First: Definitions and Expressions: :‫ ﻣﺼﻄﻠﺤﺎﺕ‬،‫ ﺗﻌﺎﺭﻳﻒ‬:‫ﺃﻭﻻ‬
1. Company: Means Zain (Mobile Telecommunication Company), its branches, authorized .ً‫ ﺗﻌﻨﻲ ﺯﻳﻦ ﻭﻓﺮﻭﻋﻬﺎ ﻭﻭﻛﻼﺋﻬﺎ ﺍﻟﻤﻌﺘﻤﺪﻳﻦ )ﺍﻟﻤﻮﺯﻋﻴﻦ ﻭﺃﻓﺮﻉ ﺍﻻﻣﺘﻴﺎﺯ ﻟﺘﺠﺎﺭﻱ( ﺧﺎﺭﺟﻴﺎً ﻭﺩﺍﺧﻠﻴﺎ‬:‫ﺍﻟﺸﺮﻛﺔ‬ .1

2. Customer: Means any legal person (individual or corporate) that has the capacity and ً‫ ﻳﻘﺼﺪ ﺑﻪ ﺃﺟﻬﺰﺓ ﺍﻟﻬﺎﺗﻒ ﺍﻟﻨﻘﺎﻟﺔ ﻭﺃﺟﻬﺰﺓ ﻧﻘﻞ ﺍﻟﺒﻴﺎﻧﺎﺕ ﻭﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺃﻡ ﺃﻱ ﺃﺟﻬﺰﺓ ﺃﺧﺮﻯ ﺗﻈﻬﺮ ﻣﺴﺘﻘﺒﻼ‬:‫ﺍﻟﺠﻬﺎﺯ‬ .3

3. Device: Means mobile phone devices or data transfer devices (internet devices) or any
‫ ﺃﺳﻌﺎﺭ ﺍﻟﺨﺪﻣﺎﺕ ﻭﺍﻻﺷﺘﺮﺍﻛﺎﺕ ﺍﻟﺘﻲ ﺗﺴﺘﻮﻓﻴﻬﺎ ﺍﻟﺸﺮﻛﺔ ﻣﻘﺎﺑﻞ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﻤﻘﺪﻣﺔ ﻟﻠﻌﻤﻴﻞ ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ‬:‫ﺍﻟﺮﺳﻮﻡ‬ .4

‫ ﻭﺗﺤﺘﻔﻆ ﺍﻟﺸﺮﻛﺔ ﺑﺤﻘﻬﺎ ﻓﻲ ﺗﻐﻴﻴﺮ ﺍﻭ ﺗﻌﺪﻳﻞ ﻫﺬﻩ ﺍﻟﺮﺳﻮﻡ ﻓﻲ ﺍﻱ ﻭﻗﺖ ﺩﻭﻥ‬،ً‫ﺍﻟﻀﺮﺍﺋﺐ ﺍﻟﻤﻄﺒﻘﺔ ﺣﺎﻟﻴﺎ ﺍﻭ ﻣﺴﺘﻘﺒﻼ‬
4. Fees: Means fees of the Services and subscriptions dues to Zain for the Services provided ‫ﺇﺷﻌﺎﺭ‬
to the Customer including the currently applicable taxes and/or any future taxes. Zain has ‫ ﺍﻟﺠﻬﺔ ﺍﻟﻤﺸﺮﻓﺔ ﻋﻠﻰ ﺟﻤﻴﻊ ﻣﺎ ﻳﺨﺺ ﺗﻨﻈﻴﻢ ﺧﺪﻣﺎﺕ ﺍﻻﺗﺼﺎﻻﺕ ﺩﺍﺧﻞ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ‬:‫ﺍﻟﺠﻬﺔ ﺍﻟﺮﺳﻤﻴﺔ‬ .5
the right to change or amend such fees at any time without giving any notice.
5. Official Authority: Means an authority supervising relevant matters and regulating
‫ ﻛﺎﻓﺔ ﺍﻟﺨﺪﻣﺎﺕ ﻭﺍﻟﻤﻨﺘﺠﺎﺕ ﻭﺍﻟﻌﺮﻭﺽ ﺍﻟﺘﻲ ﺗﻘﺪﻣﻬﺎ ﺍﻟﺸﺮﻛﺔ ﺣﺎﻟﻴﺎً ﻭﻣﺴﺘﻘﺒﻼً ﻭ ﺍﻟﺘﻲ ﻳﻄﻠﺐ ﺍﻟﻌﻤﻴﻞ‬:‫ﺍﻟﺨﺪﻣﺎﺕ‬ .6
.‫ ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ ﺧﺪﻣﺎﺕ ﺍﻟﻘﻴﻤﺔ ﺍﻟﻤﻀﺎﻓﺔ‬،‫ﺍﻻﺷﺘﺮﺍﻙ ﺑﻬﺎ‬

6. Services: Means all services, products and promotions currently offered by Zain and in
‫ ﻣﺮﻛﺰ‬،‫ ﺍﻻﻣﺘﻴﺎﺯ ﺍﻟﺘﺠﺎﺭﻱ‬،‫ ﺍﻟﻤﻮﺯﻋﻴﻦ‬،‫ ﺗﻘﺪﻡ ﺍﻟﺨﺪﻣﺎﺕ ﻭﺗﻀﺎﻑ ﻣﻦ ﺧﻼﻝ ﺃﻓﺮﻉ ﺍﻟﺸﺮﻛﺔ‬:‫ﺇﺿﺎﻓﺔ ﺍﻟﺨﺪﻣﺔ‬ .7

.ً‫ﺍﻟﻘﻴﻤﺔ ﺍﻟﻤﻀﺎﻓﺔ ﻭﺃﻱ ﻁﺮﻕ ﺃﺧﺮﻯ ﻗﺪ ﺗﻈﻬﺮ ﻣﺴﺘﻘﺒﻼ‬
7. Addition of Services: Services are provided and/or added by Zain’s branches,
‫ ﻫﻮ ﺍﻟﻤﺴﺘﻨﺪ ﺍﻟﻮﺭﻗﻲ ﺃﻭ ﺍﻹﻟﻜﺘﺮﻭﻧﻲ ﻭﺟﻤﻴﻊ ﺍﻟﻨﻤﺎﺫﺝ ﻭﺷﺮﻭﻁ ﺍﻟﺨﺪﻣﺔ ﺍﻟﺘﻲ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ‬:‫ﻋﻘﺪ ﺍﻟﺨﺪﻣﺔ‬ .8

‫ﺗﻌﺒﺌﺘﻬﺎ ﻭﺍﻟﺘﻮﻗﻴﻊ ﻋﻠﻴﻬﺎ ﻭﺍﻻﻁﻼﻉ ﻋﻠﻰ ﺷﺮﻭﻁﻬﺎ ﻭﺍﻻﻟﺘﺰﺍﻡ ﺑﻬﺎ ﻛﻤﺎ ﻳﺸﻤﻞ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﺘﻲ ﻳﻄﻠﺐ ﺍﻟﻌﻤﻴﻞ ﺍﻻﺷﺘﺮﺍﻙ‬
electronic devices,value added services and/or by any other means that may be available
‫ ﺧﺪﻣﺎﺕ‬/‫ ﺍﻟﻤﻮﻗﻊ ﺍﻹﻟﻜﺘﺮﻭﻧﻲ‬/‫ ﺗﻄﺒﻴﻘﺎﺕ ﺍﻷﺟﻬﺰﺓ ﺍﻹﻟﻜﺘﺮﻭﻧﻴﺔ‬/‫ ﻣﺮﻛﺰ ﺧﺪﻣﺔ ﺍﻟﻌﻤﻼء‬/‫ﺑﻬﺎ ﺑﻮﺍﺳﻄﺔ ﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻘﺼﻴﺮﺓ‬

