1. INTRODUCTION

The Government of Malaysia, hereinafter, referred to as “the Government” is desirous of


carrying out the works mentioned earlier. This “Terms of Reference” has been prepared for
the appointment of a firm of Electrical Consulting Engineers, hereinafter, referred to as “the
Consultant”.

2. OBJECTIVES OF THE WORK TO BE CARRIED OUT

Upon accepting the appointment and assignment specified herein, the Government
expects the Consultant to provide the necessary fully functional electrical services and
systems for the project.

4. SCOPE OF CONSULTING SERVICES

4.1 GENERAL

The Consultant shall provide all personnel, equipment and everything else
necessary for the Works herein described to achieve the objectives mentioned in
Section 2 of this Terms of Reference. In carrying out the works, the Consultant
shall cooperate fully and coordinate closely with the Government.

Based on the scope of Information & Communication Technology (ICT) services


mentioned in Appendix II, if the Consultant absence of competency and does not
have registration codes with Ministry of Finance (MOF) (340601 - Kajian
Telekomunikasi and 340603 - Kajian Pengurusan Infrastruktur ICT and 340605 -
Kajian Pengurusan Maklumat ICT), the Consultant shall engage an ICT
Consultant¹ upon his tender submission to carry out the ICT services. The ICT
Consultant shall fulfil the minimum requirement as indicated in Appendix III.

An official appointment of the ICT Consultant shall be made.

The scope of work to be carried out by the Consultant shall be inclusive but not
limited to the following: -

4.1.1 Preliminary Stage

The Consultant shall do feasibility surveys including establishing load patterns and
establishing the availability of services.
The Consultant shall investigate and obtain the electrical data/load and information
on communication (Telecommunications and Information & Communication
Technology (ICT)) facilities for the existing buildings (if any) and all other relevant
data that are necessary for the planning of the Works.

Depending on the complexity and nature of project, an initial client approval on the
design concept may be required especially for ELV and ICT services to indicate
the scope of works involved. A further advice or approval from other government
agencies such as Pejabat Ketua Pegawai Keselamatan Kerajaan Malaysia, Polis
DiRaja Malaysia and Jabatan Penerangan on the concept design may be required
for projects with high national interest. The relevant cost estimates shall only be
prepared after such design concept approval (where necessary) has been
obtained.

Within 2 weeks after the appointment, the Consultant is to submit his proposed
implementation schedule for the Works.

The Consultant shall submit system proposal and investigation report to


Cawangan Kejuruteraan Elektrik Ibu Pejabat JKR Malaysia for approval before
starting the detailed design work. The report shall contain:

i. Preliminary designs, design criteria and policy

ii. Sketch plan showing proposed designs

iii. Materials, methods and sequence of installation

iv. Proposal of equipment including their layout

v. Provide approximate estimates regarding the Works to enable the


Government or the Consultant Architect to prepare architectural
schematic design plans and budget estimates for the Project

vi. Evaluation of possible time schedules for the design, tendering


and construction stages of the Project

vii. Any other relevant information

viii. Making such modifications to the preliminary report as may be


required by the Government, including preparing revised cost
estimates.

4.1.2 Design Stage

The Consultant shall prepare detail engineering design and tender drawings after
acceptance of the preliminary report by the Government.

The Consultant shall provide information and drawings on requirements for


Builder’s Works etc. necessary for the successful installation and commissioning of
the Works to all concerned parties in a timely and well co-coordinated manner.

On completion of the final design work, the Consultant shall prepare a detailed Bill
of Quantities for all items required, and measurements.

The Consultant shall also prepare a detailed cost estimate based on the Bill of
Quantities.

The Consultant shall obtain such approvals as necessary for the Works from the
various Agencies/Authorities.

4.1.3 Tender Stage

Where necessary, the Consultant shall prepare pre qualification notices, issuing
Questionnaires to prospective tenderers and evaluating their suitability to enable
tenders to be called.

Calling of tenders, evaluating, reporting and making recommendations on tenders


received, including alternative designs, if these are submitted by tenderers
provided that no tender shall be accepted or order placed without the written
authority of the Government.

