LICENSE

This End User License Agreement (“License” or “License Agreement”) applies to the Software you are
downloading. Read the following terms and conditions carefully before installing or using this Software
(defined below). Your installation and use of this Software constitutes your acceptance of these terms and
conditions. These terms supersede and replace all previous terms and conditions between the Company
and You, unless the parties have expressly agreed in writing otherwise. For purposes of this License,
“Company” and “Kodak Alaris” shall mean collectively Kodak Alaris Inc. its affiliates, subsidiaries and
parent entities.

The term “you” means either (a) in the case of an individual, the person over the age of 18 entering into
this License, or (b) in the case of a corporation (or other legal entity), the party for whom this License is
being agreed to on behalf of an authorized person having authority to bind the party.

The term “Software” applies to the software and/or firmware components you install, as well as software
components hosted by 3rd parties accessed through the software you installed; and all related
documentation that accompanies these software components.

References to the Company’s licensors refer to any third parties licensing all or any portion of such
Software to Kodak Alaris, including all affiliates, subsidiaries and related companies. This License is
specifically intended for the benefit of Kodak Alaris and any licensors.

1. Grant of License. So long as you are in compliance with this License Agreement, Kodak Alaris
grants you a non-exclusive license to use the Software subject to the License restrictions set forth below.
No rights to the use of any Kodak Alaris, or its licensors’, names, logos or trademarks are conveyed by
this License. This License Agreement is not for the sale of Software or any other intellectual property. All
right, title and interest, and all intellectual property rights in and to the Software, as well as the Software
itself, is owned by Kodak Alaris or its licensors.

2. Restrictions on Use. You may use the Software only in connection with Kodak Alaris authorized
equipment and/or consumables. In connection with such use you may copy the Software as necessary to
enable you to use the Software, but you may not further redistribute, sublicense, rent, loan or lease the
Software to a third party except as provided in Section 3. The Software may contain subroutine libraries
and sample files as described in the Software documentation. You may not modify any of the sample files
for any reason. You acknowledge and agree that the Software is intended for use solely in connection
with equipment as set forth herein.

3. Transfer of the Software. You may permanently transfer the Software to another party solely in
connection with the sale or other permanent disposition of the equipment if the other party agrees to
accept the terms and conditions of this License and you retain no copies of the Software.
4. Intellectual Property. The Software is owned by Kodak Alaris, its licensors or its suppliers and
protected by copyright laws and international treaties. You may not copy the Software other than as
expressly provided in this License. This Software and/or the equipment to which this Software pertains is
subject to claims set forth in the Kodak Alaris patents listed at www.kodakmoments.com/patents.

5. Protection. You acknowledge that the Software contains valuable proprietary and confidential
information of Kodak Alaris and/or its licensors. You therefore agree:

i. to use the Software only for the limited purposes authorized in the license granted herein,
and to limit access to the Software to your own employees, agents, consultants, and
independent contractors who are directly involved in the accomplishment of such purpose;

ii. not to copy the Software except as authorized in writing by Kodak Alaris and to include on
all such authorized copies any designated and requested copyright, trademark, and
proprietary information notices of Kodak Alaris and/or its Licensors;

iii. to otherwise protect the Software from disclosure using at least the same degree of care you
use to protect your own confidential or proprietary information;

iv. to securely store all copies of the Software at all times and in any form;

v. to notify Kodak Alaris in writing of any unauthorized access to the Software; and;

vi. You will not (and will use its best efforts consistent not allow any third party to): (i) copy,
decompile, disassemble, reverse engineer or attempt to discover any source code or
underlying ideas or algorithms of the Software (except to the extent that applicable law
prohibits reverse engineering restrictions), (ii) except as expressly provided herein, provide,
lease, lend, use for timesharing or service bureau purposes or otherwise use or allow others
to use the Software for the benefit of any third party, (iii) use the Software in violation of
any law or regulation or any third party rights, or (iv) modify or make derivative works of
the Software or remove, modify, or obscure any copyright or other proprietary notices of any
related documentation.

You agree to indemnify and hold harmless the Company and its licensors for all liability and damages
that may be incurred in any legal action in connection with the above.

6. Privacy. The Software, or the downloading thereof, may request or collect certain limited
information about you when you use the Software. The Software may also use cookies or other passive
tracking mechanisms and tools to collect information in order to facilitate your use of the Software.
Kodak Alaris’ collection, use, disclosure and handling of your information is done in accordance with its
Privacy Policy. The most recent version of the Privacy Policy can be found at
https://www.kodakalaris.com/privacy-policy. This Privacy Policy also explains the options available to
you regarding Kodak Alaris' use of your information and how you can access and update this information.

7. Term. This License is effective until terminated. You may terminate it at any time by destroying
or otherwise permanently disabling the Software, together with all copies in any form, or, if the Software
is incapable of being destroyed or permanently disabled because of the manner in which it is installed on
a device, you may terminate this License by ceasing to use or allow others to use the Software, provided
that any use of the Software thereafter again constitutes acceptance of these terms and conditions and the
License shall again be effective. This License will also automatically terminate if you fail to comply with
any term or condition of this License. Upon termination for any reason, you agree to destroy or
permanently disable the Software, together with all copies in any form, or if the Software is incapable of
being destroyed, you agree to not use or allow others to use the Software without agreeing to terms of this
License. Provisions which, by their nature, should remain in effect beyond termination of this License
Agreement shall survive.

8. Compliance with Laws and Terms. The form and content of pictures, text or other material that
you transmit or create products from is governed by applicable laws (such as, those prohibiting child
abuse, child pornography, copyright infringement, or invasion of privacy). If you use the Software to
transmit material to Kodak Alaris or its affiliates for printing or product fulfillment or other purposes, you
must comply with the relevant terms of service. You may not use the Software to transmit to Kodak
Alaris or its affiliates any pictures, text or other material that is unlawful, whether a violation of civil
rights (such as libel) or criminal law (such as obscenity), or that fosters hatred of any race, religion,
ethnicity, age- group, gender or sexuality. You agree that you will defend, indemnify and hold Kodak
Alaris harmless against any claim arising out of or related to your failure to comply with the terms of this
Section 8.

9. Your Representations and Warranties. You represent and warrant that you possess the legal right
and ability to agree to this License Agreement. You agree to indemnify and hold harmless the Company
and its licensors for all liability and damages that may be incurred in any legal action in connection with
the above.

10. Software Features. The Software may contain features that enable Kodak Alaris, via the internet,
to notify you of available software upgrades, promotions, products and services in which you may be
interested; to update product data files and instructional and marketing content in the Software; and to
collect non-personally identifiable usage data. The Software may also contain features that enable you to
download store locator files, new product themes and product catalogs. You agree that Kodak Alaris may
utilize these features to provide such notices and updates, permit such downloads and to collect such data,
unless you have elected to deactivate the features in the Software. For information on how to deactivate
one or more of these features, refer to the help file or the README file. Regardless of any information
presented on the Applications, Kodak Alaris reserves the right without prior notice to discontinue, move
or suspend the Applications or change specifications at any time, without incurring any obligations.

11. DISCLAIMER OF WARRANTY. The Software is provided to you “AS IS”. Kodak Alaris and
its licensors do not warrant that the functions contained in the Software will meet your requirements or
that the operation of the Software will be uninterrupted or error free. You assume responsibility for
operation of the Software, and for the installation, use, and results obtained from the Software.

The Software may contain hypertext links to third-party web sites or information. Kodak Alaris does not
make any warranty, endorsement, sponsorship, or recommendation of the third-party, the third-party web
site, or the information contained therein. Kodak Alaris is not responsible for the availability of any such
web site or liable for the content thereon. You need to make your own decisions regarding your
interactions or communications with any other web site.

Subject to any applicable legislation which prohibits the following exclusions, KODAK ALARIS AND
ITS LICENSORS MAKE NO WARRANTIES OF ANY KIND RELATED TO THE SOFTWARE,
EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT,
OR ARISING FROM COURSE OF PERFORMANCE, DEALING, USAGE OR TRADE. Some states
and countries do not allow the exclusion of implied warranties, or have legislation that imposes certain
statutory warranties that cannot be excluded, so the above exclusion may not apply to you.

12. LIMITATION OF LIABILITY. Your use of the Software is entirely at your own risk. Under no
circumstance will Kodak Alaris, its agents, licensors or suppliers be liable to you on account of your use
or misuse of, or reliance on, the Software. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT
WILL KODAK ALARIS, ITS LICENSORS, SUPPLIERS OR DEALERS BE LIABLE TO YOU FOR
ANY ACTUAL, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, COSTS OF PROCUREMENT OF
SUBSTITUTE PRODUCTS OR SERVICES OR OTHER DAMAGES ARISING OUT OF THE USE
OR INABILITY TO USE THE SOFTWARE EVEN IF ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES. Some states and countries do not allow the limitation or exclusion of liability for incidental
or consequential damages, or have legislation that restricts the limitation or exclusion of liability, so the
above limitation may not apply to you.

13. Governing Law. If the Software was obtained in the United States, this License is governed by
the laws of the State of New York. If the Software was obtained outside of the United States, this License
is governed by the laws of the country in which it was obtained. This License shall not be governed by the
United Nations Convention on Contracts for the International Sale of Goods, the application of which is
expressly excluded. If for any reason a court of competent jurisdiction finds any provision, or portion
thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.

14. Export Law Assurances. You may not use or otherwise export or re-export the Software except as
authorized by United States law and laws of the jurisdiction in which the Software was obtained. In
particular, but without limitation, the Software may not be exported or re-exported (a) into (or to a
national or resident of) any U.S. embargoed countries (including without limitation Cuba, Iran, Iraq,
Libya, North Korea, Serbia, Sudan, and Syria), or (b) to anyone on the U.S. Treasury Department’s list of
Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List.
By using the Software, you represent and warrant that you are not located in, under control of, or a
national or resident of any such country or on any such list.

15. Federal Acquisitions. This Section 15 applies to all acquisitions of the Software by or for the
federal government, or by any prime contractor or subcontractor (at any tier) under any contract, grant,
cooperative agreement or other activity with the federal government. The Software is a “commercial
item” as that term is defined in 48 C.F.R. 2.101 (October, 2004) consisting of “commercial computer
software” and “commercial computer software documentation” as such terms are used in 48 C.F.R.
227.7202-1, 227.7202-3, 227.7202-4 (October, 2004). If you are in the U.S. Government or any agency or
department thereof, the Software is licensed (a) only as a commercial item and (b) with only those rights
as are granted hereunder.

16. EUROPEAN COMMUNITY PROVISIONS. If you obtained this Software within a country of
the European Community, nothing in this License shall be construed as restricting any rights available
under the European Community Software Directive (91/250/EEC).

17. Miscellaneous. Each provision of this License Agreement is severable. If a provision is found to
be unenforceable, this finding does not affect the enforceability of the remaining provisions, terms, or
conditions of this License Agreement. This License Agreement is binding on successors and assigns.
Kodak Alaris will not be responsible for any non-performance or delay attributable in whole or in part to
any cause beyond its reasonable control. Nothing contained herein shall be construed as creating any
agency, partnership, or other form of joint enterprise between the parties. You acknowledge that you have
read this License Agreement, that you understand it, that you agree to be bound by its terms, and that the
foregoing is the complete and exclusive statement of the
License Agreement.

Ce Contrat de licence utilisateur final (« Licence » ou « Contrat de licence ») s'applique au Logiciel que
vous téléchargez. Lisez attentivement les conditions générales suivantes avant d'installer et d'utiliser ce

Le terme « Vous » désigne soit (a) dans le cas d'une personne physique, la personne âgée de plus de
18 ans concluant le présent Contrat de Licence, soit (b) dans le cas d'une société (ou une autre entité
juridique), la partie pour qui cette Licence est convenue pour le compte d'une personne autorisée ayant le
pouvoir de lier la partie.

Le terme « Logiciel » s'applique aux composants de logiciel et/ou firmware que vous installez, ainsi
qu'aux composants de logiciel hébergés par des tiers auxquels vous accédez par le biais du logiciel que
vous avez installé ; et toute la documentation connexe qui accompagne ces composants de logiciel.

Les références aux concédants de licence de la Société se rapportent à toute tierce partie concédant une
licence complète ou partielle du Logiciel à Kodak Alaris, incluant toutes les sociétés affiliées, filiales et
sociétés liées. La présente Licence sert de façon spécifique les intérêts de Kodak Alaris et de tous ses
concédants de licence.

1. Concession de licence. Sous réserve que vous vous conformiez aux conditions du présent Contrat
de licence, Kodak Alaris vous concède une licence non exclusive pour l'utilisation de ce Logiciel,
conformément aux restrictions de Licence exposées ci-après. La présente Licence ne permet en aucun cas
d'utiliser les noms, logos ou marques appartenant à Kodak Alaris ou à ses Concédants de licence. Le
présent Contrat de licence n'autorise pas la vente du Logiciel ni d'aucune propriété intellectuelle. Il est
entendu que tous les droits, titres de propriété et participations, y compris les droits de propriété
intellectuelle sur le Logiciel, appartiennent à Kodak Alaris ou à ses Concédants de licence.

2. Restrictions d'utilisation. L'utilisation du Logiciel est exclusivement limitée dans le cadre des
équipements et/ou consommables agréés par Kodak Alaris. En relation avec cette utilisation, vous êtes
autorisé à copier le Logiciel si cela est nécessaire à son utilisation, mais il vous est interdit de redistribuer,
de concéder en sous-licence, de louer ou de proposer en crédit-bail le Logiciel à un tiers, sauf exception
stipulée à la Section 3. Le Logiciel contient des bibliothèques de sous-programmes et des fichiers type
tels que décrits dans la documentation du Logiciel. Vous n'êtes pas autorisé à modifier les fichiers type
pour quelque motif que ce soit. Vous reconnaissez et acceptez que le Logiciel soit exclusivement destiné
à l'utilisation dans le cadre des équipements mentionnés dans la présente.

3. Cession du Logiciel. Vous pouvez transférer le Logiciel à titre permanent à une autre partie dans
le cadre d'une vente ou d'une autre disposition permanente de l'équipement, à condition que l'autre partie
accepte les conditions générales de la présente Licence et que vous ne conserviez aucune copie du
Logiciel.

4. Propriété intellectuelle. Le Logiciel est la propriété de Kodak Alaris, de ses concédants de licence
ou de ses fournisseurs et est protégé par les lois et les traités internationaux sur la propriété intellectuelle.
Toute copie du Logiciel effectuée à l'encontre des modalités expressément stipulées dans cette Licence est
interdite. Ce Logiciel et/ou l'équipement auquel il se rapporte sont soumis aux revendications énoncées
dans les brevets Kodak Alaris énumérés à l'adresse www.kodakmoments.com/patents.

5. Protection. Vous reconnaissez que le Logiciel contient des informations confidentielles et

propriétaires de valeur sur Kodak Alaris et/ou ses concédants de licence. Par conséquent, vous acceptez :

i. d'utiliser le Logiciel uniquement aux fins limitées autorisées par la licence accordée dans le
présent document, et de limiter l'accès au Logiciel à vos propres employés, agents, consultants, et
contractants indépendants qui participent directement à la réalisation de cet objectif ;

ii. de ne pas copier le Logiciel sauf autorisation écrite de Kodak Alaris et d'inclure sur toutes ces
copies autorisées tout droit d'auteur, toute marque de commerce, et les avis relatifs aux informations
exclusives de Kodak Alaris et/ou de ses Concédants de licence ;

iii. de protéger le Logiciel contre la divulgation en utilisant au minimum le même degré d'attention
que vous utilisez pour protéger vos propres informations exclusives ou confidentielles ;

iv. de stocker en toute sécurité toutes les copies du Logiciel, à tout moment et sous quelque forme
que ce soit ;

v. d'avertir par écrit Kodak Alaris de tout accès non autorisé au Logiciel ; et

vi. Vous vous engagez à ne pas (et ferez de votre mieux pour ne pas autoriser une tierce partie à) :
(i) copier, décompiler, désassembler, procéder à des opérations de rétro-ingénierie ou tenter de
découvrir tout code source ou les idées ou algorithmes sous-jacents du Logiciel (sauf dans la mesure
où la loi applicable interdit les restrictions en matière d'opérations de rétro-ingénierie), (ii) sauf
disposition expresse énoncée dans les présentes, fournir, louer, prêter, utiliser à des fins de
multipropriété ou de bureau de service, ou utiliser ou permettre à d'autres d'utiliser le Logiciel au
profit d'un tiers, (iii) utiliser le Logiciel en violation de toute loi, de toute réglementation ou des
droits de tiers, ou (iv) modifier ou créer des produits dérivés du Logiciel ou supprimer, modifier ou
masquer toute mention de droit d'auteur ou tout autre avis de propriété sur des documents liés.

Vous acceptez d'indemniser et de dégager la responsabilité de la Société et de ses Concédants de toute

responsabilité et de tous dommages qui peuvent être encourus dans le cadre d'une action en justice
relative à ce qui précède.

6. Confidentialité. Le Logiciel, ou le téléchargement de celui-ci, peut impliquer certaines informations

limitées ou leur collecte lorsque vous l'utilisez le Logiciel. Le Logiciel peut également utiliser des cookies
ou d'autres méthodes et outils de traçabilité passifs pour collecter des informations afin de faciliter votre
utilisation du Logiciel. La collecte, l'utilisation, la divulgation et le traitement de vos informations par
Kodak Alaris se font conformément à sa Politique de confidentialité. La version la plus récente de la
Politique de confidentialité est disponible à l'adresse https://www.kodakalaris.com/privacy-policy. Cette
Politique de confidentialité décrit également les options qui s'offrent à vous concernant l'utilisation de vos
informations par Kodak Alaris et la manière dont vous pouvez accéder à ces informations et les mettre à
jour.

7. Durée de validité. La présente Licence reste en vigueur jusqu'à sa résiliation. Vous pouvez résilier
la Licence à tout moment en détruisant ou désactivant à titre permanent le Logiciel, ainsi que toutes
copies, quelle que soit la forme, ou, s'il est impossible de détruire ou de désactiver le Logiciel à titre
permanent en raison de son installation spécifique sur un périphérique, vous pouvez résilier cette Licence
en cessant d'utiliser ou de permettre à d'autres d'utiliser le Logiciel, sous réserve que toute nouvelle
utilisation du Logiciel par la suite constitue une acceptation de ces conditions générales, la Licence
entrant de fait à nouveau en vigueur. Par ailleurs, la présente Licence sera automatiquement résiliée si
vous contrevenez à l'une de la présente Licence. Vous vous engagez, à la résiliation pour quelque raison
que ce soit, à détruire ou à désactiver à titre permanent le Logiciel, ainsi que toutes copies, quelle que soit
la forme, ou s'il est impossible de détruire le Logiciel, vous acceptez de ne pas utiliser ou de ne pas
permettre à d'autres d'utiliser le Logiciel sans accepter les conditions générales de cette Licence. Les
dispositions qui, par nature, restent applicables après la résiliation du présent Contrat de licence sont
maintenues.