.‫ﺍﻟﻘﻴﻤﺔ ﺍﻟﻤﻀﺎﻓﺔ‬
8. Service contract: Means any written or electronic agreement, form,, terms and
‫ ﺧﺪﻣﺎﺕ ﺍﻟﺸﺮﻛﺔ ﻻ ﺗﻤﻠﻚ ﻟﻠﻌﻤﻴﻞ ﻭﺇﻧﻤﺎ ﻳﻤﻨﺢ ﺣﻖ ﺍﻻﻧﺘﻔﺎﻉ ﺑﻬﺎ ﻁﻮﺍﻝ ﻓﺘﺮﺓ ﺍﻟﺘﺰﺍﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺸﺮﻭﻁ‬:‫ﺣﻖ ﺍﻻﻧﺘﻔﺎﻉ‬ .9
conditions of Service that the Customer completes and is bound by the agreement’s terms
.‫ ﻣﻦ ﺍﻟﻘﺎﻧﻮﻥ ﺍﻟﻤﺪﻧﻲ‬952 ‫ﺍﻟﺨﺪﻣﺔ ﻭﺫﻟﻚ ﻭﻓﻘﺎً ﻷﺣﻜﺎﻡ ﺍﻟﻤﺎﺩﺓ‬
and conditions. The term Service Contract shall also include the Services that the
Customer requests to subscribe through short messages/call center, electronic devices
applications, electronic devices, website, or value added services.
9. Usufruct: Zain’s Services cannot be owned by Customer but the Customer is granted the
right to use of such Services as long as the Customer adheres to the Service terms &
conditions Based on article 952 of the civil law.
Second: Terms and Conditions of the Service: :‫ ﺃﺣﻜﺎﻡ ﻭﺷﺮﻭﻁ ﺍﻟﺨﺪﻣﺔ‬:ً‫ﺛﺎﻧﻴﺎ‬
1. Zain provides the Customer with the required service as per the conditions and procedure ً‫ﺗﺰﻭﺩ ﺍﻟﺸﺮﻛﺔ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻟﺨﺪﻣﺔ ﺍﻟﻤﻄﻠﻮﺑﺔ ﻭﻓﻘﺎً ﻟﻠﺸﺮﻭﻁ ﻭﺍﻵﻟﻴﺔ ﺍﻟﺨﺎﺻﺔ ﺑﻬﺎ ﻭﻓﻨﻴﺎﺕ ﺍﺳﺘﺨﺪﺍﻣﻬﺎ ﺍﻟﺘﻲ ﺗﻌﺘﺒﺮ ﺟﺰءﺍ‬ .1
of the company and technical methods of use, which constitute an integral part of these .‫ ﻭﺫﻟﻚ ﻣﻦ ﺧﻼﻝ ﺍﻟﻘﻨﻮﺍﺕ ﺍﻟﻤﺘﺎﺣﺔ ﻟﻄﻠﺒﻬﺎ‬،‫ﻣﻜﻤﻼً ﻟﻬﺬﻩ ﺍﻟﺸﺮﻭﻁ‬
terms and conditions. Services are provided through the available channels for requesting /‫ ﺇﻻ ﻓﻲ ﺍﻟﺤﺎﻻﺕ ﺍﻟﺘﻲ ﺗﻠﻐﻰ ﻓﻴﻬﺎ ﺍﻟﺨﺪﻣﺔ ﻧﻬﺎﺋﻴﺎً ﻭ‬،ً‫ ﺇﻟﻐﺎء ﺃﻱ ﻣﻦ ﺍﻟﺨﺪﻣﺎﺕ ﺗﻠﻘﺎﺋﻴﺎ‬/‫ ﺗﻌﺪﻳﻞ‬/‫ﻟﻦ ﺗﻘﻮﻡ ﺍﻟﺸﺮﻛﺔ ﺑﺘﻐﻴﻴﺮ‬ .2

.‫ ﻣﻊ ﺍﺳﺘﺤﻘﺎﻕ ﺃﻱ ﻣﺒﺎﻟﻎ ﺗﻜﻮﻥ ﻗﺪ ﺗﺮﺗﺒﺖ ﻋﻠﻰ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﻤﻠﻐﺎﺓ‬،‫ﺃﻭ ﺗﻮﻗﻒ ﺍﻟﺸﺮﻛﺔ ﺗﻘﺪﻳﻤﻬﺎ‬
2. Zain will not change/ amend/ cancel any Service systematically unless the Services are no
،‫ ﻣﺮﻛﺰ ﺍﻻﺗﺼﺎﻝ‬،‫ﺟﻤﻴﻊ ﺍﻟﺨﺪﻣﺎﺕ ﻳﺘﻢ ﺇﺿﺎﻓﺘﻬﺎ ﺑﻨﺎءﺍً ﻋﻠﻰ ﻁﻠﺐ ﺍﻟﻌﻤﻴﻞ ﻭﻓﻘﺎً ﻟﻮﺳﺎﺋﻞ ﺍﻹﺿﺎﻓﺔ ﺍﻟﻤﺘﺎﺣﺔ )ﺍﻷﻓﺮﻉ‬ .3
longer available, are permanently cancelled, and no longer provided by Zain, Zain shall
(‫ ﺇﻟﺦ‬...‫ ﺍﻟﺘﻄﺒﻴﻘﺎﺕ ﺍﻻﻟﻜﺘﺮﻭﻧﻴﺔ ﻟﻠﻬﻮﺍﺗﻒ ﺍﻟﺬﻛﻴﺔ‬/‫ ﺧﺪﻣﺎﺕ ﺍﻟﻘﻴﻤﺔ ﺍﻟﻀﺎﻓﺔ‬،‫ ﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻘﺼﻴﺮﺓ‬،‫ﺍﻟﻤﻮﻗﻊ ﺍﻻﻟﻜﺘﺮﻭﻧﻲ‬
remain entitled to any amounts due that were incurred from the cancelled Services.
3. All Services are added according to Customer’s request and through available channels
‫ ﺍﻻ ﻭﻓﻘﺎ‬،(‫ ﺇﻟﺦ‬...‫ ﺩﻋﺎﺋﻴﺔ‬/ ‫ ﺳﻴﺎﺳﻴﺔ‬/‫ﻫﺬﺍ ﺍﻻﺷﺘﺮﺍﻙ ﻟﻼﺳﺘﺨﺪﺍﻡ ﺍﻟﺸﺨﺼﻲ ﻭﻻ ﻳﺠﻮﺯ ﺍﺳﺘﺨﺪﺍﻣﻪ ﻷﻏﺮﺍﺽ ﺗﺠﺎﺭﻳﺔ‬ .4
.‫ ﻭﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﻭﺣﺪﻩ ﻧﺘﻴﺠﺔ ﻣﺨﺎﻟﻔﺔ ﺫﻟﻚ‬،‫ﻟﻸﻧﻈﻤﺔ ﺍﻟﻤﻌﻤﻮﻝ ﺑﻬﺎ ﻓﻲ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ‬

applications of smart phones ….. etc.). .‫ﺍﺳﺘﻌﻤﺎﻝ ﺍﻷﺟﻬﺰﺓ ﺍﻟﻤﻘﺮﺭ ﺍﺳﺘﻌﻤﺎﻟﻬﺎ ﻓﻲ ﺃﻧﻈﻤﺔ ﺍﻟﺸﺮﻛﺔ ﻓﻘﻂ‬ .5

applicable regulations. The Customer will be solely liable for all consequences arising ‫ﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﻛﺎﻣﻞ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﻭﺍﻟﻤﺎﻟﻴﺔ ﺍﻟﻤﺘﺮﺗﺒﺔ ﻋﻠﻰ ﺇﺿﺎﻓﺔ ﺧﺪﻣﺎﺕ ﺍﻟﺸﺮﻛﺔ ﻭﻓﻘﺎً ﻟﻮﺳﺎﺋﻞ ﺍﻹﺿﺎﻓﺔ‬ .7

