MOOT PROPOSITION
The Republic of Intia, with its vast diversity and enormous population, has witnessed the rise of WhereApp
as one of its most prominent online messaging applications. However, WhereApp has faced controversy over
its involvement in several incidents of mob lynching. In May 2022, Intia’s Ministry of Technology (“MoT”)
enacted the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2022
(“IT Rules”) under the powers conferred by the Information Technology Act. These rules faced severe
backlash for mandating online communication applications like WhereApp to assist in identifying the “first
originator” of information upon receiving appropriate orders.
Ms. Hermoine, a social activist, and WhereApp challenged the IT Rules in India's Supreme Court, arguing that
they threaten privacy and free speech. The Ministry of Technology (MoT) responded by strongly rebutting
this statement and rejecting WhereApp's claims, calling them an attempt to avoid regulations while still
seeking legal protections. Amidst the IT Rules debate, the State of Intia enacted a new Telecommunications
Act to consolidate and amend the laws governing telecommunication services. Digital rights organizations
and non-profit organizations raised concerns about Section 24(2) of The Act, which states that in
emergencies or for public safety, the Intia government can order communication interception or suspension.
(a) Direct that any message or class of messages, to or from any person or class of persons, or relating to any
particular subject, brought for transmission by, or transmitted or received by any telecommunication
services or telecommunication network, shall not be transmitted.
(b) Direct that communications or class of communications to or from any person/class of persons/relating
to any particular subject, transmitted or received by any telecommunication network, shall be suspended.
Mr. Harry, Founder of Humara Internet Foundation, filed a petition before the Hon’ble Supreme Court of
Intia, citing Section 24(2) of The Act as unconstitutional in its present form. Mr. Harry House stated, "The
new Telecommunications Act is an attack on end-to-end encryption and the protection of fundamental rights
of people, and it miserably fails to adhere to the internationally recognized privacy principles endorsed by
the Hon’ble Apex Court of Intia in its landmark judgment." His stand garnered support and soon became a
hot topic of discussion for prime-time debates. Responding to Mr. Harry's statement, the Department of
Telecommunications (“DoT”) stated, "Evidence suggests that the use of Darknet and end-to-end encrypted
messaging platforms have become a haven for terrorists. Therefore, we need to have strong measures in
place for effective surveillance and tracking of such anti-social elements. The government is not asking for
access through an unsecured backdoor but instead is requesting the digital equivalent of a secured fortified
‘front door’ with locks and bars."
ISSUES
1. Whether the petitions under Article 32 are maintainable?
2. Whether the relevant provisions made under the IT Rules and Telecommunications Act are ultra vires
to the Constitution of Intia?
3. Whether the provisions under the IT Rules and Telecommunications Act are commensurate with the
Government of Intia’s policy on Telecommunications and Information Technology?