8. Respect des lois et des conditions générales. La forme et le contenu des images, textes et autres
supports, que vous transmettez ou à partir desquels vous créez des produits, sont régis par les lois
applicables (notamment en matière de maltraitance à l'égard des enfants, de pédopornographie, de
violation des droits d'auteur ou du respect de la vie privée). Si vous utilisez le Logiciel dans le but de
fournir à Kodak Alaris ou à ses sociétés affiliées du contenu pour l'impression, la réalisation d'objets ou
toute autre fin, vous êtes tenu de vous conformer aux conditions d'utilisation applicables. Vous n'êtes pas
autorisé à utiliser le Logiciel dans le but de transmettre à Kodak Alaris ou à ses filiales, toute image, tout
texte ou autre support à caractère illégal, que ce soit en violation des droits civils (diffamation) ou de la
loi pénale (obscénité), ou de nature à encourager la haine raciale, religieuse ou ethnique ou la
discrimination fondée sur l'âge, le sexe ou les préférences sexuelles. Vous acceptez de défendre,
d'indemniser et de dégager la responsabilité de Kodak Alaris contre toute réclamation découlant de ou en
relation avec votre manquement aux dispositions de la présente Section 8.

9. Vos déclarations et garanties. Vous déclarez et garantissez que vous possédez le droit légal et la
capacité d'accepter le présent Contrat de licence. Vous acceptez d'indemniser et de dégager la
responsabilité de la Société et de ses Concédants de toute responsabilité et de tous dommages qui peuvent
être encourus dans le cadre d'une action en justice relative à ce qui précède.

10. Fonctionnalités du logiciel. Le Logiciel peut contenir des fonctionnalités permettant à Kodak
Alaris de vous informer, via Internet, des mises à niveau logicielles, promotions, produits et services
disponibles et susceptibles de vous intéresser, de mettre à jour les fichiers de données produit ainsi que les
instructions et le contenu marketing du Logiciel, et de collecter des données d'utilisation non identifiables
personnellement. Le Logiciel peut également contenir des fonctionnalités vous permettant de télécharger
des fichiers de coordonnées de boutiques, de nouveaux thèmes de produits et des catalogues produit.
Vous acceptez que Kodak Alaris est susceptible d'utiliser lesdites fonctionnalités pour vous transmettre
lesdits avertissements et lesdites mises à jour, autoriser lesdits téléchargements et recueillir lesdites
données, à moins que vous ayez choisi de désactiver ces fonctionnalités dans le Logiciel. Pour savoir
comment désactiver une ou plusieurs de ces fonctionnalités, consultez le fichier d'aide ou le fichier
Lisez-moi. Indépendamment des informations présentes sur les Applications, Kodak Alaris se réserve le
droit, sans avis préalable, d'arrêter, de déplacer ou d'interrompre les Applications ou de modifier des
dispositions à tout moment, sans encourir aucune obligation.
11. EXCLUSION DE GARANTIE. Le Logiciel est fourni « EN L'ÉTAT ». Kodak Alaris et ses
Concédants de licence ne garantissent pas que les fonctionnalités du Logiciel répondront à vos attentes ni
que son fonctionnement sera ininterrompu ou exempt d'erreurs. Vous êtes responsable de l'utilisation du
Logiciel, de l'installation et de l'utilisation du Logiciel, ainsi que des résultats obtenus grâce au Logiciel.

Le Logiciel peut contenir des liens hypertextes vers des sites Web ou des informations de tiers. Les tiers,
leurs sites Web et les informations qu'ils contiennent ne font l'objet d'aucune garantie, approbation,
parrainage ou recommandation de la part de Kodak Alaris. Kodak Alaris ne pourra être tenue responsable
de la disponibilité de ces sites Web ou de leur contenu. La décision d'interagir ou de communiquer avec
tout autre site Web vous revient.

Sous réserve de toute législation applicable qui interdit les exclusions exposées ci-après, KODAK
ALARIS ET SES CONCÉDANTS DE LICENCE NE FOURNISSENT AUCUNE AUTRE GARANTIE
DE QUELQUE SORTE QUE CE SOIT CONCERNANT LE LOGICIEL, QU'ELLE SOIT EXPRESSE
OU TACITE, Y COMPRIS LES GARANTIES TACITES DE QUALITÉ MARCHANDE OU
D'ADÉQUATION À UN USAGE PARTICULIER, D'ABSENCE DE CONTREFAÇON, OU
DÉCOULANT DES MODALITÉS D'EXÉCUTION OU DE NÉGOCIATION, DE L'UTILISATION OU
DE LA COMMERCIALISATION DU LOGICIEL. Certains états et pays n'autorisant pas l'exclusion de
garanties tacites, ou possédant une législation qui impose des garanties légales qui ne peuvent être
exclues, l'exclusion susmentionnée peut ne pas s'appliquer à votre cas.

12. LIMITATION DE RESPONSABILITÉ. Les risques liés à l'utilisation du Logiciel vous

incombent entièrement. Kodak Alaris, ses représentants, ses concédants de licence ou ses fournisseurs ne
pourront en aucun cas être tenus responsables de votre utilisation ou de votre mauvais usage du Logiciel,
ou de votre confiance dans le Logiciel. KODAK ALARIS, SES CONCÉDANTS DE LICENCE, SES
FOURNISSEURS OU SES REVENDEURS NE POURRONT EN AUCUN CAS ÊTRE TENUS
RESPONSABLES DES DOMMAGES DIRECTS OU INDIRECTS, Y COMPRIS LE MANQUE À
GAGNER, LES COÛTS LIÉS À L'ACQUISITION DE PRODUITS OU DE SERVICES DE
SUBSTITUTION OU DE TOUT AUTRE DOMMAGE DÉCOULANT DE L'UTILISATION OU DE
L'IMPOSSIBILITÉ D'UTILISER LE LOGICIEL, ET CE MÊME SI KODAK A ÉTÉ AVERTIE DE LA
POSSIBILITÉ DE TELS DOMMAGES. Certains états et pays n'autorisant pas les limitations ou
exclusions de responsabilité relatives aux dommages consécutifs ou fortuits, ou possédant une législation
qui restreint les limitations ou les exclusions de responsabilité, les limitations susmentionnées peuvent ne
pas s'appliquer à votre cas.

13. Loi applicable. La présente Licence est soumise aux lois américaines en vigueur. Tout différend
émergeant en raison de ou suite à l'exécution de cette Licence sera porté devant les tribunaux compétents.
Si le logiciel a été obtenu en dehors des États-Unis, la présente Licence est régie par la législation du pays
d'obtention. La présente Licence ne sera pas régie par la Convention des Nations Unies sur les contrats de
vente internationale de marchandises, dont l'application est expressément exclue. Si, pour quelque raison
que ce soit, un tribunal d'une juridiction compétente juge une disposition inapplicable en tout ou partie, le
reste de la présente Licence doit rester pleinement en vigueur et de plein effet.

14. Assurances relatives aux lois sur l'exportation. Vous ne pouvez en aucune façon utiliser, exporter
ou réexporter le Logiciel sauf de la manière autorisée par le droit des États-Unis et les lois de la
juridiction dans laquelle le Logiciel a été obtenu. En particulier, mais sans limitation, le Logiciel ne peut
être exporté ni réexporté (a) vers tout pays (ni à tout résident ou ressortissant de tout pays) soumis à
embargo des États-Unis (notamment Cuba, l'Iran, l'Irak, la Libye, la Corée du Nord, la Serbie, le Soudan
et la Syrie) ou (b) à toute personne figurant sur la liste « Specially Designated Nationals » du Ministère
des Finances des États-Unis ou sur les listes « Denied Person » ou « Denied Entity » du Ministère du
Commerce des États-Unis. Si vous utilisez le Logiciel, vous déclarez que vous ne vous trouvez pas dans
l'un de ces pays, ni sous le contrôle de l'un de ceux-ci, que vous n'êtes ni natif, ni résident de ces pays et
que vous ne figurez pas dans une liste de ce type.

15. Acquisitions fédérales. La présente section 15 s'applique à toutes les acquisitions du Logiciel par
ou pour le gouvernement fédéral, ou par son donneur d'ordres ou sous-traitant (à tous les niveaux) en
vertu d'une entente contractuelle, d'un accord de subvention, d'un contrat de coopération ou au titre de
toute autre activité réalisée avec le gouvernement fédéral. Le Logiciel est un « élément commercial »
selon la définition de 48 C.F.R. 2.101 (octobre 2004) constitué d'un « logiciel informatique commercial »
et d'une « documentation du logiciel informatique commercial » selon l'utilisation de ces termes dans
48 C.F.R. 227.7202-1, 227.7202-3, 227.7202-4 (octobre 2004). Si vous travaillez dans le gouvernement
américain ou dans une agence ou un département de ce dernier, le Logiciel est concédé en licence
(a) uniquement en tant qu'article commercial et (b) avec les seuls droits qui sont octroyés en vertu des
présentes.

16. DISPOSITIONS CONCERNANT L'UNION EUROPÉENNE. Si vous obtenez ce Logiciel dans

un État membre de la Communauté européenne, aucune des dispositions de la présente Licence ne saurait
être interprétée comme une restriction des droits prévus par la directive européenne 91/250/CEE sur les
logiciels.

17. Dispositions diverses. Chaque disposition du présent Contrat de licence est séparable des autres.
Si l'une des dispositions s'avérait non applicable, cela n'affecterait en rien le caractère exécutoire des
autres dispositions ou conditions générales du présent Contrat de licence. Le présent Contrat de licence lie
également vos successeurs et ayants droit. Kodak Alaris ne peut être tenue responsable d'un problème ou
d'un retard de fonctionnement résultant directement ou indirectement de toute cause raisonnablement hors
de son contrôle. Nul terme contenu dans les présentes ne doit être interprété comme créant une agence, un
partenariat ou toute autre forme de co-entreprise entre les Parties. Vous reconnaissez avoir lu le présent
Contrat de licence, l'avoir compris et vous en acceptez les termes et reconnaissez que ce qui précède

LIZENZ

Dieser Endbenutzer-Lizenzvertrag („Lizenz“ oder „Lizenzvertrag“) gilt für die Software, die Sie
herunterladen. Lesen Sie die folgenden Bedingungen sorgfältig durch, bevor Sie diese Software
installieren oder verwenden (im Folgenden definiert). Durch die Installation und die Nutzung dieser
Software erklären Sie sich mit den Bedingungen dieses Lizenzvertrags einverstanden. Diese Bedingungen
ersetzen alle bisherigen Bedingungen des Lizenzvertrags dem Unternehmen und Ihnen, sofern die
Vertragsparteien nicht ausdrücklich schriftlich etwas anderes vereinbaren. Im Kontext dieser Lizenz
bezeichnet „Unternehmen“ und „Kodak Alaris” Kodak Alaris Inc., dessen Partnerunternehmen sowie
Tochter- und Muttergesellschaften zusammen.

Der Begriff „Sie“ bezeichnet entweder (a) im Falle einer Einzelperson die Person, die volljährig ist und
diesen Lizenzvertrag abschließt oder (b) im Falle eines Unternehmens (oder einer sonstigen
Rechtseinheit) die Vertragspartei, für die dieser Lizenzvertrag im Auftrag einer bevollmächtigten Person,
die befugt ist, die Vertragspartei vertraglich zu binden, abgeschlossen wird.

Der Begriff „Software“ bezieht sich auf die Software- und/oder Firmware-Komponenten, die Sie
installieren, sowie auf die Software-Komponenten, die von Dritten gehostet werden und auf die über die
von Ihnen installierte Software zugegriffen werden kann. Ebenfalls umfasst ist die gesamte dazugehörige
Dokumentation, die diesen Software-Komponenten beiliegt.

Lizenzgeber des Unternehmens sind alle Drittanbieter, die die gesamte oder einen Teil dieser Software für
Kodak Alaris, einschließlich aller Partnerunternehmen, Tochtergesellschaften und verbundenen
Unternehmen, lizenzieren. Diese Lizenz regelt die Rechte von Kodak Alaris und seinen Lizenzgebern.

1. Lizenzerteilung. So lange Sie sich an diesen Lizenzvertrag halten, garantiert Ihnen Kodak Alaris
eine nicht exklusive Lizenz zur Verwendung der Software unter den nachfolgenden Lizenzbedingungen.
Durch diesen Lizenzvertrag werden keinerlei Rechte für die Verwendung jeglicher Namen, Logos oder
Marken von Kodak Alaris oder seinen Lizenzgebern übertragen. Dieser Lizenzvertrag beinhaltet keinen
Verkauf von Software oder anderem geistigem Eigentum. Alle Rechte, Eigentum und Nutzung bezüglich
der Software sowie die Software selbst stehen Kodak Alaris oder seinen Lizenzgebern zu.

2. Nutzungsbeschränkungen. Sie dürfen die Software ausschließlich in Verbindung mit durch

Kodak Alaris autorisiertes Gerät und/oder Verbrauchsmaterial verwenden. Im Zusammenhang mit dieser
Verwendung darf die Software kopiert werden, um ihre Verwendung zu ermöglichen. Sie dürfen die
Software nicht an Dritte weitergeben, vermieten, verleihen, verleasen oder Unterlizenzen vergeben,
ausgenommen unter den in Abschnitt 3 erläuterten Umständen. Die Software enthält, wie in der
Dokumentation zur Software beschrieben, unter Umständen Unterprogrammbibliotheken und
Beispieldateien. Sie dürfen die Beispieldateien keinesfalls ändern. Sie bestätigen und erklären sich damit
einverstanden, dass die Software ausschließlich für die Verwendung in Verbindung mit den hier
aufgeführten Geräten vorgesehen ist.
3. Software-Transfer. Sie dürfen die Software ausschließlich in Verbindung mit dem Vertrieb oder
einer anderen dauerhaften Verwendung des Geräts dauerhaft an Dritte übertragen, wenn diese die
Bestimmungen und Bedingungen dieses Lizenzvertrags akzeptieren und Sie selbst keine Kopie der
Software zurückbehalten.

4. Geistiges Eigentum. An dieser Software haben Kodak Alaris, seine Lizenzgeber oder Zulieferer
das Urheberrecht; sie ist durch dieses und durch internationale Verträge geschützt. Die Software darf nur
kopiert werden, soweit diese Lizenz dies ausdrücklich vorsieht. Diese Software und/oder die Geräte, zu
denen diese Software gehört, unterliegt den Patenten von Kodak Alaris, die unter
www.kodakmoments.com/patents aufgeführt sind.

5. Schutz. Sie bestätigen, dass die Software wertvolles, urheberrechtlich geschütztes Eigentum und
wertvolle Informationen zu Kodak Alaris und/oder seinen Lizenzgebern enthält. Sie stimmen daher zu:

i. die Software ausschließlich für die in dieser Lizenz gewährten begrenzten Zwecke zu verwenden
sowie den Zugriff auf die Software auf Ihre Mitarbeiter, Agenten, Berater und unabhängigen
Auftragnehmer zu beschränken, die unmittelbar an der Erfüllung dieses Zweckes beteiligt sind;

ii. die Software nicht ohne ausdrückliche schriftliche Genehmigung durch Kodak Alaris zu
kopieren und genehmigte Kopien mit den benannten und verlangten Urheberrechts-, Schutzmarken-
und sonstigen Eigentumshinweisen von Kodak Alaris und/oder seinen Lizenzgebern zu versehen;

iii. die Software anderweitig vor Veröffentlichung zu schützen, indem Sie sie mit der gleichen
Sorgfalt behandeln, die Sie zum Schutz Ihrer eigenen vertraulichen oder urheberrechtlich relevanten
Informationen aufwenden;

iv. alle Kopien der Software zu jeder Zeit und in jeglicher Form sicher aufzubewahren;

v. Kodak Alaris über jeglichen nicht autorisierten Zugriff auf die Software schriftlich zu
benachrichtigen; und

vi. Es ist Ihnen nicht erlaubt (und Sie müssen sich nach besten Kräften bemühen, keinem Dritten zu
ermöglichen): (i) den Quellcode oder die zugrundeliegenden Ideen oder Algorithmen der Software
zu kopieren, zu dekompilieren, zu disassemblieren, zurückzuentwickeln oder zu versuchen, diese zu
entdecken (es sei denn, anwendbares Recht untersagt Beschränkungen von Reverse-Engineering),
(ii) sofern es nicht ausdrücklich hierin vermerkt ist, die Software zu Gunsten Dritter bereitzustellen,
zu vermieten, zu verleihen, für Timesharing- oder Dienstleistungsbüros zu nutzen oder anderweitig
zu verwenden oder anderen deren Nutzung zu erlauben, (iii) die Software unter Nichteinhaltung von
Gesetzen und Vorschriften oder Rechten Dritter zu verwenden oder (iv) die Software zu
modifizieren oder von dieser abgeleitete Werke zu erstellen oder Copyright- oder andere
Eigentumshinweise von allen zugehörigen Dokumentationen zu entfernen, zu verändern oder zu
verschleiern.

Sie stellen das Unternehmen und seine Lizenzgeber von jeglichen Ansprüchen frei, die sich aus einer
Verletzung der in diesem Abschnitt beschriebenen Bestimmungen ergeben.

oder durch das Herunterladen derselben angefordert oder gesammelt werden. Die Software kann auch
Cookies oder andere passive Nachverfolgungsmechanismen und Tools zum Sammeln von Informationen
verwenden, um Ihnen die Nutzung der Software zu erleichtern. Die Erfassung, Verwendung, Offenlegung
und Handhabung Ihrer Daten durch Kodak Alaris erfolgt in Übereinstimmung mit der
Datenschutzrichtlinie von Kodak Alaris. Die aktuellste Version der Datenschutzerklärung ist unter
https://www.kodakalaris.com/privacy-policy zu finden. Diese Datenschutzrichtlinie erläutert auch die
Optionen, die Ihnen bezüglich der Verwendung Ihrer Informationen durch Kodak Alaris zur Verfügung
stehen, und wie Sie auf diese Informationen zugreifen und sie aktualisieren können.

7. Geltungsdauer. Dieser Lizenzvertrag gilt bis zu seiner Beendigung. Sie können ihn jederzeit
beenden, indem Sie die Software einschließlich aller in jeglicher Form vorhandenen Kopien zerstören
oder auf andere Weise dauerhaft unbrauchbar machen oder, wenn die Software aufgrund der Art in der sie
auf einem Gerät installiert ist nicht zerstört oder dauerhaft unbrauchbar gemacht werden kann, können Sie
diese Lizenz beenden, indem Sie darauf verzichten die Software zu verwenden oder Dritten die
Verwendung zu gestatten, vorausgesetzt jegliche Verwendung der Software hiernach stellt eine erneute
Annahme dieser Bestimmungen und Bedingungen dar und die Lizenz wird wieder wirksam. Diese Lizenz
endet auch automatisch, wenn Sie gegen eine Vertragsbedingung verstoßen. In diesem Fall sind Sie
verpflichtet, die Software einschließlich aller in jeglicher Form vorhandenen Kopien zu zerstören oder
dauerhaft unbrauchbar zu machen oder, wenn die Software nicht zerstört werden kann, stimmen Sie zu
auf die Verwendung der Software zu verzichten und Dritten die Verwendung nicht zu gestatten, ohne den
Bedingungen dieser Lizenz zuzustimmen. Bedingungen, die ihrer Natur nach auch nach Beendigung
dieses Lizenzvertrags Bestand haben, bleiben hiervon unangetastet.