4.1.4 Construction Stage

The Consultant shall:

4.1.4.1 prepare contract documents relating to accepted tenders

4.1.4.2 prepare any further designs and drawings to enable the contractor to carry
out the works.

4.1.4.3 function as the Superintending Officer’s Representative on behalf of the


Government in the supervision of the Works and in the administration of
the Works’ contract.

4.1.5 Defects Liability Period

The Consultant shall perform any other duties which are necessary under the
contract for the execution of the Works up to end of Defects Liability Period and/or
Maintenance Period such as

- Supervision of maintenance works

- Rework/rectification on the systems

- Attending to complain from the Government about the performance of the


system

- Preparing for final handing over to the Government upon the expiry of
Defects Liability Period.

4.1.6 Any other duties

The Consultant will be required to carry out such duties as are described else
where in this Terms of Reference and in the Agreement.

4.2 DESIGN WORK

The Consultant shall liase with the Electricity Supply Authority and/or Electricity
Supply Company on the electricity supply system for the project and Telekom
Malaysia Berhad (TMB) or Communications Company for the Telecommunications
and ICT work to ensure that the requirements are fully complied with.

The Consultant shall investigate and obtain the electrical data/load and information
on communication (Telecommunications and ICT system) facilities for the existing
buildings (if any) and all other relevant data that are necessary for the design of
the Works.

Particular attention shall be given to the client needs especially of ELV and ICT
services where requirements are very project specific.

4.2.1 Design Criteria

4.2.1.2 Telecommunications Works

The design and drawings for the telecommunications work shall be


based on JKR Specifications, the Guide Books and guidelines
issued by Telekom Malaysia Bhd. and Suruhanjaya Komunikasi &
Multimedia Malaysia (SKMM).

4.2.1.3 Information & Communication Technology (ICT) System

The design and drawings for the ICT system shall be based on the
following:-

4.2.1.4 Extra Low Voltage

The Consultant shall be obliged to ascertain the actual


requirements if any, for all extra low voltage system (audio visual,
public address system, security system, sound reinforcement
system, etc.) prior to carrying out any work on such systems.

Depending on the complexity and nature of project, client


endorsement may be required for the layout, placement and
quantities of the ELV services. For project of high national interest,
the approval of other government agencies such as Pejabat Ketua
Pegawai Keselamatan Kerajaan Malaysia, Polis DiRaja Malaysia
and Jabatan Penerangan may be required

Infrastructure for the IP-based ELV services shall be designed for


that services alone and separated from any other ICT network. If
such condition arises where the IP-based ELV services need to be
integrated into a shared common ICT network, consideration on
bandwidth requirement, power over ethernet etc shall be taken
into account. The ICT Consultant shall communicate with the
Consultant for any electrical works connected to it.
The design and drawings for any such system shall be based on
JKR Specifications and guidelines, if available. If such documents
are not available, reference shall be made to widely accepted
good industry practices.

4.2.2 Integrated Design & Optimum Design

The Consultant shall liaise with the architect and mechanical engineer in
applying an integrated building design concept to achieve Energy
Efficiency during the life cycle of the building.

The Consultant shall make every endeavour to optimise the design in the
interest of future electrical load growth and economy of design and also
negotiate with the Supply Authority for the optimum possible tariff
structure.

In the case of extensions or new development to existing government


complexes, the Consultant shall take special effort to integrate the new
design work into the existing system.

4.2.3 Diversion of Existing Services

The Consultant shall expeditiously investigate on site and identify the


existing electrical, telephone and other communication services that have
to be diverted. The Consultant shall then advise the Government the
necessary action to be taken.

4.2.4 Design Drawings

The Consultant shall prepare design drawings on A1 size sheets.


Dimensions are to be in metric units. Standard JKR Electrical symbols
shall be used for all the drawings.

The title panel is to be placed at the bottom right hand corner of the
drawings. All drawings, whether preliminary or final shall be signed by a
Partner/Director of the Consultant and all plans submitted for approval
shall also bear the Professional Engineer’s (of electrical discipline) seal of
the Partner concerned.

