KMS3084 Employment Laws (Tutorial 3)

1) Kanapalan has serious attendance issues due to sick leave. Sometime he just do
not turn up and proclaim that he is not feeling well and only stay home to have a
good rest. Discuss how are you going to manage this issue.

2) Shamsiah always comes late to work and sometiem go back earlier. If you are the
HR Manager of the organization, how are you going to manage this situation?

3) Siaw Lan perform badly in her new job responsibilities as Quality Assurance
Manager. She got promotion last 6 months because she performs her job very well
as Quality Assurance Senior Executive and her previous manager has resigned
too. Do propose way to manage this situation in future.

4) You have been appointed as the panel of domestic inquiry. The accused person for
this domestic inquiry is your subordinate. However, you feel that it is okay
because your current job position is higher than the accused person. What is your
advice on this matter?

5) The Chairman of Domestic Inquiry panel propose a termination to the Chief


Executive Officer (CEO) during the submission of the outcome report. What is
your view on this matter?

6) The accused employee has been found guilty by the panel of domestic inquiry. The
the Management make a decision to terminate his service. The accused employee
wants to appeal for more lenient disciplinary action. What is your advice to the
Management on this situation?

7) Susan feel that her employer is rude to her when providing feedback on her yearly
appraisal. Can Susan claim this under constructive dismissal?

8) Hamzah transfer Sivabalan from HR and Admin Department at HQ to the


subsidiary company in November 2023. Then he recruited Shamsiah to replace
Sivabalan job position at HQ. Do justify whether this case warrant for
constructive dismissal or not.

9) Harrold working at the company based in Sarawak. His wife give birth to a baby
boy on 2 January 2024. He claims that he is eligible for paternity leave because
his HQ is based in Johor. What is your input on this situation?