8. Einhaltung der Gesetze und Bestimmungen. Form und Inhalt der Bilder, Texte oder von anderem
Material, das Sie übertragen oder mit Hilfe dessen Sie Produkte erstellen, dürfen nicht gegen geltendes
Recht verstoßen (beispielsweise gegen das Verbot der Kindesmisshandlung bzw. der Verbreitung
kinderpornografischer Schriften, wie auch Verletzungen des Urheber- oder Persönlichkeitsrechts). Wenn
Sie die Software verwenden, um Material an Kodak Alaris oder seine Partner zum Drucken, zur
Produkterfüllung oder zu anderen Zwecken zu übermitteln, müssen Sie die jeweiligen Bedingungen für
den Service einhalten. Sie dürfen die Software nicht verwenden, um Bilder, Text oder anderes Material an
Kodak Alaris oder seine Partner zu übermitteln, das gegen das geltende Recht verstößt (z. B.
Beleidigungen, Obszönität oder Volksverhetzung). Sie verteidigen und halten Kodak Alaris frei und
schadlos gegen jegliche Ansprüche, die sich aus einer Verletzung der in Abschnitt 8 beschriebenen
Bedingungen durch Sie ergeben bzw. damit in Verbindung stehen.

9. Pflichten des Nutzers. Sie erklären, dass Sie über den rechtlichen Anspruch und die Fähigkeit
verfügen, dieser Lizenzvereinbarung zuzustimmen. Sie stellen das Unternehmen und seine Lizenzgeber
von jeglichen Ansprüchen frei, die sich aus einer Verletzung der in diesem Abschnitt beschriebenen
Bestimmungen ergeben.

10. Software-Funktionen. Die Software kann Funktionen enthalten, die Kodak Alaris über das
Internet Folgendes ermöglichen: Sie über verfügbare Softwareaktualisierungen, Angebote, Produkte und
Dienstleistungen zu informieren, an denen Sie interessiert sein könnten, Produktdatendateien, Anleitung
und Marketinginhalte der Software zu aktualisieren und nicht personenbezogene Daten zu sammeln. Die
Software kann zudem Funktionen enthalten, die Ihnen den Download von Dateien zur Händlersuche,
neuer Produktthemen und Produktkataloge ermöglichen. Sie stimmen zu, dass Kodak Alaris diese
Funktionen einsetzen darf, um solche Hinweise und Aktualisierungen zu übermitteln, Downloads zu
ermöglichen und Daten zu sammeln, sofern Sie die Funktionen in der Software nicht deaktiviert haben.
Informationen zur Deaktivierung einer oder mehrerer dieser Funktionen entnehmen Sie der Hilfedatei
oder der README-Datei. Unabhängig davon, welche Informationen in den Anwendungen aufgeführt
werden, gilt, dass Kodak Alaris sich das Recht vorbehält, die Anwendungen jederzeit ohne vorherige
Ankündigung endgültig oder vorübergehend einzustellen oder zu verlagern, ohne dass daraus Ansprüche
gegen Kodak Alaris erwachsen könnten.

11. GARANTIEAUSSCHLUSS. Die Kodak Software wird „WIE BESEHEN“ zur Verfügung
gestellt. Kodak Alaris und seine Lizenzgeber garantieren nicht, dass die Funktionen der Software Ihren
besonderen Anforderungen genügen oder dass die Benutzung der Software ohne Unterbrechungen oder
fehlerfrei verläuft. Sie sind für den Betrieb der Software sowie für die Installation, die Nutzung und die
mit der Software erzielten Ergebnisse verantwortlich.

Die Software kann Hyperlinks zu den Websites anderer Parteien oder Informationen dazu enthalten.
Kodak Alaris gibt weder eine Garantie noch eine Einwilligung, Unterstützung oder Empfehlung in Bezug
auf eine solche Partei, deren Website oder darin enthaltene Informationen. Kodak Alaris ist für die
Verfügbarkeit solcher Websites nicht verantwortlich und haftet nicht für deren Inhalte. Sie entscheiden
selbst, ob Sie mit einer anderen Website arbeiten oder kommunizieren möchten.

ENTGANGENEM GEWINN ODER VERLORENER ERSPARNISSE, BESCHAFFUNGSKOSTEN
FÜR ERSATZPRODUKTE UND -LEISTUNGEN, ODER ANDERER SCHÄDEN, DIE DURCH DIE
VERWENDUNG ODER UNBRAUCHBARKEIT DER SOFTWARE ENTSTANDEN SIND, SELBST
WENN AUF DIE MÖGLICHKEIT SOLCHER SCHÄDEN HINGEWIESEN WURDE. In einigen
Staaten ist der Ausschluss der Haftung für indirekte oder Folgeschäden oder die Beschränkung oder der

13. Anwendbares Recht. Wenn die Software in den Vereinigten Staaten erworben wurde, unterliegt
diese Lizenz den Gesetzen des Bundesstaats New York. Wenn die Software außerhalb der
Vereinigten Staaten erworben wurde, unterliegt dieser Lizenzvertrag den Gesetzen des Landes, in dem sie
erworben wurde. Dieser Lizenzvertrag unterliegt nicht dem Übereinkommen der Vereinten Nationen über
Verträge für den internationalen Warenkauf; die Anwendung des Übereinkommens wird ausdrücklich
ausgeschlossen. Sollte eine Bestimmung dieses Lizenzvertrags oder Teile davon unwirksam sein, wird die
Wirksamkeit des Vertrags im Übrigen nicht berührt.

14. Gesetzliche Exportbestimmungen. Sie stehen dafür ein, dass die Software nur unter Beachtung
aller anwendbaren Exportbestimmungen des Landes, in dem Sie die Software erhalten haben und der
Vereinigten Staaten von Amerika verwendet, exportiert oder reexportiert wird. Insbesondere darf die
Software nicht (a) in ein Land exportiert oder reexportiert werden, über das die Vereinigten Staaten ein
Embargo verhängt haben, oder einem Staatsangehörigen oder Bewohner eines solchen Landes überlassen
werden (derzeit Kuba, Iran, Irak, Libyen, Nordkorea, Serbien, Sudan und Syrien) oder (b) einer Person
überlassen werden, die auf der Liste der Specially Designated Nationals des U.S. Treasury Department
oder der U.S. Department of Commerce Denied Person's List oder der Entity List verzeichnet ist. Durch
die Benutzung der Software erklären Sie, dass Sie weder in einem dieser Länder wohnhaft sind, noch
seiner Kontrolle unterliegen, noch ein Staatsangehöriger oder Bewohner eines dieser Länder sind, noch
auf einer der vorstehend erwähnten Listen genannt werden.

15. Erwerb der Software im Namen der U.S.-Regierung. Dieser Abschnitt 15 gilt für jeden Erwerb
der Software von oder im Namen der U.S.-Regierung oder von einem Haupt- oder Unterauftragnehmer
(auf allen Ebenen), der im Rahmen eines Vertrags, einer Fördervereinbarung, einer
Kooperationsvereinbarung oder durch sonstige Aktivitäten für die U.S.-Regierung tätig ist. Bei der
Software handelt es sich um ein „Commercial Product“ (Handelsprodukt) laut Definition dieses Begriffs
in 48 C.F.R. 2.101 (Oktober 2004) bestehend aus „Commercial Computer Software“ (kommerzieller
Computer-Software) und „Commercial Computer Software Documentation“ (kommerzieller
Softwaredokumentation), wie diese Begriffe in 48 C.F.R. 227.7202-1, 227.7202-3, 227.7202-4 (Oktober
2004) verwendet werden. Wenn Sie der U.S.- Regierung oder einer ihr zugehörigen Behörde oder
Dienststelle angehören, ist die Software (a) nur als kommerzielles Produkt und (b) nur mit den dort
gültigen Rechten lizenziert.

16. BESTIMMUNGEN DER EUROPÄISCHEN GEMEINSCHAFT. Falls diese Software in einem

Land der Europäischen Gemeinschaft erworben wurde, darf keine Bestimmung dieses Lizenzvertrags so
ausgelegt werden, dass sie die in der EG-Software-Richtlinie (91/250/EWG) gewährten Rechte
einschränkt.

17. Verschiedenes. Jede Bestimmung dieses Lizenzvertrags ist trennbar vom übrigen Vertrag. Wenn
eine Bestimmung sich als unwirksam erweist, bleiben die übrigen Bedingungen dieses Lizenzvertrags
davon unberührt. Dieser Lizenzvertrag ist bindend für Abtretungsempfänger und Rechtsnachfolger.
Kodak Alaris haftet nicht für jegliche mangelnde Leistung oder Verzögerung, die teilweise oder
vollständig auf Gründe zurückzuführen ist, die außerhalb der angemessenen Kontrolle von Kodak Alaris
liegen. Nichts in diesem Lizenzvertrag kann zur Schaffung einer Agentur, Partnerschaft oder einer
anderen Form eines gemeinschaftlichen Unternehmens zwischen den Vertragsparteien ausgelegt werden.
Sie bestätigen hiermit, diesen Lizenzvertrag gelesen und verstanden zu haben, den Bedingungen
zuzustimmen und dass es sich bei dem oben Genannten um die vollständige und alleinige Aussage des
Lizenzvertrags handelt.

LICENZA

Il presente Contratto di licenza con l'utente finale ("Licenza" o "Contratto di licenza") si riferisce al
Software che si sta scaricando. Leggere con attenzione i termini e le condizioni seguenti prima di
installare o utilizzare il presente Software (in base alle definizioni riportate di seguito). L'installazione e
l'utilizzo del presente Software implicano l'accettazione da parte dell'Utente dei presenti termini e
condizioni. Questi sostituiscono e subentrano a tutti i termini e condizioni stabiliti precedentemente tra
l'Azienda e l'Utente, salvo espressamente e diversamente concordato dalle parti per iscritto. Ai fini della
presente Licenza, con "Azienda" e "Kodak Alaris" si intende collettivamente Kodak Alaris Inc. e le sue
affiliate, le società controllate e le entità controllanti.

Con "Utente" si intende (a) un individuo di età superiore ai 18 anni che stipula la presente Licenza o (b)
una società (o entità giuridica) per la quale è stata concordata tale Licenza per conto di una persona
autorizzata a vincolare tale parte.

Il termine "Software" si applica ai componenti software e/o firmware installati, nonché ai componenti
software ospitati da terze parti a cui si accede tramite il software installato e a tutta la documentazione
correlata che accompagna tali componenti software.

Per concessori di licenza dell'Azienda si intendono tutte le terze parti che concedono in licenza il
Software, tutto o in parte, a Kodak Alaris, incluse tutte le affiliate, le società controllate e le aziende
correlate. La presente Licenza è stata concepita in modo specifico a vantaggio di Kodak Alaris e dei
concessori di licenza.

1. Concessione di licenza. In conformità ai termini del presente Contratto di licenza, Kodak Alaris
concede all'Utente una licenza non esclusiva per l'uso del Software, soggetta alle restrizioni di licenza
enunciate di seguito. La presente Licenza non concede alcun diritto di utilizzo dei nomi, loghi o marchi di
Kodak Alaris o dei suoi concessori di licenza. Il presente Contratto di licenza non include la vendita del
Software o di altra tipo di proprietà intellettuale. Tutti i diritti, i titoli e gli interessi, nonché tutti i diritti di
proprietà intellettuale relativi al Software, così come il Software stesso, sono proprietà di Kodak Alaris o
dei suoi concessori di licenza.

2. Limitazioni all'uso. L'uso del Software è consentito esclusivamente in combinazione con

apparecchiature e/o materiali di consumo Kodak Alaris. In relazione a tale utilizzo, è possibile copiare il
Software se necessario, ma non è consentito ridistribuirlo o concederlo in sublicenza, affitto, prestito o
leasing a terzi, eccetto nei modi stabiliti nella Sezione 3. Il Software può contenere librerie di subroutine e
file campione, come descritto nella documentazione del Software. Non è consentita la modifica dei file
campione per alcun motivo. L'Utente riconosce e accetta che il Software è destinato a essere utilizzato
solo in combinazione con altre apparecchiature, come indicato nel presente documento.

3. Trasferimento del Software. L'Utente potrà trasferire definitivamente il Software a terzi,

esclusivamente in relazione alla vendita o altra disposizione permanente dell'apparecchiatura, a
condizione che il cessionario accetti i termini e le condizioni della presente Licenza e che l'Utente non
trattenga alcuna copia del Software.

4. Proprietà intellettuale. Il Software è proprietà di Kodak Alaris, dei suoi concessori di licenza o dei
suoi fornitori ed è protetto dalle leggi e dai trattati internazionali sul copyright. L'Utente non è autorizzato
a copiare il Software, a eccezione delle modalità esplicitamente definite nella presente Licenza. Il
presente Software e/o l'apparecchiatura a cui appartiene il presente Software è soggetto a rivendicazioni
stabilite nei brevetti Kodak Alaris elencati all'indirizzo www.kodakmoments.com/patents.

5. Tutela. L'Utente riconosce che il Software contiene importanti informazioni proprietarie e

confidenziali di Kodak Alaris e/o dei suoi concessori di licenza. L'Utente si impegna pertanto a:

i. utilizzare il Software solo per gli scopi limitati autorizzati dalla licenza ivi concessa e per limitare
l'accesso al Software ai propri dipendenti, agenti, consulenti e appaltatori indipendenti direttamente
coinvolti nella realizzazione di tale scopo;

ii. non copiare il Software se non autorizzato per iscritto da Kodak Alaris e di includere su tutte
queste copie autorizzate qualsiasi diritto d'autore designato e richiesto, marchio e avvisi di
informazioni proprietarie di Kodak Alaris e/o dei suoi concessori di licenza;

iii. proteggere in altro modo il Software dalla divulgazione utilizzando almeno lo stesso livello di
cura applicato per proteggere le proprie informazioni riservate o proprietarie;

iv. conservare in modo sicuro tutte le copie del Software in qualsiasi momento e forma;

v. comunicare a Kodak Alaris per iscritto eventuali accessi non autorizzati al Software;

vi. l'Utente non è autorizzato (e compierà tutti gli sforzi possibili per non autorizzare terzi) a: (i)
copiare, decompilare, disassemblare, applicare ingegneria inversa o tentare di scoprire qualsiasi
codice sorgente o idee o algoritmi sottostanti del Software (tranne nella misura in cui la legge
applicabile vieti le restrizioni di ingegneria inversa), (ii) salvo quanto espressamente previsto nel
presente documento, fornire, affittare, prestare, utilizzare per scopi di comproprietà o agenzia di
servizi o altrimenti utilizzare o consentire ad altri di utilizzare il Software a vantaggio di terzi, (iii)
utilizzare il Software in violazione di qualsiasi legge o regolamento o diritti di terzi o (iv) modificare
oppure creare opere derivate dal Software o rimuovere, modificare oppure oscurare qualsiasi
copyright o altri avvisi di proprietà di qualsiasi relativa documentazione.

L'Utente si impegna a manlevare e tenere indenne l'Azienda e i suoi concessori di licenza per ogni perdita
o danno in cui la stessa possa essere incorsa in relazione ad azioni legali legate a quanto sopra.

6. Privacy. Durante l'utilizzo, il Software, o il suo download, potrebbe richiedere o raccogliere

informazioni limitate sull'Utente. Il Software potrebbe utilizzare cookie o altri meccanismi di tracciatura
passiva e strumenti per raccogliere informazioni che possono agevolare l'utilizzo del Software. La
raccolta, l'uso, la divulgazione e la gestione delle informazioni di Kodak Alaris sono effettuate in
conformità con la relativa Informativa sulla privacy. La versione più recente dell'Informativa sulla
privacy è disponibile all'indirizzo https://www.kodakalaris.com/privacy-policy. Questa Informativa sulla
privacy illustra anche le opzioni disponibili per quanto riguarda l'utilizzo delle informazioni da parte di
Kodak Alaris e come è possibile accedere e aggiornare tali informazioni.
7. Risoluzione. La presente licenza è valida fino alla risoluzione dalla stessa. La risoluzione può
aver luogo in qualsiasi momento distruggendo o disattivando permanentemente il Software e tutte le
relative copie in qualsiasi forma, oppure se il Software non può essere distrutto o disattivato
permanentemente a causa del modo in cui è stato installato su un dispositivo, è possibile rescindere la
presente Licenza interrompendo l'utilizzo o autorizzando altri a usare il Software, a condizione che
qualsiasi uso del Software preveda da quel momento l'accettazione di questi termini e condizioni e che la
Licenza venga considerata nuovamente effettiva. La presente Licenza verrà, inoltre, rescissa
automaticamente in caso di violazione di qualsiasi termine o condizione della stessa. In caso di
risoluzione, l'Utente si impegna a distruggere o disattivare permanentemente il Software e tutte le relative
copie in qualsiasi forma, oppure se il Software non può essere distrutto, l'Utente accetta di non utilizzare o
non autorizzare altri a utilizzare il Software, senza previa accettazione delle condizioni della presente
Licenza. L'Utente può mantenere solamente le copie che, per loro natura, devono restare in suo possesso
anche dopo la rescissione del Contratto di licenza.

8. Conformità alle leggi e ai termini. La forma e il contenuto delle immagini, del testo o di altro
materiale trasmesso o utilizzato per la creazione di prodotti sono regolati dalle leggi applicabili (ad
esempio, dalle norme che vietano gli abusi sui minori, la pornografia infantile e la violazione del
copyright o della privacy). Nel caso in cui l'Utente utilizzi il Software per trasmettere materiale a Kodak
Alaris o alle sue affiliate per la stampa o la realizzazione di prodotti o per altri scopi, l'Utente deve
attenersi ai relativi termini del servizio. Non è consentito l'uso del Software per trasmettere a Kodak
Alaris o alle sue affiliate qualsiasi tipo di immagine, testo o altro materiale considerato illegale, in quanto
violazione dei diritti civili (ad esempio, materiale diffamatorio) o delle norme penali (ad esempio,
materiale osceno) o incitamento a sentimenti ostili verso qualsiasi razza, religione, etnia, fascia di età,
sesso od orientamento sessuale. L'Utente riterrà Kodak Alaris esente da qualsiasi responsabilità e sosterrà
il pagamento di eventuali indennizzi in relazione a richieste di risarcimento derivanti da o correlate alla
mancata osservanza da parte dell'Utente dei termini contenuti nella Sezione 8 del presente Contratto di
licenza.

9. Dichiarazioni e garanzie dell'Utente. L'Utente dichiara e garantisce di disporre dei diritti legali e
della possibilità di accettare il presente Contratto di Licenza. L'Utente si impegna a manlevare e tenere
indenne l'Azienda e i suoi concessori di licenza per ogni perdita o danno in cui la stessa possa essere
incorsa in relazione ad azioni legali legate a quanto sopra.

