Thingyan Celebra ons Campaign Terms and Condi ons

We are happy that you wish to take part in the Thingyan Celebra ons Campaign (the "Campaign").
These Terms & Condi ons (the "Terms") govern your par cipa on in the Campaign. By par cipa ng in
the Campaign, you agree to be bound by these Terms, so please read these Terms carefully. If you do not
agree to be bound by these Terms, you should refrain from par cipa ng in the Campaign. "Viber" means
Viber Media S.à r.l., a company incorporated in the Grand Duchy of Luxembourg, having o ces at 2 rue
du Fossé, L-1536 Luxembourg.
Par cipa on. In order to par cipate in the Campaign, you must have a valid Viber account registered
with the valid phone number in your country and be at the legal age of consent to form a binding
agreement in your country (or older), but in any event not less than 16 years old.
VOID IN ALL TERRITORIES WHERE PROHIBITED BY LAW.
1. General
1. During the Term of the Campaign (as de ned below), subject to the quan es, territories and
further Partners’ (as this term is de ned below) terms as stated in the Prizes Table below, and as
further detailed herein, users of the Viber App that have accessed and subscribed to the Viber
Thingyan Celebra ons Bot (the “Bot”) will be granted with an op on to be awarded a Prize (as
de ned below) from the selec on of Prizes:, up to a total of 3 Prizes per user (any such user, a
“Par cipant”, or “you”).
As further men oned below, all Prizes are provided by Viber’s Partners under the Campaign. The
Par cipant’s country, for the purposes of determining the eligibility of relevant Partners Prizes, is
determined based on the Par cipant’s phone number country pre x.
You may not enter the Bot by using mul ple iden es or devices in an a empt to circumvent an
orderly conduct of the Campaign as set forth under these Terms. If you use fraudulent methods or
otherwise a empt to circumvent these Terms and an orderly conduct of the Campaign, your
access to the Bot may be denied, your Entry may be disquali ed and your eligibility may be
voided, at the sole and nal discre on of Viber.
The terms and condi ons set forth in the Viber Terms of Service available at h ps://
www.viber.com/en/terms/viber-terms-use/, as amended from me to me, shall apply to the Bot
and its subscribers at all mes, and nothing herein shall derogate from their applicability.
2. Par cipa on in the Campaign is free of charge and does not require making any purchase or
paying any fee to Viber. If your Prize is provided by one of the Partners, then such Prize will be
subject to the Partner’s binding terms and condi ons, which apply in addi on to these Terms, and
which are further set in the Prizes Table below. Furthermore, you may have to be asked to make a
purchase at such Partner’s resource, pla orm, facility, online or o ine store, etc. in order to be
able to take advantage of the Prize.
3. The Campaign shall take place between March 28, 2024, 00:01 and April 28, 2024 Myanmar me
zone (the “Term”). The term “day”, “daily” and other deriva ves used in these Terms will mean a
calendar day (24 hours) according to Myanmar me zone , within the Term. Viber reserves the
right to modify or delay the Term.
4. Entry to the Bot shall be considered an "Entry" and par cipa on in the Campaign, and is subject
to the Terms hereof.
5. Viber assumes no responsibility for Entries not received on me or at all for whichever reason,
including due to a technical error or malfunc on.
2. Prizes
1. Subject to the terms and condi ons under these Terms, Par cipants who will enter the Bot and
click on the click-to-ac on bu on, as further set forth in Sec ons 2.4 and 2.5 below, will be

en tled to receive one prize, which will be randomly awarded to the Par cipants out of the
available pool of Prizes as described in the Prizes Table below (the “Prize(s)”).

A Prize may be redeemed during the Term, and within up to 7 days following the lapse of the
Term.

2. It is acknowledged that except for the S ckers and the mobile devices which are awarded by
Viber, all other Prizes are provided by the Partners described below in the Prizes Table. The
applicability, eligibility, redemp on, use and exercise of each Partner’s Prize is solely subject to
the speci c terms and condi ons of each Partner appearing against the relevant Partner’s Prize
under the column “Partner’s Binding Terms and Condi ons” in the Prizes Table. All Prizes are
provided “as is” without any warranty, representa on, or guarantee, express or implied, in fact
or in law, whether now known or hereina er enacted, rela ve to the actual redemp on,
exercise, use or enjoyment of the Prize, including, without limita on, its quality,
merchantability, or tness for a par cular purpose and Viber hereby expressly disclaims any
responsibility and/or liability whatsoever with respect to any aspect of the Partner’s Prizes,
including inter alia in connec on with the applicability, eligibility for, validity, redemp on,
exercise and use of such Partner’s Prizes. Furthermore, in some territories the grant of prizes in
connec on thereto may not be permi ed and in such case, the eligibility for a Prize shall be
void.

3. No cash alterna ve to the Prizes will be o ered. The Prizes are o ered on a 'NO EXCHANGE, NO
REFUND' basis and are not transferable. Any redemp on, exercise and use of any Prize , as well as
any and all Prize -related expenses, if any, including without limita on any and all federal, state,
and/or local taxes, shall be the sole responsibility of the Par cipant. No subs tu on of Prize or
request for the cash equivalent by Par cipant shall be allowed.

