jannat only
belongs to a particular Mazhab)
Q.
A. Few minutes ago you were saying you don’t care about what
Muslim countries do. Now you seem worried when CAA exposes
persecution of three Muslim countries towards Non-Muslims. Time
to reject hypocrisy.
How many times did you burn buses-trains, attack police and ask
law-makers – “why are not Hindus of India given right to marry 4
women like Muslims”? You went too far till Sri Lanka! Are you
really burning India in name of protest because you care about
Tamil Hindus of Sri Lanka?
“…fact that the areas which the Muslims want to be separated from
India (Pak-Ban) have always been a part of India. Historically this
is, no doubt, true. This area was a part of India when Chandragupta
was the ruler; it continued to be a part of India when Hsuan Tsang,
the Chinese pilgrim, visited India in the 7th century A. D. In his
diary, Hsuan Tsang has recorded that India was divided into five
divisions or to use his language, there were ‘five Indies’ : (1)
Northern India, (2) Western India, (3) Central India, (4) Eastern
India and (5) Southern India and that these five divisions contained
80 kingdoms.
According to Hsuan Tsang, Northern India comprised the Punjab
proper, including Kashmir and the adjoining hill States with
the whole of Eastern Afghanistan beyond the Indus, and the present
Cis-Satlaj States to the west of the Sarasvati river. Thus, in
Northern India there were included the districts of Kabul,
Jallalabad (both in today’s Afghanistan), Peshawar, Ghazni (Af)
and Bannu, which were all subject to the ruler of Kapisa, who was a
Hindu Kshatriya and whose capital was most probably at Charikar,
27 miles from Kabul. In the Punjab proper, the hilly districts
Taxila, Singhapura, Urasa, Punch and Rajaori, were subject to the
Raja of Kashmir; while the whole of the plains, including Multan
and Shorkot, were dependent on the ruler of Taki or Sangala, near
Lahore. Such was the extent of the northern boundary of India at
the time when Hsuan Tsang came on his pilgrimage.
It is true that when Hsuan Tsang came, not only the Punjab but
what is now Afghanistan was part of India and further, the people
of the Punjab and Afghanistan were either Vedic or Buddhist by
religion. But what has happened since Hsuan Tsang left India?”

A. And our patience has been burned in past and present invasions,
rape, massacre and conversion of Crores. We don’t have patience
for illegal occupants anymore. Show documents or leave.