5. Only devices recommended by Zain as per its regulations shall be used. ‫ﺃﻭ ﺍﻟﻬﺎﺗﻒ ﺍﻟﻨﻘﺎﻝ ﻭﻣﺎ‬/‫ﺃﻭ ﺳﺮﻗﺔ ﺍﻟﺸﺮﻳﺤﺔ ﻭ‬/‫ﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﻭﺍﻟﻤﺎﻟﻴﺔ ﺍﻟﻨﺎﺗﺠﺔ ﻋﻦ ﻓﻘﺪﺍﻥ ﻭ‬ .8
6. It is not allowed to use or allow others to use Zain Services for any purpose that is in .‫ ﻭﻳﻠﺘﺰﻡ ﺑﺎﺗﺨﺎﺫ ﺍﻹﺟﺮﺍءﺍﺕ ﺍﻟﻼﺯﻣﺔ ﻻﺳﺘﺨﺮﺍﺝ ﺷﺮﻳﺤﺔ ﺃﺧﺮﻯ ﺍﻭ ﻭﻗﻒ ﺍﻻﺷﺘﺮﺍﻙ‬،‫ﺗﺤﻮﻳﻪ ﻣﻦ ﺑﺮﺍﻣﺞ‬
violation of the law or the local traditions or in a manner that violates the security and ‫ﺃﻭ ﺗﺰﻭﻳﺪ ﺍﻟﻌﻤﻴﻞ ﺑﺄﻱ ﻣﻦ ﺧﺪﻣﺎﺗﻬﺎ ﻷﺳﺒﺎﺏ ﺗﺮﺟﻊ ﺍﻟﻰ ﺗﺨﻠﻒ ﺍﻟﻌﻤﻴﻞ ﻋﻦ ﺳﺪﺍﺩ ﺃﻱ‬/‫ﻳﺤﻖ ﻟﻠﺸﺮﻙ ﺭﻓﺾ ﺗﻘﺪﻳﻢ ﻭ‬ .9

7. The Customer is fully liable legally and financially for adding Zain’s Services as per the ‫ ﻭﻟﻦ ﻳﻌﺘﺪ ﺑﺄﻱ‬،‫ ﺍﻟﻤﺘﻮﻓﺮﺓ ﻋﻠﻰ ﺍﻹﺷﺮﺍﻙ‬،‫ﺍﻟﻌﻤﻴﻞ ﻣﺴﺆﻭﻝ ﻋﻦ ﻣﻌﺮﻓﺔ ﺍﻟﺨﺪﻣﺎﺕ ﻭﺗﻜﺎﻟﻴﻒ ﺍﻻﺳﺘﺨﺪﺍﻡ ﻭﺍﻷﺳﻌﺎﺭ‬ .10
available Addition of Services methods. The Customer is also legally and financially liable .‫ﺍﺩﻋﺎء ﺑﻌﺪﻡ ﺍﻟﻌﻠﻢ ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻮﺩ ﺍﺳﺘﺨﺪﺍﻡ ﻟﻠﺨﺪﻣﺔ‬
for the use of Services whether voice/ text/ video/ data services/ roaming Services and
international calls/ value added services or any other Services that may be requested by
.‫ﺟﻤﻴﻊ ﺧﺪﻣﺎﺕ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﻼﻣﺤﺪﻭﺩﺓ ﺗﺨﻀﻊ ﻟﺴﻴﺎﺳﺔ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﺎﺩﻝ‬ .11
the Customer to be added in the future, subject to individual fees for each Service whether
in Kuwait or abroad.
8. The Customer is fully responsible for any legal and/or financial liability that may arise as
a result of the loss and/or theft of SIM, mobile phone, and the mobile applications.
The Customer undertakes to take the necessary action for obtaining another SIM or to
discontinue the line.s
9. Zain reserves the right to refuse the provision of any of the Services without cause or
reason or as a result of Customer’s failure to settle any past due amounts due to Zain.
10. It is the Customer’s responsibility to be aware of the subscription’s services and fees.
Claims that the Customer was unaware of the Services and/or their fees shall be
immediately waived upon use of Service.
11. All unlimited Service offers are subject to the fair use policy.
Third: Subscription Period Conditions and the Temporary and Permanent :‫ ﺃﺣﻜﺎﻡ ﻣﺪﺓ ﺍﻻﺷﺘﺮﺍﻙ ﻭﻗﻄﻊ ﺍﻟﺨﺪﻣﺔ ﺍﻟﻤﺆﻗﺖ ﻭﺍﻟﻨﻬﺎﺋﻲ‬:ً‫ﺛﺎﻟﺜﺎ‬
Disconnection Thereof:
‫ ﻓﻴﻤﺎ ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺇﻧﻬﺎء ﺍﻟﺨﺪﻣﺔ ﻓﻮﺭﺍً ﺑﻤﺠﺮﺩ ﺇﺧﻼﻟﻪ ﺑﻬﺬﻩ‬،‫ﺍﻟﺘﺰﺍﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺸﺮﻭﻁ ﺍﻟﺨﺪﻣﺔ ﻳﻀﻤﻦ ﺍﺳﺘﻤﺮﺍﺭ ﺗﻘﺪﻳﻤﻬﺎ‬ .1
1. The Customer’s continued adherence to the Service terms and conditions shall ensure the .‫ ﺃﻭ ﻓﻲ ﺣﺎﻟﺔ ﺍﻧﺘﻔﺎء ﺍﻟﺠﺪﻭﻯ ﺍﻟﺘﺠﺎﺭﻳﺔ ﻣﻦ ﺍﻟﻌﺮﺽ‬،‫ ﺃﻭ ﺑﺎﻧﺘﻬﺎء ﺍﻟﻌﺮﺽ ﺍﻟﺨﺎﺹ ﺑﺎﻟﺨﺪﻣﺔ‬،‫ﺍﻟﺸﺮﻭﻁ‬
continuation of providing of such Services. Zain has the right to terminate the Service ‫ ﻛﻤﺎ ﻳﺪﺭﻙ ﺍﻟﻌﻤﻴﻞ ﺃﻥ ﺍﻟﺨﺪﻣﺔ ﻗﺪ‬،‫ﺗﺴﺘﻤﺮ ﺍﻟﺸﺮﻛﺔ ﺑﺘﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﻁﻮﺍﻝ ﻣﺪﺓ ﺳﺮﻳﺎﻥ ﺍﻟﻌﻘﺪ ﻣﺎ ﻟﻢ ﻳﻄﺮﺃ ﺃﻱ ﻋﺎﺭﺽ‬ .2
immediately in the event that the Customer breaches these conditions, or when the
‫ ﺍﻟﺸﺒﻜﺔ ﻭﺍﻟﻈﺮﻭﻑ ﺍﻟﺠﻮﻳﺔ ﻭﺃﻱ ﺃﺳﺒﺎﺏ ﺃﺧﺮﻯ ﻗﺪ ﺗﻌﻮﻕ‬/‫ﺗﺘﺄﺛﺮ ﺳﻠﺒﺎً ﻣﻦ ﻭﻗﺖ ﻵﺧﺮ ﺑﻌﺎﻣﻞ ﺿﻐﻂ ﺍﻟﻤﺒﻴﻌﺎﺕ‬
Service offer expires or if the commercial feasibility of the offer declines.
‫ ﺑﻤﺎ ﻓﻴﻬﺎ ﺻﻴﺎﻧﺔ ﺍﻟﺸﺒﻜﺔ ﺃﻭ ﺍﻟﺨﺪﻣﺎﺕ ﺩﻭﻥ ﺍﺷﻌﺎﺭ ﻣﺴﺒﻖ ﺃﻭ ﻣﻦ ﻗﺒﻞ ﺍﻟﺠﻬﺔ ﺍﻟﻤﺸﺮﻓﺔ ﺃﻭ ﺃﻱ ﺧﻠﻞ ﻓﻨﻲ‬،‫ﺃﺩﺍﺋﻬﺎ‬
2. Zain will continue to provide the Services throughout the Service Contract term, unless .‫ﻣﻔﺎﺟﺊ‬
interrupted due to any sudden causes. The Customer acknowledges that the Service might ‫ ﻣﻊ‬،‫ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺇﻋﺎﺩﺓ ﺗﺨﺼﻴﺺ ﺍﻻﺷﺘﺮﺍﻙ ﺑﻌﺪ ﺍﻧﻘﻀﺎء ﻣﺪﺓ ﺍﻟﻘﻄﻊ ﺍﻟﻤﺤﺪﺩﺓ ﺩﻭﻥ ﺍﻟﻤﺒﺎﺩﺭﺓ ﻹﻋﺎﺩﺓ ﺍﻟﺘﺸﻐﻴﻞ‬ .3
be negatively affected from time to time, due to the sales/network pressure or weather
‫ ﻭﺫﻟﻚ ﻋﻨﺪ ﻓﺼﻞ ﺍﻟﺨﺪﻣﺔ ﺃﻭ‬،‫ﺗﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﻤﺴﺘﺤﻘﺔ ﻋﻠﻰ ﺍﻻﺷﺘﺮﺍﻙ ﻭﻗﻴﻤﺔ ﺍﻻﺷﺘﺮﺍﻙ ﺧﻼﻝ ﻓﺘﺮﺓ ﺍﻟﺴﻤﺎﺡ‬
conditions or any other causes that hinder its performance including unannounced
.‫ﺍﻧﻬﺎء ﺍﻟﻌﻘﺪ ﻷﻱ ﺳﺒﺐ ﻣﻦ ﺍﻷﺳﺒﺎﺏ ﺍﻭ ﺍﺫﺍ ﻛﺎﻥ ﺍﻟﻌﻤﻴﻞ ﻣﻘﺼﺮﺍً ﻓﻲ ﺃﻱ ﻣﻦ ﺍﻟﺘﺰﺍﻣﺎﺗﻪ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﺍﻭ ﺍﻟﻤﺎﻟﻴﺔ‬
maintenance of the network or the Services, or by the supervising authority or due to
any sudden technical problems.
3. Zain has the right to reallocate the line after lapse of the fixed termination period
without trying to re­connect it. The Customer should pay the charges due on the line and
the subscription amount during the grace period. Reallocation of the line shall be made
after termination of Service, upon expiry of or termination of the Service Contract (due
to any reasons) or if the Customer was in default of any of its legal or financial
obligations.