10. Funzionalità del Software. Il Software può contenere funzionalità che consentono a Kodak Alaris
di informare l'Utente tramite Internet della disponibilità di aggiornamenti software, promozioni, prodotti e
servizi di possibile interesse, di aggiornare i file di dati del prodotto e il contenuto del Software relativo
alle istruzioni e al marketing e di raccogliere dati sull'utilizzo del prodotto in forma anonima. Il Software
può anche contenere funzionalità che consentono all'Utente di scaricare file per la ricerca di negozi, temi
di nuovi prodotti e cataloghi di prodotti. L'Utente accetta l'utilizzo, da parte di Kodak Alaris, di queste
funzionalità per la fornitura di tali notifiche e aggiornamenti, l'esecuzione dei download e la raccolta dei
dati, salvo che l'Utente non decida di disattivare tali funzioni nel Software. Per informazioni su come
disattivare una o più di queste funzioni, fare riferimento al file della guida o il file README.
Indipendentemente da qualsiasi informazione presentata sulle Applicazioni, Kodak Alaris si riserva il
diritto di interrompere, spostare o sospendere le applicazioni o di modificare le specifiche senza preavviso
in qualsiasi momento, senza incorrere in alcun obbligo.

11. ESCLUSIONE DI GARANZIA. Il Software viene fornito "COSÌ COM'È". Kodak Alaris e i suoi
concessori di licenza non garantiscono che le funzioni del Software saranno rispondenti alle esigenze
dell'Utente o che il funzionamento del Software non verrà interrotto o sarà esente da errori. L'Utente si
assume la responsabilità per il funzionamento del Software, così come per l'installazione, l'utilizzo e i
risultati ottenuti utilizzando il Software.

Il Software può contenere collegamenti ipertestuali a siti Web o informazioni di terzi. Kodak Alaris non

RESPONSABILI NEI CONFRONTI DELL'UTENTE PER DANNI EFFETTIVI, DIRETTI,
INDIRETTI, INCIDENTALI, SPECIFICI, EMERGENTI O PUNITIVI, COMPRESE EVENTUALI
PERDITE DI PROFITTI, DENARO O ALTRI DANNI DERIVANTI DALL'USO O
DALL'IMPOSSIBILITÀ DI USARE IL SOFTWARE, ANCHE SE INFORMATI DELLA
POSSIBILITÀ DI TALI DANNI. Alcuni Stati e Paesi non consentono la limitazione o l'esclusione della
responsabilità per danni incidentali o emergenti o hanno leggi che riducono la limitazione o l'esclusione di

13. Legge applicabile. Se il Software è stato acquistato negli Stati Uniti, la presente Licenza è
soggetta alle leggi dello Stato di New York. Nel caso in cui il Software sia stato acquistato al di fuori
degli Stati Uniti, la presente licenza è soggetta alle leggi del Paese in cui è stato acquisito. La presente
licenza non è soggetta alla Convenzione delle Nazioni Unite sui contratti di vendita internazionale di
merci, la cui applicazione è stata espressamente esclusa. Se, per qualsiasi ragione, un tribunale
giurisdizionale competente ritenga inapplicabile una disposizione, o una parte di essa, il resto della
licenza continuerà ad avere pieno vigore e validità.

14. Garanzie offerte dalle leggi sull'esportazione. L'Utente non è autorizzato ad utilizzare, esportare o
riesportare il Software, salvo quando autorizzato dalle leggi degli Stati Uniti e dalle leggi della
giurisdizione all'interno della quale il Software è stato acquisito. Nello specifico, ma senza limitazioni, il
Software non può essere esportato o riesportato (a) in (o a un residente o cittadino di) qualsiasi Paese
posto sotto embargo dagli Stati Uniti (inclusi senza limitazioni Cuba, Iran, Iraq, Libia, Corea del Nord,
Serbia, Sudan, Siria) o (b) a chiunque si trovi nell'elenco "Specially Designated Nationals" (Cittadini
specialmente designati) del Dipartimento del Tesoro degli Stati Uniti o "Denied Person's List or Entity

computer software" (software commerciale per computer) e "commercial computer software

16. DISPOSIZIONI DELLA COMUNITÀ EUROPEA. Se si è ottenuto il Software in un Paese della

Comunità europea, nessuna disposizione contenuta nella presente licenza deve essere interpretata come
una restrizione dei diritti garantiti dalla Direttiva europea sui software (91/250/CEE).

17. Varie. Ciascuna clausola del presente Contratto di licenza è separabile. Nell'eventualità in cui una
delle clausole venga ritenuta inapplicabile, ciò non influisce sull'applicabilità delle rimanenti clausole,
termini o condizioni del presente Contratto di licenza. Il presente Contratto di licenza è vincolante per gli
eredi e gli assegnatari. Kodak Alaris non verrà ritenuta responsabile per mancate prestazioni o ritardi
attribuibili in tutto o in parte a qualsiasi causa che non sia sotto il suo controllo. Nessuna disposizione ivi
contenuta deve essere interpretata in modo che possa dare luogo alla creazione di contratti di agenzia,
partnership o altre forme di imprese societarie tra le parti. L'Utente riconosce di aver letto e compreso il
presente Contratto di licenza; inoltre, conferma di accettare i termini e quanto dichiarato in precedenza
come dichiarazione completa ed esclusiva del Contratto di licenza.

LICENCIA

Este es el Contrato de licencia de usuario final («Contrato» o «Contrato de licencia») del software que
se dispone a descargar. Lea los siguientes términos y condiciones atentamente antes de instalar o usar este
Software (definido a continuación). La instalación y el uso de este Software implican la aceptación de
dichos términos y condiciones. Estos términos sustituyen todos los términos y condiciones previos
establecidos entre la Empresa y el Usuario, a menos que ambas partes hayan acordado expresamente lo
contrario por escrito. A los efectos de este Contrato de licencia, «Empresa» y «Kodak Alaris» hacen
referencia de forma colectiva a Kodak Alaris Inc. y a sus entidades filiales, subsidiarias y matrices.

El término «Usuario» hace referencia (a), en caso de un individuo, a la persona mayor de 18 años que
acepta esta Licencia o (b), en caso de una empresa (u otra entidad legal), a la parte en cuyo nombre una
persona autorizada y con autoridad para vincular a dicha parte acepta esta Licencia.

El término «Software» se aplica a los componentes de software y/o firmware instalados por el Usuario,
así como a los componentes de software alojados por terceros a los que se accede a través del software
instalado, y a la documentación relacionada que acompaña a dichos componentes de software.

Las referencias a los otorgantes de licencia de la Empresa hacen referencia a cualquier tercero que otorga
una licencia de la totalidad o parte del software a Kodak Alaris, incluyendo todas las filiales, subsidiarias
y empresas relacionadas. Esta Licencia está redactada específicamente para el beneficio de Kodak Alaris
y sus otorgantes de licencia.

1. Concesión de licencia. Siempre y cuando el Usuario cumpla con los términos de este Contrato de
licencia, Kodak Alaris le otorga una licencia no exclusiva para utilizar el Software con sujeción a las
restricciones que se estipulan a continuación. En esta Licencia no se otorga ningún derecho para usar las
marcas comerciales, los logotipos ni los nombres de Kodak Alaris o de sus otorgantes de licencia. Este
Contrato de licencia no supone la venta del Software ni de ninguna otra propiedad intelectual. Cualquier
derecho, título de propiedad y participación, y todos los derechos de propiedad intelectual relacionados
con el Software, así como el Software en sí, pertenecen a Kodak Alaris o sus otorgantes de licencia.

2. Restricciones de uso. El Usuario debe hacer uso del Software únicamente en conjunto con los
consumibles y el equipo autorizado por Kodak Alaris. Para el uso del Software en dicho equipo, es
posible copiar el Software según sea necesario, pero no se podrá redistribuir, otorgar sublicencias,
alquilar, prestar ni arrendar a terceras partes, excepto según lo estipulado en la Sección 3. El Software
podría contener archivos de muestras y bibliotecas de subrutinas, tal y como se describe en la
documentación del Software. Estos archivos no se podrán modificar bajo ningún concepto. El Usuario
acepta que el Software está diseñado para su uso exclusivo en conjunto con el equipo según lo descrito en
el presente documento.

3. Transferencia del Software. El Usuario podrá transferir el Software de forma permanente a un

tercero únicamente en conexión con la venta del equipo o cualquier otra disposición permanente
relacionada con el mismo, siempre que el tercero acepte los términos y condiciones de esta Licencia y el
Usuario no retenga ninguna copia del Software.

4. Propiedad intelectual. El Software es propiedad de Kodak Alaris, sus otorgantes de licencia o sus
proveedores y está protegido por las leyes de derechos de autor y los tratados internacionales. El Software
no se podrá copiar salvo por lo expresamente estipulado en esta Licencia. Este Software o el equipo al
que este Software pertenece están sujetos a las afirmaciones estipuladas en las patentes de Kodak Alaris
recogidas en www.kodakmoments.com/patents.

5. Protección. El Usuario acepta que el Software contiene información confidencial y de propiedad

valiosa, que pertenece a Kodak Alaris y a sus otorgantes de licencia. Por lo tanto, el Usuario se
compromete a lo siguiente:

i. Utilizar el Software únicamente para los fines autorizados y según las limitaciones que se indican
en la presente Licencia, así como limitar el acceso al Software a los empleados, agentes, asesores y
contratistas independientes que se encuentren directamente involucrados en la consecución de dichos
fines.

ii. No realizar ninguna copia del Software, a excepción de que Kodak Alaris autorice lo contrario
por escrito, e incluir en todas las copias autorizadas los avisos correspondientes relacionados con la
información de propiedad intelectual, la marca comercial y los derechos de autor, tanto de Kodak
Alaris como de sus otorgantes de licencia.

iii. Evitar la publicación del software mediante el empleo del mismo nivel de atención que el
Usuario emplea para proteger su propia información confidencial o de propiedad.

iv. Almacenar de forma segura todas las copias del Software, en todo momento y en cualquier
formato.

v. Notificar por escrito a Kodak Alaris de cualquier acceso no autorizado al Software.

vi. El Usuario se abstendrá, y llevará a cabo su mejor esfuerzo para hacer que cualquier tercero se
abstenga, de: (i) copiar, descompilar, desmontar, aplicar procedimientos de ingeniería inversa o
intentar descubrir cualquier código fuente o ideas o algoritmos subyacentes del Software (excepto en
la medida en que la legislación aplicable prohíba las restricciones relativas a la ingeniería inversa);
(ii) proporcionar, alquilar, prestar, utilizar en tiempo compartido o con fines de oficinas de servicios,
o permitir de cualquier otro modo el uso del Software para el beneficio de terceros, con excepción de
lo expresamente permitido según el presente documento; (iii) usar el Software en cualquier modo
que infrinja cualquier legislación, normativa o derecho de terceros; o (iv) modificar o crear trabajos
derivados del Software, así como eliminar, modificar u ocultar la información relacionada con los
derechos de autor o cualquier otra información de propiedad presentes en la documentación
relacionada.

Asimismo, el Usuario acepta indemnizar y eximir a la Empresa y a sus otorgantes de licencia de cualquier
responsabilidad y daños incurridos por una acción legal en relación con lo anterior.

6. Privacidad. Al utilizar o descargar el Software, este podría solicitar o recopilar determinada

información confidencial limitada sobre el Usuario. El Software también puede utilizar cookies u otros
mecanismos y herramientas de seguimiento pasivo para recopilar información con el objetivo de facilitar
el uso del Software. La recopilación, el uso, la divulgación y el tratamiento de la información del Usuario
por parte de Kodak Alaris se lleva a cabo de conformidad con la Política de privacidad. La versión más
reciente de la Política de privacidad está disponible en https://www.kodakalaris.com/privacy-policy. Esta
Política de privacidad también explica las opciones a disposición del Usuario con respecto al uso que
Kodak Alaris hace de su información y cómo puede acceder a ella.

7. Vigencia. Esta Licencia estará en vigor hasta su rescisión. Se podrá rescindir en cualquier
momento mediante la destrucción o la desactivación permanente del Software y de todas las copias
efectuadas en cualquier formato. Si no es posible destruir el Software o desactivarlo permanentemente
debido a la forma en la que está instalado en un dispositivo, el Usuario podrá revocar esta Licencia
mediante el cese del uso del Software, teniendo en cuenta que cualquier uso posterior del Software
constituirá la aceptación de estos términos y condiciones, así como la entrada en vigor de nuevo de esta
Licencia. Esta Licencia también se rescindirá automáticamente si el Usuario incumple cualquier
disposición de la Licencia. Con la rescisión, independientemente de la causa, el Usuario acepta destruir el
Software y todas las copias, sea cual sea el formato en que se conserven. Si no es posible destruir el
Software, el Usuario acepta no utilizar el Software ni permitir que otros lo utilicen sin aceptar los
términos de esta Licencia. Las disposiciones que, por su naturaleza, permanezcan vigentes tras la
rescisión de este Contrato de licencia seguirán siendo aplicables.

8. Cumplimiento con la legislación y los términos. El formato y contenido de las imágenes, el texto
u otro material que se transmitan o con los que se creen productos está sujeto a las leyes en materia
aplicables (como las relativas a la prohibición del abuso de menores, pornografía infantil, incumplimiento
de derechos de autor o invasión de la privacidad). Si el Software se utiliza para transmitir material a
Kodak Alaris o a sus empresas filiales para la impresión o ejecución de un producto u otros fines, se
deberán cumplir las condiciones de servicio relevantes. El Software no se podrá utilizar para transmitir a
Kodak Alaris o a sus empresas filiales imágenes, texto u otro material considerado ilegal, ya sea por una
infracción de carácter civil (daño a la reputación) o penal (como obscenidad), o que incite al odio por
motivos de raza, religión, etnia, grupo generacional, género o inclinación sexual. El Usuario acepta
defender, indemnizar y eximir a Kodak Alaris de reclamaciones derivadas o relacionadas con el
incumplimiento de las condiciones de esta Sección 8.

9. Declaraciones y garantías del Usuario. El Usuario declara y garantiza que dispone de los derechos
legales y la capacidad necesarios para aceptar este Contrato de licencia. Asimismo, el Usuario acepta
indemnizar y eximir a la Empresa y a sus otorgantes de licencia de cualquier responsabilidad y daños
incurridos por una acción legal en relación con lo anterior.

10. Características del Software. El Software puede contener funciones que permitan a Kodak Alaris
realizar lo siguiente a través de Internet: notificar al Usuario la disponibilidad de actualizaciones de
software, promociones, productos y servicios que pueden resultar de su interés; actualizar los archivos de
datos del producto y el contenido de marketing o instrucciones del Software; y recopilar datos de uso
anónimos. El Software también podría contener funciones que permitan descargar archivos de buscador
de tiendas, nuevos temas y catálogos de productos. El Usuario acepta que Kodak Alaris emplee estas
funciones para proporcionar avisos y actualizaciones, permitir descargas y recopilar datos, a menos que
desactive dichas funciones en el Software. Para obtener información acerca de cómo desactivar una o
varias de estas funciones, el Usuario puede consultar el archivo de ayuda o el archivo LÉAME. Con
independencia de cualquier información que se presente en las Aplicaciones, Kodak Alaris se reserva el
derecho a interrumpir, trasladar o suspender las Aplicaciones, o a cambiar las especificaciones en
cualquier momento y sin previo aviso sin contraer obligación alguna.

11. EXCLUSIÓN DE GARANTÍAS. El Software se proporciona «tal cual». Kodak Alaris y sus
otorgantes de licencia no garantizan que las funciones contenidas en el Software cumplan los requisitos
del Usuario ni que el Software funcione de forma ininterrumpida o sin errores. El Usuario asume la
responsabilidad por el funcionamiento del Software y por la instalación, el uso y los resultados obtenidos
con el mismo.

El Software podría contener enlaces de hipertexto a sitios web o información de terceros. Kodak Alaris no
garantiza, recomienda, patrocina ni respalda a terceros, así como tampoco a sitios web de terceros ni la
información contenida en los mismos. Kodak Alaris no es responsable de la disponibilidad ni del
contenido de tales sitios. Será decisión del Usuario interactuar o comunicarse con cualquier otro sitio
web.

De acuerdo con la legislación aplicable, que prohíbe las siguientes exclusiones, KODAK ALARIS Y SUS
OTORGANTES DE LICENCIA NO OFRECEN GARANTÍAS DE NINGÚN TIPO RELACIONADAS
CON EL SOFTWARE, YA SEAN EXPRESAS O IMPLÍCITAS, ENTRE OTRAS LAS GARANTÍAS
DE COMERCIALIZACIÓN E IDONEIDAD PARA UN FIN CONCRETO Y DE NO
INCUMPLIMIENTO, O LAS GARANTÍAS QUE SURJAN EN EL CURSO DE EJECUCIÓN DEL
RENDIMIENTO, GESTIÓN, USO O USO COMERCIAL. Algunos estados y países no permiten la
exclusión de garantías implícitas, o tienen legislaciones que imponen determinadas garantías de derecho
que no se pueden excluir, por lo que la exclusión anterior podría no aplicarse en su caso.

12. LIMITACIÓN DE RESPONSABILIDAD. El Usuario utiliza el Software asumiendo todos los

riesgos. Bajo ninguna circunstancia, Kodak Alaris, sus agentes, otorgantes de licencia o proveedores
serán responsables por el uso o mal uso del Software, así como tampoco por las expectativas previstas.
EN LA MEDIDA PERMITIDA POR LA LEY, KODAK ALARIS, SUS OTORGANTES DE
LICENCIA, PROVEEDORES O COMERCIALES NO SERÁN RESPONSABLES EN NINGÚN CASO
DE NINGÚN DAÑO REAL, DIRECTO, INDIRECTO, ACCIDENTAL, ESPECIAL, DERIVADO,
SECUNDARIO O PUNITIVO QUE SUFRA EL USUARIO, INCLUIDOS LUCRO CESANTE,
PÉRDIDA DE AHORROS, COSTE DE ADQUISICIÓN DE SERVICIOS O PRODUCTOS
SUSTITUTOS U OTROS DAÑOS DERIVADOS DEL USO O LA INCAPACIDAD DE USO DEL
SOFTWARE, INCLUSO SI TENÍA ADVERTENCIA DE LA POSIBILIDAD DE TALES DAÑOS.
Algunos estados y países no permiten limitar ni excluir la responsabilidad de daños incidentales o
derivados, o tienen legislaciones que restringen la limitación o exclusión de la responsabilidad, por lo que
la limitación anterior podría no aplicarse en su caso.

13. Legislación aplicable. Si el Software se ha adquirido en los Estados Unidos, esta Licencia se
interpretará según las leyes del estado de Nueva York. Si el software se ha adquirido fuera de los Estados
Unidos, la presente Licencia estará sujeta a la legislación del país donde se haya adquirido. Esta Licencia
no estará regida por la Convención de las Naciones Unidas sobre los Contratos de Compraventa
Internacional, cuya aplicación queda expresamente excluida. Si, por cualquier motivo, un tribunal de la
jurisdicción competente considera que alguna disposición de la presente Licencia o parte de ella no es
válida o aplicable, las demás disposiciones seguirán en plena vigencia.

14. Garantías frente a las leyes de exportación. El Usuario no puede utilizar ni, de otro modo,
exportar o reexportar el Software, excepto en los casos previstos por la legislación de los Estados Unidos
y de la jurisdicción en la que se haya adquirido el Software. En particular, pero sin limitación, el Software
no se podrá exportar o reexportar (a) a ningún país embargado por los EE. UU. (incluidos, entre otros,
Cuba, Irán, Irak, Libia, Corea del Norte, Serbia, Sudán y Siria), ni a un residente o ciudadano del mismo,
o (b) a ninguna persona que figure en la lista del Departamento del Tesoro de los EE. UU. de Nacionales
Especialmente Designados, en la Lista de Personas Rechazadas del Departamento de Comercio de los
Estados Unidos o en la Lista de Entidad. Al utilizar el Software, el Usuario declara y garantiza que no
está en ninguna de estas listas ni países, ni bajo el control de un ciudadano o residente de uno de estos
países o una persona incluida en dichas listas.

