Booking Terms and Conditions:

Terms and conditions for the provision of services at The FREEDIVE TRIBE PH, Brgy.
Bagalangit, Mabini Batangas.

A. These Terms apply to all contracts of any kind made by the Tribe with its Guests
and apply to all reservations, bookings and agreements for accommodation,
dining, and use of all facilities at the Tribe. Once the guest provided all the
details such as names, contact number, email and proof of payment, it is
mutually agreed that you enter into a direct, legally binding contractual
relationship with the Tribe,

Reservations and Payments

B. For overnight stay, a 50% NON-REFUNDABLE down payment of the total amount
of stay and services are required for a guaranteed reservation while DAYTOUR
GUEST AND STUDENTS are required a 100% NON-REFUNDABLE payment and may
be paid through the following ways: credit card payment via Paypal (+5%
transaction fee), bank transfer, cash bank deposit and GCash. Rates are based on
dormitory type occupancy and charge as per person per bed. Balances are required
to be paid upon check-in.

C. Any additional charges due to the Tribe from the Guest for the Services shall be
paid by the Guest before check out;

D. Upon confirmation of the booking, we shall request payment details from you
such as Screenshot of bank transfer or Bank deposit slips. The Guest must also
provide the full names and contact details;

E. All personal details will be stored in line with Data Protection laws;

F. Once the Tribe confirms a reservation by any method (telephone, email message,
online booking system or other method) the Contract is conditional on the Guest
supplying valid payment information at the time of the reservation. The Tribe
may make exceptions at its discretion. The authority for charges (including any
cancellation charges) shall be levied, on the payment terms in the Schedule.

G. If the payment details are not provided to the Tribe by the Guest then the
Contract will cease to have effect, except for any liability (including any
cancellation
charges) accrued b y the Guest. The Services that had been subject to the
reservation may then be re-sold by the Tribe.

H. In case of shortened stay or room downgrade, guest is still required to

pay all balances due indicated on their booking. NO REFUNDS WILL BE
GIVEN.

Cancellation and ‘No Show’ charges

I. When you book, you agree to a contract which protects the Tribe from being left
with empty beds which they may not have time to re-sell. If you cancel 24-hours
before agreed check-in date (“late cancellation”) or fail to arrive for your booking
(“no show”), the Tribe will forfeit any deposits made. Rebooking or
Rescheduling are allowed for booking 2 days before the scheduled date.
Otherwise, the reservation is considered cancelled and down payment shall be
forfeited.

FORCE MAJEURE:

J. In rare event that we, need to cancel a booking, please be aware that we cannot
be held liable for circumstances beyond our control and that our liability is
limited to the refund of any payment already made. We may cancel the
accommodation contract under the following cases:

• When the Guest is deemed liable to conduct or has conducted

him/herself in a manner that would contravene the laws or act against
the public order and good morals in regard to the accommodation
• When the Guest seeking accommodation is carrying an infectious
disease
• When violent demands, actions or burdens that exceed the scope of
reasonable requests are made by the Guest
• When the Tribe is unable to provide accommodation due to natural
calamities and/or other causes of force majeure;
• When the Guest is liable to conduct him/herself in a manner that would
cause serious annoyance to other guests or behaves in such manner
due to intoxication or other reasons
• When the Guest does not observe prohibited actions such as smoking
in the room and other prohibitions stipulated by the Tribe to avoid the
causing of fires
• When the Guest is an Organized Crime Group, a member of such group
or related to such group.
J.1 Freedive Tribe PH will not be responsible for weather conditions, personal
emergencies or schedule changes. Tribe’s operation and all services are based on
LGU’s approval and cancellations of any outdoor activities such as diving.
Supply of the Services

K. The Tribe will supply the Services to the Guest under the Contract.

• The Guest shall at his / her own expense supply the Tribe with all
necessary information relating to the Services within sufficient time to
enable the Tribe to provide the Services in accordance with the
Contract. The Guest shall ensure the accuracy of all such information.
• The Tribe may at any time alter the Services, such as itinerary,
instructors and room reservations depending on the availability.
• to comply with statutory requirements (including those regarding
health and safety health, or
• out of unforeseen necessity, and
• in any event, provided that the standard of the Services is not
diminished.

Guest obligations

• Arrival and departure times for accommodation are indicated on the

Booking Confirmation or on the itinerary sent by the designated
Freediving Instructor.
• The Guest is responsible to ensure the good conduct of his guests in the
Tribe and, in particular to ensure that they cause no nuisance or
annoyance to any person and that they cause no personal injury or
physical damage.
• The Guest has an obligation to ensure that he does not leave or render
any part of the Tribe insecure,
• that he does nothing to cause a fire,
• that he complies with directions on all notices posted in the Tribe, such
as fire notices, and policies, such as quiet hours and the Tribe alcohol
and drug policy, and
• that he will inform the reception when he checks out the Tribe.