The Professional Engineer shall be registered with the Board of Engineers


Malaysia.

4.3 BILL OF QUANTITIES AND COST ESTIMATE

The Consultant shall submit a preliminary cost estimate to the Government for
budgetary purpose immediately after the completion of the preliminary design
work.

On completion of the final design work, the Consultant shall prepare a detailed Bill
of Quantities for all items required, inclusive of all quantities and measurements.
The Bill of Quantities shall follow the format practised by Cawangan Kejuruteraan
Elektrik, Ibu Pejabat JKR Malaysia and as approved by the Government. The
practice of putting “lump sum” quantities shall be avoided.

The Consultant shall also prepare a detailed cost estimate based on the Bill of
Quantities. The detailed cost estimate shall be signed by a partner of the
Consultant (of electrical discipline) and submitted to Government under
confidential cover. The estimates shall be based on realistic current market prices.

4.4 SPECIFICATIONS AND TENDER DOCUMENTS

The Consultants shall use JKR standard specifications L-S1 to 20 and others
which available for the Works. Where no JKR standard specification is available,
the Consultant shall prepare the necessary specifications which shall be submitted
to the Government for approval. The specification shall be complete and clear and
shall cover the various aspects of the Work.

The Consultant shall prepare complete tender documents based on the standard
Government Conditions of Contract, Form of Tender and other documents
currently in use for electrical engineering works. Prior consultation with the
Government will be necessary before the tender documents are drawn up.

Two draft copies of the tender documents shall be submitted for the Government’s
review at least three weeks before the date schedule for calling of tenders. Final
tender documents shall only be printed after the draft documents have been
approved by the Government.

The Consultant will be informed of the number of copies of the tender documents
to be furnished to the Government. Payment for this will be as a reimbursable item.

4.5 EVALUATION OF TENDERS

The Consultant shall be required to evaluate tenders submitted. The Consultant


shall put up his evaluation reports and recommendations within two (2) weeks after
receiving the submitted tender documents from the Government.

4.6 SUPERVISION OF WORKS AND CONTRACT ADMINISTRATION


The Consultant shall be required to carry out supervision, testing, commissioning
of installation and administration of contract. In carrying out the work, the
Consultant shall provide suitably qualified supervisory staff and office
administration to ensure the proper installation of the works in accordance and in
compliance with the requirements of the contract document.

The various activities of work to be carried out are described below. The
Consultant’s duties shall include, but not necessarily be limited to:-

4.6.1 Discharge of the Consultant’s duties in the administration of the


construction contract and supervision of construction using Sistem

4.6.2 Before commencement of electrical works on site, Consultant’s


supervision staff shall be stationed initially either at Cawangan
Kejuruteraan Elektrik, Ibu Pejabat JKR Malaysia or JKR state electrical
office, to facilitate the examination of main and subcontractor’s initial
proposals and details on Works Programme, Quality Management
Programme, Quality Assurance Plans, Coordinated Working Drawings, etc
prior to submission for approval to the Government
4.6.3 Conduct / attend technical coordination meetings and carry out briefings
4.6.4 Attend site meetings chaired by the Government and attend auditing
sessions by the Government
4.6.5 Liaison with and submission of the necessary applications for approval
and subsequent registration and or licenses with the relevant Authorities
4.6.6 Inspection, including check testing, where required, of all materials and
workmanship to ensure that they comply with the specifications and plans
and giving immediate notice to the Contractor of any defects or
deficiencies
4.6.7 Maintain a site diary
4.6.8 The Consultant shall provide information for the Resident Engineer to
prepare a comprehensive report at monthly interval on the progress of the
construction works
4.6.9 Certifying to the Government of the acceptance of each part of the works
as completed
4.6.10 Updating of working drawings as the works complete for the preparation of
As Built Drawings
4.6.11 Recommendations to the Government on any change in the plans and
specifications which may prove necessary or desirable during the course
of the project, together with the production of the necessary revised plans
and specifications for any change which may be approved by the
Government
4.6.12 Recommendations to the Government on possible reduction of
expenditure during the progress of construction
4.6.13 Measurement of quantities of approved and accepted work and materials,
and the checking and certifying to the contractor’s payment certificate.
4.6.14 Periodic checking of remaining quantities and constant check on the cost
estimate including estimate and a quarterly updating of monthly cash flow
projections to the end of the project
4.6.15 Ensure that the necessary off-site testing shall be carried out by accredited
laboratories with prior approval
4.6.16 Witness, analyse and certify off-site testing carried out by testing
agencies/labs
4.6.17 Witness on site testing and certify results and maintain all test and
commissioning records before submission to the Government. In the event
of test failure, the Consultant shall propose rectification to achieve the
required specification and to witness and certify the subsequent test
carried after work had been rectified
4.6.18 Full load testing and commissioning of the whole electrical system,
complete with test result and records