15. Adquisiciones federales. Esta Sección 15 se aplica a las adquisiciones del Software por parte del
gobierno federal estadounidense o por un contratista principal o subcontratista (de cualquier nivel)
vinculado al gobierno federal por un contrato, beca, acuerdo de cooperación u otra actividad. El Software
constituye un «artículo comercial», considerando ese término como se lo define en 48 C.F.R. 2.101
(octubre de 2004), que consiste en «software informático comercial» y «documentación de software
informático comercial», como se utilizan tales términos en 48 C.F.R. 227.7202-1, 227.7202-3,
227.7202-4 (octubre de 2004). Si el Usuario trabaja para el gobierno de los EE. UU. o para alguna
agencia o departamento del mismo, el Software se otorga mediante licencia (a) únicamente como artículo
comercial y (b) solo con los derechos otorgados según el presente documento.

16. DISPOSICIONES PARA LA COMUNIDAD EUROPEA. Si el Software se ha adquirido en un

país de la Unión Europea, ninguna de las disposiciones estipuladas en esta Licencia habrá de interpretarse
como una restricción de los derechos otorgados en la Directiva de Software de la Comunidad Europea
(91/250/CEE).

17. Disposiciones varias. Todas las disposiciones de este Contrato de licencia son divisibles. Si se
concluye que alguna disposición no se puede ejecutar, esto no afectará a la vigencia del resto de
disposiciones, condiciones ni términos de este Contrato de licencia. Este Contrato de licencia vincula a
sucesores y cesionarios. Kodak Alaris no será responsable frente a faltas de rendimiento o retrasos
atribuibles, total o parcialmente, a alguna causa que escape de su capacidad de control razonable. Nada de
lo expresado en este documento habrá de interpretarse como la creación de una agencia, sociedad o
cualquier otro tipo de empresa conjunta entre las partes. El Usuario confirma que ha leído este Contrato
de licencia, que lo comprende y que acepta vincularse por sus condiciones, y que lo anterior es una
declaración completa y exclusiva del Contrato de licencia.

Este contrato de licença de usuário final (“Licença” ou “Contrato de licença”) refere-se ao Software que
você está baixando. Leia com atenção os seguintes termos e condições antes de instalar ou usar este
Software (especificado a seguir). A sua instalação e uso do Software constitui a aceitação destes termos e
condições. Estes termos anulam e substituem todos os termos e condições anteriores entre a Empresa e
você, a menos que as partes tenham expressamente acordado de outra maneira por escrito. Para fins desta

e toda a documentação relacionada que acompanha esses componentes de software.

As referências aos licenciantes da Empresa referem-se a qualquer terceiro que licencie toda ou qualquer
parte de tal Software para a Kodak Alaris, incluindo todas as empresas afiliadas, subsidiárias e
relacionadas. A única finalidade desta Licença é oferecer os benefícios da Kodak Alaris e de seus
licenciantes.

1. Concessão da licença. Desde que você esteja em conformidade com o Contrato de licença, a
Kodak Alaris concede a você uma licença não-exclusiva de uso do Software, sujeita às restrições
definidas abaixo. Nenhum direito de uso de nomes, logotipos ou marcas comerciais da Kodak Alaris ou
de seus licenciantes é concedido nesta Licença. O Contrato de licença não tem como objetivo a venda do
Software ou de qualquer outra propriedade intelectual. Todos os direitos, títulos e interesses, bem como
todos os direitos de propriedade intelectual sobre o Software, bem como o próprio Software, são de

2. Restrições de uso. Você pode usar o Software apenas em conexão com equipamentos e/ou
produtos autorizados pela Kodak Alaris. Em conexão com esse uso, você pode copiar o Software
conforme necessário para permitir que você utilize-o, mas você não poderá redistribuir, sublicenciar,
alugar, emprestar ou arrendar o Software a terceiros, exceto conforme previsto na Seção 3. O Software
pode conter bibliotecas de sub-rotina e arquivos de amostra, descritos na documentação do Software.
Você não pode modificar os arquivos de amostra por quaisquer motivos que seja. Você reconhece e
concorda que o Software é destinado para uso somente em conexão com o equipamento, conforme
estabelecido neste documento.

3. Transferência do Software. Você pode transferir permanentemente o Software para outra parte
somente em conexão com a venda ou outra disposição permanente do equipamento se a outra parte concordar
em aceitar os termos e condições desta Licença e você não conservar nenhuma cópia do Software.
4. Propriedade intelectual. O Software é de propriedade da Kodak Alaris, seus licenciantes ou
fornecedores e é protegido por leis de direitos autorais e tratados internacionais. Não é permitido copiar o
Software, a não ser conforme expressamente descrito nesta Licença. Este Software e/ou o equipamento ao
qual este Software pertence está sujeito a reivindicações estabelecidas nas patentes da Kodak Alaris
listadas em www.kodakmoments.com/patents.

5. Proteção. Você reconhece que o Software contém informações proprietárias e confidenciais

valiosas da Kodak Alaris e/ou seus licenciantes. Portanto, você concorda em:

i. Usar o Software apenas para os fins limitados autorizados na licença aqui concedida, e limitar o
acesso ao Software aos seus próprios funcionários, agentes, consultores e contratantes independentes
que estejam diretamente envolvidos na realização de tais fins;

ii. Não copiar o Software, exceto conforme autorizado por escrito pela Kodak Alaris e incluir em
todas as cópias autorizadas, quaisquer direitos autorais designados e solicitados, marca registrada e
avisos de informações de propriedade da Kodak Alaris e/ou seus licenciantes;

iii. Proteger o Software da divulgação, usando pelo menos o mesmo grau de cuidado que você usa
para proteger suas próprias informações confidenciais ou proprietárias;

iv. Armazenar com segurança todas as cópias do Software em todos os momentos e em qualquer
forma;

v. notificar a Kodak Alaris por escrito sobre qualquer acesso não autorizado ao Software; e

vi. Você não vai (e vai usar seus melhores esforços consistentes para não permitir aos terceiros): (i)
copiar, descompilar, desmontar, fazer engenharia reversa ou tentar descobrir qualquer código-fonte
ou ideias ou algoritmos subjacentes do Software (exceto na medida em que a lei aplicável proíbe as
restrições de engenharia reversa), (ii) exceto conforme expressamente previsto neste documento,
fornecer, arrendar, emprestar, usar para fins de tempo compartilhado ou bureau de serviços ou, de
outra forma, usar ou permitir que outras pessoas usem o Software para o benefício de terceiros, (iii)
usar o Software em violação de qualquer lei ou regulamento ou quaisquer direitos de terceiros, ou
(iv) modificar ou fazer trabalhos derivados do Software ou remover, modificar ou ocultar qualquer
direito autoral ou outros avisos de propriedade de qualquer documentação relacionada.

Você concorda em indenizar e isentar a Empresa e seus licenciantes de todas as responsabilidades e danos
que possam incorrer em qualquer ação legal relacionada ao acima disposto.

6. Privacidade. O Software, ou seu download, pode solicitar ou coletar certas informações limitadas
sobre você quando você usa o Software. O Software pode ainda usar cookies ou outros mecanismos e
ferramentas de rastreamento passivo para coletar informações a fim de facilitar sua utilização do
Software. A coleta, o uso, a divulgação e o manuseio de suas informações pela Kodak Alaris são feitos de
acordo com a Política de Privacidade. A versão mais recente da Política de Privacidade pode ser
encontrada em https://www.kodakalaris.com/privacy-policy. Esta Política de Privacidade também explica
as opções disponíveis para o uso de suas informações pela Kodak Alaris e como você pode acessar e
atualizar essas informações.

7. Vigência. Esta Licença vigorará até que seja rescindida. Você pode encerrá-la a qualquer
momento, destruindo ou desativando permanentemente o Software, juntamente com todas as cópias de
qualquer formato ou, se o Software não puder ser destruído ou permanentemente desativado por causa da
maneira como ele está instalado em um dispositivo, você poderá rescindir esta Licença deixando de usar
ou permitir que outros usem o Software, desde que qualquer uso do Software posteriormente constitua
uma aceitação destes termos e condições e a Licença será novamente efetiva. Esta Licença também
poderá ser rescindida caso você não cumpra os termos e condições desta Licença. Após a rescisão por
qualquer motivo, você concorda em destruir ou desativar permanentemente o Software, juntamente com
todas as cópias em qualquer forma, ou se o Software não puder ser destruído, você concorda em não usar

8. Conformidade com leis e termos. O formato e o conteúdo das fotos, dos textos ou de outros
materiais transmitidos, ou pelos quais produtos são criados, são regidos pelas leis aplicáveis, como a de
proibição de abuso infantil, de pornografia infantil, de infração dos direitos autorais ou de invasão de
privacidade. Se você usar o Software para transmitir material à Kodak Alaris ou suas afiliadas para
impressão ou realização de produtos ou outros fins, você deve cumprir os termos de serviço relevantes.
Você não poderá usar o Software para transmitir à Kodak Alaris ou às suas afiliadas fotos, textos ou outro
material ilegal que consista em violação dos direitos civis (como calúnia) ou de leis criminais (como
obscenidade), ou que represente agressão de qualquer forma, seja de raça, religião, etnia, idade, gênero ou
sexualidade. Você concorda em defender, indenizar e manter a integridade da Kodak Alaris contra
qualquer reivindicação que possa surgir do descumprimento dos termos desta Seção 8 ou que possa estar
relacionada a ela.

9. Suas representações e garantias. Você declara e garante que possui o direito legal e a capacidade
de concordar com este Contrato de licença. Você concorda em indenizar e isentar a Empresa e seus
licenciantes de todas as responsabilidades e danos que possam incorrer em qualquer ação legal
relacionada ao acima disposto.

10. Recursos do Software. O Software poderá conter recursos que permitam à Kodak Alaris, por
meio da Internet, notificá-lo de serviços, produtos, promoções e atualizações de software disponíveis que
possam interessá-lo, atualizar conteúdo instrucional, de marketing e arquivos de dados no Software, além
de coletar dados de identificação de uso não pessoal. O Software também pode conter recursos que
possibilitam a você fazer o download de arquivos localizadores de lojas e de novos temas e catálogos de
produtos. Você está de acordo que a Kodak Alaris poderá utilizar esses recursos para fornecer as
atualizações, notificar, conceder downloads e fazer a coleta dos dados, salvo quando você optar por
desativar tais recursos no software. Para obter mais informações sobre como desativar um ou mais destes
recursos, consulte o arquivo de ajuda ou o arquivo LEIA-ME. Independentemente de qualquer
informação apresentada nos Aplicativos, a Kodak Alaris se reserva o direito, sem aviso prévio, de
interromper, mover ou suspender os Aplicativos ou alterar especificações a qualquer momento, sem
incorrer obrigações.

11. AVISO DE ISENÇÃO DE GARANTIA. O Software é fornecido a você “NO ESTADO EM

QUE SE ENCONTRA”. A Kodak Alaris e seus licenciantes não garantem que as funções contidas no
Software atenderão às suas exigências nem que a operação será ininterrupta ou sem nenhum erro. Você
assume a responsabilidade pela operação do Software e pela instalação, uso e resultados obtidos do
Software.

O Software poderá conter links de hipertexto para informações ou sites de terceiros. A Kodak Alaris não
faz garantias, declarações, patrocínios nem recomendações de terceiros, sites de terceiros ou informações
a estes relacionadas. A Kodak Alaris não é responsável pela disponibilidade de tais sites nem pelo
conteúdo dos mesmos. Você deverá tomar suas próprias decisões quanto às interações ou comunicações
com outros sites.

MÁXIMA EXTENSÃO POSSÍVEL DENTRO DA LEI, EM HIPÓTESE ALGUMA, A KODAK
ALARIS, SEUS LICENCIANTES, FORNECEDORES OU REVENDEDORES SERÃO
RESPONSÁVEIS POR DANOS REAIS, DIRETOS, INDIRETOS, INCIDENTAIS, ESPECÍFICOS,
CONSEQUENCIAIS OU PUNITIVOS, INCLUINDO PERDA DE LUCROS, PERDA DE
ECONOMIAS, CUSTO DE AQUISIÇÃO DE PRODUTOS OU SERVIÇOS SUBSTITUTOS OU
OUTROS DANOS RESULTANTES DO USO OU DA INCAPACIDADE DE USO DO SOFTWARE,
MESMO SE AVISADA A POSSIBILIDADE DE TAIS DANOS. Alguns estados e países não permitem
a limitação ou exclusão de responsabilidade por indenizações incidentais ou indiretas ou possuem uma
legislação que restringe a limitação ou exclusão de responsabilidade e, portanto, a limitação acima
mencionada pode não se aplicar a você.

13. Lei Regente. Se o Software for adquirido nos Estados Unidos, esta Licença será regida pelas leis
do Estado de Nova York. Se o Software for adquirido fora dos Estados Unidos, este Contrato será regido
pelas leis do país onde ele foi obtido. Esta Licença não deve ser governada pela Convenção das Nações
Unidas para a Venda Internacional de Mercadorias, sendo que a aplicação desta é expressamente
rejeitada. Se, por qualquer motivo, uma corte de jurisdição competente determinar que qualquer cláusula
(ou parte dela) é inexequível, o restante desta Licença continuará em pleno vigor e efeito.

14. Garantias da Lei de Exportação. Não é permitido usar, exportar ou reexportar o Software, exceto
quando autorizado pela lei dos Estados Unidos e pelas leis de jurisdição sob as quais o Software foi
obtido. Especificamente, mas sem limitação, o Software não pode ser exportado ou reexportado (a) para
os países embargados pelos Estados Unidos (ou para cidadãos ou residentes destes), inclusive, entre
outros, Cuba, Irã, Iraque, Líbia, Coreia do Norte, Sérvia, Sudão e Síria; ou (b) para qualquer pessoa na
lista de Cidadãos Especialmente Designados do Ministério da Fazenda dos Estados Unidos, na Lista de
Pessoas Negadas do Departamento do Comércio dos Estados Unidos ou na Lista de Entidades. Ao usar o
Software, você declara e garante que não faz parte nem está sob o controle de nenhuma destas listas, nem
é cidadão ou residente de nenhum destes países.

15. Aquisições Federais. Esta Seção 15 se aplica a todas as aquisições do Software realizadas pelo
governo federal ou para ele ou por qualquer fornecedor especial ou subfornecedor (em qualquer nível)
sob qualquer contrato, concessão, contrato de cooperação ou outra atividade junto ao governo federal. O
Software consiste em um “item comercial”, conforme definido em 48 C.F.R. 2.101 (outubro de 2004), e
consiste em “software comercial para computador” e em “documentação de software comercial para
computador”, conforme esses termos são usados em 48 C.F.R. 227.7202-1, 227.7202-3, 227.7202-4
(outubro de 2004). Se você fizer parte do Governo dos EUA ou de algum órgão ou departamento do
mesmo, o Software estará licenciado (a) apenas como um item comercial e (b) somente com os direitos
concedidos pelo presente instrumento.

16. DISPOSIÇÕES DA COMUNIDADE EUROPEIA. Se você obteve este Software em um país da

Comunidade Europeia, nenhum termo desta Licença deverá ser interpretado como restrição a qualquer
direito garantido pela Diretiva de Software da Comunidade Europeia (91/250/EEC).

17. Diversos. Todas as cláusulas deste Contrato de licença podem ser consideradas distintas. Se uma
cláusula for considerada não aplicável, isso não afeta a aplicabilidade das demais cláusulas, termos ou
condições do Contrato de licença. Este Contrato de licença é vinculativo para sucessores e pessoas
atribuídas. A Kodak Alaris não será responsável por nenhuma execução malsucedida ou atraso atribuído
em todo, ou em parte, a qualquer causa além de seu controle cabível. Nenhuma informação contida neste
instrumento deverá ser interpretada como formadora de agência, parceria ou outra forma de

使用許諾

本エンドユーザー使用許諾契約（以下「使用許諾」または「使用許諾契約」という）は、お客様
がダウンロードされているソフトウェアに適用されます。以下の条件をよくお読みになった上で、
本ソフトウェア（以下に定義）をインストールまたは使用してください。お客様は本ソフトウェ
アをインストールして使用することで、これらの条件に同意したものと見なされます。これらの
条件は、両当事者が別途、書面で明示的に合意しない限り、弊社とお客様の間の以前のすべての
条件に優先し、これらに代わるものです。本使用許諾において、「弊社」および「Kodak Alaris」
は、Kodak Alaris Inc.、その系列会社、子会社および親会社の総称です。

「お客様」という用語は、(a) 個人の場合は、本使用許諾契約を締結する18歳以上の個人を指し、
(b) 会社（または他の法人）の場合は、当事者を法的に拘束する権利を有する個人の代わりに、
本使用許諾契約に同意する当事者を指します。

「ソフトウェア」という用語は、お客様がインストールするソフトウェア、ファームウェアコン
ポーネント、またはその両方のほか、お客様がインストールしたソフトウェアを介してアクセス
される、サードパーティがホストするソフトウェアコンポーネント、ならびにこれらのソフトウ
ェアコンポーネントに付随するすべての関連ドキュメントに適用されます。

弊社のライセンサーとは、すべての系列会社、子会社および関連会社を含むKodak Alarisに対し
て、当該ソフトウェアの全部または一部の使用を許諾する第三者に対する言及と見なされます。
本使用許諾は、具体的にKodak Alarisおよびすべてのライセンサーの利益を目的としています。

1. 使用許諾：お客様が本使用許諾契約を厳守することを条件として、Kodak Alarisは下記の

3. 本ソフトウェアの譲渡：お客様は機器の販売または他の恒久的な処置に関連する場合に
のみ、本ソフトウェアを他者に永久に譲渡することができます。ただし、相手が本使用許諾の条
件を受け入れることに同意し、お客様が本ソフトウェアのコピーを保持しないことが条件となり
ます。

4. 知的財産：本ソフトウェアは Kodak Alaris、そのライセンサーまたはサプライヤーによっ

て所有され、著作権法および国際法によって保護されています。本使用許諾に明示的に規定され
ている場合を除き、本ソフトウェアを複製することは禁じられます。本ソフトウェア、および/
または本ソフトウェアに関連する機器は、www.kodakmoments.com/patentsに一覧表示された
Kodak Alaris の特許に規定された主張に基づきます。

