SUB:- Demand Notice for recovery of the dues of Rs 78,250/-

Dear Sir,
Under the specific instruction and consent on behalf of my aforesaid
clients I am inclined to address you this notice stating as follows:

1. That before purchasing the said flat being premises no ___________,


you have assured to all the flat owners that after hand over the
possession of the flat you will definitely complete the remaining works
which are mentioned below:
a. Boundary wall is incomplete,
b. Water reservoir not done properly,
c. Septic tank not done properly,
d. Garage incomplete.

2. But it is regretted to say that till
today, after 3 years from purchasing the said flat, you have failed to
complete the above mentioned remaining works.
3. That after my client’s several solicitation towards you, my client’s
perception that you will take initiative to complete the remaining
works but you did not bother to do the same.
4. That after passing of several years my client did not get their
Completion Certificate till today from you but it is your liability to
handover the Completion Certificate within stipulated time.
5. It is pertinent to inform you that the Real Estate (Regulation And
Development) Act, 2016 under section 14(3) says:

“ in case any structural defect or any other defect in workmanship,


quality or provision of services or any other obligations of the promoter
as per the agreement of sale relating to such development is brought to
the notice of the promoter within a period of five years by the allottee
from the date of handing over possession, it shall be the duty of the
promoter to rectify such defects without further charge, within thirty
days, and in the event of promoter’s failure to rectify such defects
within such time, the aggrieved allottees shall be entitled to receive
appropriate compensation in the manner as provided under law.”

6. I therefore on behalf of my above mentioned client call upon you to


take initiative for rectifying such defects without further charge and
handover the completion certificate within thirty days after receiving
this legal notice.

7. Please further note that if you do not agree to any of the requirements as
aforesaid, it would be painful necessity on my above-named client to
institute a suit against you for compensation on the expiry of 30 (thirty)
days from the date of receipt hereof together with all consequential reliefs.