4. Zain has the right to take the suitable action including termination of the Service and ً‫ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺍﺗﺨﺎﺫ ﺍﻹﺟﺮﺍء ﺍﻟﻤﻨﺎﺳﺐ ﺑﻤﺎ ﻓﻴﻪ ﻗﻄﻊ ﺍﻟﺨﺪﻣﺔ ﻋﻦ ﺍﻻﺷﺘﺮﺍﻙ ﻭ ﺍﻟﺮﺟﻮﻉ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺑﻤﺎ ﺗﺮﺍﻩ ﻣﻨﺎﺳﺒﺎ‬ .4
initiate proceedings against the Customer if proved that the line was misused or upon the ،‫ ﺃﻭ ﺑﻄﻠﺐ ﻣﻦ ﺍﻟﺴﻠﻄﺎﺕ ﺍﻟﻌﺎﻣﺔ ﺃﻭ ﺍﻟﺠﻬﺎﺕ ﺍﻟﺮﺳﻤﻴﺔ ﻓﻲ ﺍﻟﺪﻭﻟﺔ‬،‫ﻣﻦ ﺇﺟﺮﺍءﺍﺕ ﻓﻲ ﺣﺎﻟﺔ ﺛﺒﻮﺕ ﺇﺳﺎءﺓ ﺍﻻﺳﺘﺨﺪﺍﻡ‬

indirect loss or damages that the Customer may incur. ‫ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﺍﻟﺘﻨﺎﺯﻝ ﺃﻭ ﺍﻟﻨﻘﻞ ﺣﻴﺎﺯﺓ ﺍﻻﺷﺘﺮﺍﻙ ﺃﻭ ﺍﻟﺨﺪﻣﺔ ﻟﻠﻐﻴﺮ ﻁﺒﻘﺎً ﻟﻺﺟﺮﺍءﺍﺕ ﺍﻟﻤﺘﺒﻌﺔ ﺑﺎﻟﺸﺮﻛﺔ ﺑﻌﺪ ﺳﺪﺍﺩ ﻛﺎﻓﺔ‬ .5
5. The Customer has the right to assign or transfer the line or Service to others as per .‫ﺍﻟﻤﺴﺘﺤﻘﺎﺕ ﺍﻟﻤﺎﻟﻴﺔ ﺍﻟﻤﺘﺮﺑﺔ ﻋﻠﻰ ﺍﻻﺳﺘﺨﺪﺍﻡ‬
Zain’s procedures upon payment of all financial dues for use of Service. ‫ ﻭﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺴﺪﺍﺩ‬،‫ﺇﻟﻐﺎء ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﻓﺼﻞ ﺍﻻﺷﺘﺮﺍﻙ ﻧﻬﺎﺋﻴﺎَ ﺃﻭ ﻣﺆﻗﺘﺎً ﻳﺨﻀﻊ ﻟﻺﺟﺮﺍءﺍﺕ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﺸﺮﻛﺔ‬ .6
6. Zain’s Procedures govern the temporary or final suspension and/or termination of .‫ﻛﺎﻓﺔ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﻨﺎﺗﺠﺔ ﻋﻦ ﺍﻻﺳﺘﺨﺪﺍﻡ ﻭﻓﻘﺎً ﻟﻺﺟﺮﺍءﺍﺕ ﻭﺍﻟﺮﺳﻮﻡ ﺍﻟﺨﺎﺻﺔ ﺑﻜﻞ ﺧﺪﻣﺔ ﺍﻭ ﻋﺮﺽ‬
Service. The Customer undertakes to pay all amounts resulting from using the line as per َ‫ﻛﻤﺎ ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﻌﻠﻤﻪ ﻭﺑﻤﻮﺍﻓﻘﺘﻪ ﺑﺄﺣﻘﻴﺔ ﺍﻟﺸﺮﻛﺔ ﻓﻲ ﻗﻄﻊ ﺍﻟﺨﺪﻣﺔ ﻣﺆﻗﺘﺎً ﺃﻭ ﻧﻬﺎﺋﻴﺎً ﻭﻣﺎ ﻳﺘﺮﺗﺐ ﻧﺘﻴﺠﺔ ﺫﻟﻚ ﻭﻓﻘﺎ‬ .7