4.6.19 Examination of and recommendations to the Government on claims from


the contractor for extensions of time, payment for extra works and any
other similar matters inclusive of all paperwork, e.g. Variation orders
4.6.20 Negotiation with Contractor on the rates for any unscheduled items of
works which may arise and recommendation on these to the Government
4.6.21 Assistance in settling disputes or differences which may arise between the
Government and the contractors expecting litigation and arbitration
4.6.22 Examination and approval of Contractor’s handing over program
4.6.23 Preparation of handover documents
4.6.24 Delivery to the Government on completion of the works ‘As Built’ Drawings
(prepared by the Contractor and checked and certified by the Consultant)
of the works as constructed, Test & Commissioning records, Operation
and Maintenance Manuals, Schedule of Maintenance, a brief overview and
concept of all systems installed, etc.
4.6.25 Manage the handover process from Contractor to the Government
4.6.26 Ensuring training programs are carried out
4.6.27 Conduct / attend monthly maintenance meetings.
4.6.28 Compile all complaints including submission to Contractor for rectification
4.6.29 Monitor, inspect and certify rectification works done by Contractor
4.6.30 In the event of the Contractor failing to carry out rectification works, the
Consultant shall propose a means of getting the rectification done (with the
approval of the Government)
4.6.31 Inspect and compile final defects list at the end of the Defects Liability
Period and to monitor and certify the works that have been carried out
4.6.32 Prepare and recommend the Certificate of Making Good Defects and
Closing of Accounts
4.6.33 Recommendation to the Government regarding the Competent Persons
necessary for the inspection and operation of the installation during its
lifetime according to the Law.
4.6.34 Any other responsibilities that are deemed necessary to be done by a
professional for the successful implementation of the Works

The Consultant’s supervision staff shall be skilled and experienced in construction


works and contract procedures to coordinate construction and maintenance
activities on site.

5. MATERIALS AND WORKMANSHIP

The materials and workmanship to be used for the Works are to be of the best quality of
their respective kinds. All materials and workmanship for which there is a Malaysian
Standard Specification or Code of Practice, are to be specified, designed and installed to
comply with the latest edition of that specification or Code of Practice. Where any
Malaysian Standard or Code of Practice is not yet available, the British or IEC equivalent
may be adopted. For the materials which are in the JKR Electrical Material List, EMAL
(download from http://jmal.jkr.gov.my/emalv3/) only those approved brands and models
shall be acceptable in the Works.

6. INFORMATION TO BE PROVIDED BY GOVERNMENT

The Government shall provide the following to the Consultant to start the work:
6.1 1:100 scale architectural plans
6.2 The site plans
6.3 The Standard JKR Electrical Symbols
6.4 The Standard JKR Electrical Specifications
6.5 The Sistem Pengurusan Bersepadu JKR Formats

7. TECHNOLOGY TRANSFER/TRAINING PROGRAMMES

The Government may wish to assign one or more professional staff to the Consultant for
training with the Works. A decision will be taken on this matter at the time of contract
negotiations and the Consultant shall be prepared to accommodate the Government’s
requirement in this regard.