5. 保護：本ソフトウェアには、Kodak Alarisおよび/またはそのライセンサーの貴重な専有情
報および機密情報が含まれていることをお客様は確認します。よって、お客様は以下に同意しま
す。

i. 本ソフトウェアを、本契約による使用許諾で許可された限定的な目的のみで使用するこ
と。および、自身の従業員、代理店、コンサルタント、当該の目的達成のために直接関与す
る独立請負業者のみに本ソフトウェアへのアクセスを制限すること。

ii. Kodak Alarisが書面で許可した場合を除き、本ソフトウェアを複製しないこと。および当

該の承認済みコピーのすべてに、Kodak Alarisおよび/またはそのライセンサーの指定および
要求する著作権、商標および 専有情報に関する通知を記載すること。

iii. その他、少なくともお客様自身の機密情報または専有情報を保護するのと同等の注意を
払って、本ソフトウェアが開示されないよう保護すること。

iv. 本ソフトウェアのあらゆるコピーをいかなる形式でも常に安全に保管すること。

v. 本ソフトウェアへの不正アクセスがあった場合、書面にてKodak Alarisに通知すること。

vi. 次の行為が禁止されること（第三者に対しても禁止するよう一貫して最善の努力をす
る）。(i) 本ソフトウェアのソースコード、基盤となるアイディア、あるいはアルゴリズム
の 複製、逆コンパイル、逆アセンブル、リバースエンジニアリング、検出の試み （適用法
がリバースエンジニアリングの制限を禁じる場合を除く）、(ii) 本契約に明示的に規定され
ている場合を除き、本ソフトウェアの提供、リース、賃貸、タイムシェアあるいはサービス
ビューローの目的での使用、あるいは第三者の利益を目的とした使用または使用許可の提供、
(iii) 法規に違反する、または第三者の権利を侵害する方法で 本ソフトウェアを使用するこ
と、または (iv) 本ソフトウェアの改造、あるいは派生物の作成、関連ドキュメントの著作
権または他の専有情報に関する通知の 削除、変更、遮蔽。

お客様は、上記に関連した法的措置で発生する、あらゆる責任および損害について、弊社および
そのライセンサーを擁護し、これらから保護することに同意します。

6. プライバシー：本ソフトウェア、またはそのダウンロードでは、お客様が本ソフトウェ
アを使用する場合にお客様に関する特定の限定的な情報を要求または収集することがあります。
本ソフトウェアではまた、本ソフトウェアの使用を容易にするため、Cookieまたは他の受動的な
トラッキングメカニズムおよびツールを使用して、情報を収集する場合があります。Kodak Alaris
のお客様の情報の収集、使用、開示、および取り扱いは、そのプライバシーポリシーに従って行

たは他者への使用許可を終了することにより、本使用許諾を終了することができます。ただし、
その後再度本ソフトウェアを使用すると、これらの条件に同意したことになり、本使用許諾は再

を禁止しているもの等）に準拠します。印刷、製品の完成またはその他の目的で、Kodak Alaris
またはその系列会社に資料を送信するために本ソフトウェアを使用する場合、サービスの関連条
件を遵守する必要があります。お客様は、公民権の侵害（名誉棄損等）か刑法違反（わいせつ罪
等）かを問わず、違法な、または人種、宗教、民族性、年齢層、性別または性的嗜好に対する嫌

10. ソフトウェア機能：本ソフトウェアには、Kodak Alarisがインターネットを介して、お客

およびサービスをお客様に通知し、本ソフトウェアの製品データファイルおよび指示/マーケテ

法律で認められている範囲内で、Kodak Alaris、そのライセンサー、サプライヤー、ディーラー
は、本ソフトウェアの使用または使用不能に起因する利益喪失、預金喪失、代替製品またはサー
ビスの取得費用またはその他の損害を含む、現実的、直接的、間接的、付随的、特別、必然的ま
たは懲罰的な損害について、それらの発生可能性を知らされていたとしても、一切責任を負いま
せん。一部の州や国においては付随的、必然的な損害に対する賠償責任の制限または免責が許可

14. 輸出法の保証：お客様は、米国の法律および本ソフトウェアを取得した管轄区域の法律
で許可されている場合を除き、本ソフトウェアを使用したり、輸出または再輸出したりすること
はできません。特に、例外なく本ソフトウェアは (a) 米国禁輸国（キューバ、イラン、イラク、
リビア、北朝鮮、セルビア、スーダン、およびシリアを含むがこれらに限定されない）（または
その国民または居住者）、または (b) 米財務省特定国籍業者リストまたは米商務省取引禁止顧

17. 雑則：本使用許諾契約の各条項は分離可能です。特定の条項に法的拘束力がないと判断
された場合、この判断は本使用許諾契約の残りの条項、条件の執行可能性に影響を与えるもので
はありません。本使用許諾契約は継承者および譲受人に対して法的拘束力を有するものとします。
全部または一部を問わず、Kodak Alarisの合理的な支配の及ばない理由によって生じた不履行ま
たは遅延について、Kodak Alarisは責任を負わないものとします。本契約の条項は、当事者間で

본 최종 사용자 라이선스 계약(“라이선스” 또는 “라이선스 계약”)은 다운로드 중인

소프트웨어에 적용됩니다. 본 소프트웨어(아래 정의됨)를 설치 또는 사용하기 전에 다음
약관을 잘 읽어보시기 바랍니다. 본 소프트웨어를 설치 및 사용하면 본 약관에 동의하는

“소프트웨어”라는 용어는 사용자가 설치하는 소프트웨어 및/또는 펌웨어 구성 요소,

vi. 다음을 수행할 수 없습니다(그리고 제삼자가 이를 수행할 수 없도록 최선의 노력을

다합니다). (i) 본 소프트웨어의 소스 코드 또는 기본 아이디어나 알고리즘을 복사,
디컴파일, 디스어셈블, 리버스 엔지니어링하거나 발견하려고 시도하는 행위(해당 법률이
리버스 엔지니어링 제한을 금지하는 경우 제외), (ii) 여기에 명시적으로 규정된 경우를
제외하고, 본 소프트웨어를 시분할 또는 서비스 사무소 목적을 위해 제공, 임대, 대여,
사용하거나 제삼자의 이익을 위해 다른 사람이 사용하거나 사용하도록 허용하는 행위,
(iii) 법률이나 규정 또는 제삼자 권리를 위반하여 본 소프트웨어를 사용하는 행위, 또는
(iv) 본 소프트웨어의 파생물을 수정 또는 만들거나 관련 문서의 저작권 또는 기타
소유권 고지를 제거, 수정 또는 모호하게 하는 행위.

위와 관련한 어떠한 법적 조치로 인해 발생할 수 있는 모든 책임 및 손해로부터 회사 및

해당 라이선스 제공자를 면책할 것에 동의합니다.

6. 개인 정보 보호. 소프트웨어 또는 이의 다운로드는 사용자가 소프트웨어를 사용하는

상황에 대한 특정한 제한된 정보를 요청하거나 수집할 수 있습니다. 또는 소프트웨어는
사용자의 소프트웨어 사용 편의를 위해 쿠키 및 기타 수동 추적 메커니즘과 도구를
사용하여 정보를 수집할 수도 있습니다. Kodak Alaris의 정보 수집, 사용, 공개 및 처리는
해당 개인정보 보호정책에 따라 수행됩니다. 개인정보 보호정책의 최신 버전은
https://www.kodakalaris.com/privacy-policy에서 확인할 수 있습니다. 해당 개인정보

7. 조건. 본 라이선스는 만료될 때까지 유효합니다. 소프트웨어 및 모든 형태의

소프트웨어 사본을 파기 또는 다른 방법으로 영구적으로 사용 불가 상태로 만들어 언제라도
라이선스를 종료할 수 있으며, 소프트웨어를 장치에 설치한 방법으로 인해 파기 또는
영구적으로 사용 불가 상태로 만드는 것이 불가능한 경우 본인 또는 타인의 소프트웨어
사용을 중지함으로써 라이선스를 종료할 수 있습니다. 단, 이후 소프트웨어를 다시 사용할
경우 본 이용 약관의 승인을 다시 의미하며 라이선스가 다시 적용됩니다. 본 라이선스는
사용자가 본 라이선스의 조항이나 조건을 준수하지 않은 경우에도 자동으로 종료됩니다.
이유를 막론하고 라이선스 종료 시에는, 소프트웨어와 모든 형태의 소프트웨어 사본을 파기
또는 영구적으로 사용 불가 상태로 만들어야 하며 소프트웨어를 파기할 수 없는 경우 본
라이선스의 약관 동의 없이 본인 또는 타인이 소프트웨어를 사용하지 않아야 합니다.

8. 법률 및 약관 준수. 제품을 통해 전송하거나 만드는 사진, 텍스트 또는 기타 자료의

형식과 내용에는 해당 법률(예: 어린이 학대, 아동 포르노, 저작권 침해 또는 개인 정보
침해 금지)이 적용됩니다. 소프트웨어를 사용하여 인쇄나 제품 제작 또는 기타 용도로
자료를 Kodak Alaris 또는 자회사에 전송하는 경우 관련 서비스 약관을 준수해야 합니다.
소프트웨어를 사용하여 시민권(예: 명예 훼손) 또는 형사법(예: 음란)을 위반하거나 인증,
종료, 민족, 나이, 성별 또는 섹슈얼리티 차별을 조장하는 불법적인 사진, 텍스트 또는 기타

내용을 업데이트하고 개인 식별 정보 이외의 사용 데이터를 수집하기 위해, Kodak Alaris가
인터넷을 통해 귀하에게 사용 가능한 소프트웨어 업그레이드, 프로모션, 관심 있을 수 있는
제품 및 서비스를 알리는 기능이 포함될 수 있습니다. 또한 소프트웨어에는 매장 위치 파일,
새 제품 주제 및 제품 카탈로그를 다운로드할 수 있는 기능이 포함될 수 있습니다.
사용자는 소프트웨어에서 해당 기능을 비활성화하도록 선택하지 않는 한, Kodak Alaris가
이러한 기능을 사용하여 통지와 업데이트를 제공하고 다운로드를 허용하며 데이터를

您可以在必要时复制软件以便于使用本软件，但是不可进一步将软件重新分发、颁发从属许可、出
租、出借或租赁给第 3 条中未指明的任何第三方。本软件可能包含软件文件中描述的副程式库和
样本文件。您不能出于任何理由修改任何样本文件。您承认并同意本软件仅适合与本许可协议中所
规定的设备结合使用。

3. 软件转让。如果另一方同意接受本许可的条款和条件并且您不保留软件的任何副本，则您
可仅以出售或永久处置设备的其他方式将软件永久转让给另一方。

4. 知识产权。软件归 Kodak Alaris、其许可颁发者和供应商所有并受著作权法和国际条约的

保护。除本许可明确规定外，不得复制本软件。本软件和/或本软件相关的设备受
www.kodakmoments.com/patents 上所列 Kodak Alaris 专利中陈述的声明限制。

5. 保护。您承认软件包含 Kodak Alaris 和/或其许可颁发者的有价值的所有权和机密信息。因

此，您同意以下事项：
 i. 软件仅用于本协议所授予许可中授权的有限目的，并且仅限为完成此类目的而直接涉及其
中的员工、代理、顾问和独立承包商使用本软件。

ii. 除 Kodak Alaris 书面授权外，不复制软件，也不会在所有此类授权副本中包含 Kodak

Alaris 和/或其许可颁发者的任何指定和要求的版权、商标和所有权信息声明；

iii. 至少以保护自己机密或所有权信息相同的程度保护软件信息不被泄漏；

iv. 始终安全存储各种形式的软件副本；

v. 一旦发现任何未经授权使用软件的情形，将以书面形式通知 Kodak Alaris；以及

vi. 不得（并始终尽最大努力禁止任何第三方出现以下行为）：(i) 复制、反编译、反汇编、逆

向工程或尝试找出本软件的源代码、基本概念或算法（除非在适用的法律禁止对逆向工程进行
限制的范围内）；(ii) 提供、出租、出借、分时使用本软件，或出于服务机构目的，或出于任
何第三方利益使用或允许其他人使用本软件，除非本协议另有明确规定；(iii) 以违反任何法律
或法规或任何第三方权利的方式使用本软件；或者 (iv) 修改软件或制作软件的衍生品，或移
除、修改或掩盖任何相关说明文件的任何版权或其他所有权声明。

您同意赔偿公司、其许可颁发者因所有赔偿责任和损害而遭受的损失，包括可能因以上事项引发的
法律诉讼所导致的所有责任和损害。

6. 隐私。当您使用或下载本软件时，其可能要求您提供或收集某些和您相关的有限信息。软
件还可能使用 Cokie 或其他被动跟踪机制和工具来收集信息以便帮助您更好地使用软件。Kodak
Alaris 依 据 其 隐 私 政 策 收 集 、 使 用 、 披 露 和 处 理 您 的 信 息 。 可 在
https://www.kodakalaris.com/privacy-policy 上找到最新版本的隐私政策。本隐私政策还阐述了有关

7. 有效期限。本许可在终止前一直有效。您可以通过销毁或永久禁用软件及其各种形式副本
的方式终止本许可，或者，如果软件因其在设备上的安装方式无法销毁或永久禁用，您可以通过停
止使用或停止允许他人使用软件的方式终止本许可，之后以任何方式重新使用软件即表示您接受这

利（如诽谤）或违反刑法（如淫秽），或是宣扬种族、宗教、年龄层和性别歧视的照片、文字或其
他材料。您同意将会保护 Kodak Alaris 免受因为您未能遵守本条中的条款而造成的任何索赔，并

9. 您的声明或保证。您声明并保证自己有接受本许可协议的法律权利和能力。您同意赔偿公
司、其许可颁发者因所有赔偿责任和损害而遭受的损失，包括可能因以上事项引发的法律诉讼所导
致的所有责任和损害。

10. 软件功能。本软件可能包含一些使 Kodak Alaris 能够通过互联网进行以下活动的功能：向

您发送您可能感兴趣的新发布的软件升级、促销活动、产品和服务的通知；更新软件中的产品数据
文件和说明性及市场推广性内容；收集个人身份无法识别的使用数据。软件中还可能包含使您能够
下载店铺位置文件、新产品主题和产品目录的功能。您须同意 Kodak Alaris 可以使用这些功能提
供此类通知和更新信息，允许为收集此类数据而进行的下载，除非您选择禁用软件中的这些功能。

Kodak Alaris 概不负责。您在与任何其他网站进行交互或通信时，必须自行做出判断。

遵循所有禁止排除下列内容的法律：Kodak Alaris 及其许可颁发者不做出与本软件有关的任何类型

的担保（无论明示或暗示），包括对特定用途的适销性与适用性担保、无侵权行为的担保，或是对
在履行、分发、使用或交易过程中出现的任何问题的担保。某些国家和地区不允许排除暗示担保，

12. 责任限制。您需自行承担使用本软件的所有风险。无论在任何情况下，Kodak Alaris 及其

代理商、许可颁发者或供应商都不会对您使用或错误使用、依靠本软件而造成的任何后果承担责任。
在法律允许的范围内，在任何情况下 Kodak Alaris 及其许可颁发者、供应商或经销商都不会对您
所遭受的任何实际、直接、间接、意外、附带、结果性或惩罚性损失承担责任，包括任何利润损失、
成本节省方面的损失、采购替代产品或服务所花费的成本、或任何其它因软件的使用或不当使用而
造成的损失，即使事先已对此类可能造成的损失进行了说明。某些国家和地区不允许限制或排除意
外或结果性损失，或是对限制或排除责任存在法律约束，因此上述责任限制可能不适用于您。

13. 适用法律。如果软件是您在美国境内获取的，则本许可受纽约州法律的约束。如果软件您
是在美国境外获得本软件的，则本许可受当地相应法律的约束。本许可将不受《联合国国际货物销
售合同公约》的约束，此处明确说明该公约不适用。若出于任何理由，具有管辖权的法院认为任何
规定或其中的一部份是不可实施的，本许可的其余部份将继续有效。

14. 出口法律担保。在未获得美国法律或软件购买地法律准许的情况下，不得使用或出口或再
出口软件。不得将本软件出口或再出口至下列国家/地区以及个人和实体，包括但不限于：(a) 任何
美国政府对其实施贸易禁运制裁的国家/地区（或是这些国家/地区的公民或居民），包括但不限于
古巴、伊朗、伊拉克、利比亚、朝鲜、塞尔维亚、苏丹和叙利亚，或是 (b) 被列入美国财政部的
“特别指定国民”名单或美国商务部的“拒绝人员名单”或“拒绝实体名单”的个人或实体。您一
旦使用本软件，即表示您声明并保证您身处的国家/地区不在上述国家/地区之列，您未受到上述任
何国家/地区的国民或居民或者上述任何名单中人士的控制，亦非上述任何国家/地区的国民或居民
或者上述任何名单中的人士。

15. 联邦采购。本节（第 15 节）适用于：联邦政府对软件进行的所有采购活动、其他机构或

个人代联邦政府对软件进行的所有采购活动，或是任何总承包商或次承包商（任何级别的承包商）
依据合同、授权、合作协议对软件进行的所有采购活动，或任何其它与联邦政府有关的活动。本软
件属于美国联邦法规第 48 章第 2.101 条（2004 年 10 月）所定义的“商用物品”，由美国联邦
法规第 48 章第 227.7202-1 条、第 227.7202-3 条、第 227.7202-4 条（2004 年 10 月）所定义
的“商用计算机软件”和“商用计算机软件文档”所组成。如果您在美国政府或任何其所属机构或
部门中工作，则软件 (a) 仅能作为商品颁发许可，以及 (b) 许可的权利仅限于本许可中授予的相
关权利。

16. 欧盟规定。如果您在欧盟中的任何一个国家/地区获得本软件，则本许可中的任何条款都不
能对“欧盟软件指令”(91/250/EEC) 中规定的权利构成限制。

17. 其他。本许可协议中的所有条款都是独立的。如果其中一则条款无法执行，则不会影响本
许可协议中其余条款或条件的可执行性。本许可协议对本软件的转让对象和接受者同样有效。对于
部分程度上或完全是由于超出 Kodak Alaris 合理控制范围的原因所造成的任何协议未得到履行或
履行延迟的情况，Kodak Alaris 不承担任何责任。本协议中包含的任何内容不应解释为建立任何代
理、合作关系或其他形式的合资企业。您承认已阅读了本许可协议，完全理解协议的内容，同意遵

Лицензионное соглашение с конечным пользователем («Лицензия» или «Лицензионное

соглашение») распространяется на программное обеспечение, которое вы загружаете.
Внимательно прочитайте следующие условия перед установкой или использованием данного
Программного обеспечения (определение которого приводится далее). Установка и использование
вами данного Программного обеспечения означает согласие с настоящими условиями. Настоящие
условия заменяют собой все предыдущие условия, согласованные между Компанией и вами, если
стороны явным образом не согласовали иной порядок в письменном виде. Для целей Лицензии
«Компания» и «Kodak Alaris» означают совместно компанию Kodak Alaris Inc., ее
аффилированные, дочерние и родительские компании.

«Вы» означает a) лицо, принимающее условия настоящей Лицензии, в случае, если это
физическое лицо старше 18 лет, или b) сторону, выражающую согласие с условиями настоящей
Лицензии от имени уполномоченного лица, имеющего полномочия вменять обязательства этой
стороне, в случае, если это корпорация (или иное юридическое лицо).

Термин «Программное обеспечение» применяется к компонентам программного и/или

микропрограммного обеспечения, устанавливаемым вами, а также к компонентам программного
обеспечения сторонних поставщиков, доступ к которым предоставляется посредством
установленного вами программного обеспечения, а также ко всей соответствующей документации,
сопровождающей данные компоненты программного обеспечения.