7. The Customer declares that he/she understands that Zain has the right to terminate the
.‫ ﺍﻟﺼﻴﺎﻧﺔ ﺃﻭ ﺍﻟﻘﻮﺓ ﺍﻟﻘﺎﻫﺮﺓ‬،‫ﺗﻌﻄﻞ ﺍﻟﻨﻈﺎﻡ ﻷﺳﺒﺎﺏ ﻓﻨﻴﺔ ﺧﺎﺭﺟﺔ ﻋﻦ ﺍﻹﺭﺍﺩﺓ‬
Services temporarily or permanently in the following instances:
‫ﺇﺧﻼﻝ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻟﺒﻨﻮﺩ ﻭﺍﻟﺸﺮﻭﻁ ﺍﻟﺤﺎﻟﻴﺔ ﻭﺍﻟﻤﺴﺘﻘﺒﻠﻴﺔ‬
In case of system breakdown due to technical reasons beyond Zain’s control or maintenance, or
force majeure ‫ ﻳﻮﻣﺎ ﻋﻠﻰ ﺗﺎﺭﻳﺦ ﺇﻧﺘﻬﺎء ﺻﻼﺣﻴﺔ ﺍﻟﺨﻂ‬6 7‫ ﺃﻭ ﻣﺮﻭﺭ‬/‫ ﻳﻮﻣ ًﺎ ﻣﻦ ﺗﺎﺭﻳﺦ ﺷﺮﺍء ﺇﺷﺘﺮﺍﻙ ﻣﺴﺒﻖ ﺍﻟﺪﻓﻊ‬1 4 ‫ﻋﺪﻡ ﺇﺟﺮﺍء ﻣﻜﺎﻟﻤﺔ ﺧﻼﻝ‬
‫ ﺃﺷﻬﺮ ﻣﺘﻮﺍﺻﻠﺔ ﻋﻠﻰ ﺍﻟﺮﻏﻢ ﻣﻦ ﺗﻮﻓﺮ ﺍﻟﺮﺻﻴﺪ‬6 ‫ ﺃﻭ ﻋﺪﻡ ﺇﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﻂ ﺍﻟﻤﺴﺒﻖ ﺍﻟﺪﻓﻊ ﻟﻤﺪﺓ‬/‫ﻣﺴﺒﻖ ﺍﻟﺪﻓﻊ ﺩﻭﻥ ﺇﻋﺎﺩﺓ ﺗﻌﺒﺌﺘﻪ‬
If the Customer violates the Service Contract or future terms and conditions.
‫ﻭﺍﻟﺼﻼﺣﻴﺔ ﻟﻠﺤﺎﻟﺘﻴﻦ ﻣﻤﺎ ﻳﺘﺮﺗﺐ ﻋﻠﻴﻪ ﺍﻧﻘﻄﺎﻉ ﺍﻟﺨﺪﻣﺔ ﻭ ﺃﺣﻘﻴﺔ ﺍﻟﺸﺮﻛﺔ ﻓﻲ ﺳﺤﺐ ﺧﻂ ﺍﻹﺷﺘﺮﺍﻙ ﻹﻋﺎﺩﺓ ﺗﺨﺼﻴﺼﻪ ﻟﻌﻤﻴﻞ ﺁﺧﺮ‬
If the Customer fails to use the prepaid line within 14 days from date of purchase or Customer fails to ‫ﺑﺎﻻﺿﺎﻓﺔ ﺍﻟﻰ ﻓﻘﺪﺍﻥ ﺍﻟﺮﺻﻴﺪ ﺍﻟﺪﺍﺋﻦ ﺩﻭﻥ ﺃﺩﻧﻰ ﻣﺴﺆﻭﻟﻴﺔ ﻋﻠﻰ ﺍﻟﺸﺮﻛﺔ‬
recharge the prepaid line within 67 days from the prepaid line’s expiration date or the Customer .‫ﺇﺫﺍ ﺗﺠﺎﻭﺯﺕ ﻓﺎﺗﻮﺭﺓ ﺍﻟﻌﻤﻴﻞ ﺣﺪﻭﺩ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﺎﺩﻱ ﻟﻠﺨﺪﻣﺔ ﻁﺒﻘﺎً ﻷﻧﻈﻤﺔ ﺍﻟﺸﺮﻛﺔ ﺍﻟﻤﻨﺸﻮﺭﺓ ﺑﻤﻮﻗﻌﻬﺎ ﺍﻻﻟﻜﺘﺮﻭﻧﻲ‬
fails to use the prepaid line for a consecutive period of 6 months despite prepaid line’s validity and
available credit. In the event that any of the above occurs and without further liability on Zain, Zain .‫ﻋﺪﻡ ﺗﺤﺪﻳﺚ ﺍﻟﺒﻴﺎﻧﺎﺕ ﺧﻼﻝ ﺃﺳﺒﻮﻉ ﻣﻦ ﺗﺎﺭﻳﺦ ﺍﺭﺳﺎﻝ ﺍﻟﺸﺮﻛﺔ ﺭﺳﺎﻟﺔ ﻧﺼﻴﺔ ﺑﻀﺮﻭﺭﺓ ﻣﺮﺍﺟﻌﺔ ﺍﻟﻌﻤﻴﻞ ﻟﺘﺤﺪﻳﺚ ﺍﻟﺒﻴﺎﻧﺎﺕ‬
shall be entitled to terminate the Service and reallocate the line to another customer and confiscate
‫ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﻗﻄﻊ ﺍﻟﺨﺪﻣﺔ ﻧﻬﺎﺋﻴ ًﺎ ﺃﻭ ﻣﺆﻗﺘ ًﺎ ﻋﻦ ﻛﺎﻓﺔ ﺍﻟﺨﻄﻮﻁ ﺍﻟﻤﺪﺭﺟﺔ ﺗﺤﺖ ﻋﻘﺪ ﺍﻟﻌﻤﻴﻞ ﻓﻲ ﺣﺎﻟﺔ ﺗﻘﺪﻳﻢ ﺍﻟﻤﺴﺘﻨﺪﺍﺕ ﺍﻟﺪﺍﻟﺔ ﻋﻠﻰ‬
any and all available credit balance.
.‫ ﻭﺗﻄﺒﻖ ﺑﺸﺄﻥ ﺍﻟﺨﻄﻮﻁ ﻭﺍﻟﻤﺪﻳﻮﻧﻴﺔ ﺍﻹﺟﺮﺍءﺍﺕ ﺍﻟﻤﻌﺘﻤﺪﺓ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﻌﻤﻼء ﺍﻟﻤﺘﻮﻓﻴﻦ‬،‫ﻭﻓﺎﺓ ﺍﻟﻌﻤﻴﻞ‬
If Customer’s invoice exceeds normal Service use in accordance with Zain’s regulations posted on
Zain’s website.
If the data is not updated after one week from sending text massage to the customer to update his/her
information in Zain system.
Zain has the right to disconnect and terminate all subscriptions under his contract if an official
document been submitted showing the decease of the subscriber, customers procedures will be
applied on the debts and subscriptions)