4. In order to receive a Prize, the Par cipant will be o ered to click on the click-to-ac on bu on
within the Bot. Following such clicking, the indica on of Prize, which has been randomly selected
and automa cally assigned to the Par cipant, will be revealed, and the user will be suggested
to redeem/proceed to exercise the Prize (in case the Prize is provided by one of the Partners, such
redemp on/exercise will be subject to such Partner’s terms and condi ons). On each daily Entry
the Par cipant will be eligible for one Prize and will be able to secure its eligibility for one Prize in
the next Entry, provided that the overall eligibility of one Par cipant will be limited to a total of up
to 2 Prizes: either 1 Onepay voucher or 1 S cker pack, and possibly also and as per Sec on 2.5
below, a mobile device.
The Prizes will be distributed randomly by the Bot subject to the availability and the country pool
of prizes as set forth in the Prizes Table).

5. Each week during the Term, one lucky Par cipant who clicked on the click-to-ac on bu on within
the Bot during said week, will be randomly elected in a ra e, out of all those Par cipants who
clicked on the bu on during said week, and will be en tled to win one mobile device. The total
number of mobile devices which will be granted in the Campaign, is 4.

A Par cipant may only par cipate in one ra e.

The lucky winner will be contacted via a direct message on Viber a er its elec on in the ra e (the
“Prize No ca on”) and must reply seventy-two (72) hours of the date of the Prize No ca on
(the “Deadline”) with its full name, email address for further communica on and a mailing
address.

If the lucky winner and does not respond to the Prize No ca on by the Deadline, he/she may be
disquali ed, and another Par cipant may be elected in a ra e by Viber to be the alternate weekly

winner of the mobile device. Viber may repeat the aforemen oned process un l a Par cipant will
be awarded with the mobile device.

6. Each Par cipant hereby acknowledges that the availability of Prizes during the Campaign is not
guaranteed, that the pool of Prizes may be fully exhausted prior to the end of the Term, and
Par cipant shall have no right or en tlement in connec on thereof, and Viber shall have no
obliga on whatsoever to replenish the Prizes and/or provide Par cipant with alterna ves.
Without deroga ng from any provisions hereunder and in addi on to Sec on 3 below, the
Par cipant hereby con rms its non-reliance on the Prizes’ availability and waives, as between the
Par cipant and Viber, to the maximum extent permi ed under applicable law, any and all claims
whatsoever that it may have in connec on thereof or with respect to the eligibility for Prizes.

7. Viber reserves the right to change, modify, suspend and/or cancel the Campaign or any part
thereof at any me (including by way of limi ng the use of the Prizes, adding or reducing the
number of Prizes and/or opportuni es, or canceling any and all Prizes etc.), or discon nue this
Campaign at any me, without no ce, at Viber's sole discre on, and without any liability on its
part. Viber’s decisions on all ma ers involving the Campaign will be nal and binding.

3. Limita on of Liability; No Warranty

1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIBER AND EACH OF ITS AFFILIATES,
AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS
SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT,
SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGE ARISING FROM YOUR
PARTICIPATION IN THE CAMPAIGN OR ANY OTHER CLAIM RELATED IN ANY WAY TO THE
CAMPAIGN. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS,
LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR
ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF VIBER HAD BEEN ADVISED OF THE
POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE
CLAIM IS BASED. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES
OR JURISDICTIONS, VIBER'S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

2. EVERYTHING ON VIBER IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESSED OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PARTICIPANTS AGREE AND ACKNOWLEDGE THAT
ALL PRIZES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE,
EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED,
RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZES, INCLUDING, WITHOUT LIMITATION, ITS
QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, NO
RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-
ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY.

3. BY PARTICIPATING IN THE CAMPAIGN, YOU HEREBY RELEASE VIBER AND EACH OF ITS AFFILIATES
AND SUBSIDIARIES AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES,
CONTRACTORS OR AGENTS, TO THE MAXIMUM EXTENT PERMITTED BY ANY APPLICABLE LAW,
FROM AND AGAINST ANY AND ALL LIABILITY, LOSS, CLAIMS, DEMANDS OR ACTIONS OF ANY KIND
WHATSOEVER WITH RESPECT TO INJURIES, DAMAGES, OR LOSSES, TO PERSONS OR PROPERTY,
WHICH MAY BE SUSTAINED IN CONNECTION WITH SUBMITTING AN ENTRY, PRIZES, PARTICIPATION
IN THE CAMPAIGN OR WITH RESPECT OF ANY ASPECT OF THE CAMPAIGN.

The Campaign and these Terms are governed by the laws of England and Wales, without regard to the
con ict of laws principles. As a condi on of par cipa ng in this Campaign, a Par cipant agrees that any
and all disputes which cannot be resolved between the par es hereto, and causes of ac on arising out
of or connected with this Campaign, shall be resolved individually, without resort to any form of class
ac on, exclusively before a court located in London, UK. Further, in any such dispute, under no
circumstances will Par cipant be permi ed to obtain awards for, and hereby waives all rights to claim
puni ve, incidental, or consequen al damages, including a orneys’ fees.
