1. Riyaz wanted to sell his house. He wrote a letter offering to sell the house to Dhanush
for 50 lakhs. Riyaz posted the letter on 4th January. In the letter, it was mentioned that
the offer is valid till 20th January. The letter reached Dhanush on 9th January. Dhanush
posted the letter of acceptance on 17th January. On 21st January, Riyyaz sold the house to
Krishnan. The letter of acceptance posted by Dhanush never reached Riyaz. It seems the
letter of acceptance was lost in the post. Dhanush wanted to file a case against Riyaz for
breach of contract. Is Riyaz liable for breach of contract?
2. Anna Nagar is an upcoming town. Due to the real estate boom, Anna Nagar started
growing very fast. One issue in the town is that it does not have a decent community hall.
Mr. Mohammed is the Surpunch of Anna Nagar, decided to have a community hall built
in Anna Nagar. However, he has no sufficient finances to construct the hall. Hence in the
Gram sabha meeting, he urged the people to donate generously to construct the hall. He
personally met several people for donations. When Mohammed requested Ahok, the
CEO of Sky Constructions, to donate, Mr. Ashok promised to donate 10 lakhs for the
construction of the hall. The construction of the hall started, but Mr. Ashok did not pay
the 10 lakhs that he promised and said now his company’s financial position is not so
sound; hence he will not be able to pay, and anyway, it being charity Mohammad cannot
insist on performance. Can Mohammed file a case against Ashok for breach of contract?