Fourth: Rules of Warranty Term: :‫ ﺃﺣﻜﺎﻡ ﻣﺪﺓ ﺍﻟﻜﻔﺎﻟﺔ‬:ً‫ﺭﺍﺑﻌﺎ‬

1. Zain shall provide Manufacturer and/or Distributor warranties to devices not detected or ‫ﺳﻮﻑ ﺗﻘﺪﻡ ﺍﻟﺸﺮﻛﺔ ﺧﺪﻣﺔ ﺍﻟﻜﻔﺎﻟﺔ ﻟﻸﺟﻬﺰﺓ )ﻭﻓﻘﺎَ ﻷﺣﻜﺎﻡ ﻛﻔﺎﻟﺔ ﺍﻟﻤﺼﻨﻊ ﺃﻭ ﺍﻟﻮﻛﻴﻞ( ﺑﺎﺳﺘﺜﻨﺎء ﺍﻟﻌﻴﻮﺏ ﻭﺍﻷﻋﻄﺎﻝ‬ .1

2. Any and all laws, ministerial regulations and orders issued by an official authority related ‫ﺗﻄﺒﻖ ﺍﻟﻘﻮﺍﻧﻴﻦ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﻮﺯﺍﺭﻳﺔ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﺍﻟﺠﻬﺔ ﺍﻟﺮﺳﻤﺔ ﺑﻜﻞ ﻣﺎ ﻳﺘﻌﻠﻖ ﺑﺸﺮﻭﻁ ﻭﺿﻮﺍﺑﻂ ﺑﻴﻊ‬ .2

Fifth: General Rules: :‫ ﺃﺣﻜﺎﻡ ﻋﺎﻣﺔ‬:ً‫ﺧﺎﻣﺴﺎ‬
1. Zain will not disclose personal details of the Customer or his/her communications except ً‫ﺍﻟﺸﺮﻛﺔ ﻟﻦ ﺗﻜﺸﻒ ﻋﻦ ﺑﻴﺎﻧﺎﺕ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺸﺨﺼﻴﺔ ﺃﻭ ﺗﻔﺎﺻﻴﻞ ﺣﺮﻛﺔ ﺍﺗﺼﺎﻻﺗﻪ ﺇﻻ ﺑﺤﺼﻮﺭﻩ ﺷﺨﺼﻴﺎً ﻁﺒﻘﺎ‬ .1
in their presence personally (subject to specific administrative fees) or in accordance ‫ ﺃﻭ ﺑﻮﻛﺎﻟﺔ ﺭﺳﻤﻴﺔ ﻋﺎﻣﺔ ﺃﻭ ﺧﺎﺻﺔ ﻳﺴﻤﺢ ﻓﻴﻬﺎ ﺑﺬﻟﻚ ﺃﻭ ﻭﻓﻘﺎً ﻟﻠﻘﻮﺍﻧﻴﻦ‬,‫ﻟﻠﺮﺳﻮﻡ ﺍﻹﺩﺍﺭﻳﺔ ﺍﻟﻤﻘﺮﺭﺓ ﻟﺪﻯ ﺍﻟﺸﺮﻛﺔ‬
with a general/special official power of attorney or as per the local laws of the country or ‫ ﻭ ﺑﻬﺬﺍ ﺍﻟﺸﺄﻥ ﻳﻔﻮﺽ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺸﺮﻛﺔ ﺍﻟﻜﺴﻒ ﻋﻦ‬،‫ﺍﻟﻤﺤﻠﻴﺔ ﻟﻠﺒﻼﺩ ﺃﻭ ﺑﻄﻠﺐ ﻣﻦ ﺍﻟﺴﻠﻄﺎﺕ ﺍﻟﻌﺎﻣﺔ ﻟﻠﺪﻭﻟﺔ ﺃﻭ ﺍﻟﻘﻀﺎء‬
as per the request of the public State or judicial authorities of the country. In this regard, ‫ ﻛﻤﺎ ﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﻛﺎﻣﻞ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ‬،‫ﻣﻌﻠﻮﻣﺎﺗﻪ ﺍﻟﺸﺨﺼﻴﺔ ﻭ ﺗﻔﺎﺻﻴﻞ ﻣﻜﺎﻟﻤﺎﺗﻪ ﻁﺒﻘﺎً ﻟﻠﺤﺎﻻﺕ ﺍﻟﺴﺎﺑﻘﺔ‬
the Customer herewith authorizes Zain to disclose the Customer’s personal information ‫ ﺗﻄﺒﻴﻖ ﺍﻟﺸﺮﻛﺔ ﻹﻟﻜﺘﺮﻭﻧﻲ ﺳﻮﺍء ﻛﺎﻥ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺑﻮﺍﺳﻄﺘﻪ ﺃﻭ ﺑﻮﺍﺳﻄﺔ ﺃﻱ ﻣﻦ ﺣﺎﺋﺰﻱ‬/ ‫ﻋﻦ ﺍﺳﺘﺨﺪﺍﻡ ﻣﻮﻗﻊ‬
and details of the Customer’s calls in the previously mentioned situations. The Customer ‫ﺍﻻﺷﺘﺮﺍﻛﺎﺕ ﺍﻟﻤﺴﺠﻠﺔ ﺑﺎﺳﻤﻪ ﻻﺳﺘﺨﺮﺍﺝ ﺃﻱ ﻣﻦ ﺑﻴﺎﻧﺎﺗﻪ ﺃﻭ ﺗﻔﺎﺻﻴﻞ ﺣﺮﻛﺔ ﺍﺗﺼﺎﻻﺗﻪ ﺩﻭﻥ ﺃﺩﻧﻰ ﻣﺴﺆﻭﻟﻴﺔ ﻋﻠﻰ‬
hereby undertakes the responsibility for use of Zain’s application/website, whether used .‫ﺯﻳﻦ‬
by the Customer or by any of the subscriptions users that are registered under the ‫ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﻌﻠﻤﻪ ﺍﻥ ﺷﺮﻛﺔ ﺍﻻﺗﺼﺎﻻﺕ ﺍﻟﻤﺘﻨﻘﻠﺔ )ﺯﻳﻦ( ﺗﻜﻔﻠﻪ ﻟﺪﻯ ﺍﻟﺸﺮﻛﺎﺕ ﺍﻟﺨﺎﺭﺟﻴﺔ ﺑﺨﺪﻣﺔ ﺍﻟﺘﺠﻮﺍﻝ ﻟﺬﺍ ﻳﻘﺒﻞ‬ .2
Customer’s name for the extraction of any data or call trace without any liability towards
‫ﻭﻳﻮﺍﻓﻖ ﻋﻠﻰ ﺳﺪﺍﺩ ﺃﻱ ﻣﺒﺎﻟﻎ ﻣﺴﺘﺤﻘﺔ ﻋﻦ ﻫﺬﻩ ﺍﻟﺨﺪﻣﺔ ﺳﻮﺍء ﻓﻲ ﺣﺎﻟﺔ ﺍﺳﺘﻤﺮﺍﺭﻳﺔ ﺗﻌﺎﻗﺪﻩ ﺍﻭ ﺍﻧﺘﻬﺎء ﻋﻘﺪ ﺧﺪﻣﺎﺗﻪ‬

