to provide for protection of same sex marriage in a manner that recognizes the legal rights of same sex
couples and their right to marriage along with the right of choosing their life partner and the need to
them give equal dignity in eyes of law and for the matters connected therewith or incidental thereto.

BE it enacted by the Parliament in the Seventy-fourth Year of Republic of India as follows:-

CHAPTER I
PRELIMINARY
1. (1) This Act may be called the Same Sex Marriage Protection Act, 2023.

(2) It shall be force on such date as the Central Government may, by notification in the Official Gazette,
appoint and different dates may be appointed for different provisions of this Act and any reference in any such
provision to the commencement of this Act shall be construed as a reference to coming into force of that
provision.

2. In this Act, unless the context otherwise requires,-

(a) “Man”,“Woman”, the word “man” denotes an adult with male counterpart; the word “woman” means an
adult female with a female counterpart

(b) “Homosexual” refers to the sexual attraction to individuals of ones own sexual orientation

(c) “Marriage” means recognition of a legal union between a man and a woman as husband and wife

(d) “Civil union” refers to a legal relationship between two individuals specifically for same sex couples
providing legal protection at State level without permitting them to marry

(e) “Same sex Marriage” means the the legal union between two men as husband and husband; or between two
women as wife and wife

3. Application of Act
This Act applies to any person regardless of his religion
