AGREEMENT

THIS AGREEMENT is made on this 07th Day of September 2023 between District Education Officer,
Ganjam (herein after called the “First Party” of the one part and Smt. Anita Kumari Tripathy wife of
Deba Prasad Mahapatra, Aged about 35 years residing at Harikrushnapur, Po Sheragada, Ps:
Sheragada, Dist Ganjam, Odisha- 761106 Herein after called “Second Party” of the other part.

And whereas, the second party is willing to be engaged as Peon/ Night Watchman- cum-
Sweeper/ sweeper on Contractual basis and will be under School & Mass Education Department to
perform the duties as and when will be entrusted upon him / her by the concerned Block Education
Officer (BEO)/ Headmaster/ Headmistress of the School.

And whereas the party desired to engage the Second Party on a Contract Basis as Group-D
employees (Peon / NWS) for the period specified hereunder and the second party agreed to enter
into this Contract and abide by the terms and conditions of this agreement.

NOW THIS AGREEMENT WITNESSED and the parties hereunder hereby agree as follows:

1. That the First Party shall provide engagement to the second party as Peon /NWS on
contractual basis for a period commencing on …………………………………….…. Year and ending on
the 29th day of February month of Year, 2024 as agreed to by both the parties and the
Contract if this engagement ipso-facto shall be terminated on the last working day of the
date specified for which no formal notice of order is required to be issued by the First Party.
The contract will stand cancelled on expiry of the period.

2. That, the Second Party shall submit himself / herself to the orders of Headmaster/
headmistress of ……………………………………………………….. High School/ Block Education Office
………………………………………. and of the officers authorities under whom he/she may from time
to time to be placed by the First party and shall act all times obey the rules prescribed shall
discharge whenever required to perform such duties as may be assigned.
3. That the second party shall employ himself/herself efficiently and diligently and to the best
of his/her liability.
4. That the Second party shall be paid Rs. ………………..…. (Rupees …………………………………
………………………..….) only per month as consolidated honorarium.
5. That, the Second Party shall not claim the service benefit as admissible to the State
Government employees.
6. That the Second Party Shall not be eligible to get any other allowances and shall not claim
any other dues except the honorariums mentioned in Clause(4) above.
7. The second party shall be eligible subject to exigency of public service for casual leave of
10(ten) days during an academic year.
8. That the Second party shall not be entitled for any other kind of authorized absence beyond
authorized lave. If he / she remain absent with permission and he she done not have any
authorized leave at his / her credit the proportionate amount from his/ her consolidated
remuneration shall be deducted.
9. That the engagement of the Secondary part is purely temporary and terminable at any time
without assigning any reason thereof.
10. That, the Second Party has agreed to serve in the manner as required and perform the
duties assigned by the First Party and he/she has agreed to be disengaged without any
notice on ground of involvement in criminal case / gross misconduct / delinquency/
incapacitation/ unauthorized absence/ poor performance / dereliction in duty.
11. That the engagement of second party engagement is without prejudice to the claims of
others.
12. That, the Second Party will work under the administrative control of the Block Education
Officer/ Headmaster/ Headmistress of the school to which he/she is assign and will perform
the duties as and when will be entrusted upon him/her by the concerned Block Education
Officer/ headmaster/ headmistress of the school.
13. That the Second Party must maintain regularity and punctuality in attending school/office.

15. That the second party shall perform all such other duties as assigned to him / her by the
competent authority as and when required.
16. That the engagement of the Second Party engagement shall be cancelled if any fraudulent
testimonial is detected in future.
17. That if the Second Party declines to accept the offer of engagement his /her cased will be
deleted from R.A list.

IT IS EXPRESSLY STAED AND AGREED that, any duties rendered under this agreement by the
Second Party shall not any circumstances whatever provide him / her any right to claim for any

scale of pay or to be appointed in any service that may exist now or may arise in future if any
educational institution or in any Government officers.