‫ ﺣﺘﻰ ﻓﻲ ﺍﻟﺤﺎﻻﺕ ﺍﻟﺘﻲ ﻗﺪ ﻳﺘﺄﺧﺮ ﻓﻴﻬﺎ ﻅﻬﻮﺭ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﺨﺎﺻﺔ ﺑﻬﺬﻩ ﺍﻟﺨﺪﻣﺔ ﺑﻔﺎﺗﻮﺭﺓ‬،‫ﻷﻱ ﺳﺒﺐ ﻣﻦ ﺍﻷﺳﺒﺎﺏ‬
2. The Customer declares and understands that Zain guarantees the Customer with foreign .ً‫ ﺃﻭ ﻓﺼﻞ ﺍﻟﺨﺪﻣﺔ ﻧﻬﺎﺋﻴﺎ‬/‫ﺍﻟﻌﻤﻴﻞ ﻷﺳﺒﺎﺏ ﻓﻨﻴﺔ ﺧﺎﺭﺟﺔ ﻋﻦ ﺇﺭﺍﺩﺓ ﺍﻟﺸﺮﻛﺔ ﻭ‬
companies and third parties to provide roaming Service. Therefore the Customer agrees ‫ﻳﻌﻠﻢ ﺍﻟﻌﻤﻴﻞ ﺍﻥ ﺃﺳﻌﺎﺭ ﺍﻟﻤﻜﺎﻟﻤﺎﺕ ﺍﻟﺪﻭﻟﻴﺔ ﺗﺨﻀﻊ ﺍﻟﻰ ﺍﻻﺗﻔﺎﻗﺎﺕ ﺍﻟﺪﻭﻟﻴﺔ ﻭﺗﻌﻠﻦ ﻣﻦ ﺍﻟﺠﻬﺔ ﺍﻟﺮﺳﻤﻴﺔ ﺑﺎﻹﺿﺎﻓﺔ ﺍﻟﻰ‬ .3
to pay any amounts charged in this respect, whether during the term of the Service
‫ ﻋﻠﻤﺎً ﺑﺄﻥ ﻫﺬﻩ ﺍﻷﺳﻌﺎﺭ ﻗﺎﺑﻠﺔ ﻟﻠﺘﻐﻴﻴﺮ ﻭﺍﻟﺘﻌﺪﻳﻞ ﻣﻦ ﻗﺒﻞ‬،‫ﺍﻟﺮﺳﻮﻡ ﺍﻹﺩﺍﺭﻳﺔ ﻟﻠﺸﺮﻛﺔ ﻁﺒﻘﺎً ﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺠﻬﺔ ﺍﻟﺮﺳﻤﻴﺔ‬
Contract or after the Service Contract’s expiration for any reasons, including: any delays
.‫ﺍﻟﺠﻬﺔ ﺍﻟﺮﺳﻤﻴﺔ ﺍﻟﻤﺴﺆﻭﻟﺔ‬
in calculating and including the charges in the Customer’s invoice, due to any technical
reasons or reasons outside the control of Zain and/or in case of disconnection of the ‫ ﻓﺈﻥ ﺍﻟﻌﺮﻭﺽ ﺍﻟﺨﺎﺻﺔ ﺗﻄﺒﻖ ﻋﻠﻴﻬﺎ ﺍﻟﺸﺮﻭﻁ ﻭﺍﻹﺟﺮﺍءﺍﺕ ﺍﻟﺨﺎﺻﺔ ﺑﻜﻞ ﻋﺮﺽ ﻋﻠﻰ‬،‫ﺍﺳﺘﺜﻨﺎ ًء ﻣﻦ ﻫﺬﻩ ﺍﻟﺸﺮﻭﻁ‬ .4
Service permanently .‫ ﺍﻹﻟﻐﺎء ﻭﺭﺳﻮﻡ ﺍﻹﻟﻐﺎء‬/ ‫ ﺍﻷﺳﻌﺎﺭ‬/ ‫ ﺗﻔﺎﺻﻴﻞ ﺍﻟﺨﺪﻣﺔ ﻭﺷﺮﻭﻁﻬﺎ‬/‫ﺣﺪﺓ ﻭﺫﻟﻚ ﻣﻦ ﺣﻴﺚ ﺍﻟﻤﺪﺓ‬
3. The Customer understands that the prices of international calls are subject to .‫( ﺃﻳﺎﻡ ﻋﻦ ﺃﻱ ﺗﻐﻴﻴﺮ ﻓﻲ ﻋﻨﻮﺍﻧﻪ ﺍﻟﺪﺍﺋﻢ ﺃﻭ ﻣﻘﺮ ﺇﻗﺎﻣﺘﻪ‬7) ‫ﺍﺧﻄﺎﺭ ﺍﻟﺸﺮﻛﺔ ﺑﺪﻭﻥ ﺗﺄﺧﻴﺮ ﺧﻼﻝ‬ .5
international agreements announced by the official authority. Additionally, Zain’s / ‫ ﺍﻟﺒﺮﻳﺪ ﺍﻻﻟﻜﺘﺮﻭﻧﻲ‬/ ‫ﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻘﺼﻴﺮﺓ‬/‫ ﺍﻻﺗﺼﺎﻝ ﺍﻟﺼﻮﺗﻲ ﻋﻠﻰ ﺭﻗﻢ ﺍﻟﻬﺎﺗﻒ ﺍﻟﻨﻘﺎﻝ ﺃﻭ ﺍﻷﺭﺿﻲ‬/‫ﺍﻟﻌﻨﻮﺍﻥ‬ .6
administrative fees are also determined by the decisions of the official authority, The .‫ﺍﻟﻤﺮﺍﺳﻼﺕ ﺍﻟﺒﺮﻳﺪﻳﺔ ﻭﺳﻴﻠﺔ ﻗﺎﻧﻮﻧﻴﺔ ﻹﺭﺳﺎﻝ ﺃﻱ ﺇﺷﻌﺎﺭﺍﺕ ﺍﻭ ﺍﺧﻄﺎﺭﺍﺕ ﻟﻠﻌﻤﻴﻞ‬
Customer further acknowledges that such prices and fees are subject to change by the
official Authority at any time.
‫ ﻭﻳﻌﺘﺒﺮ‬،‫ ﺍﻟﻌﺮﻭﺽ ﻋﻠﻰ ﺍﻟﻤﻮﻗﻊ ﺍﻻﻟﻜﺘﺮﻭﻧﻲ‬/ ‫ ﺍﻷﺳﻌﺎﺭ‬/ ‫ﺃﻭ ﺗﻐﻴﻴﺮ ﻓﻲ ﺍﻹﺟﺮﺍءﺍﺕ‬/‫ﺗﻘﻮﻡ ﺍﻟﺸﺮﻛﺔ ﺑﻨﺸﺮ ﺃﻱ ﺗﻌﺪﻳﻞ ﻭ‬ .7
.‫ﻫﺬﺍ ﺍﻟﻨﺸﺮ ﺑﻤﺜﺎﺑﺔ ﺇﺧﻄﺎﺭ ﻟﻠﻌﻤﻴﻞ ﺑﻬﺬﻩ ﺍﻟﺘﻌﺪﻳﻼﺕ‬
4. As exceptions to these conditions, each individual special offer may be provided with
offer specific special conditions and procedures in respect of the term/ Service details,
َ‫ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﻌﻤﻠﻪ ﻭﻣﻮﺍﻓﻘﺘﻪ ﻋﻠﻰ ﺍﻥ ﺍﺳﺘﺮﺩﺍﺩ ﺃﻱ ﻣﺒﺎﻟﻎ ﻣﺴﺪﺩﺓ ﺑﺎﻟﺰﻳﺎﺩﺓ ﻋﻠﻰ ﺍﻻﺷﺘﺮﺍﻙ ﺳﻮﺍء ﻛﺎﻥ ﺍﻻﺷﺘﺮﺍﻙ ﻣﻔﻌﻼ‬ .8
conditions of Service, prices, cancelation and cancelation fees. ‫ ﺍﻭ ﻳﻌﺮﺿﻬﺎ ﻟﻠﻤﺴﺆﻭﻟﻴﺔ‬،‫ﺍﻭ ﻣﻠﻐﻰ ﻧﻬﺎﺋﻴﺎَ ﻳﺨﻀﻊ ﻟﺘﻘﺪﻳﺮ ﺍﻟﺸﺮﻛﺔ ﻭ ﺑﻤﺎ ﻻ ﻳﺘﻌﺎﺭﺽ ﻣﻊ ﻣﺼﺎﻟﺤﻬﺎ ﺍﻟﺘﺠﺎﺭﻳﺔ‬
‫ ﻭ ﻳﺒﻘﻰ ﺭﺻﻴﺪﺍً ﺩﺍﺋﻨﺎً ﺍﻟﻰ ﺍﻥ ﻳﺘﻢ ﺍﺳﺘﻬﻼﻛﻪ ﺑﺎﻟﻜﺎﻣﻞ ﻧﻈﻴﺮ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﻤﺸﺘﺮﻙ ﺑﻬﺎ‬،‫ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﺗﺠﺎﻩ ﺍﻟﺠﻬﺎﺕ ﺍﻟﺮﺳﻤﻴﺔ‬
5. Zain should be notified, without delay, within (7) days of any change in the permanent
.‫ﻭﻓﻘﺎً ﻹﺟﺮﺍءﺍﺕ ﺍﻟﺸﺮﻛﺔ ﻭﺩﻭﻥ ﺍﺩﻧﻰ ﻣﺴﺆﻭﻟﻴﺔ ﻋﻠﻴﻬﺎ ﺗﺠﺎﻩ ﺃﻱ ﺍﻁﺮﺍﻑ ﺃﺧﺮﻯ‬
address of the Customer or its residency place
‫ﺍﺳﺘﺨﺪﺍﻡ ﺍﻻﺷﺘﺮﺍﻙ ﺑﻮﺍﺳﻄﺔ ﻣﺴﺘﺨﺪﻡ ﺁﺧﺮ ﻣﺨﺘﻠﻒ ﻋﻦ ﺍﻟﻌﻤﻴﻞ ﺍﻟﻤﺴﺠﻠﺔ ﺑﻴﺎﻧﺎﺗﻪ ﺑﻨﻈﺎﻡ ﻣﻌﻠﻮﻣﺎﺕ ﺍﻟﺸﺮﻛﺔ ﻻ ﻳﺨﻠﻰ‬ .9

