BRIEF BACKGROUND OF THE ORGANISATION/INDIVISUAL.

“Mr. Ashish Shrivastava, presently Senior Advocate, and former (first and youngest) Advocate
General of the State of Chhattisgarh. He is regularly engaged by the State Government of
Chhattisgarh, State Government of Madhya Pradesh, State Government of Uttar Pradesh as
Senior Counsel to argue important cases in the Supreme Court. He was especially engaged by the
Government of India, Ministry of Human Resource Development to argue important cases in the
High Court of Allahabad and Andhra Pradesh.”
“For the last 20 years or more advising and representing Dow Chemicals, the USA in
environmental matters in the High Court and Supreme Court as well as liability litigation arising
out of Bhopal Gas litigation. Recently appeared for another multinational Cott Beverages Inc,

LEARNING OBJECTIVES.

1. To learn how files are kept and how records are kept, I was required to study at
least four case files.

2. I was given the responsibility of watching the Examination-in-Chief, Cross-


Examination, and Final Arguments in support of the attorneys who attend the
programme and office.

3. Attending meetings and appointments and providing support as needed. Work


related to office organisation, such as photocopying, filing, and desk organisation.

4. Reviewing any recommended legal resources for my personal benefit. Given that I
don't yet have a lot of experience in the pitch, I would like to assist clients if I am able
to.

5. Speaking with numerous attorneys in our office. study of decisions involving the
case's facts.

DESCRIPTION OF THE STUDY.

Second week- On my second week in court, I was asked to sit and observe proceedings. As
I was a party to the case, involvement to the case was the most intriguing part of my whole
internship when providing old judgments to the lawyers so that they could relate it with the case.
The judge also heard from other witnesses, experts, or lawyers, and asked questions or made
rulings on various issues related to the case.
I also got the opportunity to speak with your lawyer and other legal representatives to discuss the
case and my opinions carried forward. It's important to follow all courtroom rules and
procedures, and to be respectful of the judge and other parties involved in the case.
Overall, every court experience is unique and can vary depending on the nature of the case and
the specific court we are in. It's important to seek guidance from a qualified legal professional for
specific advice related to your situation.

Third week-On my third week in High court, I became familiar with the layout of the
building and the basic procedures of the court. I had spent the first few days observing
proceedings and learning about the different types of cases that are heard in the high court.
Depending on the nature of the case we were involved in, my third week in high court involved
further witness testimony, cross-examination, and the presentation of evidence. I also had the
opportunity to hear arguments from the opposing counsel and to present your own arguments
before the judge.
Throughout the proceedings, I was asked to maintain a professional demeanor and to adhere to
the court's rules and procedures. I also worked closely with my legal team to prepare and review
documents, gather evidence, and strategize my case.
Overall, my third week in high court can be both exciting and challenging as you continue to
navigate the legal system and work towards a favorable outcome in our case.

Fourth week- On my fourth day in high court, I continued to observe proceedings if we


were not a party to the case. If we were a party, we were required to provide additional testimony
or evidence. The judge may also hear from other witnesses, experts, or lawyers, and may make
rulings or decisions based on the evidence presented.
In some cases, there may be arguments made by both sides, with lawyers presenting their cases
to the judge. The judge may ask questions or clarify certain points and may ultimately decide or
provide a ruling.
It's important to follow all courtroom rules and procedures, and to be respectful of the judge and
other parties involved in the case. I also had the opportunity to speak with your lawyer or legal
representatives to discuss the case and your options moving forward.

EXPERIENCE GAINED DURING THE INTERNSHIP

The High Court as it actually exists differs from how it is typically portrayed in movies. In
movies, a lawyer's job is more like a detective's, which is very different from the reality. Just
assisting a party in a lawsuit regarding the proceedings and appearing before the judge on his
behalf is the role of a lawyer. Every lawyer keeps a court journal, which has proven to be
convenient and very valuable since all the case's specifics are recorded there with the correct date
and petition number. It works well because the lawyer records the relevant cases date-wise,
which saves time when thinking about and looking up the cases in light of the current moment.
While I was an intern,I learned to maintain the lawyer's diary. It was a learning experience as
Juniors take one year for learning the court proceedings which I could learn during the period of
internship.

Even if a month wasn't long enough, it was enough to learn the basics. Only in trial court can one
learn the fundamentals. I now understand the fundamentals of drafting. I learned about
LokAdalat, an up-and-coming idea, and Fast Track Court. I made a lot of effort to learn. For me,
it was exciting since nothing was predictable. Every customer has a unique case, unique
circumstance, and a unique problem for which there is no ideal solution. I also felt the emotions
and ideas that the Honorable Judges were thinking. When they are in a good mood, they will
instruct you on how to carry out tasks properly; nevertheless, if they are not, they will reprimand
you for making apparent errors.About advocates I experiences that it is not easy to work as an
advocate, it requires a lot of dedication and hard work, only then you can achieve success, and
most importantly social recognition.

CONCLUSION.

As is illustrated by the above detailed report of my internship, I was handed a lot of work to do
which I was able to handle responsibly. My internship experience was varied and included
making research notes and doing research on important and tricky propositions of law. In
addition, I was required to make numerous searches online to find a case or an order of a court
for the perusal of the lawyers at the office of my internship. What is more, I actively used various
legal databases for my research. In this regard, I was lucky to have remote access to Symbiosis
Law School’s E-library access which meant that I could access legal databases such as
SCCONLINE or MANUPATRA anywhere. Further, I was required to go through case files and
read them. I was also required to check and proofread the documents and annexures that were to
go before the courts. I was assigned by my immidiate seniors to read Files which were to be
presented in court so that to have an idea about what is going to happen in court specifically in
the next hearing of a case.

Perhaps the most challenging part of my internship was the work I was given for drafting. I was
tasked with preparing the list of dates in a number of petitions that were to go before the Hon’ble
High Court of Chhattisgarh. This helped in paying attention to details of a particular case. In
addition, I was also required at various times during the internship to draft notices. I was able to
accomplish these tasks with ease and excellence. Moreover, I was also required to sit and make
notes during client conferences which helped me in understanding the dynamics of the lawyer-
client relationship. On many occasions, I was required to accompany the office clerk to the Court
registry to see how filing is done. At other times, I was able to observe how e-filing is done. This
ultimately led to file one particular writ petition through the Chhattisgarh High Court e-filing
portal. Indeed, I was able to go through all the Chhattsigarh High Court requirements for filing
such as having bookmarked petition which is searchable and putting all the documents according
to the listing proforma available on the High Court website.

Overall, I had a valuable internship experience which taught me numerous practical aspects of
the law. It introduced me to the other side of a lawyer’s practice which includes the filing of
cases in the registry, communicating with clients etc. Finally, I learnt that as a lawyer, one must
always be on the top of one’s game in terms of reading.