8. SUBMISSION OF REPORTS AND SCHEDULES

8.1 IMPLEMENTATION SCHEDULE

Within 2 weeks after the appointment, the Consultant is to submit his proposed
implementation schedule for the Work. The Consultant shall make every effort to
complete its assignments before the dates stipulated in the implementation
schedule.

8.2 PROGRESS REPORTS

The Consultant shall submit 2 copies of Progress Reports to the Cawangan


Kejuruteraan Elektrik IP JKR Malaysia each month showing the progress of the
Works. The report shall be in the format that is approved by the Government.

8.3 REPORTS ON DESIGN WORK

8.3.1 Investigation and Design Proposal

The Consultant shall submit system proposal and investigation report to


Cawangan Kejuruteraan Elektrik IP JKR Malaysia for approval before
starting the detailed design work.

8.3.2 Initial Design

The Consultant shall submit an initial design and the related reports
together with drawings to Cawangan Kejuruteraan Elektrik IP JKR
Malaysia for approval before starting the detailed design work.

The document shall be submitted in duplicate copies.

8.3.3 Final Report And Detailed Design

The Consultant shall submit detailed designs and related reports including
drawings to the Government for approval.

Copies of the final reports including all detailed drawings and calculations
shall be submitted in a format that is approved by the Government. All
design calculations shall be properly bound and set out in an orderly
manner. The design calculation submitted must be complete and be
legible. Where computer results are used, a full description of the
computer programmed used, its input and assumptions made must be
included.

All reports, calculations and associated drawings shall be signed by a


Partner/Director of the Consultant and shall also bear the Professional
Engineer’s (of electrical discipline) seal of the Partner concerned.

Failure to comply will render the report unacceptable and the same will be
returned to the Consultant for resubmission.

8.4 COMPLETION CERTIFICATE AND AS-INSTALLED DRAWINGS.

During the supervision, the Consultant shall submit monthly progress reports on
the installation work. On completion of the installation work, the Consultant shall
submit to the Government a Completion Certificate by a partner. The format of the
certificate shall be as in Appendix 1.
The Consultant shall also submit 4 sets of manuals of the installation work to the
Government and each set shall include the following: -

i. 1 set of print of the As-Installed Drawings certified by a partner of the


Consultant

ii. 1 set of operation manual for each of the equipment

iii. 1 set of maintenance manual for each of the equipment

iv. Testing results for the installation and equipment

v. Registration certificates and/or licenses from the relevant authorities

One set of the As-Installed Drawings in CD-ROM and one set of tracing shall also
be submitted to the Government.

Upon completion, the Consultant shall also recommend to the Government, the
Competent Persons necessary for the routine inspection and daily operations of
the installation according to the Law. The recommendation shall be complete with
number and class of personnel required including its cost implications.

9. PROJECT COORDINATION

The Consultant shall liase and coordinates very closely with the architect, civil and
structural engineer, mechanical engineer and the quantity surveyor for the work.

The Consultant shall attend all the coordination and site meeting and also to ensure that
the works proceed smoothly.

10. LIAISON WITH OTHER AGENCIES/AUTHORITIES

The Consultant shall liase closely with Tenaga Nasional Bhd, Telekom Malaysia Bhd.,
Suruhanjaya Tenaga, Suruhanjaya Komunikasi dan Multimedia Malaysia, Jabatan Bomba
Dan Penyelamat, Jabatan Alam Sekitar, Ministry of International Trade and Industry and
other relevant authorities, which have jurisdiction over the works and shall ensure that the
Works are designed in compliance with the requirements of these Authorities and to
ensure power supply and communication facilities are made available before testing and
commissioning commences. Where necessary, the Consultant shall submit the design to
these authorities for approval.

11. REMUNERATION PROCEDURE

All reimbursable items, especially out of pocket expenses shall be claimed on a monthly
basis. Any reimbursable claims which are outstanding after three (3) months shall not be
entertained at all.

12. AGREEMENT

The Consultant shall prepare the agreement as soon as possible after issuance Letter of
Appointment (LA) before the date of first payment been made and prepare ten (10) copies
of the agreements for distribution to related parties.