.‫ﻣﺴﺆﻭﻟﻴﺘﻪ ﻋﻦ ﺃﻱ ﺇﺳﺎءﺓ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻭ ﻣﺒﺎﻟﻎ ﻣﺘﺮﺗﺒﺔ ﻋﻠﻰ ﺍﻻﺷﺘﺮﺍﻙ‬
E­mail, post correspondences are considered legal means for sending any notices or
letters or notifications to the Customer.
‫ ﻭ ﻳﻨﻌﻘﺪ ﺍﻻﺧﺘﺼﺎﺹ‬،‫ﻳﺨﻀﻊ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻷﺣﻜﺎﻡ ﺍﻟﻘﻮﺍﻧﻴﻦ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﻤﻨﻈﻤﺔ ﻟﺨﺪﻣﺎﺕ ﺍﻻﺗﺼﺎﻻﺕ ﺩﺍﺧﻞ ﺍﻟﻜﻮﻳﺖ‬ .10
‫ ﻛﻤﺎ ﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻘﻀﺎﺋﻴﺔ ﻭ ﺍﺗﻌﺎﺏ ﺍﻟﻤﺤﺎﻣﺎﺓ ﻭ ﻋﻤﻮﻟﺔ ﺍﻟﺘﺤﺼﻴﻞ ﺍﺫﺍ‬،‫ﺍﻟﻘﻀﺎﺋﻲ ﻟﻠﻤﺤﺎﻛﻢ ﺍﻟﻜﻮﻳﺘﻴﺔ‬
7. Zain will publish any amendment and/ or change in the procedures, prices, offers on its
.ً‫ﺍﺿﻄﺮﺕ ﺍﻟﺸﺮﻛﺔ ﻟﻤﻄﺎﻟﺒﺘﻬﺎ ﻗﻀﺎﺋﻴﺎ‬
website. Such publication is considered as notification of these amendments to the
Customer
.‫ ﺍﻣﺎ ﺍﻟﻌﺮﻭﺽ ﺍﻷﺧﺮﻯ ﻓﺘﻄﺒﻖ ﻋﻠﻴﻬﺎ ﺍﻻﺣﻜﺎﻡ ﺍﻟﺨﺎﺻﺔ ﺑﻬﺎ‬،‫ﺗﻤﺜﻞ ﻫﺬﻩ ﺍﻟﺒﻨﻮﺩ ﺍﻟﺸﺮﻭﻁ ﺍﻟﻌﺎﻣﺔ ﻟﺨﺪﻣﺎﺕ ﺍﻟﺸﺮﻛﺔ‬ .11
8. The Customer understands that any refunds of any amounts that were paid in excess on ‫ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻮﺩ ﺃﻱ ﺍﺧﺘﻼﻑ ﺍﻭ ﺗﻌﺎﺭﺽ ﻣﺎ ﺑﻴﻦ ﻧﺺ ﺍﻟﻠﻐﺔ ﺍﻟﻌﺮﺑﻴﺔ ﻭﺍﻟﻠﻐﺔ ﺍﻹﻧﺠﻠﻴﺰﻳﺔ ﻓﺈﻥ ﺍﻟﻨﺺ ﺍﻟﻌﺮﺑﻲ ﻟﻪ‬ .12
the line (whether the subscription line is active or disconnected) are subject to Zain’s .‫ﺍﻷﻭﻟﻮﻳﺔ‬
discretion . Refunds, if made, shall be made in a manner that does not contradict with
Zain’s commercial interests or subjects Zain to legal liability to the official authorities.
Such excess credit amounts will remain on Customer’s balance until fully utilized by the
subscribed Services in accordance with Zain’s procedures and without any liability towards
any third parties
9. The use of the Customer’s line by another user other than the Customer, whose data is
registered in Zain information system, will not relieve the Customer from its
responsibility for any misuse or any charges incurred on the line.
10. This Service Contract is subject to the laws and the decisions regulating the
communications Services inside the state of Kuwait with full jurisdiction to the courts of
Kuwait. In the event that Zain turns to the court to demand payment, the Customer shall
pay for the judicial fees, lawyers' fees and collection commission arising out of such
demand.
11. These clauses represent the general conditions of Zain Services. Additional specific terms
and conditions may apply for Zain’s other offers.
12. In the event of any conflict between the Arabic version of this Service Contract and the
English version, the Arabic version shall prevail.