Liability of Tribe

• The Tribe shall have no liability to the Guest for any loss, damage, costs
or expenses or other claims for compensation arising from any
instructions supplied by the Guest which are incomplete, incorrect,
illegible, out of sequence or in the wrong order or form or arising.
 • All guests acknowledged and recognized that they must be in adequate
physical and mental health to participate in any Activities conducted by
the Tribe. Guest also understands that these activities may require
intense physical exertion, and guest represent and warrant that they
are physically fit enough to participate, and has no medical condition
which would prevent their full participation in the Activities. Guest also
recognizes that the activities may cause or aggravate a physical injury
or medical condition. Guest also understands that it is their
responsibility to consult with a physician before their participation in
any activities. If I have done so, I have taken the physician’s advice.
Tribe reserves the right to refuse your participation in any Activity on
medical, fitness, or any other grounds.

• In further consideration of being permitted to participate in the

Activities, the guest knowingly, voluntarily, and expressly waives any
“Claim” they may have against the Tribe and any of the Tribe’s
employees, independent contractors, or assistants that the guest may
sustain as a result of participating in the Activities even if the Claim
arises from the negligence of Released Party or anyone else.

• The guest agrees to indemnify and hold harmless, released the Tribe
from any loss, cost, or liability incurred in defending any Claim made
by the guest or anyone making a Claim on their behalf, even if the Claim
is alleged to or did result from the negligence of the Tribe or anyone
else.

Pet Policy

• Guests who bring dogs or other pets to the Tribe must abide by the
Tribe pet policy as described here.
• Guests may only allow their pets to urinate or defecate outside. Guests
must pick up and properly dispose of their pet’s feces at all times.
• Guests must keep their pets in sight at all times. Guests may not leave
their pets in their bedrooms unattended. Guests may not leave their
pets at the Tribe unattended. Guests may not leave the Hostel without
their pet. Pets are not allowed to sleep on the beds. Penalties applies
once violated.
• Guests are responsible for paying to repair any damages caused by
their pet, whether to the Tribe’s property, personal property of the
Tribe’s owners or staff, or to another Guest or visitor at the Tribe.
• Pets must be up to date on shots and heath (e.g. anti rabies)
• Pets who are unfriendly or create a chronic disturbance must stay
outside.
Amendments to bookings

All prices and information stated on this booking request are subject to change.
Please note that every effort has been made to ensure the accuracy of all
information. However, the Tribe does not accept responsibility for any errors or
omissions.

Payment terms
All charges incurred by the Client in the Hostel must be paid in full before you finally
depart the Hostel.

Reviews, Comments, Photos, and Other Submissions

All students agreed to have their photos and videos taken by their assigned
instructors to the Tribe which will be submitted or posted via by electronic mail, its
online platforms or otherwise, included in any reviews, photos, videos, questions,
comments, suggestions, ideas or the like. You grant FREEDIVE TRIBE PH and/or
partners through whom we provide service, a non-exclusive, royalty-free, perpetual,
transferable, irrevocable and fully sub-licensable right to

1. use, reproduce, modify, adapt, translate, distribute, publish, create derivative

works from and publicly display and perform such Submissions throughout the
world in any media, now known or hereafter devised; and

2. use the name that you submit in connection with such Submission.

You are prohibited from posting or transmitting to or from these online platforms:

1. any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other

material or content that would violate rights of publicity and/or privacy or that
would violate any law;

2. any commercial material or content (including, but not limited to, solicitation of
funds, advertising, or marketing of any good or services); and

3. any material or content that infringes, misappropriated, or violates any

copyright, trademark, patent right or other proprietary rights of any third party. You
shall be solely liable for any damages resulting from any violation of the foregoing
restrictions, or any other harm resulting from your posting of content to this
Website. You acknowledge that Freedive Tribe PH may exercise its rights (e.g. use,
publish, delete) to any content you submit without notice to you.

CHECK-IN/CHECK-OUT
Check-in after 2:00pm; check-out by 12:00 pm latest on day of departure. Early check-
in for students are allowed depending on room availability.

WI-FI
Guests accept to use this access to the internet fairly and appropriately. It is not
intended or suited for heavy media streaming, online gaming, extensive downloads
/ uploads or any illegal activity.
SMOKING
Smoking is not allowed inside the rooms, on the balconies and terraces, or in the
restaurant area. Smoking is only allowed outside in designated areas and in
accordance with local regulations. Please note that the municipality has a no
smoking policy in public areas.

We impose a penalty fee of PHP5,000 (five thousand pesos) for violating our on-site
smoking policy.
FOOD & DRINKS
Outside food and drinks are not allowed to be consumed within the property,
unless otherwise explicitly agreed with the Hotel. .

We reserve the right to cancel any booking without compensation or refund if

these terms and conditions are breached by the Guest and/or their party.
