OBC Certificatein the prescribed formatissued withinThreeyears, before the last date of
receipt of applications and up to 180 daysafter the closing date of applications wouldbe
accepted by the Commission.
2.It hasbeenobservedby the Commission that the candidates were facing difficulties inproducing
the OBC Certificates intheprescribed format within the cut off datespecifiedinthe Notices. Some
of the candidateshadalso challenged the above provisions in variousCourts.
3.Keeping in view the difficulties faced by the candidates and the Order of Hon’bleSupreme
Court in SLP No. 3116/2017 in the matter of Union of Indiavs Abdul Rasheed,theCommission took
up the matterregarding relaxationinthe stipulated time limit (as indicatedat para 1 above)with
the Department of Personnel & Training.TheDepartment of Personnel& Trainingin consultation
withDepartment of Legal Affairs,endorsed the followingdecisions of the Commission as given
below:-(i)With effect from23.01.2017,[i.e the date of dismissal of SLP No. 3116/2017 filed bythe
Commission in the Hon’ble Supreme Court of India (UOI vs Abdul Rasheed)] theCommission will
not insist oncandidates producingOBC Certificates issued within thecut off dates i.e. 3 years,
before the last date of receipt of applications and up to180 days after the closing date of
applications mentioned in the Notices.(ii)In cases where document verification has already
been completed and the final resultwasdeclared after 23.01.2017or is yet to be declared, the
candidates may furnishprima facie proof of being OBC, if already not produced, to enable the
Commission toconsider/processtheir claim under the OBC category.(iii)The candidature of OBC
candidates will remainprovisional; subject to verification ofhis/her claim by the User
Departmentconcernedas Appointing Authority,as perthe extant Government
provisions/guidelines on the subject.(iv)It is categoricallystatedthat the Commissionshall not
reopencases where the finalresult has already been declaredbefore 23.01.2017.Under Secretary