Ссылки на лицензиаров Компании относятся к любым третьим лицам, предоставляющим

лицензии на все Программное обеспечение корпорации Kodak Alaris, включая все
аффилированные, дочерние и связанные компании, или любую его часть. Целью Лицензии
является предоставление льгот и привилегий компании Kodak Alaris и любым лицензиарам.

1. Предоставление Лицензии. При соблюдении условий настоящего Лицензионного

соглашения Kodak Alaris предоставляет неисключительную лицензию на использование
Программного обеспечения в соответствии с ограничениями Лицензии, описанными ниже.
Настоящей Лицензией не могут передаваться никакие права в отношении использования любых
названий, логотипов или товарных знаков компании Kodak Alaris или ее лицензиаров. Настоящее
Лицензионное соглашение не предназначено для продажи Программного обеспечения или любой
другой интеллектуальной собственности. Все имущественные и интеллектуальные права на
Программное обеспечение, а также само Программное обеспечение, принадлежат компании Kodak
Alaris или ее лицензиарам.

2. Ограничения использования. Вы можете использовать Программное обеспечение только

совместно с одобренным компанией Kodak Alaris оборудованием и/или расходными материалами.
В связи с таким использованием разрешается при необходимости копировать Программное
обеспечение с целью использования данного Программного обеспечения, но запрещается
дальнейшее распространение, передача на условиях сублицензии, сдача в аренду, передача в заем
или долговременную аренду настоящего Программного обеспечения любому третьему лицу,
кроме случаев, указанных в разделе 3. Настоящее Программное обеспечение может содержать
библиотеки стандартных подпрограмм и файлы-примеры согласно документации Программного
обеспечения. Запрещается вносить изменения в любые файлы-примеры на любом основании. Вы
подтверждаете и соглашаетесь с тем, что Программное обеспечение предназначено
исключительно для использования с предусмотренным в настоящем документе оборудованием.

3. Передача Программного обеспечения. Вы можете безвозвратно передать Программное

обеспечение другому лицу исключительно в связи с продажей или безвозвратной передачей
оборудования, если другое лицо согласно принять условия данной Лицензии и у вас не
сохраняется ни одной копии Программного обеспечения.

4. Интеллектуальная собственность. Программное обеспечение принадлежит компании

Kodak Alaris, ее лицензиарам или поставщикам и защищено законом об авторском праве и
международными соглашениями. Копии программного обеспечения разрешается создавать только
в случаях, явным образом оговоренных в настоящей Лицензии. На данное Программное
обеспечение и/или оборудование, к которому относится данное Программное обеспечение,
распространяются притязания, изложенные в патентах Kodak Alaris, перечисленных по адресу
www.kodakmoments.com/patents.

5. Защита. Вы подтверждаете, что Программное обеспечение содержит ценную частную и

конфиденциальную информацию, принадлежащую компании Kodak Alaris и/или ее лицензиарам.
В связи с этим вы соглашаетесь:

i. Использовать Программное обеспечение только в ограниченных целях, предусмотренных

Лицензией, предоставленной настоящим Лицензионным соглашением, и предоставлять
доступ к Программному обеспечению только своим сотрудникам, агентам, консультантам и
независимым подрядчикам, непосредственно привлеченным к реализации такой цели.

ii. Не копировать Программное обеспечение без письменного разрешения компании Kodak

Alaris и включать в такие копии все названные и запрошенные отметки об авторском праве,
товарные знаки и уведомления компании Kodak Alaris и/или ее лицензиаров о
принадлежности информации.

iii. Принять иные меры по недопущению раскрытия сведений о Программном обеспечении

как минимум в той же степени, что применяются вами для защиты собственной
конфиденциальной или частной информации.

iv. Постоянно и в любой форме хранить все копии Программного обеспечения в безопасном
месте.

v. Сообщать Kodak Alaris в письменном виде о любых случаях несанкционированного

доступа к Программному обеспечению.

vi. Вы не должны (и должны предпринимать все возможные меры, чтобы не позволять

любому третьему лицу): (i) копировать, декомпилировать, дизассемблировать, осуществлять
вскрытие технологии или пытаться извлечь исходный код, базовые идеи или алгоритмы
Программного обеспечения (кроме как в степени, в которой действующее законодательство
 запрещает наложение ограничений на вскрытие технологий), (ii) за исключением случаев,
прямо оговоренных в настоящем Лицензионном соглашении, предоставлять, сдавать в
аренду, передавать на условиях займа, использовать в целях владения долевыми правами
собственности или предоставлять доступ к Программному обеспечению в формате бюро
услуг, а также иным образом использовать или предоставлять в пользование третьим лицам
Программное обеспечение в интересах любых третьих лиц, (iii) использовать Программное
обеспечение в нарушение норм законодательства или прав третьих лиц, (iv) изменять или
создавать производные продукты на базе Программного обеспечения, а также удалять,
изменять или скрывать уведомления об авторском праве и иных правах собственности в
любой соответствующей документации.

Вы соглашаетесь обеспечивать защиту и ограждать Компанию и ее лицензиаров от любой

ответственности и обязательств по возмещению ущерба, которые могут возникнуть в результате
какого-либо судебного процесса в связи с вышеизложенным.

6. Конфиденциальность. Программным обеспечением или в процессе его загрузки может

запрашиваться или собираться определенная ограниченная информация о вас при использовании
Программного обеспечения. Программное обеспечение может использовать файлы cookie или
другие пассивные механизмы и инструменты отслеживания для сбора информации с целью
оптимизации использования Программного обеспечения. Сбор, использование, раскрытие вашей
информации и обращение с ней компанией Kodak Alaris осуществляются в соответствии с
Политикой конфиденциальности компании Kodak Alaris. Актуальная версия Политики
конфиденциальности опубликована по адресу https://www.kodakalaris.com/privacy-policy. Данная
Политика конфиденциальности также разъясняет доступные вам параметры использования
компанией Kodak Alaris вашей информации и то, как вы можете получить доступ к этой
информации и изменить ее.

7. Срок действия. Данная Лицензия действует до момента ее аннулирования. Вы можете в

любое время прекратить действие Лицензии путем удаления или безвозвратного отключения
Программного обеспечения вместе со всеми копиями в любой форме, а если Программное
обеспечение невозможно удалить или безвозвратно отключить из-за способа, которым оно было
установлено на устройство, вы можете прекратить действие Лицензии, прекратив использовать
или отозвав предоставленное другим пользователям разрешение использовать Программное
обеспечение, при условии, что после этого любое использование Программного обеспечения
будет сопровождаться принятием данных условий, а Лицензия вновь вступит в силу. Настоящая
Лицензия также автоматически аннулируется в случае невыполнения любого из условий
настоящей Лицензии. В случае аннулирования по любой причине вы соглашаетесь удалить или
безвозвратно отключить Программное обеспечение вместе со всеми копиями в любой форме, а
если Программное обеспечение невозможно удалить, вы соглашаетесь не использовать и не
позволять другим пользователям использовать Программное обеспечение без принятия условий
Лицензии. Положения, которые в силу своей природы должны иметь силу и после аннулирования
настоящего Лицензионного соглашения, останутся в силе после такого аннулирования.

8. Соблюдение законов и правил. Форма и содержание изображений, текстовой информации

или других материалов, передаваемых вами или используемых вами для создания на их основе
других продуктов, регулируются действующим законодательством (например, запрещающим
насилие над детьми, детскую порнографию, нарушение авторских прав или вторжение в личную
жизнь). При использовании настоящего Программного обеспечения для передачи материалов
компании Kodak Alaris или ее дочерним предприятиям с целью печати, обеспечения продукцией
или для иных целей необходимо соблюдать соответствующие условия использования.
Запрещается использовать настоящее Программное обеспечение для передачи компании Kodak
Alaris или ее дочерним предприятиям любых изображений, текстовой информации или других
материалов, имеющих противозаконный характер, будь то нарушение гражданских прав
(например, клевета)или уголовного законодательства (например, непристойное поведение) или
нарушение, способствующее разжиганию ненависти на почве расовой, религиозной, этнической,
возрастной, гендерной или сексуальной неприязни. Вы соглашаетесь защищать, ограждать и
освобождать компанию Kodak Alaris от любой ответственности, возникающей в результате
несоблюдения положений раздела 8 или связанной с их несоблюдением.

9. Ваши заявления и гарантии. Вы заявляете и гарантируете, что обладаете законным правом

и правоспособностью для принятия условий настоящего Лицензионного соглашения. Вы
соглашаетесь обеспечивать защиту и ограждать Компанию и ее лицензиаров от любой
ответственности и обязательств по возмещению ущерба, которые могут возникнуть в результате
какого-либо судебного процесса в связи с вышеизложенным.

10. Функции программного обеспечения. Программное обеспечение может содержать

функции, позволяющие компании Kodak Alaris через Интернет уведомлять вас о доступных
обновлениях ПО, рекламных акциях, продукции и услугах, которые могут вас заинтересовать,
обновлять файлы данных продуктов, инструкции и маркетинговые материалы в Программном
обеспечении, а также собирать данные об использовании Программного обеспечения, не
служащие для идентификации личности. В Программном обеспечении могут также содержаться
функции, позволяющие загружать файлы для поиска магазинов, новые темы и каталоги
продукции. Вы соглашаетесь с тем, что Kodak Alaris может использовать эти функции для
предоставления уведомлений и обновлений, давать разрешение на загрузку и сбор данных
подобного рода в том случае, если эти функции в Программном обеспечении не будут отключены.
Информация о порядке отключения одной или нескольких из данных функций представлена в
файле справки или файле README. Независимо от любой информации, представленной в
Приложениях, компания Kodak Alaris оставляет за собой право без предварительного уведомления
прекратить, перенести или приостановить работу Приложений или изменить их характеристики в
любой момент, не неся при этом никаких обязательств.

11. ОТКАЗ ОТ ГАРАНТИИ. Настоящее Программное обеспечение предоставляется по

принципу «КАК ЕСТЬ». Компания Kodak Alaris и ее лицензиары не гарантируют соответствие
функций Программного обеспечения конкретным требованиям, а также бесперебойную и
безошибочную работу Программного обеспечения. Ответственность за использование, установку,
эксплуатацию и результаты, полученные при использовании настоящего Программного
обеспечения, возлагается на вас.

В Программном обеспечении могут содержаться гипертекстовые ссылки на сторонние веб-сайты

или информацию. Компания Kodak Alaris не предоставляет гарантию, поддержку, поручительство
или рекомендации третьих лиц, сторонних веб-сайтов или содержащейся в них информации.
Компания Kodak Alaris не несет ответственность за доступность любых таких веб-сайтов или их
содержание. Вы должны принимать собственные решения в отношении взаимодействия или
ведения переписки с любыми прочими веб-сайтами.

С учетом любого действующего законодательства, которое запрещает предусмотренные ниже

исключения, КОМПАНИЯ KODAK ALARIS И ЕЕ ЛИЦЕНЗИАРЫ НЕ ПРЕДОСТАВЛЯЮТ
НИКАКОГО РОДА ГАРАНТИЙ В ОТНОШЕНИИ ПРОГРАММНОГО ОБЕСПЕЧЕНИЯ, КАК
ПРЯМЫХ, ТАК И ПОДРАЗУМЕВАЕМЫХ, ВКЛЮЧАЯ ПОДРАЗУМЕВАЕМЫЕ ГАРАНТИИ
ТОВАРНОГО СОСТОЯНИЯ И ПРИГОДНОСТИ ДЛЯ ОПРЕДЕЛЕННОЙ ЦЕЛИ, А ТАКЖЕ
НЕНАРУШЕНИЯ ЧЬИХ-ЛИБО ПРАВ, ИЛИ ВОЗНИКАЮЩИХ В ХОДЕ РАБОТЫ, СБЫТА,
ИСПОЛЬЗОВАНИЯ ИЛИ ТОРГОВЛИ. Принимая во внимание, что законодательство некоторых
регионов и стран не допускает исключение подразумеваемых гарантий или устанавливает
определенные обязательные гарантии, которые не могут быть исключены, предусмотренное выше
исключение может не распространяться на вас.

12. ОГРАНИЧЕНИЕ ОТВЕТСТВЕННОСТИ. Вы принимаете на себя все риски, связанные с

использованием настоящего Программного обеспечения. Компания Kodak Alaris, ее агенты,

ОБСТОЯТЕЛЬСТВАХ КОМПАНИЯ KODAK ALARIS, ЕЕ ЛИЦЕНЗИАРЫ, ПОСТАВЩИКИ И
ДИЛЕРЫ НЕ НЕСУТ ОТВЕТСТВЕННОСТИ ЗА ФАКТИЧЕСКИЕ, ПРЯМЫЕ, КОСВЕННЫЕ,
ПОБОЧНЫЕ, РЕАЛЬНЫЕ, СЛУЧАЙНЫЕ ИЛИ ШТРАФНЫЕ УБЫТКИ, ВКЛЮЧАЯ
УПУЩЕННУЮ ВЫГОДУ, ПОТЕРЮ СБЕРЕЖЕНИЙ, ЗАТРАТЫ НА ПОСТАВКУ ИЛИ ЗАМЕНУ
ТОВАРОВ ИЛИ УСЛУГ ИЛИ ИНЫЕ УБЫТКИ, ВОЗНИКАЮЩИЕ ВСЛЕДСТВИЕ
ИСПОЛЬЗОВАНИЯ ИЛИ НЕВОЗМОЖНОСТИ ИСПОЛЬЗОВАНИЯ ПРОГРАММНОГО
ОБЕСПЕЧЕНИЯ, ДАЖЕ В СЛУЧАЕ ПРЕДВАРИТЕЛЬНОГО ПРЕДУПРЕЖДЕНИЯ О
ВОЗМОЖНОСТИ ТАКИХ УБЫТКОВ. Принимая во внимание, что законодательство некоторых
регионов и стран не допускает ограничение или исключение ответственности за побочные или
косвенные убытки или ограничивает ограничение или исключение ответственности,
предусмотренное выше ограничение может не распространяться на вас.

13. Применимое право. Если Программное обеспечение было приобретено в США, Лицензия
регулируется законами штата Нью-Йорк. Если Программное обеспечение приобретено за
пределами США, Лицензия регулируется законодательством той страны, в которой оно
приобретено. Лицензия не регулируется Конвенцией Организации Объединенных Наций о
договорах международной купли-продажи товаров, применение которой явным образом
исключается. Если суд надлежащей юрисдикции по какой-либо причине сочтет любое положение
или его часть не имеющим юридической силы, действие остальной части настоящей Лицензии
сохраняется в силе без изменений.

14. Гарантии экспортного закона. Запрещается использовать или иным способом

экспортировать или реэкспортировать настоящее Программное обеспечение, кроме случаев, когда
это допускается законодательством США или законодательством той страны, в которой оно
приобретено. В частности, помимо прочего, Программное обеспечение запрещено экспортировать
или реэкспортировать а) в любые страны (или резиденту или гражданину такой страны),
находящиеся под эмбарго США (в том числе Кубу, Иран, Ирак, Ливию, Северную Корею,
Сербию, Судан и Сирию) или b) любому лицу из Перечня граждан особых категорий и
запрещенных лиц, изданного Министерством финансов США, либо из Перечня исключенных лиц
и предприятий, изданного Министерством торговли США. Используя настоящее Программное
обеспечение, вы заявляете и гарантируете, что не находитесь на территории или под контролем
любой из подобных стран и не являетесь ее гражданином или резидентом, а также не включены в
такие перечни.

15. Государственные закупки. Раздел 15 распространяется на все закупки Программного

обеспечения от имени или по поручению федерального правительства США или любого
генерального подрядчика или субподрядчика (любого ранга) по любому контракту, гранту,
соглашению о сотрудничестве или другой совместной деятельности с федеральным
правительством. Программное обеспечение является «коммерческим продуктом», определенным в
части 2.101 раздела 48 Свода федеральных постановлений США (октябрь 2004 г.), состоящим из
«коммерческого программного обеспечения» и «документации на коммерческое программное
обеспечение», определенных в частях 227.7202-1, 227.7202-3, 227.7202-4 раздела 48 Свода
федеральных постановлений США (октябрь 2004 г.). Если вы являетесь сотрудником
Правительства США или любого его агентства или департамента, данное Программное
обеспечение лицензировано а) только как коммерческий продукт и b) только с теми правами, что
предоставлены в настоящей Лицензии.

16. ПОЛОЖЕНИЯ ДИРЕКТИВЫ ЕВРОПЕЙСКОГО СООБЩЕСТВА. Если настоящее

Программное обеспечение приобретено в одной из стран Европейского Союза, ничто в настоящей
Лицензии не следует считать ограничением каких-либо прав, предоставляемых в рамках
Директивы Европейского Сообщества о Программном обеспечении (91/250/EEC).

17. Прочее. Каждое положение настоящего Лицензионного соглашения является отделимым.

Если какое-либо положение будет сочтено не имеющим юридической силы, это не оказывает
влияние на юридическую силу остальных положений и условий настоящего Лицензионного
соглашения. Лицензионное соглашение имеет обязательную силу для правопреемников. Компания
Kodak Alaris не несет ответственности за неисполнение или нарушение сроков, полностью или
частично вызванное обстоятельствами непреодолимой силы. Никакие положения Лицензионного
соглашения не должны толковаться как создание агентства, товарищества или любой другой
формы совместного предприятия между сторонами. Вы подтверждаете, что прочитали настоящее
Лицензионное соглашение, понимаете его и даете согласие на выполнение его условий, а также
что вышесказанное является полным и исчерпывающим изложением Лицензионного соглашения.

Bu Son Kullanıcı Lisans Sözleşmesi (“Lisans” veya “Lisans Sözleşmesi”), indirmekte olduğunuz
yazılım için geçerlidir. Bu Yazılımı (aşağıda tanımlanmıştır) kurmadan veya kullanmadan önce aşağıdaki
hüküm ve koşulları dikkatlice okuyun. Bu yazılımı kurmanız ve kullanmanız, burada yer alan hüküm ve
koşulları kabul ettiğiniz anlamına gelir. Taraflar arasında yazılı bir şekilde aksi kararlaştırılmadıkça, bu
hükümler Şirket ile sizin aranızda akdedilen tüm eski hüküm ve koşulları geçersiz kılar ve bunların yerine
geçer. Bu Lisansın amaçları doğrultusunda, “Şirket” ve “Kodak Alaris” birlikte Kodak Alaris Inc., bağlı
ve alt kuruluşları ile çatı kurumlarını ifade edecektir.

“Siz” terimi, (a) bireysel olarak 18 yaşını geçmiş biri olarak Lisan sözleşmesini imzalayan veya (b)
kurumsal (veya diğer yasal kuruluş) olarak işbu Lisans sözleşmesini tarafı bağlayıcı kılmak için yetkili
kişi adına imzalayan taraf anlamına gelmektedir.

“Yazılım” terimi, sizin kurduğunuz yazılım ve/veya aygıt yazılımı bileşenlerinin yanı sıra, kurduğunuz
yazılım aracılığıyla erişilen 3. tarafların yazılım bileşenleri ve bu yazılım bileşenleri ile birlikte sunulan
tüm ilgili belgeler için geçerlidir.

Şirket lisans verenlerine yapılan atıflar, bu tür Yazılımların tamamının veya bir kısmının üçüncü
şahıslarca Kodak Alaris Inc'e, tüm alt kuruluşları, bağlı ve ilişkili şirketleri dahil olmak üzere
lisanslanmasını kapsar. İşbu Lisans, özellikle Kodak Alaris ve tüm lisansörlerinin lehine olacak şekilde
tanzim edilmiştir.

