I. Overview of Study:

The study delves into a case wherein a tenth-grade student, Emily, purchases a laptop
with an extended warranty from a local electronics store. As issues arise with the
laptop’s performance, Emily seeks recourse under the extended warranty, only to face
denial from the store. This investigation scrutinizes the warranty terms, the veracity of
sales representations, and Emily’s rights as a consumer under pertinent consumer
protection statutes.

II. Purpose of the Study:

The purpose of this study is to examine a real-life scenario involving warranty disputes
and consumer rights under Republic Act No. 7394, also known as the Consumer Act of
the Philippines. By analyzing the case of Emily's laptop purchase and subsequent
warranty issues, the study aims to provide insights into navigating consumer
protections, legal remedies, and alternative dispute resolution mechanisms available to
consumers in similar situations. Through this analysis, the study seeks to empower
consumers with knowledge and strategies to assert their rights effectively in the
marketplace.

III. Recommendations:

1. Negotiation Strategies:
- Referencing Consumer Protection Laws: Emily should emphasize her rights as
outlined in consumer protection laws, such as the right to expect goods to be of
acceptable quality and fit for purpose, as mandated by Republic Act No. 7394,
otherwise known as the Consumer Act of the Philippines. She can assert that the
store's refusal to honor the warranty constitutes a breach of statutory rights.
- Demanding Compliance: Emily should assertively demand that the store
complies with its contractual obligations under the extended warranty. She can
cite relevant clauses in the warranty agreement that cover the issues she is
experiencing and request immediate resolution.

2. Legal Actions:
- Breach of Warranty Claims: Emily may consider initiating legal action for breach
of warranty under the Sale of Goods Act, Republic Act No. 7394, arguing that the
laptop's malfunctioning constitutes a breach of the implied warranty of
merchantability. She can seek remedies such as repair, replacement, or refund
of the purchase price.
- Misrepresentation Claims: If Emily can demonstrate that the salesperson's