1. Lisansın Verilmesi. İşbu lisans sözleşmesine riayet ettiğiniz müddetçe, Kodak Alaris aşağıda
belirtilen lisans kısıtlamalarına tabi olarak size, Yazılımı kullanmanız için münhasır olmayan bir lisans
vermektedir. Bu Lisans, Kodak Alaris'e ya da lisansörlerine ait bir ad, logo ya da ticari markayı kullanma
hakkı vermez. İşbu Lisans Sözleşmesi, Yazılımın veya diğer herhangi bir fikri mülkiyetin satışı için
değildir. Yazılımın kendisine ait ve yazılıma yönelik ve ilgili bilumum hak, yetki ve menfaatler ile tüm
fikri mülkiyet hakları, Kodak Alaris ve lisansörlerinin mülkiyetindedir.

2. Kullanıma İlişkin Kısıtlamalar. Yazılımı sadece Kodak Alaris tarafından onaylanan donanım
ve/veya sarf malzemeleri ile bağlantılı olarak kullanabilirsiniz. Söz konusu kullanım ile ilişkili olarak,
Yazılımı kullanabilmek amacıyla gerektiğinde Yazılımı kopyalayabilirsiniz, ancak 3. Bölüm'de belirtilen
durumlar haricinde Yazılımı üçüncü şahıslara yeniden dağıtamaz, alt lisansını veremez, kiralayamaz,
ödünç veremez veya finansal olarak kiralayamazsınız. Yazılım, yazılım belgelerinde belirtildiği üzere alt
program kitaplıkları ve örnek dosyalar içerebilir. Örnek dosyaların herhangi biri üzerinde hiçbir nedenle
değişiklik yapamazsınız. Yazılımın sadece işburada belirtilen donanım ile bağlantılı olarak kullanıma
yönelik olduğunu kabul ve beyan edersiniz.

3. Yazılımın Devri. Yazılımı, bu Lisansın hüküm ve koşullarını kabul eden bir kişiye, Yazılımın
kopyasını elinizde tutmamanız şartıyla, sadece donanımın satılması veya başka bir şekilde kalıcı olarak
devredilmesi halinde kalıcı olarak devredebilirsiniz.
4. Fikri Mülkiyet. Yazılım Kodak Alaris, lisansörleri veya tedarikçilerinin mülkiyetinde olup, telif
hakkı kanunları ve uluslararası antlaşmalar ile korunmaktadır. Yazılımı işbu Lisans'ta açıkça belirtilen
amaçlar dışında kopyalayamazsınız. Bu Yazılım ve/veya bu Yazılımın ait olduğu ekipman,
www.kodakmoments.com/patents adresinde listelenen Kodak Alaris patentlerinde ileri sürülen iddialara
tabidir.

5. Koruma. Yazılımın Kodak Alaris ve/veya lisansörlerine ait değerli tescilli ve gizli bilgiler
içerdiğini kabul edersiniz. Bu nedenle aşağıdakileri yapacağınızı kabul edersiniz:

i. Yazılımı sadece işburada verilen lisans ile onaylanan sınırlı amaçlar doğrultusunda kullanmayı ve
Yazılıma erişim hakkını sadece söz konusu amaçların gerçekleştirilmesinde doğrudan görev alacak
çalışanlarınız, temsilcileriniz, danışmanlarınız ve bağımsız yüklenicileriniz ile sınırlandırmayı;

ii. Yazılımı Kodak Alaris tarafından yazılı olarak yetki verilen haller dışında kopyalamamayı
ve yetki verilen tüm kopyalarda Kodak Alaris ve/veya Lisansörlerinin talep ettiği ve belirlediği tüm
telif hakkı, ticari marka ve tescilli bilgi bildirimlerini bulundurmayı;

iii. Yazılımı başka hallerde asgari olarak kendi gizli ve tescilli bilgilerinizi korumak adına
gösterdiğiniz özen seviyesinde ifşa edilmekten korumayı;

iv. Yazılımın tüm kopyalarını her zaman ve her biçimde güvenli bir şekilde saklamayı;

v. Yazılıma yetkisiz erişim durumlarını Kodak Alaris’e yazılı olarak bildirmeyi ve

vi. Aşağıdakileri yapmayacağınızı (ve herhangi bir üçüncü tarafın yapmaması adına azami gayreti
göstereceğinizi) beyan edersiniz: (i) Yazılımı kopyalayamaz, kaynak koda dönüştüremez, parçalara
ayıramaz, ters mühendisliği gerçekleştiremez veya kaynak kodunu ya da temelini teşkil eden fikirleri
veya algoritmasını açığa çıkarmaya teşebbüs edemez (geçerli yasaların ters mühendislik
kısıtlamalarını açıkça yasakladığı durumlar haricinde), (ii) işburada açık bir şekilde belirtilmedikçe,
zaman paylaşımı veya servis bürosu amaçları için tedarik edemez, ödünç veremez, kiraya veremez
veya kullanamaz ya da Yazılımı bir üçüncü taraf yararına olacak şekilde kullanamaz ve başkalarının
kullanmasına izin veremez, (iii) Yazılımı herhangi bir yasa, düzenleme veya üçüncü taraf haklarını
ihlal edecek şekilde kullanamaz veya (iv) Yazılım çalışmalarını değiştiremez veya türev eserler
oluşturamaz ya da ilgili belgelerin telif hakkını veya aidiyet belirten diğer uyarılarını kaldıramaz,
değiştiremez veya gizleyemezsiniz.

Yukarıdakilerle bağlantılı bir hukuk davasında doğabilecek sorumluluk ve hasarlardan Şirket'i ve

lisansörlerini muaf tutmayı kabul edersiniz.

6. Gizlilik. Yazılımı kullanmanız sırasında, Yazılım veya indirme işlemi sizin hakkınızda belirli
sınırlı bilgileri isteyebilir veya toplayabilir. Yazılım kullanımınızı kolaylaştırmak amacıyla bilgileri
toplarken çerezleri ve diğer pasif takip mekanizmalarını ve araçları da kullanabilir. Kodak Alaris’in
bilgilerinizi toplaması, kullanması, açıklaması ve işlemesi Gizlilik Politikası gereğince yapılır. Gizlilik
Politikasının en son sürümü https://www.kodakalaris.com/privacy-policy adresinde bulunabilir. Bu
Gizlilik Politikası ayrıca Kodak Alaris’in bilgilerinizi kullanımına ilişkin elinizdeki seçenekleri ve bu
bilgilere nasıl erişebileceğinizi ve bilgileri nasıl güncelleyebileceğinizi açıklamaktadır.

7. Süre. Bu Lisans feshedilene kadar geçerlidir. Bu Lisansı, dilediğiniz zaman Yazılımı herhangi bir
biçimdeki tüm kopyaları ile birlikte imha ederek veya kalıcı olarak devre dışı bırakarak iptal edebilirsiniz;
Yazılımın bir cihaza kurulma yöntemi dolayısıyla imha edilememesi veya kalıcı olarak devre dışı
bırakılamaması durumunda ise Yazılımın bu tarihten sonra kullanımının işbu hüküm ve koşulların kabulü
ve Lisansın tekrar yürürlüğe girmesi anlamına geldiğinin bilincinde olarak Yazılımı kullanmayı bırakmak
ve başkalarının kullanmasına da izin vermemek suretiyle bu Lisansı iptal edebilirsiniz. İşbu Lisans,
herhangi bir hüküm veya koşulunu ihlal etmeniz durumunda da kendiliğinden feshedilecektir. Bu
Lisansın herhangi bir nedenle feshedilmesinin ardından, Yazılımı herhangi bir biçimdeki tüm kopyaları
ile birlikte imha etmeyi veya kalıcı olarak devre dışı bırakmayı kabul edersiniz; Yazılımın imha edilmesi
mümkün değilse, işbu Lisansın hükümlerini kabul etmeden Yazılımı kullanmamayı veya başkalarının
kullanmasına izin vermemeyi kabul edersiniz. Doğaları gereği işbu Lisans Sözleşmesi'nin feshi
sonrasında geçerli olacak hükümler, yürürlükte kalacaktır.

8. Kanun ve Hükümlere Uygunluk. Aktardığınız veya ürün oluşturduğunuz resim, metin veya diğer
materyallerin biçim ve içeriği yürürlükteki kanunlara tabidir (çocuk istismarını, çocuk pornosunu, telif
hakkı ihlalini veya gizliliğin ihlalini yasaklayanlar gibi). Yazılımı Kodak Alaris'e veya bağlı kuruluşlarına
baskı veya ürün karşılama ya da diğer amaçlarla materyal aktarmak için kullanıyorsanız, ilgili hizmet
koşullarına uymanız gerekir. Yazılımı Kodak Alaris'e veya bağlı kuruluşlarına, medeni hakların (hakaret
gibi) ya da ceza hukukunun (müstehcenlik gibi) ihlali anlamına gelen ya da bir ırk, din, etnik köken, yaş
grubu, cins veya cinsiyete karşı nefreti besleyen yasa dışı resimler, metin veya başka bir materyal
aktarmak için kullanamazsınız. Bölüm 8'deki hükümlere uymamanızdan doğan veya bunlarla ilgili her
türlü iddiada Kodak Alaris'i savunacağınızı, muaf tutacağınızı ve tazmin edeceğinizi kabul ediyorsunuz.

9. Beyan ve Taahhütleriniz. İşbu Lisans Sözleşmesini kabul etme konusunda yasal hakka ve ehliyete
sahip olduğunuzu beyan ve taahhüt edersiniz. Yukarıdakilerle bağlantılı bir hukuk davasında doğabilecek
sorumluluk ve hasarlardan Şirket'i ve lisansörlerini muaf tutmayı kabul edersiniz.

10. Yazılım Özellikleri. Yazılım, Kodak Alaris'in sizi İnternet yoluyla, ilgi duyabileceğiniz
kullanılabilir yazılım yükseltmeleri, promosyonlar, ürünler ve hizmetler hakkında bilgilendirmesini,
Yazılımda bulunan ürün veri dosyalarını ve eğitim ve pazarlama içeriklerini güncellemesini ve kimlik
tespit edici nitelikte olmayan verilerin toplamasını sağlayan özellikler içerebilir. Yazılım ayrıca mağaza
bulucu dosyalarını, yeni ürün temalarını ve ürün kataloglarını indirmenize imkan tanıyan özellikler
içerebilir. Kodak Alaris'in Yazılımdaki özellikleri devre dışı bırakmayı tercih etmediğiniz sürece bu tür
bildirim ve güncellemeleri sunmak, bu tür indirmelere izin vermek ve bu tür verileri toplamak amacıyla
bu özellikleri kullanabileceğini kabul ediyorsunuz. Bu özelliklerden bir veya daha fazlasının nasıl devre
dışı bırakılacağına ilişkin bilgi için yardım dosyasına veya README dosyasına başvurun.
Uygulamalarda sunulan bilgilerden bağımsız olarak Kodak Alaris, önceden haber vermeksizin ve
herhangi bir yükümlülük üstlenmeden herhangi bir zamanda Uygulamaları durdurma, taşıma veya askıya
alma ya da özelliklerini değiştirme hakkını saklı tutar.

11. GARANTİ FERAGATNAMESİ. Yazılım size "BU HALİYLE" temin edilmiştir. Kodak Alaris
ve lisansörleri, Yazılım fonksiyonlarının gereksinimlerinizi karşılayacağını ve Yazılımın kesintisiz veya
hatasız bir şekilde çalışacağını garanti etmez. Yazılımın çalıştırılması, kurulması, kullanılması ve
Yazılımdan elde edilen sonuçlar konusunda sorumluluk size aittir.

Yazılım üçüncü web sitelerine veya bilgilere metin bağlantıları içerebilir. Kodak Alaris üçüncü kişiler,
üçüncü kişi web siteleri veya buralarda yer alan bilgiler için herhangi bir taahhüt, doğrulama, sponsorluk
veya tavsiyede bulunmaz. Kodak Alaris bu tip bir web sitesinin kullanılabilirliğinden ya da içindeki
içerikten sorumlu değildir. Başka web siteleriyle etkileşiminiz veya iletişiminiz konusundaki kararları
kendiniz almalısınız.
Aşağıdaki istisnaları önleyen herhangi uygulanabilir bir mevzuata tabidir, KODAK ALARIS VE
LİSANSÖRLERİ, ZIMNİ PAZARLANABİLİRLİK VE ÖZEL AMACA UYGUNLUK GARANTİLERİ
VE İHLAL ETMEME DAHİL VEYA PERFORMANS, ANLAŞMA, KULLANIM VEYA TİCARET
GİDİŞATLARINDAN DOĞABİLECEK, YAZILIMLA İLGİLİ AÇIK VEYA ZIMNİ HERHANGİ BİR
GARANTİ VERMEZ. Bazı eyaletlerde ve ülkelerde, zımni garantilerin hariç tutulmasına izin verilmez
veya hariç tutulmasını önleyecek belirli yasal garantiler getiren mevzuatlar olabilir, bu yüzden yukarıdaki
istisnalar sizin için uygulanabilir olmayabilir.

12. SORUMLULUĞUN SINIRLANDIRILMASI. Yazılımı kullanmanızla ilgili riskler tamamen size

aittir. Kodak Alaris, temsilcileri, lisansörleri veya tedarikçileri, Yazılımı kullanmanız ya da yanlış
kullanmanız veya Yazılıma güvenmeniz konusunda size karşı hiçbir durumda sorumlu tutulamaz.
YASALARIN İZİN VERDİĞİ ÖLÇÜDE, KODAK ALARIS, LİSANSÖRLERİ, TEDARİKÇİLERİ
VEYA BAYİLERİ, BU TÜR BİR ZARARIN OLASILIĞINDAN HABERDAR OLSALAR DAHİ, KAR
KAYBI, TASARRUF KAYBI, İKAME ÜRÜN VEYA HİZMETLERİ TEDARİK ETMEK AMACIYLA
YAPILACAK MASRAFLAR DÂHİL OLMAK ÜZERE, FİİLİ, DOĞRUDAN, DOLAYLI, ARIZİ,
ÖZEL, SONUÇ OLARAK ORTAYA ÇIKAN VEYA CEZAİ HİÇBİR ZARAR VE ZİYANDAN
VEYAHUT YAZILIMIN KULLANILMASINDAN YA DA KULLANILAMAMASINDAN
KAYNAKLANAN DİĞER ZARAR VE ZİYANLARDAN HİÇBİR ŞEKİLDE SORUMLU
OLMAYACAKLARDIR. Bazı eyaletlerde ve ülkelerde, bağlı veya dolaylı zararlar için sorumluluğun
sınırlandırılmasına veya dışarıda bırakılmasına izin verilmez ya da sorumluluğun sınırlandırılmasını veya
dışarıda bırakılmasını kısıtlayan kanunlara sahiptir; dolayısıyla yukarıdaki sınırlandırma sizin için geçerli
olmayabilir.

13. Tabi Olunan Kanun. Yazılım ABD'de alındıysa, işbu Lisans New York Eyaleti yasalarına tabidir.
Yazılım ABD dışında alındıysa, işbu Lisans yazılımın alındığı ülkenin yasalarına tabidir. Bu Lisans,
Malların Uluslararası Satışına Dair Birleşmiş Milletler Konvansiyonu'na tabi değildir ve bu
konvansiyonun uygulanması açıkça dışarıda bırakılmıştır. Bir hükmün yetkili yargı makamı tarafından
herhangi bir nedenle tamamen ya da kısmen uygulanamaz bulunması durumunda, bu Lisans'ın geri kalanı
tamamen yürürlükte kalmaya devam eder.

14. İhracat Kanunu Güvenceleri. Yazılımı, Amerika Birleşik Devletleri yasaları veya Yazılımın
alındığı ülkenin yasalarınca izin verilmediği takdirde kullanamaz ve ihraç veya yeniden ihraç
edemezsiniz. Yazılım özellikle, ancak herhangi bir sınırlama olmaksızın (a) ABD'nin ambargo uyguladığı
herhangi bir ülkeye (sınırlama olmaksızın Küba, İran, Irak, Libya, Kuzey Kore, Sırbistan, Sudan ve
Suriye) (veya bu ülkelerden herhangi birinin vatandaşlarına veya bu ülkelerde ikamet eden kişilere) veya
(b) ABD Hazine Bakanlığı'nın Özel Olarak Belirtilmiş Ülkeler listesinde veya ABD Ticaret Bakanlığı'nın
Sınırlama Tablosunda bulunan gerçek kişi veya tüzel kişilere ihraç veya yeniden ihraç edilemez. Yazılımı
kullanarak, bu ülkelerde yaşamadığınızı, bu ülkelerin denetiminde veya vatandaşı olmadığınızı ya da
böyle bir listede bulunmadığınızı beyan ve taahhüt edersiniz.

15. Federal İktisaplar. Bu 15. Kısım, federal yönetim tarafından veya onun için gerçekleştirilen veya
federal yönetimle yapılmış herhangi bir sözleşme, vaat, işbirliği anlaşması veya diğer etkinlikler uyarınca,

tüm iktisapları için geçerlidir. Yazılım, 48 C.F.R. 227.7202-1, 227.7202-3, 227.7202-4'te (Ekim, 2004)
tanımlandığı üzere “ticari bilgisayar yazılımı” ve “ticari bilgisayar yazılımı belgeleri”nden oluşan, 48
C.F.R. 2.101'de (Ekim, 2004) tanımlandığı şekliyle bir “ticari kalem”dir. ABD Yönetimi'nde veya
yönetiminin herhangi bir devlet dairesinde veya bakanlığında iseniz, Yazılım (a) yalnızca ticari bir kalem
olarak ve (b) yalnızca işbu belgede verilen haklar ile lisanslıdır.
16. AVRUPA TOPLULUĞU HÜKÜMLERİ. Bu Yazılımı Avrupa Topluluğu'na dahil bir ülkeden
edindiyseniz, işbu Lisans'taki hiçbir hükmün Avrupa Topluluğu Yazılım Direktifi (91/250/EEC)
kapsamındaki hakları kısıtladığı kabul edilemez.

17. Diğer Hükümler. İşbu Lisans Sözleşmesi'nin her bir hükmü tek başına geçerlidir. Bir hükmün
uygulanamaz olduğunun anlaşılması, işbu Lisans Sözleşmesi'ndeki diğer hüküm, koşul ve şartların
uygulanabilirliğini etkilemez. İşbu Lisans Sözleşmesi devralanlar ve varisler üzerinde bağlayıcıdır. Kodak
Alaris makul kontrolünü aşan nedenlerle tamamen veya kısmen yaşanan adem-i ifa ya da gecikmeden
sorumlu tutulamaz. Buradaki hiçbir hükmün, taraflar arasında bir temsilcilik, ortaklık veya başka bir ortak
işletme türü oluşturduğu kabul edilemez. İşbu Lisans Sözleşmesi'ni okuduğunuzu ve anladığınızı,
koşullarının sizin için bağlayıcı olduğunu ve yukarıdaki hususların eksiksiz ve işbu Lisans Sözleşmesi'ne
münhasır olduğunu kabul edersiniz.
